The National Gun Victims Action Council is just as extreme as the Coalition to Stop Gun Violence – only more so. While both organizations would gladly throw the United States Constitution under the proverbial bus to realize their dream of a disarmed America, Fineman doesn’t hide his intentions. In the change.org petition after the jump, we learn that Fineman would have President Obama declare a state of emergency to impose gun control across the nation and establish a “commission” to create gun control laws (excluding “members of the gun lobbies.” Committee of Public Safety much? Here’s Elliot’s plan . . .

Americans are in the midst of a gun violence epidemic. The National Emergencies Act gives the president the power and responsibility to declare a state of emergency when the government lacks the procedures and capacity to address an unchecked natural or man-made public health epidemic.

How much more must Americans endure? Domestic military installations have been attacked; media members have been murdered on camera. Shootings have recently occurred at church prayer meetings, in movie theaters, restaurants, department stores, offices, factories, schools, colleges, national parks and while driving along major US highways.

We ask that you declare a state of emergency to protect us from the gun violence epidemic now. The public space has become Russian roulette–every place is a potential risk. When the H191 flu hospitalized 20,000 people and killed 1,000, you used your power and declared a state of emergency.

The Government cannot stop the Gun Violence Epidemic without information:
Under existing law, states do not have to report prohibited gun purchasers to the National Instant Criminal Background Check System (NICS)— In many states 90% of mental health records are missing.[ii]

—Millions of people with mental disabilities have purchased guns. We do not know who they are. Nor do we know who has developed mental illness since buying a gun.

—Guns sold at gun shows, over the internet or through private sales do not require a background check. These represent 40% of the guns sold,[iii] and we do not know if these people should be prohibited purchasers

Countries with strong gun laws and our national statistics show “law- abiding” citizens cause most gun violence.  Only 7% to 8% of US gun homicides are gang based — most mass shooters are legal gun owners. [iv]

Rather than attracting gun crime “gun-free zones” repel it.  That is why courts and the headquarters of all major U.S. corporations (including the NRA) ban guns.

Remedy: Declare a National State of Emergency and, among other things, consider:
1.
  The requirements and standards for people to be carrying guns outside their homes.

2. That parents who own guns be held accountable as accomplices for gun violence their children cause with the parent’s guns.

3. That gun trafficking be made a felony to reduce the gun violence epidemic in the inner cities.

4. Appointing a commission to address this epidemic, such commission to exclude members of the gun lobbies, who profit from the epidemic they’ve caused and do everything they can to keep it going.

Clearly, our government does not have the resources, procedures and data to stop the next Aurora, Charleston and Chattanooga.

  1. I know there is a lot I there, but I’m curious about one particular point – the NRA offices. Is it confirmed that they ban guns there?

    I hated moving to TX, but I had to give them credit for their CHL policy at the Capitol. It was putting their money where their mouth is. I’d hate to think the NRA doesn’t do the same.

    • Ditto. The usual garbage spewing is nothing new, but NRA banning guns, unless they’re in DC proper where the state makes the rules, it just doesn’t sound right. The national conventions allow carrying.

    • I walked into the NRA headquarters/museum/basement firing range in Mclean, VA while concealed and carrying. I didn’t see any signs saying otherwise and they didn’t have metal detectors or security guards to check. Granted I didn’t take the elevators to the corporate offices upstairs, but I was there for the museum full of firearms.

      So, like their claim I can buy a firearm off the internet or gunshow without a background check, I say this is downright false.

  2. Obama is a would be tyrant. I emphasize the would be because he also isn’t interested in being the next Salvador Allende. He would have to rely on the Army to enforce it and given a chance the JCS would use it as excuse to depose him. They hate his guts.

    Also, my guess is that you could find the requisite number of Democratic senators to vote to convict him.

    • I wouldn’t count on the last. I can’t think of many Democratic Senators with much respect for the rule of law. Obama could messily devour a screaming baby on live TV, and I wold still be surprised if they could get 2/3 on articles of impeachment. That is, as long as Obama continues to pushing the leftist agenda on the little people and continues to take care of the super-rich like he has.

      That’s a riot. The military has ignored the part of their oath to defend against both enemies foreign AND DOMESTIC since the beginning. They’re blindly loyal to whoever sits upon the throne and on about half a dozen occasions in the 20th century, they followed their orders to shoot unarmed Americans on US soil. If you put your faith in them because propaganda tells you that they’re “heroes”, you’re going to end up on your knees with a gun to your head.

