New York State Senator Michael Gianaris [above] is introducing new gun control legislation for the Empire State. His bill would limit New York gun buyers to one handgun purchase per month, impose a ten-day waiting period on all firearms sales and require that gun and ammo buyers register all purchases with the state (including gun shows and what are currently called private sales). Gianaris’ meshugga mishegos joins the gun grabbers’ queue; the New York Senate is set to consider other gun control bills . . .

Also on the card: banning “assault weapons,” mandating microstamping and “child-safety locks.”

“New York has more than our fair share of gun violence,” Gianaris told nydailynews.com. “There’s no reason why we shouldn’t be leading the nation in providing for the safety of our citizens.”

Double negative and misguided as Gianaris may be is, gun rights advocates can take comfort in the fact that pro-gun Republicans control the New York State Senate. Chances are they will shoot these bills down with extreme prejudice. Still, scary stuff.

  1. we have 1 handgun a month in ca and a 10 day waiting period. no private sales and starting in 2014 a long gun registry. don’t even want to talk about “assualt weapons”.

      • And the legislature is still trying to ban internet sales of ammunition as well as require “registration” of all ammo purchased in face to face transactions. I’ve asked this before but still haven’t seen any answer: why does anyone believe that registration of ammo sales will do anything at all to prevent or assist in the investigation or prosecution of crime? Are they going to throw out the fifth amendment and reverse the burden of proof by passing a law that it is presummed that ammunition has been used to commit a crime unless we can prove where and when we shot it off? And it is pretty obvious that none of these folks take the time to “think it through,” instead willingly gorging at the Bradey trough of misinformation.

    Not just because criminals will go around these rules with illegal purchases, but like the Aurora shooting shows, these crazies are willing to wait if they do purchase legally.

    • Hell, VA had a 1-gun-a-month law that did nothing to stop the Virinia Tech shooter. And VA recently removed that law, effective July 1st

      • I don’t think they are trying to prevent all gun crime, they are just trying to make it a very slight bit more inconvenient.

        We should be in favor of such legislation. Instead of over-reacting, they are just going after sham sales. From a legislative point of view, this seems like the best possible outcome.

  4. In NYS, there’s a built-in waiting period for handguns, because they have to be registered and added to our “permit to own.” This requires a review by a judge and a re-issuance of the permit, which in itself required a LOT of paperwork and scrutiny.
    If this crap passes, I might finally be pushed to move out of this state. Ridiculous.

      • In fairness, it’s pretty much a rubber stamp. Some judges sign them summarily, others actually have a real backgroud check run, others simply let them sit around, then suddenly sign them. There’s never a denial of these “amendments” as far as I know, just varying waiting times depending on caseload, which judge gets it, and also which county.
        There are a lot of things keeping me tied to this state… believe me, I’d love to move to a free state.

  6. Microstamping comes up every year, and it will continue to come up every year until it passes. Now, the gun grabbers see an opportunity to pile on. The tide will not be held back in the Republican-controlled Senate forever.

    I can’t wait to retire and leave this liberal sinkhole. Just like all the State and municipal employees do. They take their six-figure pensions and GTFO. Last one out gets stuck with the check.

  8. All the more reason to keep buying guns & ammo when you can. This country is going to hell and we need to be prepared to protect our wives and children from those who will want in our homes.

    I’m not saying become a nut-job and go out and hurt people, but as the Boy Scouts always say, “Be Prepared”.

    • If modern women want to be like men then I advocate arming and training the women and then giving them the duty to first protect their men and children.

      I recently spoke with a Chinese born and raised female librarian. She told me that she came to America expecting to have the full freedom and rights of free speech. Rather, she finds the pressure of political correctness at the Portland Public Library (and in society increasingly too) not much different than China.

    Why isn’t our side introducing legislation to make concealed carry easier? Or to cut down on waiting periods? Something… Anything…

  11. Does this guy not realize that these things he proposes would have made No difference whatsoever in Aurora, Tuscon and Virginia Tech?
    – Waiting period? Sure no problem. Each of those guys spend months waiting and planning.
    – Register gun and ammo sales? They all passed background checks (some of them multiple checks) so there is no reason to think they couldn’t have registered if there was a registry.
    – One gun a month? (see waiting period).

    What would be nice is for our politicians to come up with something New. Like an idea that would actually address the problem at hand rather than be a case of Doing Something in order to look busy. How about thinking up ways to improve mental health care in this country?

    I saw no mention of any new ideas about improving coordination between Mental Health professionals and LE in order to improve the existing background check system. Yes- I know there are privacy issues to be addressed, but that could at least be a possible way to prevent this kind of tragedy.

