Whatever it was about, it appears that the Bundy Ranch vs. the Bureau of Land Management (BLM) confrontation has reached a successful conclusion. TTAG’s man on the ground, Bryan Hyde, reports that the BLM is backing down from a battle over grazing rights on federal lands. Clark County Sheriff Doug Gillespie brokered a deal with the BLM to release the Bundy Ranch’s impounded cattle and allow their owner to graze the bovines on public lands again. Bryan tells us that during the Sheriff’s press conference at the Bundy Ranch to announce the deal, Bundy was surrounded by militia types in “full battle rattle.” And that the rancher isn’t satisfied with the latest arrangement. Meanwhile, a reliable source says there’s a large police staging area on Mormon Butte, just south of the Bundyville exit, with SWAT a plenty. More info as we get it.

To blame the NRA for the low number of black members is misguided and an unfair accusation. It is very basic. The NRA is a Conservative organization and votes conservative ideas and concepts.The main one is Freedom to be armed. TT, you are so wrong on this one. Nothing involving public land use in the West is this simple. I say “in the West” because there is no parallel in the eastern states. None. Your comment presupposes the in fact the Feds “own” the land, which is not the case (well, not so much in Nevada because the Feds own about 94% of it through a wide range of highly dubious claims).
The BLM does not, in fact, own the public lands Bundy ranches on. That land is still owned by the State of Nevada. In that case, the BLM functions as land managers. Sadly, this is most frequently the entry point into a long slide of the land sliding out of the public trust into private ownership of developers and others. This is, indeed, how the Feds ended up owning 94% of Nevada. But even as I write that I am drastically over-simplifying the whole issue. It is a rats nest of legal wranging, competing public vs. private interests, and fundamental conflicts between states and federal rights.
Personally I’m amazed at all the people from the east coast who have never lived or worked in nature in a western desert state that are now suddenly experts on western water rights and land use litigation – who knew there was such a market for this knowledge on the east coast? /sarc

The other thing that really winds me up are the horse-besotted women from cities (esp. back east) who want to carp about “over grazing of public lands” but then want the BLM to leave all the “pretty mustangs” alone.
Want to see rangeland that’s been hammered to dust? Look at some of the HMA’s where the horse numbers are 5 to 10X the AML.
And because of those bleedy heart women worrying about the pretty mustangs they suffer from a lot of terrible diseases due to the closed genetic system. That and the horses are generally worthless for riding even after being trained because of their bad conformation caused again by the close genetic system.
That’s bull. Some of the best scholarship on western water and land law has been done by east-coast law school scholars. What I find much more laughable is all the arguments which completely ignore western water-rights and land law, finding a mystical right to graze without paying…when the family moved to the valley to farm, not raise cattle, and moved into cattle raising, eagerly joining other ranchers in ending the open range system that broke the ranchers, happily trading that for a system of exclusive grazing rights for a nominal fee.
I find the comments sympathetic to Bundy very uninformed about the history of the grazing lease system. I wouldn’t fault easterners for that. Water rights conflicts are found everywhere in agriculture, in all parts of the country. The problems vary of course.
The “Mesta” system brought to cattle ranching from Spain via Mexico launched (or grounded) the culture of the open range grazing system. The system didn’t work because of greed, rancher greed. Ranchers understood that and willingly pursued a change. They got it. Cliven doesn’t like it. So? It really is that simple. Cliven didn’t have a ‘right’ to expand into other land whose leases had been bought out. I’m sure he feels aggrieved. Again, so? It isn’t a lack of knowledge that burdens the case. It is the possession of knowledge which just ain’t so. But Cliven still has a chance to use politics to improve his lot, when the law does not suffice.
I hope that the deal offered by the BLM is one Bundy can accept. It sounds like there is a lot to be done in disentangling the Feds from the states.
The Bundy deal is a “throwaway” for the feds. They have another two years and a vast bureaucracy at their disposal. And a private, unsworn army. And support from the sworn armed forces and three-letter agencies.
Given past federal behavior, I’m wondering if this isn’t a fallback, regroup and replan. This seems to solve immediate and superficial issues, but doesn’t seem to address any decades long issues.
Exactly. The end game is to break Bundy and steal his land. This phase of the Federal land grab may be over, but the next phase has already begun, quietly, behind the scenes.

I haven’t heard and don’t believe that the BLM yet has a ‘money judgment’ against Cliven Bundy. I think they pursued their first remedy against trespass, which in the case of cattle means removing the cattle. That was impeded, obviously, and a court will have difficulty directing BLM to repeat that exercise. Since the trespass is ongoing and BLM has attempted to remedy it, they’ll move on to seek a judgment for fees, damages, and costs. They need to reduce their claims to a money judgment. That will take time. Then enforcement of the judgment brings other complications.
Politics will enter the picture. How it will affect things is unclear to me. Politics really does create strange bedfellows, as they say. You never know what’s what until someone turns the the lights on.

