US Virgin Islands Seizing Guns, Ammo ahead of Hurricane Irma

The post-Katrina gun confiscations were met will no end of howling about the obvious violations of Louisianans’ constitutional rights. And given the much more orderly response in Houston (where no one’s guns were grabbed) we won’t be seeing any more door-to-door “emergency” firearms confiscations. Right? Guess again.

The U.S. Virgin Islands Governor has signed an order allowing the seizure of privately-held guns and ammunition. Not only that, the measure also allows the taking of other private property deemed “necessary to protect the islands.”

In other words, they’re not stopping at taking US citizens’ guns and ammo. They may also take your fuel, shelf-stable food, water and generators, too. Not to mention any other private property/survival supplies they deem critical. All to give to those who did not prepare for a storm that’s been approaching for almost a week

While this proclamation would likely never survive a court challenge, super-hurricane Irma will likely arrive before anyone could write, much less file a court challenge.

In the aftermath of Irma, islanders are going to need their firearms to protect against looters. St. Thomas isn’t all beaches and tourist hotels. Thirty years ago in my college days, my Spanish class teaching assistant, who came from St. Thomas, described the ghettos there as drug-riddled cesspools of violence.

This seizure order should serve as a cautionary tale for Virgin Islanders. Even worse, for those who have prepared for emergencies, this makes agents of the government almost as much a threat as looters.

U.S. Virgin Islands Gov. Kenneth Mapp signed an emergency order allowing the seizure of private guns, ammunition, explosives and property the National Guard may need to respond to Hurricane Irma.

Mapp signed the order Monday in preparation for Hurricane Irma. The order allows the Adjutant General of the Virgin Islands to seize private property they believe necessary to protect the islands, subject to approval by the territory’s Justice Department.

This unsettling news should provide yet another reason to keep your own emergency preparations fairly low-key.

    (b) this satisfies due process since the duly appointed/elected governor wrote out the order on a piece of paper.

    • Of note at the end of the order there is a line about how all pay and benefits for federal employees during the emergency are guaranteed by the government there. But it doesn’t say anything about Payment to the citizens whose property gets seized

  4. The armed people of the Virgin Islands need to team up and resist this confiscation. It’s not like the Virgin Islands can expect federal reinforcements from the mainland.

      • As far as SHTF scenarios go, this is closest I’ve seen to a legitimate need for armed insurrection in the US.

        You have a government willfully planning to seize arms in direct contravention to the 2A and 4A. Furthermore, they’ve claimed the power to sieze whatever they deem necessary, with no means of recourse or compensation for the afflicted.

        To top it all off, they plan to do this while a very powerful hurricane is barreling down on them, and in the aftermath of said catastrophe.

      You say laws have been changed to prevent this? Read the National Security Act details…not only can they take your guns and ammo, they can pretty much take anything and everything, including our tractors, other equipment, seed, harvested crops, our cattle, our chickens, our guineas (if they can catch them), our boat, our generator, etc, etc, and that’s probably after they kill our dogs.

        • You should be reminded that every time Obamamonkey was sworn in, the first executive order he issued to himself allowed him to declare Martial Law, anytime for any reason, peace, war or natural disaster! And it prevented Congress from acting for the first 6 months! He would take control of EVERYTHING OWNED BY ALL AMERICANS! Food, guns, transportation, ammunition, housing, everything!
          Now MAPP’S actions actions have placed the lives of his people in serious jeopardy. The National Guard is well armed above the average citizen. So there is no need to confiscate firearms and ammunition. Food supplies they are required to ask for with vouchers given for amounts and costs. Generators, the same. The biggest problem will be the criminal element that will attempt to loot, rob, kill for what they want. The citizens must depose Mapp by direct action and install a temporary governor that will work for everyone. There is NO TIME for elections as some bozos have suggested!

We are aware of it because of all the press it got in the farm journals in 2012.

