While two different courts have issued temporary injunctions against Virginia’s new ban on so-called “assault weapons,” which was supposed to take effect on July 1, Virginia Attorney General Jay Jones is doing everything he can to get the law enforced.
Jones: The injunctions only bind the named defendants
In fact, Jones is dismissing the court injunctions, telling anyone who will listen that the only ones barred from enforcing the semi-auto and magazine ban are the Superintendent of the Virginia State Police, his successors, officers, agents, servants and employees, Commonwealth’s Attorneys in Washington County, Chesapeake, York County, Frederick County, Giles County, and Chesterfield County.
“Entry of a preliminary injunction itself does not void or invalidate the new laws,” Jones wrote in an update from his office. “Rather, entry of these injunctions bar enforcement of the laws by the named defendants in the respective suits.”
Jones then went on to write that all other law enforcement agencies in the state can still enforce the bans, which he says are still in effect.
“The injunctions bar enforcement by only the named defendants listed above,” Jones wrote. “For more details on the specific provisions enjoined, please see the June 30, 2026, Order of Injunction entered in the Lancaster County case here which enumerates those provisions. Otherwise, the new laws remain in force, and these injunctions do not bind individuals not named in those suits, such as non-defendant Commonwealth’s Attorneys or local law enforcement agencies.”
17 Commonwealth’s Attorneys have already refused to enforce the bans
Of course, as we reported earlier, immediately after passage of the new law, eight Commonwealth’s Attorneys and a couple of county sheriffs had already pledged not to enforce the bans. That count has since grown to 17 Commonwealth’s Attorneys committing to protecting the Second Amendment. Spotsylvania County Commonwealth’s Attorney Ryan Mehaffey said his decision was grounded in his oath of office.
“The code of Virginia is just not ever going to be able to supersede constitutional law,” Mehaffey said. “When constitutional law is clear on the point, I have to remain faithful to the supreme law of the land, and that’s the U.S. and the Virginia Constitutions.”
Jones is running to the Virginia Supreme Court to try to bring the bans back
Along with claiming the injunctions are very limited, Jones is also trying to get the Supreme Court of Virginia to reinstitute the bans statewide, according to Gun Owners of America.
“Attorney General Jay Jones did not waste any time attacking Virginia gun owners,” GOA wrote in a state alert. “Just days after GOA, GOF, VCDL, VCDF and gun rights journalist John Crump secured a preliminary injunction in Crump v. Katz, Jones and the Commonwealth are running to the Supreme Court of Virginia to try to bring the gun bans back.”
GOA: The real threat to public safety is disarming peaceable Virginians
GOA added that Jones won’t rest until enforcement of the bans begins.
“In plain English, he wants Virginia’s unconstitutional gun and magazine bans back in force while our case moves forward,” GOA concluded. “That means Jones is fighting to restore restrictions on the acquisition, transfer, manufacture, purchase, importation and public carry of many commonly owned firearms and standard-capacity magazines. These are the very bans the court has blocked from being enforced by law enforcement.
“Jones’ office is claiming the injunction creates confusion and interferes with so-called ‘public safety.’ But the real threat to public safety is disarming peaceable Virginians and threatening them with criminal penalties for exercising their rights.”

There will NEVER be a solution to this problem until there are serious consequences for politicians who promote and pass unconstitutional legislation.
So long as they can pander to their voter base with this crap and when it fails or is overturned by the courts they just say, “My bad.” and move on with no penalty for acting unconstitutionally they have zero incentive to change or stop.

Ideally; first offense that you voted in favor of legislation later ruled unconstitutional: a mandatory class on the Constitution before you can vote on anything again.
Second offense: removal from office and loss of any pension or other benefits.

This information is outdated. Its changed.
Yesterday the court expanded it’s injection to apply to all law enforcement and locations in the state. And sales can resume on 21 July 2026.
Oh, also “all law enforcement” also includes Jones so he can not in anyway attempt to enforce the ban.

Another judge expanded the injunction to encompass the entire state. Yesterday or the dau brfore, I don’t remember. The AG can pound sand.
Could it be? A politician is actively working to enforce unconstituitional laws and deprive their constituents of their Constitutional rights. Laws that would jail them if they violate them. Laws that will eventually involve law enforcement killing citizens who disobey. You don’t say.
