Man Arrested After Pulling a Gun on MAGA Hat-Wearing Sams Club Customers

Most of the news concerning MAGA hats in recent days has been concerning bogus accounts of Trump supporters allegedly assaulting pedestrians in Chicago. And as we noted, some consider the red hats to be the modern equivalent of a Klan hood.

Yesterday, however, things were ratcheted up to a new level in a Bowling Green, Kentucky Sams Club when a verbal altercation over the hats resulted in a gun being drawn.

James Phillips allegedly flipped off a couple who were wearing the hats. One of the hat-wearers told Phillips that he had as much right to wear the hat as Phillips has to decide not to and returned the middle finger salute.


The police report confirms that the suspect, identified as James Phillips, admitted to flipping off (alleged victim Terry) Pierce and Pierce’s wife because of their hats.

Pierce tells 13 News that he was shopping with his wife when Phillips “Pulled a .40 caliber out and stuck it in my face, backed up and said, ‘It’s a good day for you to die.'”

Pierce went on to tell 13 News, “I said, ‘Then pull the trigger. Put the gun down and fight me or pull the trigger. Whichever one you want.’ And he backed up and he said it again, he said, ‘It’s a good day for you to die.'”

Phillips apparently thought better of what he was doing and left the store. That’s when Pierce did something really stupid.

…Pierce followed him out into the parking lot.

“I went out the front of the store to confront him again and that’s when I got him in his car. He couldn’t leave because his mother was still in the store. And we were having a verbal altercation outside,” said Pierce.

Pierce added, “He tried telling me I assaulted him and I said, ‘I never touched you.'”

Fortunately police arrived and intervened before the situation escalated any further. The cops confirmed Pierce’s account using the store’s security camera video.

In the report, police say Phillips had a Glock .40 caliber with a round chambered in his back pocket and two additional magazines in another pocket. Police say Phillips has a current concealed carry permit in Tennessee, where he is from.

This appears to be a new escalation in the widespread infection that is media-driven Trump Derangement Syndrome. All over a red hat. How long will it be before someone actually pulls a trigger?

      It passes the test for me me. I signed up for “moms demand action” in my area to see the kinds of things they say and tweet. I got a tweet a couple of months ago saying that CCL allows people to point guns at “anyone.”
      We all know Gun ban lobby nuts have NO IDEA what the laws re, or what facts, numbers are. So why would it be a surprise that they generally DO think a CCL is a licence to just pull brandish and threaten?

      By the way north of 90% of shootings occur in the less than half of the 3,000 US counties that are Democrat run and majority populated. So we know the further left you are the more violent you are.

      I felt compelled to do the same thing, so I bought the authentic MAGA hate from Trump’s website. Unfortunately the hat doesn’t fit very well. It’s gigantic. So I’ll keep it as a mantle piece, and buy an after-market MAGA hat that fits better should I feel compelled to ruffle some feathers in public.

      Doesn’t have to be a MAGA hat. Any ol bright red baseball cap seems to work. I have one from a Diabetes walk that says Red Strider and had someone try to start something once. Then he got a good look at the cap and went oh, and told me I should not wear that color as it looks like a Trump hat.

      If a physical fights, either with fists or guns, had ensued, MAGA man would not have been able to claim self-defense, on Texas, at least. The law would view him as having accepted the challenge and consented to the fight.           The point he’s making is that, in many jurisdictions, once the first encounter is broken off, starting a second encounter can change the definition of the aggressor and defender. The anti-Trumper was the aggressor in the initial encounter and committed multiple crimes, and the MAGA hat would have been justified in shooting him then and there. The anti-Trumper left the store, and the encounter was over, as was any claim of self defense by the MAGA hat (aggressor was no longer a threat). The MAGA hat confronting the anti-Trumper again is the initiation of a second encounter, except this time MAGA hat is the aggressor, and therefore no longer has a right to self defense. The anti-Trumper could then pull his gun out and legally shot MAGA hat in self defense if things had gotten out of hand, although anti-Trumper would still have to answer to crimes committed in the first encounter. The second encounter is a revenge by MAGA hat.

          Pursuing the bad guy that is getting away is a bad idea unless you can convince a jury that the encounter was ongoing (such as a running gun battle) and that you or someone else was in danger of death or bodily injury (such as BG carjacking a getaway vehicle).

        Rather than following your attacker outside to continue the fight (accepting the challenge to mutual combat as you stated), you should be following your attacker to attempt a citizen’s arrest (for the felony that your attacker just committed) or to acquire identifying information for law enforcement.

      I also appreciate that some people would follow their attacker out of the store in order to ensure the capture and prosecution of such a scumbag who just threatened their life for wearing an “offensive” hat.

      Remember the proverb, “All good people have to do for evil to succeed is to do nothing.” Fortunately for all of us, the victim in this case chose to do something to help ensure their dangerous attacker is less likely to threaten anyone else’s life.

    Tennessee is being flooded by people fleeing Illinois, New Jersey and California. Davidson County/Nashville has been flipped deep, deep blue. Unfortunately, they bring their problems and sad voting habits with them. The Waffle House shooter was a known mental case from Illinois and was moved to Nashville, by his family, to escape the consequences of his actions in his home state. This reeks of another transplant with mental issues who thinks he’s a social justice warrior cowboy with a permit. Tennessee needs to impose a twenty year waiting limit for transplants to get a carry permit. That should nip this crazy in the bud.

Armed citizens (not that there’s any indication that MAGA hat was armed) need to hold themselves to a higher standard and try to avoid or deescalate situations.     2) the victim had every right to report the crime but should have excersised more caution. Perhaps calling 912 and getting a license plate number, etc… it was idiocy to follow the attacker for another confrontation.

    As a black kentucky gun owner who wears a MAGA hat and open carries, I have had a black man give me a thumbs up. In a Sams Club. I have had white people thank me. With a worried look on their face, they say “you are a very brave person”.

    I know blacks have been attacked at Trump rallies, just because they are a black republican voter. History is repeating itself.

    The white Liberals and the white Left have ALWAYS BEEN RACIST. The problem is the vast majority NEVER speak up against their intolerant bigoted and racist brothers and sisters. That makes them part of the problem.

    The second amendment is becoming more important to me than the other 9. Other parts of the country may see things differently.

    I had to move out of a slave state, 21st century, California, and move to a former 19th century slave state, Kentucky, to get my gun civil rights. The irony is amazing. Some people are moving forward and some people are moving backward. California was a free state when it entered into the Union in 1850.
