One-time gun seller Dick’s Sporting Goods is taking heat from customers who ordered and paid for Troy Defense carbines during their Black Friday sale. Now that Dick’s has decided that selling black rifles is a little too disturbing in a post-Newtown world, they’ve informed all of those prepaid customers that they won’t be making good on their orders. The retailer will refund the money, of course, and will throw in a $100 gift card on top of it. But that hasn’t made their customers too happy. To say nothing of Troy Defense, which Dick’s left hanging with no notification of their decision – other than what Troy read in the media. Troy’s press release on the situation (via kitup.military.com) is reprinted after the jump . . .
Troy Defense (Troy), a division a Troy Industries, Inc., was deeply dismayed and shocked to hear through national media outlets that Dick’s Sporting Goods (DSG) made the decision to stop selling the Troy Carbine along with other modern sporting rifles. DSG did not contact or inform Troy of this decision prior to notifying the public. Nor was Troy informed by DSG that cancellation letters were being sent to customers, set to arrive on Christmas Eve (a day Troy was closed).
Troy has invested millions of dollars in its facility and operations to bring its first ever modern sporting rifle to the market under an exclusive contract with DSG. In selecting DSG as the sole distributor of the Troy Carbine, Troy relied on DSG’s high sales forecasts and sales potential prior to undertaking the significant financial and corporate commitment necessary to design, develop, manufacture and bring a new modern sporting rifle to the marketplace. Based on DSG’s press release, DSG’s anti-gun stance is clear – DSG will not continue modern sporting rifle sales and Troy will sadly not see its Carbine readily available — despite the outlay of millions of dollars by Troy and its commitment to support DSG in its distribution efforts.
Troy is currently researching other channels to ensure continuous and consistent distribution for its rifles. But please note, Troy’s pricing to DSG was based upon volume sales. It is unlikely that pricing to any other outlet in the future will support the pricing granted to DSG. Troy understands the anger of certain DSG customers whose purchases have been cancelled – you got a great price from DSG. However, Troy, itself, cannot come anywhere close to offering the Carbine at the price DSG was offering it. DSG devalued and diluted Troy’s brand when it offered for sale the Carbine at a steeply discounted price during Thanksgiving week. As a result of the sale price set by DSG, DSG oversold and overpromised its inventory. Nonetheless, the current ill-will could have been avoided had DSG not terminated modern sporting rifle sales, promptly canceled overpromised orders, and forthrightly communicated with Troy.
Troy is hopeful that it will soon identify a new distribution channel for its Carbine. We ask for your patience and support during this difficult and transitory time.

If Troy did indeed have an “exclusive contract” with dsg’s, it appears a breach of contract lawsuit is in order.
I hope Troy Defense has a solid cancellation clause in their contract with Dick’s. Normally the vendor gets hung out to dry due to the customers terms and conditions (CYA) and the vendors anxiousness to seal the big deal leave then exposed to a screwing.
This is BS, they don’t want to honor the old price because they know with the current panic buying they can sell each unit for 2-3x what they committed them to on black Friday… If they turned around and honored those prices but just tacked on shipping they would have customers lined up for miles

Troy reached an agreement with Dick’s for X number of rifles, and was able to sell them to Dick’s for Y each, only because they knew they were going to make $(XxY), an amount for which they budgeted and either spent from cash reserves or, much more likely, took out a loan on.
Now, they are only going to be receiving $(ZxY), where Z is the number of rifles actually sold and paid for (presumably very small), which leaves them $(XxY)-(ZxY) in debt.
So no, they can’t afford to let them go at Dick’s Black Friday pricing, which very well may have been at or near cost in order to push ammo sales and advertise Dick’s exclusive license on the Troy Carbine.
They aren’t being jerks. Troy never agreed to sell anything to anyone at Dick’s Black Friday price. They agreed to sell Dick’s some rifles, and what Dick’s did with that is no responsibility of Troy’s.

Your right, Troy had nothing to do with the price tag that Dick’s had established. I guess I was at the head of the list on the back orders, because I got my check back already, bummer, I was looking forward to receiving one. Now I have to wait for another distributor, and the way I have it figured, it is going to cost me around 30% more.
I think part of the problem is that Dick’s “sold” more rifles than Troy could potentially supply, at whatever price. Even if Troy made good on the original agreed upon production volume, the oversold volume customer end up getting screwed. And good luck deciding on who’s order was original volume and who’s order was oversold volume. Bottom line is that Dick’s dicked Troy twice, it was a double dose of dicking from Dicks.

I wanted them to go out of business ever since they opened in indiana. They opened and galyans closed. Galyans had a great selection of all guns but since the first time I walked into dicks and seen that it was their policy not to sell handguns, I was done with them.
They lost me as a customer, just like Kmart after they quit sellin guns.

