You know how they say there’s nothing so dangerous as a wounded animal? Scratch that — it turns out there’s something much worse. Nothing’s more dangerous than a (politically) wounded politician. Particularly one with executive powers. In his obligatory annual state of the union speech tonight, president Barack Obama promised new measures (“with or without congress”) to affect via executive order that would further restrict Americans’ right to keep and bear arms – all couched in a desire to prevent another Sandy Hook, of course. Congress and our constitutionally-mandated system of checks-and-balances be damned . . .

As every grade-schooler learns in civics class, the entire point of a divided government is to keep any one branch from becoming too powerful. So if Congress passes extreme, unpopular legislation, the President can step in and veto it. Alternately, if the President proposes policies that go against the will of the people, Congress can ignore them or vote them down. And the Supreme Court acts like the parent of the (sometimes) dysfunctional family, stepping in when needed to determine if what’s passed and signed is constitutional.

The president’s decision to use his executive powers to sidestep congressional approval is more than a little worrying. A divided legislative branch has meant Obama has been largely roadblocked since 2010. But with no further elections in his future, the president apparently feels free to try to do whatever he wants with the stroke of his pen. If you like your legislative branch, you can keep your legislative branch.

While congress seems to have realized that gun control is a dead issue for now, the president isn’t so content to let things lie. He issued a number of executive orders a year ago in the aftermath of Newtown. Now he appears set to use the regulatory agencies under his control (read: ATF) to go still further. A prime example is the ATF’s recent decision to expand the CLEO sign-off requirement for every member of a gun trust. Something they seemed set to eliminate, before doing a 180, supposedly at the behest of the White House.

In tonight’s State of the Union speech, Obama announced that he intends to do just that: act to further restrict the constitutionally protected rights of American citizens without congressional approval.

Citizenship means standing up for the lives that gun violence steals from us each day. I have seen the courage of parents, students, pastors, and police officers all over this country who say “we are not afraid,” and I intend to keep trying, with or without Congress, to help stop more tragedies from visiting innocent Americans in our movie theaters, shopping malls, or schools like Sandy Hook.

What’s up Obama’s sleeve now? We don’t know, but three options come immediately to mind: 1) an ATF regulation mandating universal background checks, 2) a total ban of all firearms imports, and 3) a new “assault weapons” ban. Will he pick door number one, number two or number three? Some combination? All of them? Or maybe something altogether different? As always, watch this space.

        • The only thing Republicans have been giving good and hard in the last two decades is in the men’s room at MSP. I have never seen a group of people more willingly concede defeat while standing on the top rung in my life. Self-sabotage is the only real skill the GOP has.

Surely you jest; Bush gave us the Abomination (Patriot) Act and oversaw the greatest growth in government handouts in decades; Reagan signed the gun control bill of ’86 that outlawed new registration of select fire weapons for citizens. All the Republicans that were presented to us as an alternative have been Rino’s; Mccain? Romney?;Please! 44 Republicans senators voted to continue the NDAA- (which includes the indefinite detention of American citizens without charge or trial.)In my opinion, they would be doing mostly the same things as Obama has done.
          Until people wake up and realize the Republican Party is statist to the core and does not respect the Constitution, nothing will change the way our country is going.

          Even without the support of Congress he can cancel each and every Presidential Order of his predecessor(s). He can also order his attorney general to aggressively prosecute violations of civil rights, including state and local over-zealous enforcement of unconstitutional anti-2A laws.

        • Cliff? If we were writing the Constitution from scratch, a few major changes would be no voting rights unless you’re at least third generation American, none if you don’t own property, and none if you work for/sell to the government or receive a welfare check from the government.

          Franklin always said this experiment would fail as soon as people realized they could vote themselves money at their neighbor’s expense.

        • Yes, Jon, but all dreams. I have commented here before and included in some of the stories I write that there needs to be a test for voting a bit more stringent than surviving to your 18th birthday.

          I have also stated that no person who accepts payment from the government should be allowed to vote so long as that condition persists, which includes welfare and contractors and people who work for contractors.

          We are not so far apart philosophically, I just wonder what the alternative is at this point in our country. I do not see a Constitutional Convention as realistic at this time.

        • Jonathan and CliffH; I believe you’ve wandered over from Democratic Underground by mistake; you and the liberal/progressives are as one in your desire to use tyrannical government to enforce your will on the unwilling, to create a subservient class. That’s what the democrats did with Jim Crow laws and the progressives want now, only the right people to have the guns,(Government critters) and the power.

