Its official. The Assembly and Senate passed it, and the governor has signed it, saying “common sense prevailed.” So if you own a magazine, ANY magazine, in the state of New York with a capacity over 7 rounds you are officially a criminal. Congratulations. [via Capitol Confidential]

This is the same bill that the New York Times has issues with, and has some of the most blatantly unconstitutional provisions I’ve ever seen. Click here for the major points of the law.

    • How does:
“Current owners of higher-capacity magazines would have a year to sell them out of state.”
      become:
“So if you own a magazine, ANY magazine, in the state of New York with a capacity over 7 rounds you are officially a criminal.”

        • I bought a nice 8 round 357/38 N frame revolver this summer (S&W 627pro). Would this gun be illegal in NY due to the new law? Would I have to keep a cylinder empty?
Are these people mad? I know the answer to that last one.

        • Possibly a loophole? How about 7 in the mag, and one in the chamber? It’s only 1 more round, but I’ll bet they cant do anything about it.

        • I’m not clear about how they will tell the difference between 10 round magazines that one owned pre-ban and will be grandfather in, and ones that are purchased subsequently.

      • Are seven round magazines available for higher capacity pistols? I know there are ten rounders but don’t recall seeing sevens. Sevens most likely won’t be available for the less common pistols. Will they allow a retrofit with a spacer at the floor of the mag? Have they just rendered numerous pistols unusable in New York or created cause for a cottage industry of retro-fitters? Would manufacturers tool for this one state market?

    • unfortunately, you are correct…large, mostly urban and liberal cities are f**king up a lot of states……not everyone there, but enough to screw shit up….

      • Yah, but this isn’t just a NY problem. When cities fail, and things look bleak, those liberal elites like to move to the rural areas. The country. Where things are still done small town. Guns, fishing, hunting…free. Then they try to “fix” it. Make the country like the inner city the ran from.

It makes me worry. As a NH resident, we see it as a growing problem. We have seen an influx of Massholes moving up here.

Whats happening in NY…is like an infection that will spread if we don’t treat it ASAP.

        • I have two relatives who fit your description exactly. They both moved to New Hampshire last year. From Boston to Boulder, CO, and now NH. They want what their voting preferences inevitably destroy.

    • Don’t blame all of us New Yorkers for the ineptitude of our state government. Unfortunately those of us in upstate and western parts of NY always lose the voting battle to NYC and down state.

      • I have to disagree with you, alot of new yorkers don’t agree with this idiotic state government. But remember the elite control NYC and those are the ones that live upstate. They have armed bodyguards and gated communities to protect them from the teeming masses that they control, exploit and inevitably accustomed to being poor as a state of being. I feel your pain and even more so that I’m the only one that see’s the danger of this bill among my friends that agree with the gun ban and the blind ideology that “we don’t need those kind of guns” . I want to move as far away from Lord bloomberg and King cuomo as soon as I can..good luck all

        • Do what the rich did hit them where it hurts the pocket book. We all have to move, it’s prob a good idea anyway I think crime will go up.

    • Yes it will. Why? Because you are asking a government judge to go against the government.

People need to grow up. America is not the same.

      • Exactly. Just how you can ask to have a trial moved to another area due to to a biased jury pool making it impossible to get a fair trial in the area, you should be able to have a lawsuit against a state government moved to another court that isn’t biased against you.

  1. Any ideas on what other states will try this looney shit? I see Maryland, Ill, Ct, and maybe Mass? Has Cali done anything @ the state level??

    • They already tried in Illinois, and they were beaten back. They will try again, as soon as they can find some fresher graves to stand on, or some new bloody shirts to wave about. We will be ready though.

      • I think they are just waiting until the new legislative session officially begins–so look for developments in the local news. MSM probably won’t publicize what is going on any more than they did the last time around.

      • I guarantee that there will be more mass shootings, and more of this kind of pressure against gun owners because no-one is addressing the root of the problem, the human side. Instead, they address the proximate cause, not the ultimate cause. Until the ultimate cause is addressed, the problem will persist.

The politicians the assholes who call themselves “government” know this and they can’t wait for more children to die.

    • California has a new plan to ban bullet buttons on ARs, intended to make it impossible to have a compliant semi auto rifle unless it has an internal magazine, another proposal for ammo registration and reporting, and the silly season has just started. One city in the Bay Area just voted to ban the gun show that (used to) come to twon five times a year, and efforts are being made to ban any new gun ranges or gun stores. The Legislature has a supermajority that can pass anything, even over a governor’s veto. (We already have mag limits of ten rounds and a restrictive gun roster, so there isn’t a whole lot more they can do.)

      • They can ban all guns with more than one round capacity and confiscate everything else like they did last time. They will say that the single shot exemption is a loophole.

      • I’m still looking for anything I can do to help defeat Yee’s bills. Already donate to the usual suspects, sent in my letters of opposition, etc. I’m starting to get really frustrated — doesn’t ANYBODY have a clue on how to stop this?

        • Give it a rest. Please. My vote is inconsequential when it comes to partisan elected offices. At this point you are just harassing me and I don’t appreciate it.

Offer constructive suggestions on how to fight the disarmament advocates, or STFU. Attacking your allies is EXACTLY what the opposition wants you to do.