I bet Mr. Bundy is wondering who is going to pay for all the damage the Feds caused. Livestock loss, land improvement damage, etc. You need more than just land to run a cattle operation. Who is going to pay to restore it back to what it was? Enough loss could bankrupt the ranch.

@ I. I wouldn’t say anyone is innocent in this. There are people on both sides that feel they are right, as above Mr Bundy doesn’t like the deal. If the feds don’t like the deal then it was a compromise, but I also agree. A compromise with the right hand while the left hand drums up some other charges to have a reason to arrest.
I can’t honestly say that I understand every nuance of the situation, but I am glad the Feds were actually able to back down. I wonder what would have happened in the Bundys and company were not armed. I doubt that this outcome would have occurred. As always, an armed populace is a strong motivation for the government to at least maintain the illusion of fairness. Should the government go to far, the people maintain the right and ability to address the grievances.

My fear is that this thing is far from over. There is no way the Feds can take this thing lying down. This situation plays out hundreds of different ways every day across the West.
I think this pullback is simply a temporary de-escalation and once the supporters are gone, the Feds will SWAT the family. God, but I hope that doesn’t come to pass, but power cannot be sustained unless it is shown to be absolute.
Now that they agreed to back down their only recourse is through the legal or tax system. Much smarter and effective to sent the IRS after him. He has got too much publicity. He isn’t some odd ball Randy Weaver type of guy. It sounds like he is Ben Cartwright.
If anything does come to pass it will be decades. The Bundy’s have media contacts now plus national media exposure. Any aggressive tactics by any federal or local agency including the IRS will be viewed as retaliation and would get immediate press.
I don’t think a move like that would be taken lying down by the family or his supporters.

The really incongruous thing about this statement is that Stevens, and liberal justices of his ilk, are antithetical to the entire idea of “original intent”. They believe in a “living document” that can be tortured into meaning anything at all. Roe v. Wade is the ultimate example of this.

This is a minority position which the Supreme Court has not, as yet, accepted, but the Second Amendment did apply to the states initially as did all the rest of the Bill of Rights with the exception of those matters which are explicitly restricted to the Federal Government. It is the position of those who say, as I do, that it is one of the Privileges and Immunities of Federal Citizenship. The Founders had no intention of allowing states to deny them these fundamental rights. It would have been inconceivable to them that a citizen could not exercise any or all of these rights when traveling to or through the several states. George Washington would be subject to arrest when traveling to his inauguration with his sword today.
The legislative history of the 14th Amendment is plainly evident in the debate in Congress and statements of its proponents. It was to overturn the Dredd Scott Supreme Court decision and to grant to the freed slates and other blacks status as people and citizens. (There was case law that blacks, even freemen, were not eligible for citizenship.) you will recall that the Emancipation Proclamation purported to free slaves in states which were then in a state of rebellion. This was actually based upon the legal principle that they were property and classed as contraband. President Lincoln had no more authority to grant citizenship than he had to take it away. The Emancipation Proclamation was a political document issued during armed conflict. It remained to become law by action of the Congress, President and States after the cessation of hostilities. This distinction was seen by the Congress and hence the 14th Amendment. Administratively, the distinction was not as clear during Reconstruction under Martial Law and Radical Republican administrations.
Almost the entire body of U.S. Supreme Court 14th Amendment cases are improperly decided as a consequence. The concept of making various Constitutional Rights applicable to the states on an ad hoc basis via the 14th Amendment is a fiction.
The Supreme Court is not necessarily correct in its decisions. It is simply the last court to speak in a matter and their mistakes live on until either Congress acts to overturn them or Court itself recognizes its error and corrects it. It is little wonder that the Founders specified the oaths of office of various officials and that they were to swear to defend the Constitution of the United States against all enemies foreign and domestic.