    Its like they can’t think past their noses. This is tiring.

    • The gun grabbers know that an outright ban is not possible at this time. So a little now, then a little more in a few years and then keep going until they get the outright ban.

    I agree completely. So how about constitutional carry for NYS, and tell NYC to suck a box of appendages when it comes to local super-special laws? You know, something that would actually positively impact the safety of said citizens.

    I spend a lot of time in PA as it is. Retards like this make me rather strongly consider uprooting my business and making the move permanent.

  13. Meh.. We’ve had that here in California. The 10 day waiting period should be waived if you already own guns. Registering Ammo is total bullshit. Just get it from out of state.

  14. NJ already has most of those in place and it does NOTHING to reduce crime or do anything other then annoy and impede LEGAL gun owners. But we expect this kind of stupidity from folks on Planet Manhatten.

  16. Too many reader’s comments are using logic and reason in ways this guy never considers…you must use politics in the way this person thinks.

    1) He is NY State Senator with a Democratic run legilature with a Governor ready and willing to sign any control bill that hits his desk

    2) The state is full of liberals who applaud this bill

    3) He is not up for re-election, so bombs away

    4) There are not enough registred voters who own firearms in his district to oppose them so he can step on their rights with reckless ease and score points with the DNC

    5) Never let a tragedy go to waste especially if there is an excuse to limit rights and give more power to politcal class — you know — the real special people.

    6) It avoids the real issue, that in 2002 (the best I could find) about 11% of the prison population in NY State was locked up with mental health issue and nationwide it is 25%. But, lets not address that problem

    7) Do they know? They might, or they might not, but why should you allow facts get away from the dogma?

    One final thing, if the politician are so stupid or purposely ignorant of this issue, how well do you think they are with other important issues?

  17. There is a lot of “gun violence” in New York, mostly relating to drugs. So, I propose the following new laws:

    Drug addicts will be limited to one robbery per month with a ten-day waiting period.

    Politicians will be limited to one grandstanding speech per month, but since nobody in his or her right mind listens to these a$$holes, the waiting period is waived.

    All guns in New York are outlawed. Nobody can have a gun. That includes cops, Robert Di Niro, Bloomberg’s cronies and his bodyguards. Why would cops and bodyguards need guns if they’re outlawed?

  19. In New York State, the police have no duty to provide police protection to any particular individual. The Courts in New York have held that “generally, a municipality may not be held liable for the failure to provide police protection because the duty to provide such protection is owed to the public at large, rather than to any particular individual” (Conde v. City of New York, 24 AD3d 595, 596 [2005]; see Cuffy v. City of New York, 69 NY2d 255, 260 [1987]).

    Bill S1427 PURPOSE: This proposed constitutional amendment would provide within the New York State Constitution for a right of the people to keep and bear arms for traditionally recognized purposes

    Bill S1863 PURPOSE: This legislation would remove a gun licensing officer’s ability to deny or restrict the issuance of licenses to law abiding citizens who have successfully undergone the state’s strict application process and appropriate New York State and Federal Bureau of Investigations fingerprint background check required under law. In addition, this bill will conform New York State law to current ATF requirements regarding background checks for firearms transfers.

  20. Id like to see a study on how many criminals guns to be traced to them in legitimate purchases at gun shops, shows, etc. I have a feeling most get them through other ways.

  21. Senator Gianaris talks of using California Law for a model. I lived in California for 18 years before coming back and complied with their gun laws. A few (very few) aspects of it are sensible, to be true. However, California requires NO license for hangun possession in one’s home or business nor is one required to transport handguns (for lawful purposes) in a locked container. California also has State Pre-emption law. NYS should first repeal the Sullivan Act, together with PL Sections 265 and 400 and pass State Pre-emption before overhauling Gun Control to emulate California and score more points with the Brady Campaign. CA gun laws may be easily verified on the CA Attorney General website (Firearms Division). This is a very well constructed site.

  22. I believe that the ATF keeps records (and does not later delete as they claim) of all the criminal background checks prior to purchase along with the make, model, and serial number. Still, these states and cities demanding additional gun registration disgust me and fill me with suspicion.

  23. Perhaps we should offer to send Bloomberg, Gianaris, and Peralta to Rahm Emanuel in Chicago as an Anti-Social Behavioral Assault Team (The ASBAT Force). What an acronym. It has the makings of a new docu-drama. Lately, Mayor Emanuel seems to need these guys a lot more than New York State does.