        • It is very often the case that a crisis today has no solution but rather was caused by last year’s actions. No vote is inconsequential because it is an affirmation of your own preferences… to yourself if no one else. Change comes from within. You could persuade your colleagues or neighbors to oppose Yee’s bill. Laugh.

Don’t vote for control freaks next election, for starters.

          deal with it

        • Alpha, so did you cast a vote for any (D) or other candidate who opposes the RTKABA? If no, then no one is harassing you. If yes, then you voted for gun control. Period.

      • Fellow Delawarean here… the thing I found most disturbing was Beau Biden’s (Delaware AG, Iraq Vet, Son of Joe Biden) assertion that their proposed ban does not clash with the second amendment! Who are these people kidding? This is mob rule, plain and simple, and Delaware will be an excellent case study for all to watch. There will be immense pressure for the little Biden and Comrade Markell to turn Delaware into another gun ban enclave.

As it stands Delaware is a “May Issue” state and it is illegal to hunt anything but groundhogs with a centerfire rifle (shotgun or rimfire only for lager animals). They have a good foundation here to push their gun banning ideology. They love to tout how impressive the Deer take is every year using only shotguns.

I don’t want to get myself burned, but I will say here that I have worked for the state of DE as a contractor and they are CORRUPT. Conservatives are discriminated against in state offices, I saw it myself first hand. I was warned by an older woman who my co-workers had referred to as a “trouble maker” that “you know they’re all democrats right?” in regard to my bosses. Eventually I was deemed a trouble maker as well. My job was to process applications for tax credit by employers whose hires met certain criteria. We got an application from a local gun shop, and I informed my co-worker I had bought a gun there years before. She said “remind me never to come over to your house” and I was FIRED the next day.

Gentlemen, a storm is coming. Prepare yourselves.

        • NEVER talk about even owning a gun in the workplace, unless you are shootin sure of every ear the news might fall upon, because you will be fired for making death threats. Because saying you own an object is threatening to use it in the most obscene way possible. I don’t even want to know what people would think if you said you own something crazy like matches, or even a dishwasher! *shudder*

  2. Next up, welding up the chambers in your revolvers, so no gun can have more than 2 shots. One for the assailant, and one for the person to use on themselves rather than be gang-raped while waiting for the police to show up.

    • “Next up, welding up the chambers in your revolvers, so no gun can have more than 2 shots.”

Ssssshhhhhh, don’t give the libtards any ideas! In this day and age I wouldn’t put it past them to try to pass something like that

        • NY and MA Republicans are apparently tired of being outgunned when they bring forth their skeet gun or 1911, and don’t cotton to the idea that the middle class could have weapons sufficient to make armed objection to tyranny possible. They’ll get their reward when they find the tyranny is Democrat, and the big-money Democrats lose control of the party.

      • Yea, I love seeing a term I use alot (libtard), especially when used appropriately. I just bought an 8 round revolver, is it legal in crazytown NY?

    • The problem is that HK would probably not give to shi*s. I don’t know if the civilian sales of Glocks, FN, and other foreign gun companies would be enough to incentivize their boycott as well. So if domestic manufacturers wouldn’t provide guns, the good old government would have no problem going elsewhere, and those foreign

  3. Forgive me for not paying enough attention, but does this ban cover tube fed .22 rifles as well or just anything with a detachable box mag? My deepest condolences to my gun owning brothers and sisters to the North. Get out while you can and flee to PA.

  4. Let the Games begin. Please pass the popcorn.

    Gentlemen, prepare to defend yourselves.

Load, lock, get ready to rock. The battle has been engaged. Pick sides, choose wisely, God’s speed.

Oh, and where, exactly, is that injunction that I was speaking of earlier?

      • Indeed, please pass the ammunition, and don’t be stingy.

It should be noted, though, that in the last month alone, the American people have added to their arsenals enough hardware to equip not only the People’s Liberation Army of Red China, but also the entire army of India. A chicken in every pot, and two rifles behind every blade of grass. They have us surrounded, the poor bastards ;>)

This is going to be absolutely wicked pissa.

    • You really think they are listening Alpha. Not to be mean, but you have lots to learn about our current political system.

      • You really think the vast majority of the American people give a $hit about scary rifles and 30 round mags? They too busy voting themselves food stamps and Obamaphones.

      • Please explain your reasoning that the SAF will not immediately seek an injunction staying this law.

Are you so ignorant of our judicial process that you think such petitions would come from individuals?

        • Having filed two myself for what I considered defenses of state constitutional provisions, I can say that requests for injunctions or stays of enforcement are often filed by individuals, usually members of a law firm, and often without remuneration. In a popular cause the matter typically sees petitioners lining up behind the strongest petitioner by providing litigation support, and later as amicus curiae on appeal.

        • Fair enough. All of the really juicy injunctions I’ve seen have been filed by counsel for groups or foundations, not by individuals. There’s certainly nothing to stop an individual from filing, but I would want a pro arguing the case in dire situations such as this.

Then again, I see from comments below that you’ve attended law school and presumably you’re an attorney. That makes you something other than an ordinary individual, IMHO.

  5. I think I saw him pat himself on the back when he said that the 7 round limitation is the most aggressive in the country. Maybe the next dipshit politician will make it 6. That’ll show ’em!

    • Did he say why he picked 7 rounds? Is it bcause that is all you should need, to make sure you didn’t outgun the cops, or jsut because no one makes such small mags except for ccw compacts?

