Right now, when the federal government finds out that a sale that should have been stopped has proceeded because of the time limit, it does — this part will not surprise you! — absolutely nothing. Somewhere in some subbasement somewhere in the bowels of Washington, some bureaucrat mutters to himself, “Well, that’s unfortunate.” And then nothing else happens.

These are sales for which people have filed the requisite paperwork at a licensed firearms dealer. That means that we not only have the name, address, Social Security number, and other information about the buyer, we also have the make, model, and serial number of the firearm that changed hands. All it would take would be for someone to go and get the gun.

You don’t need Batman to fight that crime — you need a guy with a car and a shoebox.

Sending somebody out to pick up those guns would be a real improvement for several reasons: For one, we’d be taking a gun out of the hand of a prohibited person, which is good in and of itself. Second, in almost every case, a prohibited person who buys from a licensed retailer does so by lying on his application — as Joe Biden’s son, Hunter, pretty obviously did when acquiring a handgun a few years ago. (Hunter Biden is a prohibited person because he is a drug addict, and if he had not lied about that fact on his application, then it would have been rejected.)

That means that we not only have the opportunity to take the gun away, we also have the opportunity to arrest the offender for a serious gun crime. Often, there will be at least two charges that could be made: felon in possession (which by itself can bring as much as ten years in prison) and making a false statement to acquire a firearm — a fifth-degree federal felony.

If we wanted to, we could take those guns — and those criminals — off the streets.

President Biden does not need Congress to change the law to make that happen. He does not need Mitch McConnell’s permission. Nobody can filibuster him. All he has to do is pick up the phone or put his name on a memo and instruct the lazy, useless, complacent, feckless, self-serving, waiting-around-for-their-retirements bums who work for him to get off their asses and do the job we pay them to do. You don’t need a SWAT team for this — Skippy the Intern should be able to handle most of this work just fine.

But, of course, Biden will not do what is within his power — and not only because it would mean locking people up for a crime committed by his idiot crackhead son.

Likewise, Biden could instruct the U.S. attorneys — the federal prosecutors who serve at his pleasure — to start prosecuting straw-buyer cases and start putting real federal time on the table for the people who do so much to provide our nation’s career criminals with a steady supply of firearms. But he won’t do that, either.

    • That jumped out at me too. Denial could mean either A. an administrative SNAFU or B. a dangerous felon. By claiming it could be a serious preventive step and talking about ten-year prison sentences, the author seems inclined toward B., but treating enforcement like a simple A.

      • What we have seen in PA, where state police have been prosecuting every denial that isn’t appealed since 2014, is that 99%+ of denials are either just errors, or inappropriate.

        This has resulted in a lot of felony convictions for “lying” on the form(s) that should never have happened. These people are now really prohibited. It also affects their jobs, careers, professional licenses. Then it can affect their families.

        PA is the test case for the idea of doing something to people who are denied on a background check. I have been banging the drum about it for years. The gun community ignores it at our peril.

        • My point was that each case is one or the other. It’s either an oversight that could be cleared up cheaply and easily, or a vital step forward in addressing armed violence, but never both. Never “I managed to obtain this gun surreptitiously to kill all my teachers, but thanks to Williamson’s bright idea, Skippy the Intern was able to take it back from me with nothing more than a car and a shoebox!”

          That’s exactly what they want, as many people as possible to be legally-prohibited. Expect much more of this in the future.

          Example – ‘Red-Flag’ laws. Right now, it’s for concerned family members. Expect that to be eventually expanded to anyone you have interactions with…

        • Not only that, Geoff, but every sentence where probation or parole is involved there is a provision to submit to search of person, vehicle or residence at any time by any law enforcement officer. I haven’t seen it yet, but “any law enforcement officer” could possible include the building code inspector. The fire marshal, definitely

      • To my knowledge no state troopers have been attacked retrieving guns after a late denial, or had any issues getting a gun back. I doubt there are that many late denials.

    • There is a lot of funny business about the purchase of firearms that go on/are stopped without any charges being filed.
      We responsible gun owners respect the firearm, do not use them unsafely, and try to help others to also be responsible.
      I would love to see federal agents going after people that do unsafe stunts with firearms and explosives. It is very to go out to a legal public shooting area and just observe the people there. In some cases, there is no “down range”, they just setup wherever and start shooting or placing cars or appliances out to blow up. 4 beers apiece and then the fun begins. No thanks.

If it takes a few more school shootings to make it happen (as long as it is someone else’s kid), then so be it. What I find ironic is these rights are natural rights and not granted by the US fucking government. So they really have no basis to hedge these rights as they never granted it. The problem is the 2A people are trying to be nice about it and as a result are incrementally losing their right…

    Not true. Patently false. How do I know? It happened to me.

