Sen. Bob Menendez [D-NJ] has filed Senate Bill 3299, a bill to repeal certain impediments to the administration of the firearms laws. As of this writing, the bill’s text is not available, but early indications are that this is a straight-up firearm and gun owner registration move.

Per Menendez’s press release the bill is aimed at:

  • Ending the prohibition on the ATF from releasing firearm trace data for use by cities, states, researchers, litigants and members of the public;
  • Ending the requirement for the FBI to destroy all approved gun purchaser records within 24 hours of approval;
  • Ending the provision that makes it extremely difficult for ATF to retrieve firearms from prohibited persons who are mistakenly sold guns or from gun owners who become ineligible to possess guns;
  • Ending the prohibition on ATF requiring gun dealers to submit their inventories to law enforcement;
  • Ending the prohibition on public disclosure of data on multiple handgun sales, as well as gun sales information dealers are required to keep that may be required to be reported to the U.S. Attorney General for determining the disposition of one or more firearms in the course of a bona fide criminal investigation.

All of those records gathered, kept, and indexed amount to a complete registration system of firearms transferred through federal firearm licensees.

Bear in mind that the House has already passed HR 8, the Bipartisan Background Checks Act of 2019, also known as universal background checks.

So should these bills get traction in the Senate, this would eventually result in the registration of the vast majority of firearms sold since the Gun Control Act of 1968 went into effect.

Notably, this would not track the estimated 3.5 million-plus stolen firearms that are in circulation. As always, the violence-enabling victim disarmers are only out to control honest people, and their legislation is deliberately ignoring actual criminals.

A full analysis of the Menendez bill can’t be done until the text is posted, but the press release makes this sound like not just registration, but gun owner doxxing, since the records would appear to be available to everyone.

That would, of course, include dispassionate academic “researchers” like Garen Wintemute, who’s famously been tracking them for years.

      Of course, you could create an exemption for him and his pals for their Honduras sex tour, just ask AG Barr and he’d say “OK for trumps buddies!”

    • Really, you do realize that the 2A does not guarantee you the right to keep and bear arms, this right has always been. Even if the 2A was repealed you would still have the right, government nor man grant rights, if this was so then they could take these rights away, rights come from God.

      • That’s true. But violating those rights tends to lead to spilled blood, sometimes in massive amounts. That’s why such violations are to be completely off limits.

        The Second Amendment isn’t about creating the ability to spill blood, it’s really about warning off wannabe tyrants like Melendez so that bloodshed can be avoided.

        I’ve checked the Constitution of the United States of America and I can find no mention of any God, so I’m really confused.

        Perhaps you’d be kind enough to offer some evidence to support your assertion that these rights come from a God, could you be more specific?

        • Um, Miner…right there at the end of the document, just before the signatures:

          “…by the Unanimous Consent of the States present the Seventeenth Day of September in the Year of our Lord one thousand seven hundred and Eighty seven…”

        • The philosophical argument about the role and purpose of government (to protect rights) is laid out in the Declaration of Independence.

          A “right” is an objective moral claim. (“It is always wrong to…”) In order for such a thing to actually exist, there has to be a universal moral standard that comes from outside of humanity. (It doesn’t take much reflection to realize that humanity is not morally consistent.)

          Morality is the kind of thing that requires a mind. (For example, “ownership” is strictly conceptual, not physical.) This can be seen with a simple thought experiment: “A creature enters a structure and carries out an object. Is that a moral act, an amoral act, or an immoral act?” Think about the kind of questions that occur to you as you attempt to answer that question. Almost every single one will require the ability to think.

          There are other aspects that are involved as well. For example, morality involves obligation, which can only be to a thinking being.

          Bottom line, in order for there to be a universal moral system, there must be a mind outside of and superior to humanity capable of defining such a system. And that is the basis of Rights as used in the Declaration, and around which our Constitutional Republic was designed.

        • Hazy, nice try with that date year of our Lord thingy! But that has nothing to do with the Christian deity being recognized by the document, that’s just a date reference.

          Or do you believe that Saturday means the day we worship the god Saturn or Sunday is the day we worship the sun god or Thursday is the day we worship Thor?

          I did find in the constitution language indicating there could be no religious test for any office or position of trust in this document so there’s that specifically excluding religion from the government of America.

          The Constitution specifically refers to “endowed by their Creator” which leave room for everyone to choose their own deity to praise or curse as the situation warrants.

