Karl and Theresa Robart

In a tragic incident that saw a 5-year-old Michigan boy shot dead by a young relative, the grandparents of the 5-year-old are now facing felony charges under Michigan’s new safe storage law, WZZM 13 reported. That law is the same one under which James and Jennifer Crumbley, parents of a school shooter, were both found guilty and sentenced to prison for their child’s actions.

On April 1, Braxton Dykstra was at his grandparents’ home when he was shot and killed by his 6-year-old cousin, who found an unsecured 12-gauge shotgun behind a bedroom door. According to court documents, the fatal event took place while the children were watching a movie in their grandparents’ bedroom.

The grandparents, Karl and Theresa Robart, have been charged with one count of Firearms – Safe Storage Violation – with a minor present. Investigators found multiple firearms in the home, including a loaded pistol in a dresser drawer close to where the children were playing, and other unsecured long guns in a bedroom closet.

“This setup failed to adhere to laws necessitating unattended firearms to be unloaded and securely locked away, especially with children expected to be present,” stated the prosecuting attorney’s office, as reported by Fox 17.

Braxton’s father, Domynic Dykstra, has been vocal about the need for stricter enforcement of gun storage laws following his son’s death.

“My main goal right now is to obviously stop this from happening again,” Dykstra told WZZM 13. He is advocating for “Braxton’s Law” to prevent such tragedies and believes the mother of the 6-year-old shooter should also face charges.

The Robarts pleaded not guilty to the charges and are each held on a $50,000 bond, with further court appearances scheduled. If convicted, they face up to 15 years in prison.

    • Secure your gats when kids are there! Rather simple. I don’t agree with prosecution but it wasn’t my son(I have 4).

      • The following didn’t fix the problem…Bashing Blacks, denigrating Turkish firearms, peeing on History, holding hands with Trump slandering democRats, complaining about manual safeties, allowing Gun Control to set the pace, saying just enough so not to attract too much attention, giving bigoted scumbags a pass, yada, yada, yada. And they wonder why sht happens…

    • I fully agree that so-called safe storage laws, some forms of which have already been deemed unconstitutional by SCOTUS in DC, are untenable and wrong. On the other hand, you don’t leave loaded guns around 5-6 year olds unsupervised. That’s window-licking stupid. Aren’t there laws concerning gross negligence or reckless endangerment of children already on the books? Such laws would seem applicable here.

  1. There is one obvious thing here.. The RACE of the ones being charged..What about the Birthers of the main gang populations???

    • No law has ever stopped people from being stupid and never will. They aren’t being punished for what happened to the kid. They’re being punished for breaking a stupid law.

      • “No law has ever stopped people from being stupid and never will“

So you are making the case that since the storage law won’t stop people from being stupid we shouldn’t have any safe storage laws.

Do you know, even though there are radar enforced speed limits with stiff penalties, people still speed.
So, since speed limits won’t stop people from being stupid, should we have no speed limits?

        • Quick google search: it was already a felony in Michigan to “…knowingly commit an act or fail to take action that creates an unreasonable risk of harm to a child’s health.” So the grandparent’s actions (or in this case inaction in securing the guns) WERE illegal and criminally punishable before the gun-specific law was passed. No need for additional laws that hinder other peoples’ ability to defend themselves effectively, so this could not have been the reason the gun specific laws were enacted.

    • Where is punishment of the parent/s that failed to train their, moron, son (cousin) the shooter?

What kind ok idiot “stores gun unloaded? You might as have 16oz ballpeen hammer or a ball bat.

  2. As if the father didn’t know the old folks had guns. If he didn’t he’s a m0r0n. And now, to make up for his own idi0cy, he’s going to burden other people with a stupid law.

This is just Darwin in action.

    • I can’t wait for Jamal the baby-daddy gets charged with the same crime when his 14 year old son steals his Glock and shoots the other gang bangers with it.

      Never happen. Black privilege.

    • I can’t wait for Jamal the baby-daddy gets charged with the same crime when his 14 year old son steals his Glock and shoots the other gang bangers with it.

      Who am I kidding??

      Never happen. Bl*ck privilege.

        • Feel free to cite all the multiple examples of single black moms being charged when her boyfriend Dontariloshus leaves a gun on the counter. Only Caucasians will be charged under this law.