        • You can Google it yourself, especially since (as your response to the other poster has shown), you’ll defend government violence against it’s citizens to the end. However, the Bonus Army (during the Depression) is my personal favorite because it showed that US soldiers have no problem murdering US veterans simply for peacefully protesting against the government. If they’ll gladly slaughter their own (and yes, it was difficult for commanding officers to get them to STOP after they finally decided enough people were killed), how stupid do you have to be to think that they wouldn’t massacre ordinary citizens with a smile on their face? If you want something more recent, who can forget Kent State? I can’t, seeing as I live in Ohio.

          Even your own example is false. A brief research of the Bonus Army event reveals two deaths; both at the hands of civil police officers. The supposed slaughter you mention seems to be a fabrication of your imagination.

          Based on your third paragraph, it is obvious you have some deep seated emotional issues with authority, and a complete lack of understanding of military service. Best of luck with your hate campaign.

    I don’t like guns…. so I’m trying to take them away from law abiding citizens so only criminals and police will have them. All the rest can just pray they are not caught in the crossfire.

  4. Looking at their requests, what are they asking for exactly. I generally agree with them on point 1-3, but I’m not sure what they mean.

    1) consider the requirements for carrying outside the home? I’d love for some attention there – perhaps national reciprocity.

    2) if parents are leaving their weapons unattended and they are being used in the commission of a crime, of course there is a level of responsibility. There is a question of fact that needs to be determined – were the guns unattended or being stored? If my kids break into our safe and get to the guns, that’s no different than a thief. Does every gun need to be in a safe? No. It’s a totality of the circumstances issue.

    3) actual straw purchases on behalf of known prohibited persons (not gifts legit or sales to legit buyers) should be a felony. There needs to be a standard that looks at the intent of the trafficking. If I bring my gun into NYC for personal use (including letting a friend shoot it), I’m sure they’d love to call it trafficking, but it wouldn’t meet my standard.

    4) this I’m not sure I understand. Anytime you want legitimacy, you need to include all vested parties to a discussion – and that would include both gun mfrs and rights organizations. Although, a commission doesn’t seem necessary. If we provided more mental health treatment and looked at it like a treatable and manageable condition that didn’t carry a burden of impacting other rights, I think we could avoid more problems as people seek treatment. I might even become a possible supporter of some involuntary commitments in that situation.

    • 1) With the exception of the handful of constitutional carry states, you already have to be vetted and found to be in a group that has a violent crime and murder rate that is half of LEOs. If CCW permit holders weren’t so law abiding we wouldn’t have any states with constitutional carry, but public carry has become so much of a non threat that states are forced to consider scrapping the permit process altogether.

      2) In mass shooting events the parents are usually the first to be executed. The parents can be held criminally liable and will be held liable in civil court if Jr. goes on a rampage with Daddy’s gun if they do survive.

      3) ‘Gun trafficking’ is already a federal felony. Not much to say other than they should check their facts before ranting about gun laws.

      4) Another feckless commission isn’t going to accomplish anything. Excluding the ‘gun lobby’ would only succeed in stripping the commission of any legitimacy.

        Gun trafficking is apparently NOT a federal felony for federal employees under the direction of DOJ. Let’s fix that. Every single individual in the chain of command goes to federal prison for 5 years.

      Can you point out to me ANYWHERE in those 27 words where “known prohibited persons” is included, defined or even implied? Can you show me where the Second Amendment includes any possibility for any government agency to determine who is a prohibited person? You cannot, because the Second Amendment is and was intended to be a prohibition against the government doing that very thing.

    This seems like so much BS to me.

    • It looks like they added up the two gang related murder circumstances entries from the 2013 spreadsheet and just ignored all other crimes.
      For their interpretation to be true we would have to assume that if someone isn’t law abiding then they must be in a gang. Which obviously isn’t true.
      Also, the numbers are murders. Not shootings. From my city days shootings among these people were an hourly occurrence but an actual death as a result of any shooting was uncommon making the gang problem represented as murders seem quite small.

      They pick the numbers they want. Frame it how they want. Then present the picture they want knowing full well most people are too stupid or lazy to question the findings.

        So, out of all known homicides, not even just homicides by gun, over half of them are not even classified in any meaningful way. Many of the classifications that ARE there probably occur due to gang activity, but just couldn’t be proven to be related to gang killings, or couldn’t be successfully prosecuted as such.

        If they want to take this report as truth, then only about 110 of those murders fall under sub-categories that are obviously not likely to be gang related (has there ever been an incidence of a gang related baby sitter killing a child as payback to a rival gang, that would muddle things a bit.) About another 100 homicides can be thrown in the either way category, and then some unknown number of “other arguments” and “Unknown” would be in there as well, but since a domestic homicide or mass murder is pretty easy to give a cause of homicide to, I bet those unspecified categories fall more into the “we pinned the murder on a person but do not have a clear determination of motive,” realm.

