President Joe Biden is nominating an Obama-era U.S. attorney to run the Bureau of Alcohol, Tobacco, Firearms and Explosives, as his administration unveils its formal rule to rein in ghost guns, privately made firearms without serial numbers that are increasingly cropping up at crime scenes.

The White House confirmed that Biden is announcing the nomination of Steve Dettelbach, who served as a U.S. attorney in Ohio from 2009 to 2016, in a Monday afternoon event. The administration is also releasing the finalized version of its ghost gun rule, which comes as the White House and the Justice Department have been under growing pressure to crack down on gun deaths and violent crime in the U.S.

Dettelbach’s confirmation is likely to be an uphill battle for the Biden administration. Biden had to withdraw the nomination of his first ATF nominee, gun-control advocate David Chipman, after the nomination stalled for months because of opposition from Republicans and some Democrats in the Senate.

Both Republican and Democratic administrations have failed to get nominees for the ATF position through the politically fraught process since the director’s position was made confirmable in 2006. Since then, only one nominee, former U.S. Attorney B. Todd Jones, has been confirmed. Jones made it through the Senate in 2013 but only after a six-month struggle. Jones was acting director when President Barack Obama nominated him in January 2013.

The Biden administration’s plan was first reported by Politico.

For nearly a year, the ghost gun rule has been making its way through the federal regulation process. Gun safety groups and Democrats in Congress have been pushing for the Justice Department to finish the rule for months. It will probably be met with heavy resistance from gun groups and draw litigation in the coming weeks.

Gun Owners of America vowed that it would immediately fight the rule.

“Just as we opposed the Trump Administration’s arbitrary ban on bump stocks, GOA will also sue Biden’s ATF to halt the implementation of this rule,” Aidan Johnston, the group’s director of federal affairs said in a statement. The group believes the rule violates the U.S. Constitution and several federal laws.

But gun safety advocacy groups, like Everytown for Gun Safety, which pushed the federal government for years to take action on ghost guns, applauded Biden’s moves and insisted that both Dettelbach’s appointment and the finalized rule will help combat gun violence.

“Ghost guns look like a gun, they shoot like a gun, and they kill like a gun, but up until now they haven’t been regulated like a gun,” said John Feinblatt, Everytown’s president.

Christian Heyne, the vice president of policy at Brady, another gun control group, said Dettelbach was “an unimpeachable public servant who has spent a career using the levers of government to hold negligent or nefarious actors accountable.”

The new rule changes the current definition of a firearm under federal law to include unfinished parts, like the frame of a handgun or the receiver of a long gun. It says those parts must be licensed and include serial numbers. Manufacturers must also run background checks before a sale — as they do with other commercially made firearms. The requirement applies regardless of how the firearm was made, meaning it includes ghost guns made from individual parts, kits, or by 3D-printers.

Federally licensed firearms dealers must retain key records until they shut down their business or licensed activity and then transfer the records to ATF as they are currently required to do at the end of licensed activity. Previously, these dealers were permitted to destroy most records after 20 years, making it harder for law enforcement to trace firearms found at crime scenes.

Some states, like California, have enacted laws in recent years to require serial numbers to be stamped on ghost guns.

The critical component in building an untraceable gun is what is known as the lower receiver, a part typically made of metal or polymer. An unfinished receiver — sometimes referred to as an “80-percent receiver” — can be legally bought online with no serial numbers or other markings on it, no license required.

  4. Serializing up to a dozen parts in every firearm will be a regulatory & enforcement nightmare.
    What happens when a part breaks or wears out ???
    How do you put a serial number on a tiny part ???
    It will take 10 years just to digitize all the info into a system & thousands of mistakes are likely. Not to mention that there are already 350,000,000 guns out there already.

    • It’s my understanding that this effort is focused on receivers only. CA tried to go down the path of regulating “any part or precursor part that directly attaches to the receiver or frame of a firearm”. That would have included triggers, grip enhancements, springs/levers/pins, hammers, slides, locking blocks, et al. It proved to be too much of a hassle, and was eventually reduced to only the receivers. Our CA version of this stupid endeavor takes effect on July 1.