      • I watched both the Senate and Assembly discussions/debates and this was asked in the Assembly. No explanation could be given other than that is what the NY State police recommended (they were the technical “experts” who told the drafters what to limit).

Some speculated that it was because so-and-so liked their 1911s or wheel guns, etc. I actually think it’s more nefarious than that. Most handguns use proprietary magazines, and most handguns sized compact or larger only have magazines that go as small as 10 rounds. Therefore, because as of today you can no longer sell magazines with a capacity of 7 rounds or greater, any new handguns sold must be sold without magazines, thereby rendering the guns unusable. Meaning, why would you buy a new handgun for which you can’t get magazines for, and no magazines will become available in the near future? You wouldn’t. They are indirectly banning the sale of many new handguns. It’s an end run around their claiming not to touch hand guns (apart from AR style pistols which were previously covered under the ’94 ban and remain so).

    • I think Nick means immediately as in exactly a year from now detachable mags over 7 rounds will be illegal. The bill gives NY gun owners a year to get their mags out of the state.

      • Pre-’94 full capacity mags are retroactively banned and must be sold out of state. 10 rounders are legal (for now) as long as you don’t load that eeeevil 8th round in them.

        Ex Post Facto, anybody?

        • Ex post facto? Seriously? How innocent and quaint? Bless your heart.

If all of the JD’s in the legislatures hadn’t slept through their Constitutional Law classes, we wouldn’t be having this goat rodeo today. I’m guessing that all of these legiscritters took their ConLaw classes with His Excellency, Barry the Most High.

        • Greg: My advanced Con Law instructor recently advocated, in the NYT, that we leave behind the Constitution. Better we slept through his class.

        • My ConLaw prof recently got appointed by Obama to the Federal bench. He was pretty liberal as a professor, I doubt he will be reliable on the 2A.

        • This is not an ex post facto law. They are not going to prosecute anyone for having possessed a pre-94 ban hi-capacity magazine back in 2012 when they were legal.

They will prosecute you if you have a pre-94 ban hi-capacity magazine in 2014 because they had made continued possession illegal. Laws change, I don’t like it, but that doesn’t mean it’s ex post facto.

        • I had the same Prof at G’town. At least his article didn’t start with a hypothetical involving him being naked before a 4th amendment search, a near constant hypo in our class. They didn’t allow him to teach con law back in my day, only crim pro. (Class of 2000)

    • It’s not clear. I haven’t fully digested the law, and there are somethings that seem to contradict other provisions.

From what I’ve seen, pre-94 hi-capacity (greater than 10 rounds) are illegal as of signing, but you have 60 days to get rid of them.

Pre-2013 10 round magazines are legal and will continue to be so, but you can only put 7 rounds in them, and there are penalties for noncompliance. You have 90 more days to buy 10 round magazines. Good luck finding any.

From that point on, only 7 round magazines may be purchased.

    • I think it would be ethically wrong to buy mags from panicked NY residents before we see if we can get an injunction suspending the law.

I won’t judge anyone else, but I personally think it would be wrong and I won’t have any part of it.

      • Fine. I’ll buy your share. They can buy them back from me if the law changes, for cost plus shipping. In the meantime I’ll be protecting them from serious criminal charges. After all, the magazines shouldn’t ALL go to Kentucky.

      • There are many pre-94 NY ban hi-capacity magazines within the state. Many more were purchased and brought in state when the Federal 94 ban expired because “free states” didn’t need them any more. These will all need to be disposed of, pending any injunctions.

  6. NL – According to the NRA’s website it’s 1 year:

S.2230 expands the state’s existing pseudo (semi-auto) “assault weapons” ban by outlawing pre-ban firearms, unless they are registered. This new state law also expands what is now considered an “assault weapon” and goes beyond the expired federal law. This statute also lowers New York’s magazine capacity limit from ten rounds to seven. You can possess magazines capable of holding more than ten for one year, but you cannot sell or transfer them to anyone living in New York.

  7. This might be a blessing in disguise if it gets slapped down (quickly) for being so over-reaching. Long game might be a repealed law and a lot of red faces w/ d***s in the wind.

      • No $hit. Talk about head in the sand. A bunch of you guys need to open your fvcking eyes. This is but the opening ceremony. Kickoff is tomorrow.

        • I agree that it will get slapped down quickly enough in parts. The question the US Courts will face is whether to allow the severability clause in the Act to survive. That is a nice question in statutes with numerous provisions violating the same US Constitutional provision.

  8. May the politicians that voted for this get what they deserve. I don’t wish bad things on anybody, but oh well, s-it happens! And as far I’m concerned , it could’nt happen to a better group of criminal thugs.

    • Criminal thugs, indeed! Numerous elected officials
are/were convicted felons. In Feb. 2012, Cuomo
had a press conference congratulating New York
on not having a legislator being convicted of
a felony for 3 months. Seriously.

      http://www.cityandstateny.com/cuomo-starts-
      speech-swipe-paterson-spitzer/

Cuomo himself may not be all that clean either.
His mismanagement of HUD was not only
borderline criminal, but helped push the country
into the current fiscal crisis. And he did admit
to illegal use of marijuana but swears he never
touched cocaine. I guess that’s only for Harvard
      Law students.