        So what I still gleam from the report, despite their 8% claim, is that it is still the people who are already bad things to happen are the people committing homicides.

    • Highly skeptical of those low numbers for gangs. David Kennedy doesn’t use the term “gangs” (he calls them “drug groups” or something like that), but his research has shown in city after city that half to two-thirds of homicides are between groups dealing in illegal drugs. Further evidence that most murders are gang related is the fact that most murder victims have arrest records (one city Kennedy worked with, the average murder victim had been arrested ten times).

    Of course many of the facts are wrong or misrepresented. As such there convulsions are wrong

    The public Heath attack continues to be a major flaw in their argument. The antis are trying to make guns seem like the carrier of a disease. If a legal gun carrier walks into a crowded room of people with a concealed weapon nothing will happen. Statistics support this. If a person walks into the same room with a virulent flu it is very likely to spread to other people in they room.

    Most of us understand the simple truth that a gun is an inanimate object……a tool. It can not act on its own. If there is a violence issue its because of the people choosing to be violent, not because of the tools they use in acts of violence.

He is a real constitutional scholar and patriot and defender of the oath he will take , sworn proudly upon a Christian bible , to faithfully execute the office of the President and ” preserve , protect and defend the constitution of the U.     It is more like 70% to 80% of U.S. homicides are gang based, whether or not they used a firearm for the murder weapon.

    As for “mass shooters” — assuming that “mass shooters” refers to spree killers (like Umpqua Community College, Aurora movie theater, and Sandy Hook Elementary School) — then yes most of them were “legal gun owners” until they set out to murder a bunch of people.

    It is a fool’s errand to think that government can prevent spree killers from obtaining firearms. Even if some magic enabled government to correctly predict who would be a spree killer and prevent them from purchasing firearms, government cannot stop such people from purchasing firearms illegally, stealing firearms, or making their own. We need look no further than Paris, France to see proof of that.

    If you are so concerned about spree killers, then arm yourself so that YOU can stop the spree killer. Bonus: if you are armed and able to stop a spree killer, you will also have a really good chance at stopping garden-variety thugs who endeavor to take your money, your daughter/mother/sister/wife, and your life. In other words STOP WHINING AND DO SOMETHING YOURSELF.

  15. In New York, the Progressives made a law that requires citizens to register AR style guns. Out of the estimated million or so AR style guns owned by New Yorker’s, only 50K were ultimately registered. In Los Angeles, out of the hundreds of thousands of people who have standard capacity magazines, exactly zero people turned them in after they outlawed them. Why in the world do these anti-second amendment people believe if they outlaw the 2nd amendment that We The People will comply?

  18. How would you know that 90% of anything is missing? I can only create a percentage comparison when I have two known quantities. That is as much logical BS as I have ever seen. But I’m just an engineer who took calculus and avoided statistics, so maybe there is some mathemagic I am unaware of

  19. Epidemic. Gun crime has been declining for the past few decades. Coincidentally as states, starting with Florida if I recall correctly, shifted to more liberal CCW laws allowing more folks to carry and have the effective means to defend themselves.

  22. Man, they’d almost have a point if every claim they made wasn’t demonstrably false.

    Actually, they did make one correct point, that courts ban civilian firearms. That might be useful to their argument if every school, theater, or place of worship had metal detectors and armed guards. But, they don’t. So even that doesn’t support their claim.

  23. The “gun violence epidemic” is this thing that cruises around and causes all kinds of stuff…… Like all the other bogeymen of the progressive retardoverse, like “the inflation” and “the unemployment”; and the mother of them all, “the system.”

    Reagan used to say “Fellow Americans, blah blah some senile crap that admittedly sounded kind of cool coming from him…” That term is now deprecated. There is simply no possible fellowship at all with idiots like this. No commonality, aside from the misfortune of being stuck on the same continent as them. All that is good for them, is bad for us, and vice versa. Their friends are our enemies. Their joys, are our suffering. With absolutely nothing shared, what purpose does it serve to pretend we are some sort of “Nation?” If “they” are America, we should secede and form something else, better, just to no longer have to share anything, even if only pro forma, with them.

  24. EVERY “fact” (not some of them, all of them) presented in that diatribe is a complete lie. Even the footnoted documentation of some facts are lies. EVERY ONE.

    President Obama, you go ahead and declare an emergency to justify firearms confiscation. And you will start the next Revolutionary War. You, sir, will be one of the first people with your back against the wall, come the revolution.

    P.S. Legal gun owners bought more firearms during one day (Black Friday) than the US Marine Corp has. If the military and police ever have to resist a revolution in this country, they will quickly learn that they are out-numbered and out-armed.