As I understand it this isn’t even federal land, it’s state. The BLM is exerting it’s “authority” on the grounds that it’s protecting the desert tortoise, a species that’s so endangered they are euthanizing them to control their overpopulation.
My friends, our 2nd Amendment rights hang by one vote. While fiercely pro-gun, I am also a social conservative who believes in the traditional definition of marriage and all sorts of stuff guys like Stevens and his ilk hate. This is a simple plea to those who do not share my views on social issues: divided we fall. Believe me, those on this site who do not like social conservatives need to put that aside and support those who support them. If not, Hillary needs just one more justice and this recent renaissance of gun rights will come to a screeching halt.
As long a social conservatives stick to “having” their beliefs, rather than “imposing” their beliefs, I’ll stand shoulder to shoulder with them, till the bitter end.
First off I gotta say the truth which it seems most people haven’t heard too much of about this situation. Bundy is the last of the large scale independent ranchers in this country. He refuses to sell his ranch off to corporate interests. This might not be tagged as the main reason why they are coming after him, but if this ranch was a corporate ranch/farm there would be no way the government would try to mess with it. They can push a family around more easily and thats why they are choosing to. They have a lot of money to gain from seizing his property. Thats the bottom line.
As for the protest I set out to make a documentary about..
this whole thing turned into something way off from what it should have. Leave it up to a bunch of “militia”, Halloween costume wearing, “just wanna have a showdown” type of derps to not understand what organizing a protest actually means. The second these people grabbed up all their assault rifles and headed to this ranch thinking they were gonna have a wild west showdown, was the second the protest lost all legitimacy. You see, if you want to protest the use of aggression by the state, you yourself cannot become the aggressor, or you become as bad as the people you are protesting. The trouble with these types is that they have been spouting this hyperbole about “we need our guns to fight government tyranny” for so long, that they are just waiting for an incident to justify the lost cause way they think. THIS SITUATION was definitely NOT that incident. We needed a peaceful coming together more than any other protest on this one. But as for a lot of things in life, i.e. driving, television, movies, the school system, politics, social change.. the stupid people ruined it for the intelligent people who were trying to actually have a real effect. The influence of a video camera and a correct perspective are 400 times more powerful than the influence of a gun will ever be. It’s what I set out to use.. but I refuse to side with either of these aggressors. I won’t be part of a fight between one militia and another. This use of physical violence is what we are trying to leave behind in our culture, and I happen to already live in the future. It’s so sad it had to end up this way. My concerns still go out to the Bundy family.
I will wait for a less biased appraisal of the facts. The courts are where disputes are settled, not in the press and not with threats of range wars. In fact when someone starts bellowing about starting a war with the government that tells me that they haven’t got a fact or law left to support their claims.

I think this man might well be in legal peril. If there are powder burns indicating the gun went off during the struggle he’s likely home free. If not and no other weapon is found or the wounds of the assailant indicate he was retreating, the sailing may not be as smooth as you might want.

The Bundys are the last ranchers in the entire county. Fifty-two ranchers quit and sold out to the BLM. One lone rancher and his family stood against the thugs of the BLM and their hirelings. The BLM has promised to return several hundred of his cattle and withdraw their militarized vehicles and snipers.
They fear their personnel and by-standers may be injured, but did not feel that way when they imported the armed thugs and snipers. it was only after the Oath Keepers and other militia groups arrived that the BLM backed down.
Kudos to the Oath Keepers, all militia groups and citizens gathered in support for the Bundys. Kudos to the Bundy family for being strong and resisting tyranny. Local militia that are there have reported back to us that they will remain a few more days to make sure the BLM delivers on what they have promised. Cliven Bundy is not completely satisfied with the offer by BLM, but he is willing to listen to more of the details involved.

Reading over the Bundy threads over the past two days I have to say hats off to him. He ran a very professional PSYOP campaign and I have been involved in several goods ones. Here is a wealthy guy who has mobilized the peasants to come defend his land. They would have died for him. If the Reid angle is true then not only does he have a multi-million dollar ranch but he might sitting on a couple hundred million dollars in oil rights underneath his land. I am not one to begrudge a person’s wealth but neither am I one to suck up to it.

If this goes South , which could happen , you will see more backup arriving for the existing federal units on site , and they will catch the Patriots off guard , hopefully not , but then there is the lets calm everything down until everyone has left and then take on the bundy’s when they don’t have any help and if Cliven Bundy just happens to get accidentally killed well we tried to take him peacefully but ! I do not trust the Federal government at all , all these folks understand is that they get what they want no matter what , and if you don’t like it we will just kill you to get it , because that is what they have been taught , no one had any charges pressed against them after Ruby Ridge or Waco , nor will they if someone gets killed by Federal agents now or in the future , they have the get out of jail free card , because the government really can’t admit they did wrong , it would make them look weak and they don’t want that as they might lose the control they have . Super high velocity ammo like they make can skew your gun reviews. You are NOT going to get good ammo out of a 1:7 twist AR with 3500FPS ammo. I hope that you are also going to keep supplying a stream of more typical ammo for the accuracy tests. Accuracy tests using just this would be worse than useless.
Im glad I’m in Texas here if somebody breaks into your house it is assumed by statute that they are a threat and use of force is justified.
Also we can use deadly force if needed to protect property also. So guarding your property that has been a target of criminals is perfectly legal. Not evidence of some pre meditated murder.
That said zip tying the guy was risky. So was not shooting him when he saw him with the machete. If a home invader was within 25 feet of me with a machete I would have shot him first then told him to drop it. And called the ambulance and then the police.

Also, felt recoil and handling is NOT even close to the same with Liberty Ammunition as it is other standard ammo. This is based on my own testing.
