Senator Dianne Feinsteins’ website has finally dropped details of her not-so-cleverly-named (I bet it’ll be re-christened) “Assault Weapons Ban of 2013.” Here it is [via feinsteinsenate.gov]:

Mass shootings in Newtown, Aurora, and Tucson have demonstrated all too clearly the need to regulate military-style assault weapons and high capacity ammunition magazines. These weapons allow a gunman to fire a large number of rounds quickly and without having to reload.
What the bill does . . .
The legislation bans the sale, transfer, manufacturing and importation of:
- All semiautomatic rifles that can accept a detachable magazine and have at least one military feature: pistol grip; forward grip; folding, telescoping, or detachable stock; grenade launcher or rocket launcher; barrel shroud; or threaded barrel.
- All semiautomatic pistols that can accept a detachable magazine and have at least one military feature: threaded barrel; second pistol grip; barrel shroud; capacity to accept a detachable magazine at some location outside of the pistol grip; or semiautomatic version of an automatic firearm.
- All semiautomatic rifles and handguns that have a fixed magazine with the capacity to accept more than 10 rounds.
- All semiautomatic shotguns that have a folding, telescoping, or detachable stock; pistol grip; fixed magazine with the capacity to accept more than 5 rounds; ability to accept a detachable magazine; forward grip; grenade launcher or rocket launcher; or shotgun with a revolving cylinder.
- All ammunition feeding devices (magazines, strips, and drums) capable of accepting more than 10 rounds.
- 157 specifically-named firearms (listed at the end of this page).
The legislation excludes the following weapons from the bill:
- Any weapon that is lawfully possessed at the date of the bill’s enactment;
- Any firearm manually operated by a bolt, pump, lever or slide action;
- Assault weapons used by military, law enforcement, and retired law enforcement; and
- Antique weapons.
The legislation protects hunting and sporting firearms:
- The bill excludes 2,258 legitimate hunting and sporting rifles and shotguns by specific make and model.
The legislation strengthens the 1994 Assault Weapons Ban and state bans by:
- Moving from a 2-characteristic test to a 1-characteristic test.
- The bill also makes the ban harder to evade by eliminating the easy-to-remove bayonet mounts and flash suppressors from the characteristics test.
- Banning dangerous aftermarket modifications and workarounds.
- Bump or slide fire stocks, which are modified stocks that enable semi-automatic weapons to fire at rates similar to fully automatic machine guns.
- So-called “bullet buttons” that allow the rapid replacement of ammunition magazines, frequently used as a workaround to prohibitions on detachable magazines.
- Thumbhole stocks, a type of stock that was created as a workaround to avoid prohibitions on pistol grips.
- Adding a ban on the importation of assault weapons and large-capacity magazines.
- Eliminating the 10-year sunset that allowed the original federal ban to expire.
The legislation addresses the millions of assault weapons and large-capacity magazines currently in existence by:
- Requiring a background check on all sales or transfers of a grandfathered assault weapon.
- This background check can be run through the FBI or, if a state chooses, initiated with a state agency, as with the existing background check system.
- Prohibiting the sale or transfer of large-capacity ammunition feeding devices lawfully possessed on the date of enactment of the bill.
- Allowing states and localities to use federal Byrne JAG grant funds to conduct a voluntary buy-back program for grandfathered assault weapons and large-capacity ammunition feeding devices.
- Imposing a safe storage requirement for grandfathered firearms, to keep them away from prohibited persons.
- Requiring that assault weapons and large-capacity ammunition feeding devices manufactured after the date of the bill’s enactment be engraved with the serial number and date of manufacture of the weapon
Assault weapon bans have been proven to be effective
The 1994 Assault Weapons Ban was effective at reducing crime and getting these military-style weapons off our streets. Since the ban expired, more than 350 people have been killed and more than 450 injured by these weapons.
- A Justice Department study of the assault weapons ban found that it was responsible for a 6.7% decrease in total gun murders, holding all other factors equal.