          • “Feel free to cite all the multiple examples of single black moms being charged”

Your bigotry is clouding your ability to see reality, and the facts prove your narrative is lame:

“A Son Shot His Teacher. His Mother’s Prison Sentence Raises Questions.
Deja Taylor, 26, could face more time behind bars for her state child abuse case.
            By Christina Carrega
            December 5, 2023

Ten days before Christmas, a Virginia state court judge will determine if Deja Taylor should receive the maximum sentence of five years in prison for child neglect. Taylor’s 6-year-old son carried her handgun to school in January and shot his teacher.

The 26-year-old Newport News mom has already started a 21-month federal prison sentence in connection to the purchase of the gun used. The teacher, who survived the shooting and multiple surgeries, has filed a $40 million lawsuit against the school district for negligence.”

Single black mom already doing almost 2 years in the federal pen, looking at five more years in state prison.

            • One irresponsible single black mom down, THOUSANDS to go. Bigotry? GFY! I do not have to compromise my safety just because someone’s feeling might be hurt nor am I a public accommodation that has to be friends with anybody or show respect to anyone.

              • “One irresponsible single black mom down“

I posted two articles, so much for your homeschooled math skills.

                Here’s another:

“Indy mother charged after 7-year-old accidentally shot himself in stomach
                Tyler Haughn

INDIANAPOLIS — An Indianapolis mother has been charged with neglect after her 7-year-old son accidentally shot himself in the stomach on the east side of Indianapolis in late January.

Online court records show that Asia Deberry has been preliminarily charged with three felony counts of neglect of a dependent after Indianapolis Metropolitan police said her son shot himself after grabbing Deberry’s firearm from her purse while inside their east side residence, according to court documents.“

          • “Bigotry? GFY!“

So bigot has a potty mouth, as well as an intellectual deficit.

Here is another article for your edification:

“ORLANDO, Fla. – The mother of a child whom Orlando police officers accused of shooting and killing a woman engaged in a fight with her mother in 2022 entered a plea of no contest to charges during a court hearing Friday, according to the state attorney’s office.

Lakrisha Isaac, 33, entered the guilty plea on charges of manslaughter and culpable negligence by storing or leaving a loaded firearm within reach of a minor.”

It is a proven fact, bigots generally are lower functioning, and often, as Donald Trump put it, “poorly educated”.

            • What, you think a couple token prosecutions in a couple shithole minority cities is a win, cuck boy? There should be dozens in Chicago, St Louis, Nashville, New Orleans every year. Are you black or do you think if you are a big enough race traitor they will keep you around as a pet?

      • “Never happen. Bl*ck privilege.“

That’s the thing with bigotry, it just reveals how stupid you are to the public at large.

  3. I’m not for these laws at all. Adults that own guns should be responsible enough to store their property in an appropriate manner without government edict. The fact this they did not do this is a problem. One that resulted in death.

  4. Quite frankly, I have no problem with prosecution of the grandparents who owned the guns and then let children play unsupervised in their (the guns) presence, but I do believe the charge should have been reckless endangerment or involuntary manslaughter……….and the charge should have also applied to the child’s parents, who were at least participative in the failure to supervise and safeguard their children.

  5. If the death of a grandchild isn’t enough of a deterrent to convince people to make better choices I’m sure a few years of free rent, food and medical care will be.

Is apparently how this is supposed to be interpreted.

  6. Just how do you enforce such a law, other than after the fact? Random searches? Without a warrant?

  7. I don’t see a problem. Their negligence cost a 7 year old child his life, and they should be prosecuted for it.

Seriously, how hard is it to properly secure firearms when kids are around?

  8. Adult caretakers are responsible for young children under their care. And that responsibility includes ensuring that the young children under their care will not maim/kill themselves.

Thus adult caretakers of young children have to do one of two things:

    1) Clear the environment of all items that any reasonable person should foresee as a way that a young child could maim/kill themselves.

    — OR —

    2) Keep the children within arm’s reach at all times thus being able to pull the young child back/away from any item/location where the young child could maim/kill themselves.