          Usually, from history, the revolution replaces one tyrant with one that is worse; you’re “solution” would be a worse tyranny.

          It is pretty straight forward; you can’t serve two masters; you will serve someone, a human tyrant, or G-d; one will enslave you, the other will set you free. The Statists obviously see themselves as godlets and want all the rest of us be their servants. Or you can serve G-d; slave or free human being.

          It all comes down to choice. But it can’t be forced, (hint, hint), people have to make this choice freely, and those that choose true freedom will in the end prevail. Think of it as Darwinism in action.

        • Why would he? If he’s a (R) and manages to get elected that means he’ll drift to the center so as to get re-elected, doesn’t it? After all, he won’t have to win a primary, so he’ll be able to take conservatives for granted in his re-election bid, which will undoubtedly be billed as “THE MOST IMPORTANT ELECTION OF OUR TIME!!!”.

        • As long as the RNC and DNC are involved in the selecting of politicians in Washington there is no hope. Ignore the fed, they’re a distraction. Focus on what you can impact: local politics, pay as few taxes as possible, when your local government does something stupid to come down on your neighbor you and your community defy them, if you live in an oppressive state (ny, ca, il, nj, etc.)…leave.

        • So what I am reading is if you are paid by the government you should not be allowed to vote. Would this include military? The same ones who volenteer to serve while you stay home with your family, we have to leave our families for months at a time. The government is already making it as difficult on us as they can to vote. Any close election the ballots from the military are often challenges as they were not postmarked by a certain date. When mail goes through the APO/FPO system, they are not always postmarked. Therefore our ballots are not always allowed.

          You might just want to think a little more before you try to take away ones Constitutional rights. You and I don’t like seeing our RKBA taken, yet you are proposing to do just that to others.

        Thank you for that, I had not seen it (well worth watching folks). We are fast running out of options here in America and I am becoming increasingly concerned that we WILL have to invoke the Second Amendment sooner than later.

We’re about to have a Republican majority in both houses of Congress. Here’s to hoping Boehner, McConnell, Cruz, et. al are smart enough to stay out of the way and let him continue to implode his own party.

    He doesn’t have the ability to enforce anything.Three states have laws on the books which disavow Federal recognition of NFA items made in-state. He can sign whatever EO he wants to ,because the rest of America will just ignore him.

    The only places which will give Obama credence are the states which already use the US Constitution for toilet paper in the Democrats’ offices.

    Congress is meant to be deadlocked to prevent knee-jerk reactions and passing legislation without thought, consideration. It also gives a voice to the minority party.

    • Do you understand how the impeachment process works? Perhaps you were asleep in your civics class. First the House must vote to impeach the President. Impeachment is equivalent to an indictment. Then it goes to the Senate for trial. The “jury” of 100 senators votes and if 67 ayes are found then the President is removed from office. There is no point in the House impeaching the President if they can’t get 67 votes for a conviction. Remember what a failed impeachment did for Bill Clinton. In the real world if you don’t have votes you don’t start the process. Try the case in 2014 elections and elect Republicans to the Senate.

      • Clinton was damaged goods after that. He completely lost what little initiative he had, and started working with Republicans on some issues. Overall, it was worthwhile to humble him.

        • Really? The Democrats made big gains in the 1998 Congressional elections. Clinton would have rolled to a third term had he been eligible.

      • You’re slightly wrong on Clinton. He was actually impeached;
        becoming the second ever (the 1st was Andrew Johnson,
        Nixon resigned before impeachment). The term impeachment
        only refers to the act of Congress indicting a president. What
        they failed to do was remove Clinton from office.

        As for whether it’s a waste of time, I disagree. Could there be
        67 votes in the Senate to remove him from office, probably
        not. But this doesn’t mean the Congress should ignore him
        and refuse to seek impeachment. In my view, for Congress
        to do nothing is the same as a DA refusing to prosecute a
        criminal simply because they think a judge may not send
        down a lengthy sentence.

        • Choosing not to act, choosing to remain silent, (on the part of Congress) is tantamount to consent.

    The ATF and its rules-writing “authority” has been pushing its luck more than is prudent already. The more he pushes the closer he gets to drawing and losing a landmark court case.

ATF cannot charge you with a crime that doesn’t exist in statute. The reason that federal government couldn’t require a background check for intrastate sales private individuals is that don’t have the authority to do that otherwise ATF would have done it long ago.