  9. It sucks for ppl in NY, but I think this will be a catalyst to motivate more law-abiding gun owners to get up, speak out, and start making our voices heard!

I also don’t see how this law will go unchallenged in the courts as well. Lawyer up, NY friends!

    • Screw making voices heard. Money (as in taxes) is king. Move the hell out of that state and let the idiots that like the new legislation pick up the tab when taxes have to be raised.

There are way too many States way more supportive of gun owners and freedom in general to bother pissing in the wind for a state like New York. Let them look forward to no guns whatsoever in the hands of civilians, 2 ounce sodas and restaurants serving nothing but vegan food.

I know its anything but a small thing to pick up and move but what is freedom worth?

  10. I have tried to read this bill all day. To say the least it is confusing. RF we need a lawyer to really break this down PLEASE. My read is that 10 round mags are ok if they are here already. BUT YOU CAN’T LOAD MORE THAN 7 ROUNDS IN THEM.

The Times is right. This bill is a freaking disaster but also sinister. Their definition of AW starts with any gun with a pistol grip. If it has a muzzle brake or compensator it is outlawed. Period. It didn’t sink in for a while. But you have to realize that this means any of the BIG guns which really require a brake, like Barretts, are done here. Very smart. Then I mentioned in a prior comment that any semi PISTOL over 50 ozs is outlawed. Soooo…that means the big bruisers like the Desert Eagle are outlawed. Etc Etc….they sliced and diced the gun world apart. Whole categories of guns are now denied 20 Million citizens of the US.

And don’t forget that Barry is gonna do the exact same thing to the rest of America tomorrow. So those of you in states that you think are bastions of freedom, well, watch out. Your local politicians may not be clamping down on you, but the Feds will. I suspect that not only us in NY are going to feel this but ALL OF AMERICA is shortly. Like the old TV show robot said…
    “Danger, Danger Will Robinson”

  11. Firearms manufacturers should just stop supplying NY agencies with equipment. If they want a gun free state then let them truly have it and see where it takes them.

  12. There is something profoundly *wrong* with making thousands of citizens (unconvicted for now) felons with no legal recourse nor compliance period.

Here’s hoping this bill gets crammed right back up the sphincter it was excreted from.

  13. Cuomo and his cohorts all have blood on their hands. If he thought this kind of thing would actually save lives he wouldn’t have waited until so many died before doing this.

  14. I was watching him talk and around the 3:00 mark he says that you can get a hangun permit at 18 in NY… is that true? Seems like it would be 21?

    • You can (could) get a handgun license at 18, but can’t purchase through a dealer until you’re 21…(I.e you could purchase privately)….until this law passed, not sure how the requirement to go through an FFL for ALL sales, affects this…

      • Technically yes, as they can’t be legally required to incriminate themselves, criminals have more of a legal right to carry than the law abiding.

        • Remember, according to the supreme court, the NFA only applies to those who are legally permitted to own guns as well. So if I was to build a machine gun, I would face 10 years in jail, but if Rod Blagojevich or George Ryan was to build one when they got out of jail, they’d only get in trouble for being a felon with a gun.

        • augh puke etc. It is fascinating trying to figure out exactly when this country transitioned to valuing criminals more than the law abiding.

  15. Is there any source on the claim that the law went into effect immediatly, making instant felons of anyone in possession of a magazine with a capacity greater than seven rounds?

The linked Capitol Confidential article that was cited doesn’t seem to mention that.

I’d like to share an original source on this information, and for obvious reasons the skeptics that need to be convinced don’t look kindly upon links to gun blogs.

    • Existing mags are “grandfathered” for one year, during which they must be destroyed or sold out of state. But you can only load seven rounds or you’ve committed a crime.

  16. We just need to make sure the stupidity of this move is kept front and center when this dumbass runs for potus. He will retreat to the center and claim he supports the 2nd amendment when he campaigns in iowa. Farmers need to know the truth.

    • We need to put front-and-center his prolonged inability to pass a bar exam, and the tragic results of his advocacy, during his HUD stint, for low-equity ‘alternative’ mortgages. His connections to Obama and Chicago are close. Valerie Jarrett was the Chicago Housing kingpin, got Michelle her first real job, then hooked up Obama with a good job. Valerie’s grandfather had the same role in Chicago Housing, and the infamous Robert Taylor projects are named after him. What a gang. And they were key HUD constituents.

  17. HURRAY the kids are saved. That was nip & tuck there for a moment. The kids were gonners with 10 round mags but now with 7 rounders, NY is now as safe as Mayberry. THIS AINT OVER! Randy

    • Until Ralph shows up I’ll offer this: The statute (I’ve just read the PDF) does not punish, restrict, or criminalize people for prior actions except in limited ways (felon restrictions, etc.) which seem reasonably tailored to the purposes of gun licensing, see Hawker v New York. The law does not make felons of people based on previous acts not tried before a judge. Penalties for possession of formerly-legal items will only be imposed for future possession, such as possessing a loaded up a ten-rounder, thus lacking retroactive attainder. There will be takings clause challenges and 2nd Am RKBA challenges, no doubt, amongst others.

  18. Quickly gun owners and anyone that values the Constitution! Get out now before the gate to Stalag 17…I mean New York closes!

  19. Not one old patriot with cancer willing to teach the governor a lesson? Geesh.

No whining…this is what’s called an intolerable act. Remember those from American History?

