It’s never a good idea to accost someone when they’re diving into some Whataburger deliciousness. Especially in Texas. But if you’re going to stick a gun in someone’s face and demand money, make sure your intended victim isn’t packing. “Two armed robbers picked the wrong victim in northwest Dallas. Police said they approached a man eating his dinner in the parking lot of Whataburger at Inwood Road and Lemmon Avenue and tried to rob him around 1 a.m.Thursday morning. The man was an off-duty, but armed security guard. He shot and killed one of the robbers. The other ran away.” ‘Nuff said.

  1. With the trend of carrying (open/concealed) on the rise, I was about to say “Criminals are gonna have to learn eventually…” And then I sadly chuckled and reminded myself that they will not…

  2. There was something about whataburger and guns a few months ago, I don’t remember if it was on this site. Was it about whataburger banning guns, or just banning open carry, or was it telling anti gunners that they aren’t going to ban anyone carrying. Anyone remember?

      • Whataburger does however hire armed security guards for restaurants with a history of problems and/or robberies. Source: i work security for a few of em.

    • You are correct. Whataburger went out of their way in advance of the new Texas open carry law taking effect 1-1-16 to proclaim that their restaurants would ban open carry. In split-the-baby sagacity, they reiterated that licensed concealed carry would remain allowed. How nice.

      They didn’t have to get involved in this. They could’ve gone about their business and none of this would’ve made a difference. The open carry hysteria is much ado about nothing. Nobody’s actually open carrying. The benefit of the law is largely symbolic, as an advance of firearms freedom generally, but it does reinforce the will of the people and provide a foundation of support for further freedom expansions. There is the limited, practical benefit or providing more solid protection for concealed carriers whose guns are accidentally, incidentally revealed.

      As a regular customer for decades, Whataburger lost my business with that decision. Have I been tempted? Oh yeah, as recently as yesterday, but I’m standing firm. No Whataburger!

        • THIS! My grandfather (RIP) once told me “Nobody has ever been ridiculed for the stupid thing they DIDN’T say out loud, son.”

        Speak for yourself. I have opened carry several times the last few weeks (Lowes, Home Depot, Walmart, Academy). It has been a non-issue. No one running in panic, SWAT team was not called, was not asked to leave. Even open carried past 3 policemen heading to the gun range in the parking lot as I was walking out and all I got was a hello nod from them. They did not ask to “see my papers”.

        • I open carry much of the time here in KY where it has been legal since ever. I am not opposed to concealed carry. I AM opposed to paying good money to exercise a natural right. While there are zero negative incidents to report, it does seem that some have been headed off at the pass. The risk of being shot is too high even for daredevils.

        • Oh, I’m sorry, was it really necessary to mention the one guy who’s OCing somewhere? When you can round down to zero the percetage of licensees who are OCing, that’s “nobody” in common usage of the word.

          It’s just that I happen to live in Houston, in Harris County, Texas. As a county, it happens to have more licenses issued than any other in the state. In three months of legal OC, I’ve seen exactly zero people do so, and that includes at some of the same chains where you carry. It’s extremely rare, howsoever slightly above zero the rate may be.

          Whataburger stepped in a mess entirely of their own making. Geez, even the froyo places are silent on the issue. When people who make a living dispensing cheesecake frozen yogurt topped with raspberries and almond shavings (delicious!) are manning up more than Whataburger, something is rotten in the state of Texas.

      • I too avoid Whataburger after that announcement. I thought it was extremely rude and ungrateful to come out with the announcement in Texas. We will gladly show them the border and let them do without our business.

  3. Not sure what the fact of his profession has to do with the story given that he was not working and was just trying to eat a burger (and the legal status of his being armed does not depend on his job as it might in, say, NYC).

    • The progheads can comfort themselves with the thought that the gun-carrier was a professional (sort of) and not just some random, dirty plebe.

  4. love me some wataburger. the upside down “v” shaped building is always a sight for sore eyes, as they used to say. anybody know if wataburger has stores outside texas?

    • We have them here in Oklahoma and when I used to live in Florida there were a few but I heard from some family that they didn’t last there.

      • yeah, got some family in alabama, north carolina and virginny. none of them ever heard of whataburger until they came here for a visit.

        how do you think whataburger compares to hardee’s or carl’s ?

        • I think, dollar for dollar, Whataburger is a better buy. We have Carl’s here. Don’t care who or what though, nobody beats Carl’s for breakfast.

        • I am actually a Five Guys sort myself but Whataburger can be pretty tasty. Of course, I’ll take a sliced brisket sandwich from my local BBQ joint before anything else.