    2) a total ban of all firearms imports. Maybe, he does have power to restrict imports. It would increase the price of certain classes of firearms.

    3) a new “assault weapons” ban. Again, no legislative authority to redefine an “Assault Weapon” beyond what is found in the NFA. He would lose that case in court very quickly.

    Those are the obvious candidates and that is why it will be something else.

    • I agree completely. The executive authority can be exercised only within the scope of federal statutory authorization. Which is why I think he pretty much shot his was with the last round of orders a year ago–don’t you think he would have signed additional orders if he though he had the authority to do so?

      He (or his successor) would lose the court case, but not quickly. In the meantime, the unlawful regulations would remain in effect. For example, see the city councils for DC and Chicago, and the actions of various county sheriffs for foot-dragging and obstruction.

      The judicial system couldn’t handle that, and there couldn’t be arrests because there isn’t enough jail space in the US, even counting the “FEMA camps.” And the banks wouldn’t let asset forfeiture happen because they would lose whatever mortgage money they had coming in and would be forced to close.

  14. You guys did the same thing at his last address. Executive order only pertains to Feds and not civilians. So, he can not do much. You know, I thought Bush would go down as the worst…but I think I am changing my mind. Obama needs one more screw to tilt the scale. Bush getting 1000s of American soldiers killed over lies and oil fields still tops it and then say “Mission Accomplished” and then more soldiers get killed. As for VP, nothing can top Cheney shooting someone in the face with a shotgun and getting away it at the taxpayers expense.

Do you think Bush paid off the SVR [know who they are] to come up with same assessment as US, British, French and German intelligence did? By the way at last count, circa 2006 we recovered 6000 chemical rounds in Iraq.

        • With the disclaimer that I don’t have time to confirm at the moment, I believe that we have lost twice as many people in Afghanistan under Obama than we did under Bush. In roughly the same amount of time. The rules of engagement are ridiculous, as I’m sure some of the other readers who have been there can attest to.

  15. I say he might try 4:) An outright ban on all civilian ownership of firearms. Now enforcing that will be a different matter. Or maybe 5:) a ban on all “modern” firearms. Nothing in the constitution or any ruling (to my knowledge) by SCOTUS states that firearm ownership is granted to modern firearms.

    • Wrong on SCOTUS. Try the Heller vs DC.

      No executive order can levy a total ban on firearms. It Has be done by the legislative branch because only they can define penalties. As I said above He cannot go beyond his authorities as specified in the NFA to redefine classes of firearms that defined in statute. The President can issue an executive order to effect the operation of the executive branch or in areas delegated by legislation.

    • A complet and total ban is their goal, and that point we would see just how many Americans were true the their “line in the sand”

      • I believe Connecticut may have given us a measure of this – about 5% complied with the mandatory registration law as of December 31, 2013.

    • Check Heller. The majority opinion states that the 2A protects guns “in common use”. This means modern guns.

    • He can’t ban anything with an EO. Nor can be order registration. Executive orders give directives as to how the executive branch enforces existing laws. Any EO he issues will be a paper tiger with no teeth, designed to allow him to claim that he’s done SOMETHING for the children.

      If you’ve been watching much news lately, you’ve seen that the Supreme Court has put stays on the implementation of several state laws and lower court decisions until SCOTUS can hear and rule on them. Surprisingly, they have involved what most of us would consider “liberal” laws and rulings. I expect that it wouldn’t take that long for them to put a stay on an overreaching EO. There is hope yet.

  16. He’s reaffirming his executive order powers to try and set the idea in the country’s mind that he actually can do whatever he wants. Why? Because his illegal non-recess appointments from a few years ago are going to the Supreme Court. Lower courts found that he violated the law by appointing members to the National Labor Relations Board while Congress was not in a true recess. His cronies have challenged that ruling and those members have stayed on the board while the appeals are being heard. By trying to expand his executive order powers before this case is heard by the SCOTUS he’s trying to establish a precedent invalidating any challenge to his whims.

    He’s also mentioning this gun control agenda to appease his base. He knows that pushing for more federal control is going to be costly in both time, money and political capital. He’s already under siege for the Obamacare debacle, and that pressure needs to be increased. However, I am worried that he may try to enact some orders that violate the Second Amendment and that many of the agencies that have been stockpiling arms and ammunition (really, the EPA needs guns??) will be the ones to try and enforce them.