    • That’s what I keep thinking. There has to be at least one old WW2 vet out there willing to rid the world of one last Nazi.

    • I think there are some in the disarmament camp who are trying to push people to the point that such an incident happens so they can go for full confiscation.

      • People ,the overlords are praying to thier dark gods that some law abiding gun owner loses it and does something really stupid so they will have the final straw to outlaw everything with all the sheeple, I mean people, cheering wildly as their last freedoms are stripped from them.
        ,
The Hegelian dialectic-problem, reaction, solution; these people are evil, not stupid, they are masters at manipulating the herd.

  20. Cuomo has been waiting for this (the tragedy) for a loooong time. He was licking his lips when that happened. Now he has an excuse to *apparently* do what he wants without even a vote from the public. And now he gets to now be proud and stamp his name on that “law”. After all, that’s all most politicians want/care about anyway.

    • Proves he doesn’t give a rat’s ass about protecting children, cause if he did he would have tried to pass this earlier.

  21. Bet those gun ranges will be swamped with ban patrol just itching to make the headlines protecting the children. Wonder if the newspapers will print the names of those who now own illegal firearms and mags. Stay classy NY.

  22. Cuomo to NY gun owners:

“Grab your ankles and bite the pillow.”

Up next: mag cap limbo, how low can you go?

Seriously, though, I’m not looking forward to the Feds’ attempt at civilian disarmament. Never thought I’d be a single-issue voter, but I was dumb enough to believe that, after 2004, the gun-grabbers were willing to give it a rest.

  23. So every 10/22 or Marlin 60 mag is now illegal in NY?

Oh yeah. That is a great idea. Make everyone who owns the most popular gun in the USA off limits in a state full of hunters.

    Idiots…

  24. “The Webster provision, making the murder of a first responder a felony, punishable with life imprisonment”

Um, so it wasn’t a felony before????

  25. Surprised he didn’t put a ban on anyone purchasing/possessing more than TWO 7 round mags while he was at it.

7 round mag limit makes me want to throw up.

  26. Question: What if I have a Smith and Wesson M&P R8 revolver? Do my speed-loaders or moon clips count as “high capacity” magazines?

    • The law is ambiguous on that score, but it does appear to ban loading devices in excess of seven rounds, and includes stripper clips. So expect to see a lot of Garands on the market too….

      • There’s some exemption for guns & loading devices more than 50 years old. It’s clear as mud to read, but I think the intent was to exempt guns like the Garand. No body will know for sure until the lawsuits are settled years from now.

        • I’ll start the bidding at $300 for the gentlemans Garand from New York…. Going once…. Going twice… Sold to the sharp looking fellow from the free commonwealth of Pennsylvania

        • I’ll start the bidding at $300 for the gentlemans Garand from New York…. Going once…. Going twice… Sold to the sharp looking fellow from the free commonwealth of Pennsylvania.

        • Stupid double post, glad we can look at Facebook on . Gov AKA the Marriage destroyer but we can’t look at TTAG… Getting sick of mobile…

  27. Does this law now mean that in N.Y. pistols are an “assault weapon” because they have a detachable magazine and a pistol grip?

    • If only New York had a single cop half as moral as his character, unfortunately we’re stuck with a passel of fascist Annette Benings.

  28. I’d like to congratulate New Yorkers on electing an Assembly that has, faster and more completely than any other state, had the biggest emotion and non-rational reaction to a non-rational act. Simply brilliant.

It just goes to show that the only thing more dangerous to property, liberty and life than a white boy with a firearm (pretty much all MPS are white boys) is a bunch of white boys with pens.

Yankee expats who want to keep some semblance of freedom are welcome in Texas, just don’t vote Democrat when you get here or this will all happen again. For the rest of them, I’ll quote Sam Adams:

“We ask not your counsel nor your arms. Crouch down and lick the hand that feeds you. May your chains rest lightly upon you and may posterity forget that you were our countrymen.”

    • Well, you have to remember what the NY/CA qualification to hold office is.

Officeholders in these states have to be obsessed with women’s genitals and whatever women want to do with their genitals, on the public dime.

Everything else isn’t a requirement to hold office in these states.

  29. Sadly, you get the government you deserve.

You (in NY) elected those traitors. Now live with them, Democrat and Republican alike.

    • IIRC the Second Court of Appeals that covers NY handed Gura a loss on the concealed carry issue in NY. He’s the guy I’d want to litigate this but I don’t like his chances.

  30. ouch. sucks to be in ny. all the gun companies like kimber and remington should pull out of ny and move. hit them where it hurts : by losing jobs and losing money.

  31. It might also be important to note that it will be even more difficult to drive out of or into the New England states packing hardware without running afoul.

  32. I heard a speech like this once before, my grampa played it for me on a radio. I think it was from 1940s I could not understand much because it was in German

      • Too bad the Nazi’s couldn’t have extended their generous lightening of gun laws to the poles, slavs, jews and the rest. What was the penalty under those benign Nazi’s for having a gun when they occupied your territory? Death, is the rumor I heard.

        • The gun rights were extended to all German citizens. Have a source for that death rumor? It was also the US, specifically General Eisenhower who banned all guns in American controlled Germany.

        • And if your about death for owning guns is true, how did the Warsaw uprising in 1944 happen? Poland was invaded in 1939.