Like RF, I’m thinking Feinstein’s attempt at infringement will be re-christened with something cute, like, “Keeping Children Safe Act” or “Mass Shooting Prevention Act” or “People’s Protection Act”. In other words, she’ll think of a name reflecting the opposite of what the bill actually does.
This site and everyone else should keep on calling the bills what they are: Civilian Disarmament bills.
If it’s an “assault weapon (not rifle) ban” bill, then the debate centers over whether an ‘assault weapon’ (whatever that is this week) should belong to a private citizen. But the agenda and the bills effects are broader than that. If you call it a Civilian Disarmament bill, then the debate is refocused where it belongs: on the Second Amendment and the role of self defense in our society.
The filibuster is alive so the bill is DOA. Reid cut a. Deal with McConnell and the rules for a filibuster received only a minor makeover. She might have had trouble getting 50 votes so 60 is out of the question.
They definitely cannot get 50 in the senate. Reid will not want his D senate members up for reelection in 2014 to walk the plank. Ones up in ’14 (dem’s) are from Alaska, Arkansas, South Dakota, Montana, North Carolina, New Hampshire, Colorado, Minnesota, etc.
Only the commies in very safe states like MA, NY, CA will push this. The others know they’ll be DOA in the election
The firewall will be the 10 round mag limit. Most likely, they will try to monkey with the whole background check and itsy universe of legal questions.
I strongly suspect that’s not how this is going to play out. I suspect this is going to be a very long, very drawn out, slow-push/constant-pressure kind of campaign like we had with the socialized medicine offensive of ’09/’10. With this bill and all the other piecemeal bills and the president’s street-theater with the children, I think there’s a long term campaign roughly planned.
Don’t exhaust yourselves, don’t assume you’re done when one bill gets stymied or “killed” for a while, and don’t forget in 2014.

Even with the stats she used it is amazing she thinks this thing has a chance. She stated that since the ban expired more than 350 died because of these weapons. So on average (350 deaths/ 8 years=43) 43 people a year die from these weapons. 450 people die each year from falling out of bed according to the CDC. Your chances of being killed by an “assault weapon” is about the same as dying from a dog bite(34 per year) or a vending machine falling on you(13 per year). This bill has to die because we all know it is just a starting point.
How about the 9 people each day who drown. No need for swimming pools. People drown, waste of a precious resource, and carbon is used to power the equipment. What’s the likelihood that Sen Feinstein introduces an act to Prevent Useless Deaths in 2013 (known as the “PUD” Act).

Call them as well! Talk to someone in person. Have your wife, girlfriend, boyfriend, and kids call and express their displeasure as well. Tell them of the reasons while it will fail.
I have fun telling the Liberal ones that I’m a registered Democrat and that I’m fearful that this bill will lose the Democrats control for another 20 years like the last one AWB. I remind them that it’s political suicide, and as unpopular as the last AWB was, there’s been another 10MM AR15’s sold – that’s a LOT of votes.
That said, I’m able to say I’m a Democrat only because I re-registered as a Democrat so that I was able to chase down Arlen Specter and voted him out of the primaries. He wasn’t the only one that could switch parties.
Technically any standard pistol is capable to “have a fixed magazine with the capacity to accept more than 10 round” since you can insert a magazine of any size. I don’t like how they chose to word that. It opens interpretation to say any pistol that uses detachable mags is banned.
LOL at the Mini 14 Ranch Rifle not being banned as long as you use a 10rnd mag. They have the Tactical in there but I don’t see how the stock Ranch Rifle is excluded by the conditions. Whoops, that’s where knowing ANYTHING about guns would have helped their cause.