      • I haven’t verified it, but people have claimed that the colonies have no ‘states rights’ because they aren’t states, and supposedly POTUS can overturn anything his governors do.

        But, one might recall that Candidate Trump was a BIG fan of police powers when he detected right wing dislike of BlackLivesMatter.       It’s *possible* they don’t intend to seize *now*, but are using the signed order as a ‘tool’ in the toolbox *after* the storm passes. With Katrina the seizures happened *after*.

      At that point, it would be awfully convenient *wink* if the citizens had lots of terrible boat accidents and homes destroyed en-mass and can’t locate their registered guns.

          In 2004, 1 day, as in 24 hours before landfall, Charlie was predicted to be in the mouth of Tampa Bay. Had it done that, Pinellas County would have been underwater. Downtown Tampa would have been underwater, TECO prepped downtown Tampa by cutting the power in the below-streets feeds.

          Charlie ignored the prediction and hit Punta Gorda instead.

          It’s a week out, don’t get an ulcer.

        It looks like Irma is going to hit south Florida as a strong category 4 hurricane: it will be utterly devastating. I want to see how those high-rise buildings in Miami remain standing when Irma hits them with 145 m.p.h. winds.

        If I lived in south Florida, I would be prepared to live self-sufficient (without public electricity, natural gas, communications, nor municipal water) for three weeks — with extensive flooding on/near my property.

        • Ever since Andrew over 30 years ago, buildings in Miami/Dade County have been built to survive a Cat 4 hurricane. Those hi-rises will do fine. Steel re-inforced concrete walls, impact resistant windows or hurricane shutters designed to survive a Cat 4 and roofs secured to the walls with steel tie-downs, along with everything above the 1st couple of floors above the storm surges make them very likely to survive with minimal damage.

        • The one good thing about this storm is it happened 1 week after Texas got slammed.

If you resist the illegal activity of looters they may retreat, and if not and you kill them in the course of the defense you may not be imprisoned for doing so. If you try to stop the agents of the government doing the looting, they will not retreat, they will attempt to murder you (yes, murder, they have no legal authority to be there in the first place,) and if you somehow manage to fight them off you will get life imprisonment.

    The only thing I can say in the favor of the government’s criminals is they’re (probably) not going to rape you in the process.

  9. Just so those unfamiliar with the Virgin Islands gun laws know: They are very restrictive.
    We have to get a coupon signed by the police commissioner, sit a firearms course, and renew our license on each weapon every three years.

    Despite that we have the highest rate of murder per capital and… well, now we have nonsense like this. On the eve of a storm no less, which means there’s no way to challenge it.
    It seems it’s never enough to appease the political class.

    If a government agent appeared at my door to claim my property, I would politely inform him that I had everything I needed to hopefully weather the storm, and that his assistance was not required. If he attempted to cross my doorstep, he would not be leaving alive.

Amendments 3 and 4 were written in the context of a people who had soldiers of the Empire constantly grabbing whatever they needed, as if the farms of citizens of the colonies were just supply depots. That’s not something we should ever want back, even in the midst of a natural disaster…because what happens in emergencies eventually continues on in peace time.

  17. Once you get away from the tourist areas, St. Thomas is Chicago with (usually) better weather.

    A good friend was a prosecutor in the USVI. He was ordered by the Feds to leave the island because he was prosecuting a local drug lord and the drug gang didn’t like it. The Feds advised by friend that even the almighty G could not protect him. My friend and his wife immediately exited St. Thomas, post haste.

    The thing about this gun confiscation is that not one single gun will be confiscated from the bad guys who run the show down there. Every piece will be owned by good people for their own protection.

    Well, kiss another illusion goodbye. If the G couldn’t protect a prosecutor, how can it protect the mundanes?

  18. You want the answer for how this stops? It’s simple, you don’t comply with the demands of this order that has no legal right to be made. There is no clause in the constitution that says in an emergency the bill of rights can be suspended.

    This order itself violates the 2nd, 3rd, and 4th Amendments.

