The Second Amendment Foundation today filed a federal lawsuit today against the head of the Illinois State Police and the agency’s Firearms Services Bureau chief, alleging they have allowed the agency to indefinitely deny state residents their right to carry by failing to process Concealed Carry Licenses in violation of state law. The case is known as Luce v. Kelly.

Joining SAF are the Illinois State Rifle Association and four private citizens. Named as defendants are ISP Director Brendan F. Kelly and Firearms Services Bureau Chief Jarod Ingebrigtsen in their official capacities. Plaintiffs are represented by attorneys David G. Sigale of Wheaton, Illinois and Gregory A. Bedell of Chicago. The lawsuit was filed in U.S. District Court for the Northern District of Illinois, Eastern Division.

“Illinois was the last state in the country to establish a licensed concealed carry program because we sued them in federal court and won,” SAF founder and Executive Vice President Alan M. Gottlieb recalled. “The legislature passed a law requiring the ISP to either approve or deny an application within 90 days if the applicant supplies fingerprints, or 120 days if fingerprints are not submitted.

“But the ISP is habitually leaving applicants in legal limbo for months,” he said. “Compounding matters, there has been a surge of CCL applications over the past 12 months. Our plaintiffs have been waiting for months and have received nothing.”

According to the lawsuit, the individual plaintiffs “are concerned about being able to properly exercise their right to armed self-defense in public, especially given recent events and the current spate of car-jackings that have plagued Chicago and the collar counties.”

“The State Police cannot justify these delays,” Gottlieb observed. “As it stands, the ISP is indefinitely denying Illinois residents their fundamental Second Amendment right to carry a concealed sidearm in public for personal protection. We’re saying in this lawsuit that if the State of Illinois conditions the exercise of a fundamental right on the receipt of a license, then the ISP needs to comply with state law and process those applications in a timely manner as required by law. We’re taking them to court in an effort to make that happen.”

    • I think I’ve got him figured out. If he’s a reincarnation of ‘Pee Gee Two’, (about a 50 percent chance, IMO), he lies somewhere on the Asperger’s – Autistic spectrum.         Their posts seem to point to a lack of socialization within the shooting community, not having participated outside of the interwebs.

  5. They swept “unused” money accumulated from Foid and ccl fees into the general fund. Approx 30 million over 6 years yet claim the system is underfunded.

  6. I’ve taken classes in Illinois were people have been waiting for just a FOID card for almost 8 months or more and the CCW card for 6 months or more. The Illinois state legislature commiecrats from Chicago are pushing for all FOID applicants to be finger printed and also will have the applicant pay all costs for fingerprinting and processing fees for a background check, just like a CCW card, for new and renewals. Similar to what they want to do at the national level. It is coordinated effort by the commicrats at each state and federal level to push this through.

    • Paying fees to exercise Second Amendment right is akin to paying a poll tax to vote. Dems would scream about that. As alays. it is a matter of perspective.

  7. The People’s Republic of Illinois has been playing this game for a long time.

    If your application is “stuck,” try contacting your state senator. Sometimes their office can make a few calls, and make things happen. I have heard this doesn’t always work, but I have had success this way in the past. Of course, it might have just been a coincidence that my FOID showed up not very long after I sent an email. It’s worth a try, at any rate.

    • It might work if you don’t get some arrogant legislative assistant who sidetracks your request like I did. Politicians talk a good game, but they have entirely too many flunkies who intercept things on their behalf who short circuit the process of getting some action.

      • Try showing up at a range without one, they won’t let you on. Or buying ammo, or buying firearms, or picking something up from the local gunsmith, etc.

        If you already have firearms, and a lifetime supply of ammo, and a place to shoot, you might be okay…as long as the police never find out that you have them.

        A lot of what passes for the gun culture, particularly in the northeastern corner of the state (which is where the jobs are) consists of Fudds and the Fudd-ish.

        So, you can say that…but it won’t get you very far around here. And thank God for the SAF, because I sure can’t afford to make enough campaign contributions or to litigate my way through this mess. I’ve tried leaving the state, but so far every time the state has managed to suck me back in. Something about a very large metro area with an industrial base…

        Sounds like a personal problem. Especially for ammo. I’d rather travel out of state than ask permission ever again.

        Some will catch on later in the game, and some never will. There is no reason to have anything registered and it’s no ones business what you own, especially when it comes to defense weapons. It’s bad enough the “road pirates” and states tax your travel – but then again – that’s our fault too.