I think “fixed magazine” is the opposite of a detachable magazine. Usually fed from above with a stripper clip like some of the older broomhandles. Basically a type that hasn’t been made for 70 years but they included it incase someone trys to build a work-around.
Revolvers can accept “fixed magazines”? I must have been asleep when that happened.
Actually there is a revolver that accepts a magazine. I forget the creators name but it was barley a one hit wonder in the ’50s. Itwas chambered for .38 and the exclusive ammo was called a “tround.”
Nothing was unusual about the casing or bullet itself but it was wrapped in a triangular case (think of thoes prism shaped pencil grips) that allowed the round to be fed from the magazine to the “cylinder”
She does know that the “Streetsweeper” has been an NFA item for 20+ years & that the SPAS 12 hasn’t been imported much less even made for over 12 years…

As I live in Texas, I informed my Rep & Senator that “under NO circumstances will any compromise on Gun Control be acceptable”.
Anyone in a pro-2A state and/or district, make sure to stress that point. SHALL NOT BE INFRINGED is pretty damn clear to me and it needs to be clear to them.

That would classify stock walther p22’s as they come from the factory as “assault weapons”. Seeing as the threading is covered by a thread protector and the slide (instead of sticking out), most people aren’t even aware it’s threaded. Stuff like this is going to inadvertently land good people in trouble with the law who didn’t even know they weren’t in compliance.

This is why CA shooters just sigh when the idea of getting suppressors off the NFA list comes up: we can’t buy weapons with threaded barrels b/c they are “assault weapons”.
They don’t, from en engineering standpoint, have to be attached by threads.

As an engineer a small part of me looks forward to the huge middle finger I would be able to raise by working around many of their restrictions. I’m confident I’ll never need to, but they are interesting thought exercises that keep me from being too worried.
True, ILP, but the commonly available models all use a threaded connection. Just what I need, a “CA model” suppressor setup that doesn’t interchange with non-CA models and costs 50% more.
It’s bad here in Crazyfornia but not quite that bad. My still (for now) perfectly legal M1-A has a threaded barrel. However, if I remember correctly threaded pistol barrels are a no-no here in The People’s Republik for who knows what reason.
I thought a threaded barrel was a qualifying feature in the assault-weapon test, and on a pistol that it was the only feature required.
If your M1A has a 10-round magazine and the threaded barrel is its only qualifying feature, then it’s not an assault weapon, right? On the other hand, if you put a threaded barrel onto a bullet-buttoned AR15 with pistol grip, that’s two features (threads, grip) and it’s an assault weapon regardless of magazine size.
Don’t get me wrong — I’d love to have a suppressed M1A. Realistically, though, the market demand would be for AR10/AR15 and pistol suppressors.

“Military feature” is an arbitrary bullshit term. If the US Army ever used a single action black powder revolver all revolvers could be called “military style”.

I know the real reason for listing any feature is to include as many guns as possible, but why the hate for telescoping stocks? How does being able to adjust a gun until it has a comfortable length of pull make it scary?

This would ban the Glock 17 because the Glock 18 exists….at least that is how it reads.

…and with bad maintenance and a particular part breaking in a particular way, some firearms will spontaneously go full-auto without human intervention. For example, the early Remington ACRs.
The ACR went full-auto because they neglected to test the gun with a range civilian ammo. They changed the firing pins (calibrated for a couple of brands of military ammo) on the QT.
I dont know who makes them or how they work but there are aftermarket conversions for Glocks that convert to full auto. Im not even sure what its called but it replaces the plate at the back of the slide and has a semi/auto selector. The range I shoot at has one on the 9mm long slide.
We’ve been through this already, haven’t we? The Glock 17 predates the 18, and therefore fails the test.
If Glock had invented and marketed the 18 first, then created the 17 as a “civilian market” version, then you’d have a problem. Good thing that’s not the history here.
This is targeted at AR-class, AK-class, and MAC-type firearms, full stop. It has nothing to do with an obscure, impossible-to-control select-fire Glock created as a derivative of the original Glock 17.
I read the actual text of this bill (or an earlier version?) that had a tidy (and tiny) little clause in it that makes the “list” superfluous – that clause authorized the BATFE to ban any firearm not enumerated at any time after the bill’s enactment without further Congressional action. Stated another way, after the bill (with that clause) is signed into law, the POTUS and the executive branch have total autonomy to ban additional firearms for whatever reason. I want the text of the actual bill presented to the Senate to see if that’s still in there.