    So, by not complying does that give the Gestapo on the Virgin Islands the right to shoot you down because they have to follow orders? Nope, you have the right to defend yourself from this tyranny and that’s why you have the 2nd Amendment. Use it.

    • Incorrect. The order is phrased that they can proactively seize things to accomplish the mission of public safety. The defined mission is “public safety.”

      Lesson number one is: if the government gives itself waffle language, that language will be bent, twisted and extended to the maximum possible to accomplish their real goals, whether stated or unstated.

      In this instance, they are authorized to seize firearms and ammunition in the name of public safety, not because they are in any way lacking firearms and ammunition. Nice try though.

      You clearly are not familiar with emergency orders, nor VI code. What this said explicitly is if they feel an legally armed civilians anyway an impediment to their duties they can sizes any and all legally owned firearms. It does NOT say if they run out of guns and ammo, it simply says if it is required to maintain order.

      It thereby allows proactive seizure.

      You do realize it says they can also control alcohol beverage, do you think that is in the code because the Nat Guard needs to be drinking booze during an emergency?

    For the gun owners there: take note. This is your warning. You are seeing Page 1 of the government’s crisis handbook. They will attempt this by executive order on the pretext of “public” safety (note, not “your” safety or the safety of your friends and family) every single time.

    It is highly unlikely you’ll get another warning before it happens in your enclave. You need to support pro-Constitution and pro-personal rights candidates, support similar legislative groups and vote against gun grabbers and oppose this kind of action every single time you can.

The Democrats are always saying “no one wants to take your guns; we only want to register them to keep them away from the bad guys.” They never admit that the bad guys are Constitutionally protected from having to register their guns and they never admit the bad guys would simply smuggle in their guns the same way drugs get smuggled into the country or steal them from legal owners. Even the citizens of otherwise leftist New York and Connecticut had the good sense to refuse to register their “assault weapons” everyone with an ounce of honesty will admit that registration leads to eventual confiscation. I hope the all good people are able to escape before the hurricane comes.

    If, after the storm, I hear about gun confiscations, I would want to hear the news that the Marines landed on the Island to arrest the governor and the National Guard.

The organization then backed federal legislation to prohibit the confiscation of legal firearms from law-abiding citizens during states of emergency. In 2006, President George W. Bush signed this legislation into law.

    “When 911 is non-existent and law enforcement personnel are overwhelmed with search-and-rescue missions and other emergency duties, law-abiding American citizens must be able to protect their families and loved ones. The NRA is prepared to pursue legal action to halt Gov. Mapp’s dangerous and unconstitutional order,” concluded Cox.

Digging a hole then stacking and burying your firearms and ammo deep isn’t going to help in the Virgin Islands with local government compiled lists of gun owners and heavy winds/storm-related erosion. I hope the island’s law-abiding firearm owners have good hiding places ie. cinder/concrete blocks stacked and cemented perfectly so the holes “line up” and plenty of cosmoline to ward off saltwater damage.

    This unconstitutional order, whether it’s “executed” or not might turn out to be a blessing in disguise for our side. If challenged in court with an “emergency hearing” and “overturned” all the better but if not when the law-abiding citizens hear “the knock at the door” and open it to find no doubt “masked” (like AntiFa) badge-wearing tyrants demanding they turn over their legally acquired “personal property” (guns/ammo, hell even food/water/medical supplies/generators) and realize the extent to which the island’s governor, a Democrat, will go to seize their lawfully acquired firearms and if/when they are left “defenseless”, unable to protect their homes/family/possessions in the face of robbers/looters the territory may swing “Right” electing a TEA Party-type Republican in the next election, someone who respects the Constitution and the 2nd & 4th Amendments.