        • That’s not how the FOID system works. They don’t register, the guns, they register the owners. They’ve been doing this since 1968, it isn’t a new thing.

          By your argument, I might as well go ahead and start a Class 3 machine shop in the garage, because that’s nobody else’s business either. I think that’s idiotic. The S has not HTF to the point where it makes sense to risk jail over it. I’m also not going to throw away my career over it. I try to keep my residence out of state, but if someone is willing to pay enough I’ll move and slog through the administrative BS.

  8. This is not just for first time CCL applicants. They have also been delaying renewals well beyond the normal time frame. If someone already had an approved license, fulfilled the class requirements, has no legal issues, and paid the fee, it should be a simple matter of sending out the renewed license. In my case, it will be 16 weeks in just a few days since I posted my renewal. They’ve had my money to play with and gets interest from, and I have not received my renewed license. I want to know how to join this law suit.

    • I am but 3 weeks away from the 12 month mark since submitting a renewal. Just checked again and it is still under review.

      • Damn man, that’s a whole year you could’ve been looking for another place to reside. I don’t forsee any chicago militias taking back their rights anytime soon, so probably the best option is to get out of tyrannical states. I’d love to say it weren’t true and that we could overthrow government, but it’ll never happen. Find a state that allows you to defend yourself is really all we can do.

        • That’s easy for you to say. A lot of people are in situations like I am where I’m on a fixed income, and live in a mobile home. I own it, but it ain’t all that easy to pull stakes and move. I’m also 71, so I’m pretty much stuck where I am. If I could, I’d have been gone lone ago, and flipped off this f**king state on the way out!

  9. Does anyone think the defendants or the ISP care about this legal action? Once they got done having a good chuckle it was back to business as usual. Peasants and serfs will get what the State wants to give them when they feel like it.

  10. And the most important question is… where was Wayne(ker) LaPieirre and the “Nobody’s Really Accountable” (a.k.a. NRA) in all of this, probably sitting in the shadows until the suit looks like it will succeed until it jumps in on the action. Happy to say, starting recently due to members’ complaining, our gun club no longer requires us to be captive donors to the NRA , and a number of us instead give to the SAF and other groups. I don’t own a suit, much less any $20,000 ones…seems to be the suits the organization is mostly used to being concerned about.

    • The IL State Rifle Assn is the NRA State Affiliate… Having pointed this out- what does Pb_fan59 expect to get out of this lawsuit??? The ISP already lost one suit that ordered them to start issuing the permits- who thinks a second suit is going to make any difference? I guess he thinks someone from Fairfax HQ should March over to Springfield and MAKE the ISP comply. Of course if it was that easy the Prattards or NAGRs would’ve already done it, since they’d NEVER compromise on something like this. Funny they’re nowhere to be seen in the suit…

      • Here’s one possibility: it establishes a pattern that sets them up for more litigation later, maybe even a run at the SC.

  11. Been waiting 219 days so far for a new ccl. Illinois representatives are Democrats and in no way, shape, or form willing to assist or return emails. Why do we have The firearms concealed carry act 098-0063 ?

    • Royally agree. I filed my renewal 1 year ago paid them and I still have not heard a single word still shows under review

  14. Maine CCW permits are issued by municipality or county. My town isn’t issuing due to COVID-19, saying it’s not safe to take fingerprints.

    • Sounds like a great reason to buy any way you can. When a state says they can’t even track your identity and invade your personal privacy because “it’s not safe” for them to do so, it sounds like a great reason to arm yourself to the teeth by any means necessary, and never ask permission again. They are not saying they won’t, they are just saying right now it’s not safe for them to. Perfect opportunity to fly under the radar and fuck em raw when they come at you bro.

  15. You people really need to move out of IL. I began to despise the political system there in the 70’s. My Congressmen were Gus Savage, Mel Reynolds, Jessie Jackson Jr. I saw 4 Governors go to prison. The number of Cook County and City of Chicago politicians incarcerated is huge. And how about that radical anti-gunner Ed Burke, the Don of the Chicago City Council, arrested with a large cache of firearms. And don’t tell me how hard it is to leave. It took me 50 years. That was clearly in retrospect entirely my fault.

    • This. All these problems are personal AF. Nothing in these states will change their constant infringements, it will only get worse.