  5. Ok…every 80% lower requires a serial number with this in place. You can’t sell one without it. As a serialized part, a NICS check is required unless you have a state issued license to carry.

    As this makes buying an 80% lower pointless, there is also an equally pointless effort to prevent people from machining their own lowers from plain ordinary blocks of metal or polymer. To say nothing about collecting aluminum cans from the side of the road for melting down and making a lower.

    The only reason any of this becomes an issue in the first place is as a result of such strict gun control laws put into place in certain states. If they wouldn’t do that then none of this would even be a topic of discussion.

More like suggesting that they’ve always been used in crimes (ever heard of a zip gun?) yet were and are a tiny fraction of crime guns. The only thing that’s changed is the media hype.     Yes, ghost guns are increasing being used in shootings across the country.

    In July 2020, an individual who was prohibited from possessing guns allegedly murdered two people in Pennsylvania using a homemade 9mm handgun.9

    In November 2019, a 16-year-old shot five of his classmates at Saugus High School in California—two of them fatally—using a homemade handgun, before fatally shooting himself.10

    In August 2019, a shooter used a homemade gun kit to build a .223-caliber firearm that he later used to fire 41 shots in 32 seconds in a bar in Dayton, Ohio, shooting 26 people and killing nine.11

    In 2017, in Northern California, a man prohibited from possessing firearms ordered kits to build AR-15-style rifles. On November 13, he initiated a series of shootings that began with fatally shooting his wife at home, followed by a rampage the next day during which he fired at multiple people in several different locations, including an elementary school, killing five people and injuring dozens more.12

    In 2013, a shooter opened fire in Santa Monica, California, shooting 100 rounds, killing five people, and injuring several others at a community college using a homemade AR-15 rifle. Reporting indicates the shooter had previously tried to purchase a firearm from a licensed gun dealer and failed a background check, potentially indicating why he opted to order parts to build a gun instead.13

    Law enforcement officials around the country are sounding the alarm about the dramatic increase in the recovery of ghost guns at crime scenes in their communities. ATF reported that approximately 10,000 ghost guns were recovered across the country in 2019.14 Ghost guns have also been illegally trafficked to Mexico.15 In addition:

    In 2019, Washington, D.C., police recovered 115 ghost guns, a 360 percent increase from 2018, when they recovered 25 ghost guns, and a 3,733 percent increase from 2017, when only three such firearms were recovered.16

    In 2019, ATF reported recovering 117 ghost guns in Maryland with almost 25 percent recovered from Baltimore alone. Ghost gun recoveries in the state then tripled in 2020.17
    According to law enforcement in Philadelphia, ghost gun recoveries in that city rose 152 percent from 2019 to 2020.18

    The special agent in charge of the ATF Los Angeles Field Division reported in January 2021 that 41 percent of the division’s cases involve ghost guns, and a May 2019 statewide analysis in California found that 30 percent of all guns recovered in connection with a crime in the state did not have serial numbers.19

    In addition, an investigation by The Trace found that ghost guns are increasingly becoming the weapon of choice for violent white supremacists and anti-government extremists.20

    In conclusion the ATF is a law unto itself and as in the past it rules at 8:00 AM and it is then a new “regulation” (disingenuous term for new law) is now the law of the land at 5:00 PM.

    No Judge Conservative or Liberal will declare the ATF ruling illegal or Unconstitutional because ghost guns are a danger to the people of the country and even the much ballyhooed Scalia decision with the usual double talk and smoke and mirrors declared “The Courts had the right to regulate firearms” (slick disingenuous term for ban or restrict firearms).

    In conclusion your right to own a weapon rests with the rulings of the courts, not the Constitution, and history has proven this reality like it or not.

    • Our CA version of this proposed Federal change is already law, and takes effect on July 1.

