In a tragic incident that saw a 5-year-old Michigan boy shot dead by a young relative, the grandparents of the 5-year-old are now facing felony charges under Michigan’s new safe storage law, WZZM 13 reported. That law is the same one under which James and Jennifer Crumbley, parents of a school shooter, were both found guilty and sentenced to prison for their child’s actions.

On April 1, Braxton Dykstra was at his grandparents’ home when he was shot and killed by his 6-year-old cousin, who found an unsecured 12-gauge shotgun behind a bedroom door. According to court documents, the fatal event took place while the children were watching a movie in their grandparents’ bedroom.

The grandparents, Karl and Theresa Robart, have been charged with one count of Firearms – Safe Storage Violation – with a minor present. Investigators found multiple firearms in the home, including a loaded pistol in a dresser drawer close to where the children were playing, and other unsecured long guns in a bedroom closet.

“This setup failed to adhere to laws necessitating unattended firearms to be unloaded and securely locked away, especially with children expected to be present,” stated the prosecuting attorney’s office, as reported by Fox 17.

Braxton’s father, Domynic Dykstra, has been vocal about the need for stricter enforcement of gun storage laws following his son’s death.

“My main goal right now is to obviously stop this from happening again,” Dykstra told WZZM 13. He is advocating for “Braxton’s Law” to prevent such tragedies and believes the mother of the 6-year-old shooter should also face charges.

The Robarts pleaded not guilty to the charges and are each held on a $50,000 bond, with further court appearances scheduled. If convicted, they face up to 15 years in prison.

    • I fully agree that so-called safe storage laws, some forms of which have already been deemed unconstitutional by SCOTUS in DC, are untenable and wrong. On the other hand, you don’t leave loaded guns around 5-6 year olds unsupervised. That’s window-licking stupid. Aren’t there laws concerning gross negligence or reckless endangerment of children already on the books? Such laws would seem applicable here.

        • Quick google search: it was already a felony in Michigan to “…knowingly commit an act or fail to take action that creates an unreasonable risk of harm to a child’s health.” So the grandparent’s actions (or in this case inaction in securing the guns) WERE illegal and criminally punishable before the gun-specific law was passed. No need for additional laws that hinder other peoples’ ability to defend themselves effectively, so this could not have been the reason the gun specific laws were enacted.

  3. I’m not for these laws at all. Adults that own guns should be responsible enough to store their property in an appropriate manner without government edict. The fact this they did not do this is a problem. One that resulted in death.

Quite frankly, I have no problem with prosecution of the grandparents who owned the guns and then let children play unsupervised in their (the guns) presence, but I do believe the charge should have been reckless endangerment or involuntary manslaughter……….and the charge should have also applied to the child’s parents, who were at least participative in the failure to supervise and safeguard their children.

    Seriously, how hard is it to properly secure firearms when kids are around?

  8. Adult caretakers are responsible for young children under their care. And that responsibility includes ensuring that the young children under their care will not maim/kill themselves.

    Thus adult caretakers of young children have to do one of two things:

    1) Clear the environment of all items that any reasonable person should foresee as a way that a young child could maim/kill themselves.

    — OR —

    2) Keep the children within arm’s reach at all times thus being able to pull the young child back/away from any item/location where the young child could maim/kill themselves.

    If the adult caretaker fails to do either of the above and the child maims/kills themselves due to the adult caretaker’s negligence, then the adult caretaker is guilty of felony child neglect and should face corresponding prison time.

    Note that children could maim/kill themselves with several items and/or locations. Some examples include swimming pools, 5-gallon buckets of water (toddlers fall in head-first, are unable to get out, and drown), a balcony without railing, electric power tools that are still plugged into an electric outlet, sharp blades, elevated heavy objects that a child can easily pull onto themselves, chemicals, poisons, open fires, and of course firearms.

    With the above in mind, a firearm storage law is unnecessary if the state has a simple and encompassing felony child neglect law.

    West Nile fever surfaced in the United States in 1999 and has since become the country’s most common mosquito-borne illness, affecting thousands of people every year.     Tick-borne diseases are also on the move.     • Malaria was endemic to SE US until WW2. It was a huge problem during the Civil War, occurring as far north as MI. The last US case was found in AL in ’48. DDT knocked out the species that carried it.

      The malaria mosquito has made a comeback in FL. l see them regularly, since the early ’80s. Malaria will come back too, along with all the other stuff flowing across our Southern Border.

      Nothing to do with climate.

    • I got West Nile disease in 2007, man I was sick, a whole lot worse then the coronavirus I had.
      Apartment complexes across the nation are struggling with Bed Bug infestations. I’d never seen one until two years ago. The exterminator said is was because the chemicals were stronger back in the day but I think it has something to do with all the immigrants from some certain countries.

Global temperatures dropped to the point glaciers that had been receding for the last ten thousand years started growing again and snow was still on the ground thru June in the northern hemisphere.

    Other people’s kids I didn’t.
    I don’t think its wise to have kids running around the house with gunms laying around unless you know the kids, even then it’s a bit risky.
    But once again. Pass a Law.

    Was that REALLY that hard? Children can do things that are even stupider than adults. It is STUPID to have unsecured guns with children around but.