        • there used to be a place around here, long ago, where they served barbecue venison brisket sandwiches at lunch. mmm, nothing quite like it.

        • i like whataburger because of their buildings, and because they are everywhere. carl’s is tough to beat when it comes to variety.

        • 5 Guys? Another horrid snorefest fried burger, as expensive as Shake Shack, without the quality ingredients. Incinerated to ruination, and served with a pile of mediocre fries. Oh boy. It’s like going to McD’s without the value menu.

          I’ll take my ~$7 to any one of a dozen of local bars. Get a half pound of hand-pattied-grass-fed-free-range-Angus-beef. Properly cooked mid-rare, over a char-broiler on a fresh toasted bun. With freshly sliced toppings.

          Whataburger, Lotaburger, Steak-n-Shake, Shake Shack, In-n-Out, they’re all just something to stick in your face because you’re in a hurry and you have no time. Slightly varied flavor profiles, but c’mon. people only eat them because they don’t have an hour for lunch to go get something actually, you know, edible.

          I am not above White Castles. At 3 AM. With some alcohol in me. In fact, it’s rather tasty.

          I’ve suffered through thousands of FF “meals” over the decades, hell I’m old enough to remember when *everything* at Taco Bell was made fresh. In house. I even choked down some McD’s faux chicken fillet this week. But I ate crap as it was fast and I could “eat” in the car on my way to where I needed to be.

          That said, if you can’t taste (and appreciate) the difference between a soulless 1/4 Pounder and the aforementioned bar-burger, your taste buds are broken. Or dead.

    • We have quite a few Wataburgers here in New Mexico, we are an open carry state but I’m not sure if they ban open carry here.if I ever eat there it’s in my truck from the drive thru.

      • i’ve been livin’ in my cave too long: arizona, new mexico, oklahoma. i didn’t know there were that may whataburger’s out there. kinda convinced myself texas was the only place with such an iconic place to grab a bite.

    • It’s pretty much McD’s…

      Except they uses real beef and chicken. They will bring the food to your table. They will put jalapeños on your burger. And the ketchup is “fancy.” Which is to say it probably has more sugar in it.

      If you’re in a hurry and/or don’t have much money, it passes for food.

  5. Whataburger is just a notch above McDonald’s, which isn’t saying much. I’ll take 5 guys or Smashburger over Whataburger, any day.

    Also, Lemmon and Inwood at 1am… If you aren’t packing, you should be, because you’ll likely be the only one.

      • The only thing I’ll go to Dallas for is Cindi’s Deli or if work sends me there. And neither will be at one at 1am.

        Although, I could possibly be talked in to going to Uptown for a drink. But, only to ogle the future trophy wives and make fun of the effeminate yuppies.

    • SmashBurger, the Steak-n-Shake ripoff where they also proudly aggressively flatten all the flavor and juices out of the patty? Toughening it, while cooking it to a mid-well death?

      I don’t get it. Like you noted, if you’re broke, or in a hurry, it passes for food. As a destination that isn’t 10 feet from my trip path, I’ll pass.

  6. Hold on just a minute there, Robert! The Entertainment Industries Council says someone trying to use a gun in self-defense would fumble, get overpowered by the attacker, and have the weapon used against them. Therefore, this story can’t possibly be true.

      • Ah, but he is a security guard. That makes him an almost cop, and thus grants him special skills, such as the ability to hold a weapon without dropping it.

        Hollywood standards have not been defied in this case.

  7. Whataburger can do whaever they want as long as they keep the “green chile double” on thier menu. Thier brand ketchup is like a blessing to fries!

  8. This happened only a few miles from my job and I even heard the gun shots. The other robber ended up getting caught and arrested only a few blocks away.

  9. Ya know, the anti-gunners keep saying it doesn’t count as a self defence use of a gun if the bad guy didn’t die. I guess in this case they got their wish. They sure are a bloodthirsty bunch, if you ask me!

  10. I’ve Open carried in Whataburger at Willow Park and Benbrook. No signs and no problems. Employees had no problems whatsoever.

        • Especially since Mary Ann was the only one to keep getting paid residuals from Gilligan’s Island.

          Back in the day, TV shows disappeared after a re-run or two, and nobody though about these shows lasting more than a year in syndication, let alone decades. Dawn Wells (and her hubby at the time who was a lawyer, IIRC) saw the future, and the studio didn’t.