      We’ve already required all 80%-originated lowers to be serialized since the end of 2018. Now CA will require BGCs just to purchase a non-firearm. Clown world.

      Nevada tried this last year when their own version was rushed through by their new Democrat majority, but was struck down in court shortly before the effective date. I foresee a litany of lawsuits being pressed against these bills/laws/rules nationwide.

By blocking common sense gun laws that make it much more difficult for criminals and lunatics to acquire firearms they only guarantee crime will continue to escalate including mass murders. Then the simple solution and the least costly to the government is simply to bow to public pressure and start banning guns.

    Remember the London Bridge incident in London when a bunch of Lunatics were even denied shotgun permits. They tired to mass murder people in a bar with knives and got the shit beat out of them. Once again proving gun laws do work.

    As I have said many times in the past Registration helps gun owners far more than it hurts them because when all guns are vetted or better yet registered it becomes far more difficult for criminals and lunatics to get firearms. When was the last time that you heard of a mass murder with a Thompson Machine Gun or a belt fed MG42 or M60. Just a few of the examples that prove that yes registration does work and work well.

    I might add that registration is not necessary to ban or confiscate firearms either as when a weapon is banned the penalties are so severe the average citizen knows its not worth trying to keep it as you could never take the chance of getting caught when shooting it or using it in self defense or selling it to someone’s without paperwork. In short is becomes totally useless to you. And remember, the myth of the Revolutionary “Minute Man” was a myth in 1776 and is an even bigger myth in 2022 with the mass electronic surveillance we all have to live with everyday. And remember the myth of the Minute Man was again proven a farce when Trumps Jack Booted Nazi Storm Troopers that tried to take over the government by force were turned in by their own relatives.

  14. You may or may not have noticed but this “rule” also bans buying an AR upper without a background check. In fact all uppers will need to be serialized too and subject to the same rules as lowers now.

  18. Has the Ghost Gun Rule officially been announced?

    I know TTAG has been very big on reporting the Illinois and Maryland Ghost Gun Bill.

      Biden merely announced his ATF was “going to” release its new “ghost gun” rule; it hasn’t been officially released, yet. I expect it will happen any time, now, and I’m sure TTAG will report it, when it does. In order to be officially “promulgated” the rule has to be published in the Federal Register, etc.

      I’d be surprised if it wasn’t published by early next week, at the latest. Might even hit as early as tomorrow.

      • and when it does hit millions of law abiding American citizens will become felons over night simply because the upper of their AR-15 doesn’t have a serial number thus are in illegal possession of a “ghost gun” (even though the lower has a serial number) even if it was commercially manufactured. Just the upper receiver by its self will be considered a firearm requiring a background check and FFL, even if commercially manufacturered.

  20. Is a serial number the magic talisman that somehow prevents a firearm from being used in a crime? Does a serial number somehow make a firearm less lethal? How does a number on a firearm that has changed hands who knows how many times since new make easier to track to a particular crime or criminal?
    Since the claim for the need to have numbers on the firearm is to allow it to be tracked down, how does that stop the crime from happening? Any and all such tracing is done after the fact.
    The majority of tracing of firearms used in violent crime id done by markings on the spent cases or rifling marks on the projectile.
    Just as with the Saturday Night Special crap from back in the 1970’s, when 1 type of class of firearm is restricted or banned, those who would commit violent crime will just find another source of weaponry. And no firearm to date has ever gone out and committed a crime without it being in the hands of a human. Deal with the humans committing the crime and the hardware will become irrelevant.

  21. Serious question. Is there any study available that demonstrates what this will accomplish? Is this just an effort to stick it to the gun nuts (political enemies), and get more rules on the books that they can selectively enforce? They aren’t even enforcing the gun laws already on the books. They’re letting felons plea down so they won’t be prohibited in the future. They’re letting some prohibited people go with a slap on the wrist. They’re refusing to even investigate some “gun related” crimes (looking at you Hunter). As usual, this has nothing to do with public safety. That’s just the selling point.