We MUST publicize this egregious tyrannical decree to the fullest, be sure to visit all the island’s newspaper/TV network’s websites/Facebook/Twitter and Weather/Storm Update pages, post memes depicting the governor as cruel “villain”, photoshop his image to include violent thugs, portray him as a heartless bastard, an accomplice enabling criminals while leaving the law-abiding, the single mother, the elderly, the disabled, with nothing with which to defend their homes and their children/grandchildren, oh “the children” (like “the Left” we always have to “play” the “children card”), we MUST play upon peoples fears, it’s what the Democrats do.

This is the result of the NRA and the 2nd Amendment Foundation entering into a settlement agreement with New Orleans, Ray Nagin, and Eddie Compass after thousands of firearms were stolen during Katrina. Unfortunately, under our current system of “Judicial Supremacy” this isn’t a violation of the 2nd Amendment because the U.S. Supreme Court has only held that 2A protects a person’s right to own a handgun in his home for self-defense. That’s it. They have never held that you even have the right to take it out of your house.
    However, Governor Mapp and those who follow his order is in violation of 42 U.S. Code § 5207.

    42 United States Code § 5207 Firearms policies
    (a) Prohibition on confiscation of firearms
    No officer or employee of the United States (including any member of the uniformed services), or person operating pursuant to or under color of Federal law, or receiving Federal funds, or under control of any Federal official, or providing services to such an officer, employee, or other person, while acting in support of relief from a major disaster or emergency, may—
    (1) temporarily or permanently seize, or authorize seizure of, any firearm the possession of which is not prohibited under Federal, State, or local law, other than for forfeiture in compliance with Federal law or as evidence in a criminal investigation;
    (2) require registration of any firearm for which registration is not required by Federal, State, or local law;
    (3) prohibit possession of any firearm, or promulgate any rule, regulation, or order prohibiting possession of any firearm, in any place or by any person where such possession is not otherwise prohibited by Federal, State, or local law; or
    (4) prohibit the carrying of firearms by any person otherwise authorized to carry firearms under Federal, State, or local law, solely because such person is operating under the direction, control, or supervision of a Federal agency in support of relief from the major disaster or emergency.
    (b) Limitation
    Nothing in this section shall be construed to prohibit any person in subsection (a) from requiring the temporary surrender of a firearm as a condition for entry into any mode of transportation used for rescue or evacuation during a major disaster or emergency, provided that such temporarily surrendered firearm is returned at the completion of such rescue or evacuation.
    (c) Private rights of action
    (1) In general
    Any individual aggrieved by a violation of this section may seek relief in an action at law, suit in equity, or other proper proceeding for redress against any person who subjects such individual, or causes such individual to be subjected, to the deprivation of any of the rights, privileges, or immunities secured by this section.
    (2) Remedies
    In addition to any existing remedy in law or equity, under any law, an individual aggrieved by the seizure or confiscation of a firearm in violation of this section may bring an action for return of such firearm in the United States district court in the district in which that individual resides or in which such firearm may be found.
    (3) Attorney fees
    In any action or proceeding to enforce this section, the court shall award the prevailing party, other than the United States, a reasonable attorney’s fee as part of the costs.

  31. The good news is this blatantly unconstitutional act will be struck down. The NRA will then have even more precedent to stop this sort of action in the future. What we need is Federal jail time for any government official who attempts this again. Until government officials have judicial consequences for attempting such blatantly unconstitutional action they will just keep doing it.

  33. Well I was in Law enforcement for 33 years and am a big supporter of the 2nd amendment and own many weapons. I will not be giving mine away. If the police or military need my assistance I am a patriot and I will help, but only in what is lawful. Just like if they succeed in illegally removing our lawfully elected president who broken far less Federal and constitutional laws as his predecessor. In that case I will be with my fellow citizens defending our Republic hopefully with our military and police. Many people are unaware that Obama wrote numerous executive orders allowing the President to declare martial law and seize whatever the government needs from guns, to cars, to food, to people, to putting them in supervised work groups and so on. I waa hoping that President Trump would rescind these orders, but I have not heard about it yet and I am a major Trump supporter but I feel that is too much power in the hands of one person no matter who they are. I would rather the orders be rescinded.