          And for those with no deity in mind their creator might as well be their Daddy, whether they are certain who he was, as may be your issue.

          “Endowed by their Creator” is in the Declaration of Independence, not the Constitution. It’s not a legal document, which is why the Left can pretend that it’s meaningless.

          Of course, that pretense is to run away from the fact that it states the foundational principals that the Constitution is based on. In addition, the Bill of Rights is meaningless without the source of Rights as defined in the Declaration.

      • Heh? Federal charges are MUCH more severe than most states. Good luck getting time off for “good behavior” in federal prison. As for “club fed” anyone who would get that sort of security would probably get probation in NJ state court.

  6. This may get out of committee, but I doubt it’ll leave the Senate. If it does, the House will most certainly pass it, so we need to hope for a Presidential veto.

  8. Actually, this doesn’t bother me in the least. If, in fact, it bothers you then you need to reconsider your own firearms purchasing and ownership plan. 1. I reload, and now have a lifetime supply of everything I need to shoot and reload all my stuff for the next 25 years. 2. Starting with the nonsense in the 1980s with “assault weapons” I have slowly been been getting rid of everything I had purchased “legally” from an FFL dealer after 1968. AND I have bought nothing over the counter since then. I have always been able to find the handguns I was interested in (including STI, Infinity, and several other high end ones) and the rifles I wanted via undocumented personal sales. Yep, that means I have had to work and search and sometimes pay more than retail but no records and no chain of custody tracking possibilities means I don’t have to worry about this crap. I understand all the comments above, but I seriously believe the demoncrats are going to take power at some point and my NRA life membership and ILA and 2nd Amendment Foundation contributions (which ARE trackable) will cause me enough trouble.

    • There is always a chain of custody, even if it does not exist in a dealer’s books. The guy you bought it from might have kept a record such as a bill of sale with your name on it, or a memory of who you were. If he bought it from an FFL, you can be found. The only “untraceable” firearms are those that have been stolen.

      the latter always made me wonder about the whole tracing thing. The ATF can trace from the manufacturer to the dealer, to the first sale. Then they have to talk to the first buyer, and the second buyer, and the third….But once that firearm is stolen, there is no way to trace the firearm to a specific person, i.e., the person who used it to commit a crime. I have asked the question many times: if you cannot trace to the criminal that possessed it at the time of a crime, what is the point? there never seems to be an answer. (And I can imagine why not: no one wants the charade to end.)

      • To a certain extent you are correct. However with older (ahem, “classic”) weapons initially sold before 1968 there are generally no available records of the initial sale that are searchable or even discoverable. Perhaps more importantly, you will find that many (if not most) of these weapons have at least one (or more) of the intermediate owners that are deceased, breaking any possible tracking of ownership transfer.

        FYI, dealing on a personal level with estate executors BEFORE final inventory and estate sales can be a very beneficial thing.

        To my understanding, as a former FFL manager for a club on a military base with continuing relationships with the BATF(E), the whole thrust of the “tracing” thing has always been to look for “bad apple” FFL dealers who are involved with multiple incidents of shady sales to shady people. That’s also why the multiple sales reporting requirements were established for the southern border states – looking for FFL holders participating in straw sales. All of the agents I ever talked to said that tracing had nothing to do with solving a crime, after all, they already had the firearm in hand that committed that crime. Instead it was identification of preceeding crimes, such as straw purchases or sales by a given FFL dealer.

  9. Screw the democrats. They let the cat out of the bag this year when they were all tripping over each other to show they had the most draconian gun bans in mind during the primary season. Every firearm owner with half a brain understands that the democrats end goal is near total ban and confiscation of firearms and of course registration is needed to find out what subjects own firearms and exactly what they own. Their plan is to sound generous and let you keep what you already own as long as you register it and then later on tell you they changed their mind and fork it over or else the storm troopers pay you an unannounced visit.

    • we need to make it tiresome and possibly even dangerous for them. Throw up bills that outlaw such bills as they try to propose in a way that makes them personally liable to severe jail time and asset forfeiture for simply proposing them. If any bill removes ANY natural right from anyone without FULL due process of law and with an actual crime with a victim (cant be the state), any politician who dares put their name to it does 20 years minimum for example

  12. In a country of 300+million people and even more firearms, it doesn’t take much to break a chain of custody. Yes ideally, everything would be off the books but it’s not completely necessary to have guns without records.