  12. And this is why you open carry folks. Criminals don’t prey on people they know can fight back.

    Sure, conceal carry if your trying to lure them in but personally I would rather avoid a gunfight as plan A.

  13. I always get the number 1. Fries are always good at the whataburger. Nice juicy burger too. I could see how a thug with no money would feel it’s worth the risk to steal a guy’s whataburger in the parking lot.

  15. I work right across the street. Decent enough spot during the day, but things go pretty sideways once the sun goes down. Can’t even get gas around lemmon and inwood after work without someone walking up to you at the pump and trying to lean on you for “gas money”. Saw a woman rolling on the ground, clawing her face and moaning like a pregnant cat last week 100 feet from that whataburger. I asked if she needed help and she tried to shove her thumb through my eye socket. At this point, I was able to determine that she was either on some crazy stuff or giving birth to the antichrist. Being incapable of rendering aid in either circumstance, I continued on my path. Just saying, not a spot I’d stop to eat at night, a sentiment with which I’m sure the gentleman in the article would now agree. Stay safe out there folks.

  16. I live in NJ, which has a relatively high crime rate. Just about every suburban town in NJ is adjacent to an urban area, and the crime then necessarily finds its way to just about every locality.

    Unfortunately, if you are a law biding citizen in NJ, you won’t carry your hand gun because in NJ an act of God is required to get a CCW (and forget open carry, that’s just a fantasy that will never be realized by most people in the state).

    In any event, my sister was raped twice, once at gun point and once via date rape. In the first case, she was walking out of a night club, on her way to her car, when the rapist put a gun to her ribs, told her to keep quiet, then “escorted” her to his vehicle. Now, this idiot put her in the passenger seat and walked around the REAR of his vehicle, so my sister was sitting in the passenger seat with plenty of time on her hands to devise an “exit” strategy.

    Well, after the fact she had told police that she was fearful of opening the door and running, in particular she was afraid of geing shot in the back. However, she told the police that if she had been carrying a gun, she felt there would have been at least two opportunities to shoot and kill the rapist: 1) she felt that as he came around the rear and opened up the driver’s side door, that he would have been close enough for an almost point-blank shot, either immediately as he entered or as he was starting to drive, and/or 2) she could have exited the car and using the car itself as cover, she could have shot him at a 10ft range and worse case enough attention would have been generated to cause the perp to leave.

    Alas, these were just fantasies for my sister because she tended to obey the law and thus did not carry her hand gun(s). In NJ, for the most part, it is just the crooks, the gangsters, the mobsters, the criminals who carry guns, thus, there are more vics the likes of my sister. Even the police who responded to her call after the deed was done back at the rapists’s apartment told her that she should carry a gun anyway, because according to them, she “had opportunities to take care of things on her own”. The polce told her on the DQ that in all likelihood the DA/Prosecutor’s office will not press charges.

    Well, that’s exactly what transpired. The DA told us that my sister was “too traumatized” by the rape to remember events, circumstances, face, etc, in sufficient enough detail for a successful prosecution.”. Even though there was DNA evidence, the scum bag of course called it “mutual”, and the gun he had used was in his apartment, and he had a legal permit to hold it. In other words, it was his word against hers as to whether the gun was ever used in the crime, or was even outside of the apartment for that matter.

    The way this should have gone down is as follows:

    My sister walks out of the night club, is held up, is put into the passenger seat. While seated, and as he is walking around the back of the car, she pulls out her SigSauer 9mm w/a 15-round clip from her hip holster. The creep then opens the driver’s side door and as he is occupied with the process of entering the car, she opens fire, empties her clip, ejects the clip, inserts a backup clip already fully loaded, and prepares to fire again if needed. Of course, his gun is on his person.

    Yes, she would be arrested and charged in this scenario, but she lives to make her case. The alternative to this is she developed anorexia nervosa as a consequence of the rape trauma, she consistently takes diet pills because of the anorexia, and one day my father finds my sister dead in her apartment after her heart siezes up from an overdose of caffeine, which is in the diet pills.

    So she is now dead as a consequence of the rape, yet the rapist lives free, with no repercussions, and the DA could care less.

    Similar scenarios occur every day in NJ and every state in the union, but in states where would-be victims can carry, they at least have some fighting chance, a non-zero probability chance, of defending themselves successfully. The alternative is a legal system that is designed to defend the accused, but NOT designed to care about the victim.

    The 2nd Amendment is SO important, and our founders were geniuses for including this amendment in the Bill of Rights. But we must continually fight to maintain it and to fight the often severe restrictions imposed by states like NJ.