    In 2009, I bought a pistol. The 4473 went through smoothly and I thought nothing of it. I sold that gun to buy a better one–a FNP-9. This time, the 4473 came back “DELAYED.” Following established procedure, the FFL sold it to me after the three day waiting period. I followed suggestions in the forums I read at the time and waited about three weeks to take it out and shoot it. The Monday after I did, I got a phone call from Agent Harris in the Tulsa office of ATF. He informed me that I had been denied on the 4473 and that I had to remove the pistol from my possession. The FFL I had bought it from agreed to hold it for me and signed it back into his book.

    I eventually got my rights back, as I had discovered that the reason for the denial was sloppy record keeping by a local police department in New Jersey. The restraining order they had reported as active had been dissolved in 1992, twenty years earlier!

    My policy is, if someone gets one material fact wrong, then whatever he says from there on is suspect. Kevin D. Williams is flat out wrong. End of story.

There are gun prosecutions based on failed 4473s and some of those are the delayed ones, but the big lie is the implication that a delay means the person who failed is somehow a prohibited person. Looking at the statistics, a NICS failure is WRONG 90 plus percent of the time.

    • I know kids of most ages above six who have and use guns sfely and wisely. Never hurt anyone with them. A lot depends on the individul kids Parents SHOULD know.

      Dad has his own rifle at six. The boys all brought their rifles to school with them, had shooting constests at lunch break and after school.That went on well till Dad’s little sister started bringing HERS. At seven she was a better shot than most of the twelve year olds.
      Then, at 14, the school got a bus, and since Dad’s family lived furthest from the school HE was the driver. He was fourteen. The kids STILL brought their rifles along on the bus to school. The advantage was, on the way home, all the peeled eyes were able to spot jackrbbits and snakes, so Dad would stop the bus and the desingated shooters would take their hots from the steps. Some lucky families got some extra protein to put on thee table that night. Most of those boys all ended up fighintg overseas in The War. They were all far better shots than most of their platoon mates, as they’d been shooing since very young.

      Dont confuse the rotten self-centred simpering brats presently populting gummit skelwz with children in general. One yboung man I know got his own M1 Garnd when he ws eleven.When he was fourteen the local gun club’s old timers, wtching him on the range, invited him to join their conpetition team… at 14. They had to meet ahd change the bylaws of the team, as the minimum age HAD been eighteen. Within a year he was one of the best shot on that team and helped them win many competitions. Glad he’s on OUR side.

      It ain’t the kid so much as HOW he was raised. I know many kids today, am close to them (large families,probably arund two hundred under 18) ALL of them are mature, resposibiel helpful, intelligent, capable. NOT ONE would ever use a gun in anger or spite against anyone else. They have ALL been taught to deal with life’s surprised, and know none of them happened to be elected king this past year.

    Biden’s brat’s lies wwere never brought to the light until well after his purchase, it never could have turned up a false positive as he was deliberately lying. No record of his drug use could be on NICS.

    The vast majoirity of DENY codes, even delayed ones, are due to their sloppy recordkeeping. I know guy who was clean, but someone else had a similar name. Never mind middle name was different, date fo brith was different. He would always get a deny code. We who knew hom had no problem helping him out. His crazy brother came to live wiht him after a nasty divorce blowup. SHE had done the California Usual and filed a restraining order agasint him just for extra spite. He did not know because he left the state. That order renders him prohibited, but he could not contest it because he never got served and did not know. Somehow they traced him later and informed him of his new Prohibited status. WHAAAAT! My friend had to make all HIS guns disappear, as brother could not be in the same house with them. Crazy stuff.

    The database MUST be overhauled, change the set up of the operative fields. Make a “match” only when ALL fields match. WHY does my friend get confused wiht a guy born in a different state on a different date? Nuts. That’s gummit messup.

    Not to mention the failure to add relevant denying activity to a guy’s file……. such as the Air Force guy got conviced of three felonies AND a DD, soFOUR prohibiting factors, and two different Air Force desk jockeys FAILED to send the data off to the FBI/NICS. The clown went out and bought a firearm,paid his ex-wife’s church a visit, and killed twenty six people. The AirForce Desk Failures got NO consequences. Twenty six people dead because THEY did not take five minutes and DO THEIR JOB. Two of em.
    And yes, Biden Joonyer needs to be arrested, ALL his guns seized, and charged with his false statements on his 4473,AND for unlawful possession of eachof his guns.

    Of course, I disagree with the use of marijuana being a prohibiting factor, because that makes about as much sense as making any use of alcohol , or even some prescription opiods, being prohibitive. FedGov NEEDS to remove MJ from Schedule One status. And no I do NOT use the stuff, so don’t pin that on me. Its just stupid to treat it that way. Makes more criminals, and supports the $Bn65 annual budget of DEA, a waste of tax money.

    • I agree with you. MJ should not be schedule one but as you point out…there is $$$ to be made by making people felons. Usually for a crime to happen, there has to be a victim. Who or what is the victim if I were to partake a MJ joint in my own home? And you know Hunter Biden will not suffer any consequences for his actions as he is part of the protected class. So much for rule of law huh?