        • You can’t be serious matt? The germans demanded the surrender of all civilian owned firearms under penalty of death in all the occupied countries. I know how much you admire the Nazi’s, which is odd given your polish/slavic background, but you have the google fu skills. Look it up.

        • Warsaw uprising. Guns were aquired by theft from germans, smuggled in by allied agents for resistence groups. Some were also aquired thru contacts with the advancing Russian army and still others were manufactored in clandestine work shops. I will gaurantee that no jew in the Warsaw Ghetto was armed by the Nazi’s benevelent gun rights policies. But you already know all this matt.

        • Might be hard for you to understand this matt. But how do I provide links to a lifetime of reading books? How do I provide links to talking to survivors of the war in Europe? A Dutch housewife that was a grandmother and had come to the states after the war? An American soldier held as a pow by the Germans? A japenese family interned for the war because of their race? If all you have is wiki then you don’t have much.

        • Arizona Journal of International and Comparative Law Vol. 17, No. 3 2000

Carrying a firearm required a Waffenschein (license to carry a weapon)… It is noteworthy that, on the face of the law, Jews were not named as automatically disqualified. Gypsies were the only ethnic group which did not qualify. It could be that the Nazi leadership did not feel confident of the support of enough Germans to disarm Jews at this time. Many Jewish men had fought in the Great War and retained their side arms.

          https://docs.google.com/viewer?a=v&q=cache:Mq5wQIFJE2YJ:www.stephenhalbrook.com/article-nazilaw.pdf+jewish+gun+owners+in+poland&hl=en&gl=us&pid=bl&srcid=ADGEESi2syr2ThbYKTxk4CyyuAW6C-Ttp9UQB63Ed602thbfo646ZlFtivuQsPzqa39AnuuR-VkwcYb8yNUMr-MOzxHn_9ihzM6DlkpKzq-g9gYY9GRDc78GbrrZJNkWby4TCY6fRmK3&sig=AHIEtbRpr6tqUczzDckXUnmpK8M4RB1SyQ

        • Upon further reading, Jews were subsequently banned from owning weapons after one tried to assassinate the German ambassador to France. When Interior Minister Frick promulgated the Verordnung gegen der Waffenbesitz der Juden (Regulation Against Jews’ Possession of Weapons). Although this did not apply to foreign Jews who obtained permission from the Interior Minister.

I also found a source for your death penalty for occupied civilians owning weapons. Although it seemed to start in France in 1940.

        • In 1928 before the Nazis they relaxed the rules for gun ownership. Then it was in 1938 the act was passed and while they did allow ownership it was only to people they approved. So basically the population was disarmed.

  33. I have a truck, a trailer, and more ratchet straps than i can really justify. If anyone from Kimber is reading this, i’ll help you guys relocate to Virginia. All i ask is my choice of 1911.

  34. Hey NY folks: I just saw this on a gun-related FB page. I sent this guy an email. It sounds like they want folks to put their names to a class action lawsuit ASAP.

“NY lawyer filing class action-need petition signees asap Lawyer: Jim Tresmond, Attorney in Buffalo, New York. Phone: 716.202.4301

Successfully represented clients in the past on Second Amendment issues in NYS Supreme Court. This case is pro-bono for all the gun owners of New York.

According to Mr. Tresmond the new ban is illegal as it is an ex-facto law taking away previously owned property and he intends to file this action in Federal Court.

We are looking for as many as possible to add to CLASS ACTION CASE:

SEND Your Name and EMAIL ADDRESS, Physical Address and phone number to:

    [email protected]

WE ARE COLLECTING AS MANY AS POSSIBLE AS QUICKLY AS POSSIBLE!!!”

    • Hey, look, a ready-made list of people who own guns, complete with addresses! All you have to do is send your information to some random RoadRunner email address, that bears no visible resemblance to the name of the lawyer in question.

I’ll be sure to get right on that. I mean, it was on Facebook, so it has to be legit, right?

      • If you’re in Florida you shouldn’t get on that. And why don’t you cool it with the sarcasm. We’re all in this together and it doesn’t do anyone any good

        • I have to say I’m surprised by some of the attacks against this lawsuit made by people who have listened to the message that spread viral about the lawsuit. Sacco helped compile names, and people have posted in my behalf about this challenge to the law, although they wrote that it rests solely on a particular interpretation of ex post facto registration. This is simply in error. We are going to vigorously attack this law from many solid angles and we will be giving a presentation at SCOPE in Erie County this Thursday.

I am an attorney duly licensed to practice law in the State of New York. I don’t see how this could be labeled as a “scam”, my attorney registration number is public record for everyone to view.

I have extensive experience in criminal law. I have successfully defended the gun rights of my clients who had their firearms seized pursuant to arrest. I’m confidant that we are going to mount a very severe, forthright challenge to this law.

We have enough people who have signed on to challenge the law, as such we don’t need any further information from anyone. Hope this clears things up.

        • Thanks for doing this Jim. I think I was late in emailing you but like I said in the email if there’s anything I can do to help, I’d be happy to roll up my sleeves and jump in.