I bought a rifle from dicks a few years ago. When I tried to mount the scope it was for another gun and would not fit.
I took the gun back to dicks and they tried to make me keep it. They did not offer to replace the gun. And did not want to refund my money.
I would not leave the store and kept telling customers at the gun counter what was going on and they finally refunded my money and asked me to leave their store.
They are crooks and obam lites .

If you know how to “read press release,” you can see that Troy is really, really pissed about this. You can trust that they will use whatever legal means at their disposal to make their displeasure known.
The problem for Prick’s is that this counts as anticipatory repudiation. There is no “force majeure” event for “bad publicity”. As such, under the UCC, they could owe Troy lost sales + lost profit . . . Unless Troy waived those remedies in return for the contract.
I won’t be shopping at Dick’s anymore. Academy Sports will be getting my money.

I ordered 2 items from CTD on the 19th and I have no idea when I will receive them. I called yesterday for clarification and the lady who answered the phone tried to blow smoke. I ordered 3 items from Midway on the 20th and I received them yesterday. I shopped at Dick’s once and was unimpressed and see no reason to return.
I wish Midway would stop playing with us an start selling guns, they have everything I need most the time expect guns and cheaper ammo, if they did that cheaper than dirt would probably go out of business, or at least compete

I finished composing a letter addressed to Dick’s Sporting Goods last night, prior to reading this. I don’t think I will add this as a reason I will no longer shop there but do intend to hand deliver the letter to the manager of my closest Dick’s with my “loyalty card” attached to the letter, so that I can inform him of my reasons for no longer shopping in his store. They will be able to scan my loyalty card to see how much I have purchased there in the past: a rifle, ammunition and beaucoup clothes and athletic shoes. I doubt that Dick’s will suffer greatly from the loss of my future purchases, but I know I am not the only one. I waited for several weeks before delivering this letter since I wanted them to see that I was not acting in the heat of the moment before all facts were known…..unlike their corporate decision.
I am sure lawyers for other manufacturers are going over their customer contracts.
I hope the other manufactures who sell to dsg go over their contract and pull their stuff when their contract is over or at least screw them over on price to the point that fair weather gun supporters won’t buy from them.
If I were Mr. Troy, I would honor the valid Black Friday sales by any method possible.
But, long run, they should have no trouble finding markets for their guns. I know of no online company or big box store which has black rifles in stock. My favorite store, GT Distributors has so many AR-15 platforms on order they have stopped taking back orders and are virtually begging customers to stop calling them or emailing them to inquire about them because of the flood.
Troy can’t. Dick’s sold the guns at a loss or near enough as no matter in order to make sales on high-markup items that the Troy customers would also buy. Accessories, ammo, gun cases, clothing, (especially clothing). A retailing scheme that’s older than dirt. Supermarkets use the term “loss leaders”. Car dealers, for example, make almost zero on the car itself. Where they do make money is on flipping trade-ins, jacking up prices in the service dept., “extended warranties”, and oh, yes, financing. Been there, done that, got out with my ethics intact and went into engineering.
That’s part of the issue – Troy is a MANUFACTURER – not a retailer, unless I am totally misinformed. They have to go through a reputable retailing outlet, especially with the volume involved (anyone know what those numbers might actually be?) – like dicks theoretically was. It also seems highly likely that Troy has a breach of contract suit pending. I suspect that there are other national retailers that might be able to handle the volume but it remains to be seen who that might be, especially in the current political climate.

If Troy Industries made, say, magazine pouches then I could see them getting caught up in a one-sided contract with Dick’s. But anyone who manufactures and sell firearms, I’m gonna go out on a limb here, probably has a lawyer or two on retainer. So if TI really got spanked by Dick’s reneging on their contract then shame on them for not exercising due diligence when they wrote and signed the document.
Being in procurement for most of my adult life, and having a teeny bit of common sense, I believe the same thing that Joe has pointed out. TI is now in an entirely different and quite favorable bargaining position than they were a month ago. Shed no tears for Stephen, he’ll be OK.
Of course, the above is all contingent on scumbag politicians not successfully outlawing modern sporting rifles. But any business can go T.U. for any number of reasons.

