Another year at the Oscars came and went over the weekend with predictable lectures about gun control from Hollywood’s elites.
During Sunday night’s show, which was rated the lowest in televised Oscar history, everyone from host Jimmy Kimmel to actor and rapper Common took shots at American gun owners and the National Rifle Association. The gun confiscation organization Everytown, funded by former NYC Mayor Michael Bloomberg, was also in tow providing talking points.
“Tell the NRA they’re in God’s way and to the people of Parkland we say asé,” Common rapped from the stage.

A bipartisan group of senators today unveiled legislation requiring federal authorities to notify state law enforcement officials when a person barred from purchasing a gun attempts to do so.
The NICS Denial Notification Act was introduced by Sens. Pat Toomey (R-Pa.), Chris Coons (D-Del.), Marco Rubio (R-Fla.), and Bill Nelson (D-Fla.), and co-sponsored by Sens. John Cornyn (R-Texas), Tammy Duckworth (D-Ill.), Lindsey Graham (R-S.C.), and Claire McCaskill (D-Mo.). The senators argue that those who fail the background check and violate the law when trying to get a gun — such as convicted felons and domestic abusers — are rarely prosecuted.
America’s Gun-Culture Problem — The problem isn’t the guns, it’s you.
For now is the time for tension. Gun owners should feel uncomfortable by the atrocities taking place in American schools. American politics should not be dominated by those Americans who play soldier by owning assault rifles or other tactical weapons, and whose insecurity about their own identity is so pronounced that they need to buy more and more small arms to compensate for that insecurity.

Jones wants tighter background checks for gun sales and to raise the age requirement to purchase a gun from 18 to 21, and he thinks Alabamians are on the same page.

Many gun owners insist the answer isn’t a ban, but rather evaluating who can obtain these weapons. President Trump is now reportedly considering the idea of gun restraining orders, which have the ability to quickly take firearms away from those considered dangerous, like the shooter in Parkland. A variation of this law is already on the books in California.
In 2016, 86 of these restraining orders were issued, and 10 were extended past the initial 21-day period they were granted for. Our side insists that people are the problem, not guns, and to make good on that we need to come to the table with ideas on how to keep weapons out of the hands of dangerous individuals who have no business holding them.
This idea . . . isn’t a panacea. But it is a middle ground for gun-rights supporters and gun-control activists to meet. Many supporters of the Second Amendment know something is broken, just as its opponents do, and ideas like Mr. French’s can bring many more to the negotiating table than calling for outright bans on guns or the notion that there are no legislative solutions to the gun violence issue.

The problem isn’t that people are “accidentally” misusing terminology (which makes an actual conversation impossible) it’s that they have NO FUCKING IDEA WHAT THEY’RE TALKING ABOUT and that this is NOT an accident. They don’t know the difference between and AR-15 and a “machine gun” not because they are simply ignorant but because they’ve been TOLD than an AR-15 is a “machine gun” in a deliberate attempt to muddy the waters of any discussion that might take place.
The basis of a “conversation” is words. For that conversation to mean anything we have to agree on the meaning of the words before the conversations starts. Otherwise we’re just birds squawking at each other mindlessly. I mean, we can’t debate the merits of painting your house yellow if “yellow” means five different things to the five people in the discussion now fucking can we?

That Washington Post piece was laughable- the Canadian experience is that the anti-gunners always argue in bad faith, so the charge that pro-gunners are doing it is pure projection. Guns that would not be every popular if were not for the bump stocks and binary triggers. While MG’s and things like the Saint Valentines Day Massacre played a part in the NFA the law was really meant mainly to go after handguns and was basically dead in the water until Giuseppe Zangara tried to kill FDR with a $8 hardware store Iver Johnson .32 revolver and instead wounded five people, one of whom was the Mayor of Chicago who subsequently died of his injuries. This reignited a push for what would become the NFA, again with the main idea being the regulation of handguns. That portion of the bill was later dropped but the bill was passed as part of what we today would recognize as the “Well, we have to do something mantra”.

A rifle can become a submachine gun only if it shoots a pistol round. An AR-15 uses a rifle round and can, therefore, be only a machine gun.