    The members of Congress as well as any state legislator who is opposed to his control and confiscation agenda NEED to step up and draw a line in the stand. The gun control fight needs to be less about the guns and more about the restrictions on freedom. Focus on the larger picture, and start drawing real comparisons to the dictatorial governments in the last century who started with control, went to confiscation and ended with genocide. People need to understand that taking away our guns only paves the way for other rights and freedoms to be taken away.

    Universal Background Checks? On whose authority?Congress can’t even do it- the Brady Law derives it’s authority from Commerce Clause regulation of national commerce, which is why FFLs have to process BG checks but private citizens within the same state do not .

    If Congress can’t pass a law like that and make it stick, his EO will be stayed by the judiciary before lunchtime the following day.

      • Naaah. Responding to comments is job security. And it supplies ammo for future disputes. The ATF doesn’t like us, but the do like our money, and the fact that we supply them with some level of relevance- they’ve been in the fight of their lives for the last decade as Federal Law Enforcement and Homeland Security keep slicing into the pie and shoving them out. The NFA branch is one of the few things nobody has challenged the ATF for, so they’ll at least make a go of looking like they actually run it.

I suspect that NOTHING or very little is going to happen with gun control, short of another reprehensible school shooting with a black scary rifle being the weapon.     Gun control is a ship that barely staying afloat! Gabrielle Giffords can travel around and testify here and there and try to rally the troops to her cause, but it’s a sinking ship and all the Bloomberg dollars can do is pound corks in the holes and try to keep the Titanic afloat just a little longer.

And since you may have missed your civics lessons, congress is the check for the president. The legislative branch oversees the executive who oversees the judicial. The American government is the most disturbing game of rock, paper, scissors ever played, and we now have a president who declared, however fleetingly, that paper beats scissors.

    The worst I could see him pulling off is some kind of additional importation restrictions, but with so many companies manufacturing here already, and so many just waiting for an excuse to get in the game, it could be a long game win if he does.

    • The speech will be soon forgotten, as most SOTU are, but the NSA will still have a measure of the negative response from POTG and this will be noted and NOT forgotten for a long time.

  34. I hope that everybody realizes that nobody has to obey an “executive order,” except the people directly under his supervision, (i.e., the Executive Branch, AKA the bureaucrats and storm troopers) and nobody is even supposed to obey any unconstitutional order.

    So its time for state, local, even individual, nullification: “That order is illegal and unconstitutional and it is my duty to disobey it!”

    I can tell you having lived in Washington for a long time, right now, as we speak, there are people on The Hill who are doing everything they can in their power to come up with various different means by which they can possibly enact more and more gun control.

    If you think we are in for the fight of our lives, you have truly underestimated what is going on right now, behind closed doors, in some Congressman’s or Senator’s office.

    We are truly at a crossroads in this country where it things can go either way. If you are not politically active, you absolutely need to be.

  38. I see a rift forming between the states where each ideology has taken hold. Best case scenario is everyone sees the error of their ways and opts to reduce federal power, reverting to an actual federal government instead of the national government it’s become. Second best is a live and let live attitude where the pro-gun states are allowed to be pro-gun without meddling as pushes for more gun control keep failing.

    There’s that old saying: “pray you are not born into interesting times.” I say pray for the occasional boring stretch of history.

    I think what will really happen is people will cry and moan, but in the end they will comply and do as they are told.

  40. This article is somewhat misleading. Taken in context to everything Obama said in his SOTU, basically he made more empty promises he has little authority or capability to follow-thru on. Sure he can push through more EO’s to specific agencies, but in order to emplace trade changes and nation-wide bans on weapons, he will need the approval of both houses of Congress. And we’ve seen there is no support there. 2014 is a mid-term election year and it is unlikely there will be any significant changes as many politicians won’t want to risk their jobs (btw still get out and vote people!). This is mostly bluster and politicians pandering to the “hearts and minds” of the electorate. Same thing in PsyOps. Curious will be how many take it hook line and sinker after 2014 and where it will lead us until 2016.

    • Through executive order he appointed people to the NLRB which then changed the rules for unions and unionizing. That was more than two years ago. This has already had a great economic impact on many people and companies. Several non-union business that were protected from the employees unionizing were in fact unionized; the irony is that the workers LOST more than they gained in many of those places. The appointments were ruled illegal by lower courts more than 18 months ago but the people are still in place, making rulings and policy, while the case is being appealed no to the SCOTUS. Obama can do a lot of damage with executive order.

