The National Rifle Association (NRA) is threatening legal action to stop a seizure of guns and ammunition by U.S. Virgin Islands Gov. Kenneth Mapp (I) ahead of Hurricane Irma, the group said Tuesday.
“People need the ability to protect themselves during times of natural disaster,” said Chris Cox, executive director of the NRA’S Institute for Legislative Action. “This dangerous order violates the constitutional rights of law-abiding citizens and puts their lives at risk.”
In an order on Monday, Mapp activated the National Guard to “restore public order, and to guarantee the safety of life and property” in anticipation of the hurricane, the Daily Caller first reported.

A package containing the weapons was attached by magnets to the underside of the coach, which was retrieved by the men when it stopped in Coventry in January.

The order indicates guns, ammunition and explosives can be confiscated for USE BY THE NATIONAL GUARD. I guess that means U.S. v. Miller (US 1939) was right, the militia ie. citizens are expected to have military spec weapons.

Children pay for the sins of their parents, often by being drawn into the lawlessness themselves. Had these parents applied for lawful entry for their families a decade ago when they first illegally immigrated, they would likely have legal status by now and would not be facing deportation if they catch authorities’ eye. Children pay dearly for parents’ mistakes daily, which is why it is so important for parents to make good decisions. The problem with US Virgin Islands is that guns have to be registered, so it is easy for the government can come in using the list and demand the guns they know people have. There is a large population of thugs and many of them are armed with unregistered guns, besides the cops would be too frightened to go after the thugs since that would be a good way to get shot!

Firearms seizures in the United States Virgin Islands? If true, the this is the result of the NRA and the 2nd Amendment Foundation entering into a settlement agreement with New Orleans, Ray Nagin, and Eddie Compass after thousands of firearms were stolen during Katrina.
NEWSFLASH. Under our current system of “Judicial Supremacy” this isn’t a violation of the 2nd Amendment. The U.S. Supreme Court has only held that 2nd Amendment protects a person’s right to own a handgun in his home for self-defense. That’s it that’s as much as it protects. They have never held that you even have the right to take it out of your house.
Before everyone starts making up reasons why the Constitution is being violated, there is no reason to get that complicated. Because of the abuse of power during Katrina, Congress passed and Bush signed “The Vitter Amendment” which made it illegal for the police, national guard, etc. to seize firearms or ammunition during a state of emergency. The law even awards attorney’s fees for enforcing your rights.
However, Governor Mapp and those who follow his order are in violation of
42 U.S. Code § 5207.
42 United States Code § 5207 Firearms policies
(a) Prohibition on confiscation of firearms
No officer or employee of the United States (including any member of the uniformed services), or person operating pursuant to or under color of Federal law, or receiving Federal funds, or under control of any Federal official, or providing services to such an officer, employee, or other person, while acting in support of relief from a major disaster or emergency, may—
(1) temporarily or permanently seize, or authorize seizure of, any firearm the possession of which is not prohibited under Federal, State, or local law, other than for forfeiture in compliance with Federal law or as evidence in a criminal investigation;
(2) require registration of any firearm for which registration is not required by Federal, State, or local law;
(3) prohibit possession of any firearm, or promulgate any rule, regulation, or order prohibiting possession of any firearm, in any place or by any person where such possession is not otherwise prohibited by Federal, State, or local law; or
(4) prohibit the carrying of firearms by any person otherwise authorized to carry firearms under Federal, State, or local law, solely because such person is operating under the direction, control, or supervision of a Federal agency in support of relief from the major disaster or emergency.
(b) Limitation
Nothing in this section shall be construed to prohibit any person in subsection (a) from requiring the temporary surrender of a firearm as a condition for entry into any mode of transportation used for rescue or evacuation during a major disaster or emergency, provided that such temporarily surrendered firearm is returned at the completion of such rescue or evacuation.
(c) Private rights of action
(1) In general
Any individual aggrieved by a violation of this section may seek relief in an action at law, suit in equity, or other proper proceeding for redress against any person who subjects such individual, or causes such individual to be subjected, to the deprivation of any of the rights, privileges, or immunities secured by this section.
(2) Remedies
In addition to any existing remedy in law or equity, under any law, an individual aggrieved by the seizure or confiscation of a firearm in violation of this section may bring an action for return of such firearm in the United States district court in the district in which that individual resides or in which such firearm may be found.
(3) Attorney fees
In any action or proceeding to enforce this section, the court shall award the prevailing party, other than the United States, a reasonable attorney’s fee as part of the costs.

I heard from some good sources that this question was asked of the Australian military just after Port Arthur., and their response was Make that order and we WILL march on Parliament House.. When asked to elaborate the military spokesman said that such an order will clearly indicate this country is no longer the one our fathers and grandfathers fought and died for.
The Australian military has a long reputation for mutiny when it receives orders that are considered unfair, unreasonable, and even illegal.
I would imagine rank-and-file members, and even up to junior officers, in the US military would have similar sentiments. Senior officers on the other hand know better to tow the political line if they want to continue their career and keep their retirement benefits.
The regular Army, AF, Marines, Navy, CG can’t be used for police duty. That’s one of the reason the NG is used for riot/emergency purposes.
Asking the NG, which is made up of members of the local citizenry, would probably balk at being ordered to act in such a manner in its local area.
This means the feds would need to call up an outside NG unit, which wouldn’t have the same ties to the locality, but would still have to be wondering what was happening to their families back home.
I had this discussion with some NG officers a bunch of years ago, and the consensus was that this wouldn’t work well at all. IOW, there’s real way to make it work.
This leaves the local LEO agencies, from the state level down. While the same local mentality would come into play, there is the problem that such local LEO agencies tend to have a certain number of LEOs who aren’t in the force for altruistic reasons, but rather because they are bullies, plain and simple. Those who deny this simply aren’t paying attention.
It’s a trifling matter to identify these individuals and put then into ‘special units,’ who would do the bidding of supervisors or even politicians with bad motives. These agencies could even go out of their way to hire like individuals to fill these units.
This is, IMO, the real danger.
Where was the NRA during hurricane Katrina when police went door to door and confiscated firearms from legal citizens?? Many of which never received their firearm back, coincidentally. Did the NRA do anything about that after the governor (or whoever made the decision) decided to confiscate firearms door to door?