  35. So, what manufacturers are going to rush to make 7 round magazines for all types of pistols and rifles that are “New York Legal” to comply with this Law? Within a year? Why take the risk that the Law will be overturned and get stuck with a bunch of magazines no one would ever want?
What about conversion kits for tube fed rifles and shotguns? Lever action rifles?
What constitutes a satisfactory modification to a larger magazine to limit it to 7 rounds only?
What if you have your standard 7 round magazine in your 1911 with “one up the spout”? Are you a felon?
There are so many ambiguities in this one provision of this Law that it seems designed to trip-up anyone actually attempting to obey it in good faith.

    • call write your state elected daily, feed money to pro gun group of choice, dont vote for libbies in future elections

  36. “But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security.”

Will New Yorkers take this to heart and respond to this tyrant in a manner traitors deserve? Time will tell. I’m not optimistic, but I hope they prove me wrong.

There is no more honorable and righteous label to be owned in modern America than “enemy of the state.”

  37. On one point, the governor is absolutely accurate – when he says, “Unfortunately, common sense has eluded us for many, many years….”

  38. NY was always a gun hell state, this is just a natural progression.

While Cuomo rants like the madman about saving kids, most taxpayers are leaving and more minorities are moving there for the gracious welfare.

The Marxist model of NY is what Obama is trying to spread nationwide.

Maybe Yeager wont seem so incendiary when it sinks in just how serious these communists are in forcing their agenda.

    • I live in NY and it is gone just like CA the takers out number us makers and the liberal scumbags control it, so I am out of NY ASAP, with my business and $$$$ to Texas

  39. Yes indeed it is a sad day in New York to have this ban put into effect, As far as the gov i have one message for you (Screw You) it is time for new yorker to ban together and try to do something,to just sit back and take this beating and let them impose anything they want on us is the worse thing we can do, I for one will not take this lying down like a beat dog, instead of doing nothing ban together for what you believe in, what we need is for gun owners to stand up and fight, if we don!t i guess we deserve what we get, I!am not against laws that punish people for crimes, but i see nothing in this new ban to make there lives tough,The only people this affect is law abiding citizens, Wake up before it is to late next they will just come and take all of your guns is that what we should wait for?

    • A copy from wikipedia

      “Amendment may refer to:
A change made to a basic law or constitution
A change made to a pending motion or bill by a motion to amend
made to a previously adopted law or motion
A change made to a contract”

      Here is my points:
      1. Something that has been amended once is perfectly entitled to be amended twice (to any direction).
      2. Vote for the ones you really trust but, in any case VOTE (or you are not entitled ro speak).
      3. Accept the decision of majority (you probably will be on the majority side some time in the future.
      4. Slavery is on the credict cards’ microchip (ia a slave speaking)

  40. On one hand I feel bad for the people of New York. On the other hand, they chose this. They keep electing anti-guns to run their city and state. Oh well… enjoy.

I guess living in Illinois isn’t that bad anymore. 😉

  41. Born and raised in New York City. Loved the place. Not counting the deaths of Johnny, Joey and Dee Dee, I really believed the worst things to ever happen to my City were 9/11 followed by Emperor Bloomberg (the order could be reversed).

Seriously. The City that never sleeps is now the City that knows what’s good for you and by GOD, you will do as you are told! Or else!

and everyone there seems to be OK with that. Sad, very sad.

Now we have this subversion of the rights of the Citizens of New York, carried out by elected officials without comment or advice of the populace and in fact foisted upon them without a care in the world. there’s a word for that. Chutzpah. They do not care what the people think. They know what’s good for the people and they intend to ram their agenda down the throats of the populace, rule of law be damned.

I would like to start screaming VERY LOUD!!! but as I now reside (unfortunately) in the People’s Republic of Massachusetts with our very own (newly elected) fake Indian Senator, I would not like anyone to think that I was unhinged as new proposals being put forth by Cadillac Deval could deem me unfit for my CC permit.

    So I’ll just scream quietly.

In other news, I’ve noted in previous posts on this thread and in others that some peeps believe vendors should embargo supplies to LE agencies. Time for the tin foil hats gents. Does anyone remember agencies like the NWS et al buying HUGE amounts of ammo a few months back? Coincidence.

Yeah. Coincidence. Just training requirements. Nothing to be seen here folks, just move along.

Full disclosure: Long time lurker here. Now I opened my yap. Guess what? I may just do it again. Beats freaking out the neighbors when I want to scream after midnight.

    Keep the Faith

    Wilbur

    • You accidentally called the people of New York “citizens.” I think the word you’re looking for is “subjects.”

      “Slaves” is also acceptable.

      • whoops, ya got me there. Subjects would be the correct term. Do you know, I have talked to family still stuck there and they used that very same term themselves, jokingly.

The jokes on them. Man, this whole thing sux…..

        Wilbur

  42. I donated money today to the SAF, GOA, and the NRA. The fight is just starting, and I dont see an end in sight. To paraphrase a youtube-er that I watch, we can learn a lesson from our enemies: be determined to win at any cost.

  43. From what I’ve seen it is possible for a part of a state to secede from the rest. West New York has a nice ring to it.

  44. Well, I’m not an American and I don’t live there, but watching all this made me decide to actually donate some money to the pro-gun cause in the USA.

A european helping you retain your gun rights – that would be almost funny, if we ignored the reasons for it. After all, I guess I can live with possibly ending up on a no-fly, not-welcome lists for now….

  45. Someone mentioned “ex post facto” law above – yes they can. Just look back at the Lautenburg Amendment regarding domestic violence. They past the law and “poof” overnight anyone that had “ever” been guilty of domestic violence in the past could no longer own a gun.