Are they trying to ban certain NFA articles? I’m not an expert, but I thought that semi automatic M-11s were a RPB “innovation”, and not one that MAC itself under took. (Note that the ban singles out the MAC M-11, the .380 version of the M-10)(Now, of course this would be a back door machine gun ban, as it would end the transfer of the standard magazines for these guns.)
I also love the part that splits cops and ex cops out from the rest of us. Put in your service to the state, shoot a few puppies, and you get to buy a brand new AR. It only goes to further the drug war divide between cops and the rest of us.

I strongly suspect that’s not how this is going to play out. I suspect this is going to be a very long, very drawn out, slow-push/constant-pressure kind of campaign like we had with the socialized medicine offensive of ’09/’10.

Thumbhole stocks are a “workaround” for pistol grips. I want to know what’s the plan for when criminals find a “workaround” for not having a gun? It seems I came from a place where the “workaround” is lots of bombs placed on roads and whatnot.
There is lots of talk and stats in this bill of “gun” crime. Nothing about total violent crime. What is the plan to reduce violence and tyranny once all the good guys are disarmed? Where is the “workaround” in that?
The workaround is that they have bodyguards that are exempt from the law or they fit the law around them therefore it is not their problem and will never be their problem. They are in their own little world with very different “facts” than the rest of us.
Russians are so indoctrinated by their government they don’t even think to own firearms, even though they are legal to own now, and their murder and violent crime rates are about 4 times that of the US without gun use. Scotland has about 11 times the violent crime of the US with no civilian ownership of guns. UK Law Enforcement is so behind on all criminal reporting their standard procedure when witnessing (first-hand, in person) a mugging is to issue a warning. That seems like a step up from places like Cambodia, though, where all authorities carry guns while civilians cannot, so the authorities (Police, Fire Department) can regularly ask for “bonuses”, so both criminals and the authorities can rob you.
Then you look at countries with high gun ownership like Switzerland, German, and Poland and the murder rates are very low. Most of that has to do with culture, education, and economic factors, which politicians will never try to improve, but as we all know from the stats, gun control doesn’t reduce crime.
So these people have Kalifornia just the way they want it, so WHY do they want to make the rest of the country like their state? Therein lies you agenda.
If you saw you could control one state easily, who’s to say you wouldn’t get curious about trying it in another state? Power mongering is like lays potato chips….

Why does it exempt retired LE and not retired military? Not that it makes any difference to an abomination that should have a stake driven through it’s heart to never rise again (wishful thinking). My police chief has declared that he will not enforce any attempt to circumvent the Second Amendment in shape, form or fashion.
The militarily customarily stays out of politics, law enforcement (and their unions) frequently endorse candidates.

I would love to see some stats on how many of the weapons they are proposing to ban are used in actual crimes. There are more than a few weapons on that list that are collectors items and probably retail for near $10,000 or more. Are these guns really being used in crimes?

Her Kalifornia version requires background checks on all ammo purchases. That’s supposedly OK Consitution-wise, yet asking for ID at the polls is unconsitutional. Wow.
the thing that ticks me off is that in both Arizona and Sandy Hook an “Assault weapon” was not used in either of those attacks. the Coroners report as well as the investigation revealed that in Sandy Hook the perpetrator used four sidearms, a Bushmaster was found in the trunk of his car with a jam in the reciever and it was found to have been used by him to kill his mother. in the Arizona shooting the perpetrator used a Glock model 19. in the Aurora shooting the Smith and Wesson M&P 15 had a drum Magazine that jammed at under 30 rounds and was dropped on the floor, the bulk of the injuries were from a shotgun and the two sidearms he was carrying. in Virginia tech shooting there were no rifles used just two sidearms. i read a story that one of the Presidential aids was overheard saying” we need to pass the Assault weapons ban before the reports are let out to the public” knowing full well that a ban would carry more ammunition if the press and the public didnt know that a Semi Automatic Rifle was not used.