  42. Here is something from out in left field that a President could do but I don’t think Obama is smart enough to go there. Registration is not unconstitutional especially if ordered under the auspices of the militia clause. As Commander in Chief of all military forces including the unorganized Militia, He could order a census of firearms, which would include the owner’s, SSN, location and serial number of all weapons. He could state the government needs to this for purpose do logistics. Be hard to challenge his authority in court.

  45. Two of things listed (the assault weapons ban and universal background checks) are simply not doable as Executive Orders. They require new law. Any attempt to EO them would be shot down, and quickly by the Supreme Court. And the Liberal justices would not carry his water on this one: they know the implications of letting him get away with this if there is a future Republican President. Frankly speaking, it is not even clear to me that Universal Background checks would get through the Supreme Court as a law.

    • Rich, originally the only persons allowed to cast a vote for public office were land owners. This was done for a very valid reason: they had something at stake in the outcome of elections.

      People who are on welfare, receive government handouts, and are pretty much dependent upon the government have, historically, supported those who are giving them the support (those in power or those who promise more handouts) rather than those that are actually supporting them (the taxpayers). If someone doesn’t have a job, a livlihood, or anything to risk, then their vote may be cast for what they want. In most cases, these votes have been bought through handouts. The eventual progression of this is that people dependent on the government have to support the governmet, right or wrong, or they will lose their support. Essentially they become slaves. They’ve lost all voice and freedom and must obey.

      Several quotes pointed this out hundreds of years ago. Tocqueville said, “The American Republic will endure until the day Congress discovers that it can bribe the public with the public’s money,” …
      which is a variation of Elmer Peterson’s “A democracy cannot exist as a permanent form of government. It can only exist until the majority discovers it can vote itself largess out of the public treasury. After that, the majority always votes for the candidate promising the most benefits with the result the democracy collapses because of the loose fiscal policy ensuing, always to be followed by a dictatorship, then a monarchy.” (which is often attributed to Tytler)

      These words ring very true. It’s easy to understand this.

      I don’t remember these quotes as well as I should, so I had to Google them up and paste them here for anyone who cared. These words, when I first heard them years ago, intriqued me. Now, as someone who is on disability, living in some pretty crummy apartments, and trying to retrain my brain after many years of non-fulfilling careers in order to do something I really enjoy – I get it.

      I don’t want to give up my right to vote. I am intelligent, bright, and greet everyone with a smile and talk to strangers as if they are long time friends. But at some point the toxicity or the voting of those around who count of free handouts has corrupted the city I grew up in. It has brought ruination to my old neighborhood and I have watched a once thriving community become empty and hollow, devoid of caring. I would give up my voice if it would prevent the vermin from voting further damage to the home I have had for all my life but will never be able to share with my children because it is filled with that same vermin.

      If you served America, I thank you. I am not saying you can’t vote, and I don’t think anyone else is either. Personally I think you have earned the right to vote through your service to America.

      Think about this though; The guy next to you receiving government cheese has no incentive to elect leaders or policies that benefit you. His only true obligation is to ensure his cheese rations in perpetuity.

  55. Neither the right or the left have shown much respect for our constitution, the right to keep and bear arms obviously one of the more important ones to this readership. If you truly believe that we as citizens have a right to bear arms, that large government is bad and this current administrations love of ignoring checks and balances (which will only encourage future presidents to do the same) is detrimental to our future and freedom then you need to consider libertarian candidates in upcoming elections.
    We need to get government back to the state and local level where politicians are actually held responsible by their neighbors for the actions, or inactions, they take.

They are not legally binding, especially if they violate the constitution. THe only thing that can affect gun ownership is a law enacted by congress and then only if it is ratified by the house and signed by The present douchebag occupying the White House. Learn Civics 101. THe bigger danger is for people in states like California who are allowing their state governments to enact unconstitutional laws.

      The 1986 executive order affected certain ammo being allowed here under the guise of “cop killer bullets.” No legislative or judicial oversight.

      The 1989 import ban on freedom rifles was an executive order that now has force of law that was never challenged.

      The 1993 executive order banned certain freedom pistols from being imported. No one challenged that.

      The even well less known 1998 import ban also an executive order has the force of law that was never challenged.

      The 2005 barrel ban was an executive order that has the force of law that was never challenged.

      Seems to me the President can ban imported guns and ammo altogether with no one challenging him based on the ones that are already in place. Also every sitting president since Reagan has signed an executive order in the same regard so why would Obama be any different?