I think Troy is CLEARLY communicating a message to all the customers who had a CONTRACT with DSG: Those customers who HAD A CONTRACT with DSG need to go somewhere else and buy a “reasonable substitute” for the goods they had contracted with DSG to buy, and then sue DSG for the difference between their “contract price with DSG” and the “actual price they paid” for the reasonable substitute (it’s basic Uniform Commercial Code law… check with your attorney before you act). Just the simple act of having to hire attorneys to defend those hundreds or thousands of lawsuits all around the country would teach DSG a lesson they need to learn. And… your new Barrett or Wilson or Noveske is certainly a “reasonable substitute”, because they are all MilSpec. I’m pretty sure DSG will feel the effects of their bad decision once all those lawsuits get filed. To steal a fun format from MasterCard: Contract Price of “Troy Adult Toy” from DSG… 700$ Price of “reasonable substitute” after DSG repudiated binding contract in DSG’s effort to gain sympathy goodwill from politicizing a mentally ill murderer and his angelic victims… $2,300 Cost to DSG for making a stupid decision… Not priceless, but equal to [(“number of broken Troy contracts” x “difference in contract vs. reasonable substitute prices”) + (hours of legal time to defend each lawsuit x number of lawsuits) + (lost goodwill from informed shooters)]. I do believe Dr. Wood is correct. Customers had a contract to purchase an item from Dicks at a set price. Dick’s broke the contract. Those customers can no longer purchase an equivalent at anywhere near the same price. Those customers are therefore entitled to the difference in cost for an equivalent.
What about a class action law suit?

Guns and hunting are not my sole hobbies. I spend a lot of time outdoors with my dogs, hiking and playing golf so I have a different take on Dick’s and guns then most of people on TTAG.
Dick’s is not a gun store. It is a store that sells guns. Most of the floor space is devoted to other activities than hunting and fishing. Most of their customers couldn’t care less about guns. Unlike Cheaper than Dirt, Dick’s didn’t stop selling guns after Newtown. They just stopped selling scary black rifles. While I agree that they should have fulfilled their obligation to customers who were waiting for their carbines on back order I think they only merit a little scorn instead of hate. I will continue to buy golf balls, clubs, shoes and clothes at Dick’s. I will just take my guns and ammo business elsewhere.
I really hope Trot is able to open up additional avenues like bass pro shops or cabellas. I don’t know their product, but I am sure if the price is right etc, you can have a lot of fun with it…

Having a contract with ONE corporate outlet being the exclusive recipient of a product, then having that contract voided does hurt. It will take quite some time to re-establish new outlets, verify and set up all those individual accounts, FFLs etc…if you have ever been in this situation, you know it hurts and it takes alot of time to regain lost ground. No one had mentioned the employees of Troy affected by this or the bills that have accrued in the meantime. Sure the prices will be higher, sure there will be profit made, but who to you think foots the bills or pays on the loans with nothing to show for it in the meantime? establishing a contract with a large retailer other than DSG takes time for this type of distribution and may go back and forth for several weeks, you cannot use some easy legal product for this like you are buying a dozen cows from farmer Bob down the road. I have written the CEO and turned in my card. I have Dunham’s, WalMart, Cabelas, Bass Pro, Top Gun, Gunbroker and Armslist…and yes, the local mom and pop gun store.

Dick’s sucks, yes. But Troy should fulfill those layaways that Dick’s reneged on at the fixed prices. Just because rifles and their ammo and accessories have doubled to tripled in price thanks to both the anti-gun crowd and the pro-gun crowd that inflated prices after the ban threat, is no reason for Troy to be a Dick.
The ban threat started by the gungrabbers is too blame most, but the reaction of the other gungrabbers, those that stockpile and push the inflated prices, hold almost the same amount of blame.
When this is all said and done most likely we will just have bans on fairly meaningless items such as bump stocks, mags over 30, more class 3 weapons regulations and a limit on the number of firearms one can buy every year or at one time. Private sales, bans on specific rifles and ammo bans will not happen. Black rifles will be back along with the ammo and accessories. And if the gun lobby does what it’s supposed to do it will get legislation passed with this ban so new bans will not be allowed in the future so this threat nonsense will end once and for all. We actually needed this happen sooner rather then later because we all knew it was coming, now if we pro-folks play our cards right and the supporting politicians don’t back down to the liberal media, ironically I’m a liberal leaning gun owner and NRA member, we can nip this ban stuff in the butt now for good.
Woah there pardner. To sell guns you either go through a retailer or open up a shop. That means every state that had a Dick’s store which canceled an order, you’d have to have a storefront to complete the transaction. So Troy honoring the sale isn’t possible. Remember all that paperwork the Fed’s require to be maintained?
The only way would be for Troy to agree to sell through a FFL dealer in some state(s) where the rifle was legal to sell and you were legal to buy. I assure you the deal will not be without FFL dealer handling and shipping charges above the Dick’s price.
Not all states will allow residents of other states to purchase weapons. Look at the chart in Wal-Mart sometime. I haven’t been to Dick’s in 5 years and their store was closer than Cabella’s or Gander Mtn.
No stores like Walmart,K-Mart sell guns or ammo in NJ. No big box sporting good stores like Dicks, Modells etc. are allowed to sell weapons or ammo. Welcome to the gun free zone of NJ.
In addition to the gun fiasco, I would like to add another comment, that is , I bought an expensive pair of hunting boots there and after wearing them about 8 times, soles came off . I contacted Dick’s and they told me to contact the manufacturer in which I did. They in turn told me to return them to Dick’s for credit, however’ they would not take them back. Another reason not to shop at Dick’s in the future’ and they might as well get out of Indiana also.
BassPro. Academy Sports. Cabellas. They didn’t cave. I hope Troy picks up a contract with one or more of them.
Dicks is a sort of upscale Academy Sports. We have a Dicks, a BassPro, and two Academy Sports stores, and Dicks was never competitive. This is 2A country, so I suspect that their one store will be closing shortly.