I would recommend the “tomahawk” as the weapon of choice once they legislate our guns away. The tomahawk is a great fighting weapon……………..

  46. Just to be clear, you should be proud to be a single issue voter. The 1st and 2nd amendments are the only thing that make this nation freer than most. And really most other places have the 1st, it’s just not as protected when it comes to political speech. Places like Russia, China, and Singapore have much more economic freedom, for example. All nations have more “food freedom”. Here we swat team raw milk farmers. In Italy, they have raw milk vending machines. It goes on and on. I believe that one day, you may have to use your military pattern firearms in this country to defend yourself when this top down police state collapses or becomes intolerable.

  47. I must have missed the part of the Bill of Rights where is said something about “Sporting purposes,” “Skeet shooting,” or “hunting.”
I am pretty sure that it was about forcing out elected officials when they overstep their Constitution bounds. Forcing them out, arresting them or shooting them if need be.
What part of “Shall not be infringed” don’t they get? Maybe the people of New York will grow some balls and do something about it.. Wait, that’s doubtful.

  48. So a lot of New Yorkers are criminals since yesterday? I don’t think so!

“An ex post facto law (from the Latin for “from after the action” or “after the fact”), also called a retroactive law, is a law that retroactively changes the legal consequences (or status) of actions that were committed, or relationships that existed, before the enactment of the law. In criminal law, it may criminalize actions that were legal when committed………. Ex post facto laws are expressly forbidden by the United States Constitution in Article 1, Section 9, Clause 3.”

  49. But….but…how can this be? We were “winning” just a month ago.

“We” were never “winning”. Nice job lulling yourselves into a false sense of security. As long as there are people who can’t understand the 2A, you are losing. If you’re not out there guarding your freedoms with your weapons, you’ve resigned. Everyone has an agenda. Don’t blame the polititions. The only one to blame is yourself. You are America. You are losing. The people YOU VOTED FOR are winning. You cannot vote yourself to freedom. Free men don’t ask permission to exersize their rights.

It’s not worth being alive if you can’t be free. The polititions are not going to defend the Constitution for you. That’s your job. It’s okay. Grab your gun and your 10 round mag. Use them. It’s okay. That’s the only way to win.

  50. Did read this right? s1422-213 section 265.02.

Such a person commites the crime of criminal possession of a weapon in the 4th as definded in subdivision 1,2,5 and 5 says=

    (5)posses three or more firearms.

then it goes on to say in 265.04 that it is a criminal possesion of the first degree if you if you posses 10 or more

  51. All the people wondering how to stop this the answer is easy stop voting for the politician!!! People that have been in office there whole lives. Execute Ur own term limits vote for the local person that best meets your ideas n not for the incumbent We r our own worse enemies!!!!!!!!.

  52. how to stop this the answer is easy stop voting for the politician!!! People that have been in office there whole lives. Execute Ur own term limits vote for the local person that best meets your ideas n not for the incumbent We r our own worse enemies!!!!!!!!.

  53. Is it just me or is this typical gun grabber hypocrisy? You can’t have the magazines here but you can sell them out of state. You can’t have them here but we will allow the manufacture of them here as long as they are sold in other states. If they are truly evil why are we exporting them to other states?

    Just saying.

    • 1 million abortions 950,000 malpractice suits 11,000 DUI deaths just this yr. 6000 soldiers losing thier lives overseas yes it is hypocrisy

  54. File a court injunction to nullify the unconstitutional law! Get with the program, they use laws against you so use the law against them. No injunction = no 2nd Amendment
The beginning of restriction, then make it required to keep them at a range or armory and the when they have them all change the law and lock them up for good as it suits those that are beginning to have armed drones that will likely do the same in NY and California as they now do overseas, so when a suspect is at a funeral or marriage ceremony they might all be blown to bits and it will legally be Waco collateral damage. Foreigners and infil-traitors stole all the countries money and the country is on the verge of bankrupsy, when the fall or super inflation comes and they carry out the plotted radical changes the thieves and traitors do not want the American people armed asking where are those sleazy bank robbers who by screwing up the economy are causing abortions due to poverty and starving the people’s little children and babies through plotted devolution of America. Hell comes unless you drop the football and pick up the law books now. P.S. being screwed slowly often passes for something that cannot be avoided, form legal circles and follow up with an attorney advisement on actions to take, never assume someone else will do the job.

  55. Section 38 of the new bill clearly states that possessed 10 round magazines are “grandfathered in” but can only be loaded with 7 rounds. “Grandfather in” means long term not one year, i.e. January 2014! So to me that means we can keep existing 10 round mags. The bill section 38 clearly states this.

  56. If you are caught, you become a felon and will have to surrender your fire arm is where this is all going, so when Obama said he believed in the 2nd Amendment, BS, his belief is with loopholes in place for gov control, STOP THE MADNESS, DONATE TO SAF!

  57. Hello, I am new to this blog, also a new gun licensee in NYC, and a born lifelong [66] years resident of this city.
I recently bought a new Mossberg 500 12 gauge shotgun, and have applied for a handgun permit also, however what has become of Article 2, section 4 of New York civil rights law, where it explicitly states:
A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms CANNOT be infringed, seems to me this is a clear statement that it is even more strigent then the US 2nd amendent.