I absolutely support prosecuting people who fail the NICS background check IF the failure was because they were truly prohibited. My concern is that the vast majority of denials on NICS are not because the applicant was deservedly denied, but because of similarities in names, some incorrect data from 30 years ago, etc. If the senate bill results in the reporting AND arrest of every denied buyer, this is a HUGE problem for me.

The law, as it exists and is not enforced, prohibits lying in the form in order to avoid being flagged. It does not make it illegal to just be denied for any of the reasons you mentioned. In fact you can answer the questions in such a way that you will always be denied and it is not a crime as long as you answer them honestly.

All the bill requires is that the FBI notify the State of failed background checks. Nothing really hard. I think the FBI and Justice Department already keep records of prosecutions from failed background checks.
That’s my concern, if someone is refused and then arrested but it turns out that there was a mistaken identity then he still has legal issues that he cannot afford. I had a friend that was denied and it cost him thousands of dollars to get it straightened out. There should be a warning if you are turned down that you need to contact whomever to appeal the denial and to not to attempt another purchase until situation is corrected. Wonder how many erroneous denials there are a year ?

The only way could *possibly* be on board with that is, there are people who may be on the denied list, who are truly unaware they are on the denied list. For *whatever* reason.
I would propose, unless the denial was for a felony conviction involving physical violence, there should be a ‘one strike’ provision.
Such as –
The cops investigate the denial, and then inform the individual as to *why* they were denied, and have them sign a statement that they now understand why they were denied, and if they attempt to purchase again in the future, that they would be prosecuted fully. If they are prosecuted, the cops have their signature proving they were informed.
Britain has something similar, I think they call it a ‘cautionary warning’ or similar.
It’s how ‘The Who’s Pete Townsend skated on child porn charges. He claimed he was investigating child trafficking, and he apparently had evidence he was doing just that, so they gave him a ‘Caution Warning’ of some sort…

All the law is that the FBI notifies the State if someone fails to pass a NICS check.. That is all. It’s up to the states / local police to investigate.

Last year there were 17 convictions for this. As John Lott has so eloquently analyzed, the false denial rate is between 94% & 96%. And that only accounts for those who were reversed in the first 3 days as a matter of course and those which were reversed on appeal. That doesn’t account for those that we not appealed. All things being equal, this is a non issue. Somehow we muddled about for 215 years without background checks. They serve no purpose whatsoever other than to disenfranchise tens of thousands of honest citizens. If we don’t trust someone with a gun we should re-evaluate whether or not that person should be free to walk about with the rest of us. For anyone who truly wants a gun for evil purposes will get one and no law will stop them. There is no compelling governmental interest which supports infringing upon the rights of millions of citizens.

Conversely, Lott might be correct; and if it were so it were a grievous fault; and grievously ought Congress to answer for it.
How will we know whether Lott is correct or not? Congress ignores Lott. So, if we get behind this mandate to report DENY responses to the local constabulary then we will FLOOD police departments with Lott’s asserted false-positives. Police departments will face a contingent risk that they will be tarred and feathered by the press for failing to pick the needle out of the haystack whenever one of these thousands of DENY’ed buyers is arrested for a heinous crime. Police will be forced to spend precious resources thumbing through these reports looking for needles; and will fail anyway. Police chiefs will sooner or later find it to be in their own interest to join with Lott in complaining to Congress that NICS produces mostly false-positives.
The police, rank-and-file and chiefs alike, have not been outspoken in support of civilian guns. Why should they go out of their way to support the 2A? We aren’t giving them any compelling reason to do so. We could change that! We COULD give police a compelling reason to come-out in favor of gun-owner’s complaints by choosing to back the Antis’ efforts to make their lives miserable.
If we come out in support of this proposal I’d advocate that we do so forthrightly. Lott is either RIGHT / WRONG; and this proposal will yield the evidence one way or the other. It will be a small price to pay to have America’s police chase thousands of NICS denials and discover the goats and sheep. The police will discover the evidence over the course of just a couple of years and inform Congress of what might be the next step.