If the adult caretaker fails to do either of the above and the child maims/kills themselves due to the adult caretaker’s negligence, then the adult caretaker is guilty of felony child neglect and should face corresponding prison time.

Note that children could maim/kill themselves with several items and/or locations. Some examples include swimming pools, 5-gallon buckets of water (toddlers fall in head-first, are unable to get out, and drown), a balcony without railing, electric power tools that are still plugged into an electric outlet, sharp blades, elevated heavy objects that a child can easily pull onto themselves, chemicals, poisons, open fires, and of course firearms.

With the above in mind, a firearm storage law is unnecessary if the state has a simple and encompassing felony child neglect law.

  9. Wow there are some weird bugs anymore. It’s dark in my house and a tiny tiny flying insect less then the size of this . was flying at the light of the phone screen. Wonder what it was?

  10. “Wow there are some weird bugs anymore“

Brace yourself, it will get worse as we continue to burn fossil fuels and increase the heat buildup greenhouse efficiency of the Earth’s atmosphere:

Diseases Take Flight with Climate Change
The changing climate is providing opportunities for insects and other animals to spread infectious diseases to new populations
    Nature, Nurture
    by Charles Schmidt

West Nile fever surfaced in the United States in 1999 and has since become the country’s most common mosquito-borne illness, affecting thousands of people every year. The disease is also spreading into Europe, along with other mosquito-borne diseases such as dengue and chikungunya, while in Africa malaria is moving into higher elevations.
Tick-borne diseases are also on the move. Cases of Lyme disease, anaplasmosis, and Powassan encephalitis have more than doubled throughout the United States throughout the past two decades, as the ticks that transmit these illnesses expand into new areas, according to Ben Beard, deputy director of the Division of Vector-Borne Diseases at the U.S. Centers for Disease Control and Prevention in Fort Collins, Colorado.
Several factors explain these trends, not least among them demographic and land-use changes that bring people and infectious disease vectors closer together. “But many models suggest that temperature is a dominant driver,” says Jason Rohr, an infectious disease biologist and chair of the Department of Biological Sciences at the University of Notre Dame.“

    • Malaria was endemic to SE US until WW2. It was a huge problem during the Civil War, occurring as far north as MI. The last US case was found in AL in ’48. DDT knocked out the species that carried it.

The malaria mosquito has made a comeback in FL. l see them regularly, since the early ’80s. Malaria will come back too, along with all the other stuff flowing across our Southern Border.

      Nothing to do with climate.

    • I got West Nile disease in 2007, man I was sick, a whole lot worse then the coronavirus I had.
Apartment complexes across the nation are struggling with Bed Bug infestations. I’d never seen one until two years ago. The exterminator said is was because the chemicals were stronger back in the day but I think it has something to do with all the immigrants from some certain countries.

    • From the mid 14th century to the first quarter of the 19th century the world experienced what scientists call a mini ice age. Global temperatures dropped to the point glaciers that had been receding for the last ten thousand years started growing again and snow was still on the ground thru June in the northern hemisphere.
Scientists at Woodshole Oceanographic Institute are looking at the possibility it could happen again in this century. Climate change is real (t is constant and natural), man driven climate change is a scam and CO2 is not the driving force in global warming.

  11. About time the moron portion of gun owners start to face the consequences of their actions.

Make them be responsible gun owners under the threat of losing their guns AND their kids.

    • … you go first – on any given weekend in Chicongo, 5 to 7 people are killed, out of forty-something shot, mostly black gangbangers. No one fucking cares.

    • You’re being way too generous… its actually only about 7 percent as it’s generally the males in the particular group

  12. When ever some people’s kids came over I put up all the gunms.
    Other people’s kids I didn’t.
I don’t think its wise to have kids running around the house with gunms laying around unless you know the kids, even then it’s a bit risky.
But once again. Pass a Law.

  13. “Hey, honey, don’t forget the grandkids are coming over today make sure you lock up the guns. I know you like to have one out for self-defense but while they’re here we need to make sure that we have a safe environment for children that don’t have the sense that we do. when they leave you can get them back out. If you are THAT worried about us being attacked you should go ahead and carry a pistol in the house today.”

Was that REALLY that hard? Children can do things that are even stupider than adults. It is STUPID to have unsecured guns with children around but.
