Last week, at 1:55 a.m at a 7-11 convenience store in Fresno, California, an armed and alert clerk fired one shot to stop an attempted armed robbery. It has been reported that the suspects were armed with an “assault rifle.” From the daily mail.co.uk:

Two robbery suspects who burst into a California convenience store were left running for their lives after a store clerk turned the tables on them and fired back.

Surveillance footage from inside a 7-Eleven store in Fresno shows the moment a man brandishing a rifle, followed by a woman, went into the store and demanded money.

The entire incident took about eight seconds. With the advantage of plenty of time and screenshots from the surveillance video, though, you can see that the suspects were not armed with a rifle. There’s no buffer tube or stock.

The magazine appears to be of standard size, but some manufacturers make .22 rimfire pistols that are close to this configuration, such as the Mossberg 715P.  The sights and carry handle are incorrect for the Mossberg, though. It could be the Mossberg 715T rifle, with a shortened barrel and the stock removed.

Then again, it could have been an airsoft gun. That could explain why the suspect didn’t fire any shots. In California, the penalties for brandishing a fake gun are less than the penalties for brandishing a real gun. From shouselaw.com:

1. Brandishing a pistol, revolver, or other firearm capable of being concealed upon the person… in a rude, angry, or threatening manner… in a public place:
– a minimum three (3) month, to a maximum one (1) year, jail sentence, and/or
– a maximum $1,000 fine.

2. Brandishing any other firearm… or brandishing a firearm in other than a public place… in the same manner: not less than three (3) months in county jail.

3. Brandishing an imitation firearm: not less than 30 days in county jail.

Was the item used by the suspect above real or fake? Hard to decide in a few adrenaline charged seconds, and the clerk had no obligation to do so. He hasn’t been charged.

  1. Lol at the already intense restrictions on ownership of ARs and other black rifles back home. Those new laws Gavin gave us are sure to crack down on these evil weapons /sarc.

    My money is on imitation, but it really wouldn’t surprise me otherwise. There are some parts of Fresno that can be comparable to Stockton.

  2. Probably air soft. Looks awfully light in his hands. If those two needed money that bad, they could have dumped a real firearm for a couple hundred bucks and skip the gas station robbing risk.

    • Agreed. It looks like there is little weight to it. I bet my AR-7 (2.5 lbs) with empty mags weighs a lot more than that thing. A loaded, 30 round magazine of 5.56 weights about 1 pound by itself. The upper receiver of a typical AR is no less than 2 lbs; lower receiver, no less than 2 lbs. Even if he got his hands on a mostly polymer AR, which I doubt, it would probably be heavier than that thing he was carrying.

  3. I’d say it’s a toy. It almost looks like it does not have a stock or even a buffer tube. Maybe it’s there and I can’t see it but that’s my view of it

Ahhhh… the Daily Mail.. thats our answer here in the UK to your National Enquirer… The use of the term “assault rifle” would be pure drivel as most of the fucktards that seem to “write” for that rag wouldn’t know their arse from their elbow … Again, I’m sorry for the libtards that seem to screw up anything firearm related over here..

  5. 7-Eleven is Southland Corporation so the guy that fired the shot is now looking for a job. They would rather have a dead employee than a lawsuit from a wounded perp or dead perps family. They are about as anti-gun as it is possible to get.

  6. I think it might have been a paintball gun. There are many models that look like that and you screw the air tank into the rear of the gun to form the stock.

  7. As per usual, the media moves forward with headline grabbing video and premeditated anti lingo and the accompanying inaccurate reporting and labels before any research or facts are in.

    I’m pretty sure this wouldn’t fly if the tables were flipped.

  8. Dunno’ about this one but there was a shootout at a liquor store in the NW side of Chicago last night…no one killed but POSITIVELY reported on the local lamestream news. Another middle eastern dude shootin’ at the brothers?

  9. Brandishing law is irrelevant to this story. It was a robbery not a brandishing. Real gun or not, a robbery is still a felony and the subsequnt pc211 sections draw no distinction…… now if he was walking around town with his airsoft gun to draw attention to opressed airsoft owners who have to permanently mark their guns with blaze orange tips, then that would be a brandishing story.

  10. If you tell me you have a gun and are going to use it on me it’s not my job to determine if you’re lying or not. My job is to prove to you that my gun is real and I will use it on you.

  11. That dude looked like Colin Kaepernick. Maybe he was trying out a new line of work since his career in the NFL will be over in 3 weeks.