The gun sales staff at Wholesale Sports told me today that the day after Christmas they had a large number of customers whom returned all their gifts from Dicks located across the street. The customers allegedly told Dicks that they will never shop Dicks again because of their politics.
Troy’s manufacturing cost is too high as well as their price points. CNC machines can bang AR parts out like nothing at low cost, and I am sure most of the responders here have built their own custom AR platforms. Dick’s broke their agreement with Troy. Troy has damages for the loss of business and breach of contract. That being said, Troy is in business to make money. They do this by supplying a superior product to the market. Their uppers alone range from $1100-1500+, very pricy. I use quite a few accessories from Troy. Their products are well made and operate as advertised. Dick’s screwed them and and themselves. I’ll never do business with Dick’s again, but will continue to support Troy.

As soon as dicks sporting goods pulled their crap I decided not to buy any thing from them any more, and I have let all my family and friends know what a bunch of morons are running that co. Not only are they going to lose gun business, they will also lose a lot of little league ball equipment sales as well.
Dicks just opened a store in San Diego. I shopped there for the first time the Sunday before Christmas. They had 8 checkout stations, only 4 were open with a line of customers wrapped around the store. I wanted some logo items as a gift , had to find things myself – no staff on the floor. I asked at the register, why were they so understaffed 2 days before Christmas in a new store. The guy, who was very nice said I needed to complain to management about poor service, it might make a difference. I’m a marketing professional, so perhaps I’m more critical, but this is a really stupid way to make a first impression in a new area. I didn’t know about their corporate gun decision at the time; they probably decided the gun enthusiast didn’t fit their “ideal customer”model. I’m not a gun purchaser, however, it’s pretty obvious that their corporate culture doesn’t put the customer first. I’m going to stick with our regional sporting good stores, I’ve found them to actually care about how their customers are treated. Also, I’m telling a whole bunch of people about the really bad experience I had at Dicks.
The problem that many of you seem to miss is Troy leveraged itself to get these carbines out to Dicks within a certain timeframe and Dicks inturn contracted to pay them in a specific timespan, so that troy can pay the sort term loan back without losing their shirt in the process. Product takes resources to produce, and resources cost money. To meet the demand Troy had to borrow to make the purchaces to produce the carbines. In the business world this is called leverage. because the borrowed money goes for a lesser value service or product in order to create a higher value item or product. The issue is the time frame of repayment on the credit line. The carbines could be sold for ten times what Dicks was going to pay and it wouldnt matter, if the money isnt there when the bank note comes due.
Leveraging to put a product or service out is standard procedure in business today for smaller corporations, and Troy is by no means a big company. This deal would have generated funds for them to expand substantially. Hpefully they will find a dealer to handle it!
One other point of info, Not all small shops pull this but many are, since they are not part of a chain, their prices are based on what people are willing to pay not the Manufacturers Suggested Retail. Friday, I called around checking on stripped lower prices and availability. One independent dealer was asking ONE THOUSAND DOLLARS for a stripped Rock River Ar-15 lower, More than 300% retail price…. Just because they could, “take it or leave it, five in stock”…

On Sunday December 17, 2012, 2 days after the CT shooting, a man went to a restaurant in San Antonio to kill his X-girlfriend. After he shot her, most of the people in the restaurant fled next door to a theater. The gunman followed them and entered the theater so he could shoot more people. He started shooting and people in the theater started running and screaming. It’s like the Aurora, CO theater story plus a restaurant!
Now aren’t you wondering why this isn’t a lead story in the national media along with the school shooting?
There was an off duty county deputy at the theater. SHE pulled out her gun and shot the man 4 times before he had a chance to kill anyone. So since this story makes the point that the best thing to stop a bad person with a gun is a good person with a gun, the media is treating it like it never happened.
Only the local media covered it. The city is giving her a medal next week. Just thought you’d like to know.
