REGARDING THE OFFICIAL POSITION OF ALLSTAR TACTICAL ON THE NY SAFE ACT / SIMILAR LEGISLATION

Allstar Tactical strongly believes in our liberties and Constitutional rights as United States Citizens. Specifically, we fully support the second amendment to the United States Constitution, our right to Keep and Bear Arms. We vehemently oppose any attempt to illegally disarm law-abiding American citizens. Due to the infringement of our second amendment rights through pending and passed illegal legislation regarding our right to Keep and Bear Arms, Allstar Tactical has been forced to review its policies and procedures for providing any products to state and local government agencies . . .

Our headquarters is based in the state of New York less than 1000 feet from the West Webster Fire Department. On December 24th, 2012, we were deeply saddened, as was the rest of our community, to hear of the tragic events that took place right in our own backyard.

Despite the fact that the mentally-unstable criminal who committed the criminal act was a known felon, Governor Andrew Cuomo used the deaths of our brave first responders to push through his gun control agenda, without proper discussion, effectively stripping inalienable rights from the citizens of New York State.

This was especially painful for us, since many of our our brothers in the West Wester Fire Department, including those who lost their lives that day, were friends and supporters of our company, as well as loyal customers, and our cause.

The heinous NY SAFE act effectively prevents us from selling complete rifles to New York Sate citizens. This is appalling as I personally grew up in a suburb of Rochester, attended undergraduate and graduate school in Troy, NY, and chose to locate my family and businesses in a suburb of Rochester.

We are tax-paying citizens and deserve the right to free-enterprise and the right to protect ourselves. Our own elected state officials have passed this illegal law which infringes on our inherent and historic rights, and is causing the state and local law enforcement agencies to enforce unconstitutional legislation.

That said, we absolutely applaud and support the Sheriffs and law enforcement agencies who have stepped up and are fighting with us against the legislation.

There is a strong need for all of us to stand together in unwavering support of the 2nd Amendment and our right to keep and bear arms.

As such, we are joining the rest of the firearms community in doing what we can to conscientiously object to the laws and legislation being passed. Those who cannot remember the past are condemned to repeat it. Historically, the disarmament of the populous is the first step toward the establishment of a tyrannical government.

The passage of this legislation absolutely violates the Constitution of the United States, and ignores many of the Supreme Court rulings.

Due to the current legislation in New York and any states that pass similar legislation, effective March 1st 2013, Allstar Tactical will apply all current state and local legislation applicable to civilians, to all government agencies, including but not limited to, local and state law enforcement, first responders, sheriff departments, and federal agencies.

In addition, we are suspending all LE/MIL discounts on our products in those states in which our second amendment rights are being infringed upon. Discounts for personal use by LE/MIL will be evaluated on a case-by-case basis.

Lastly, we will absolutely continue to sell our stripped lower receivers in those markets where so-called “assault rifles” are now banned.

Allstar Tactical prides itself on innovation and we are working feverishly to come up with new products that will allow you to enjoy the shooting sports in a banned state and comply with these unconstitutional laws until they are changed. We cannot in good conscience remain quiet while our elected officials attempt to strip our rights away. This will remain in effect until all such legislation is repealed.

Furthermore, under these conditions, as a NY-based firearms manufacturer, tax-payer, employer, and resident, we are also looking into the possibility of relocating our headquarters and manufacturing facilities to a more second-amendment-friendly state in the Union.

This decision will not come easy for us, but, in the meantime, we will fight with our brothers and sisters in New York for as long as we can. To this end, we will be opening a new manufacturing facility to increase our production capacity, and provide additional jobs for NY residents.

  1. How are these A-holes (the politicos, not the companies) not seriously reconsidering their actions yet? Wasn’t just about all the hubbub during the election focused on jobs and getting Americans working? They harped on that til they were blue in the face. I would feel like the biggest douche in the world if I had spent months preaching about the importance of jobs, and then let employers waltz out of the state. I suppose their collective conscience wasn’t elected with them. These people make and sell tools. Would there be the same indifference if a hardware or auto manufacturer was about to pull up stakes? Nah…

The government of the United States nor the government of New York or any other state in the Union has not passed any law, regulation or even suggested the removal of all guns from the homes of anyone. This is NRA bullshit. What the governments are attempting to do is limit the kinds of guns SOLD in this country, that includes military type assault rifles and pistols, high capacity magazines and armor piercing bullets. No one has suggested taking anyone’s guns from them. What WE, who have been in war and understand what weaponry like this can do to the human body, want is for gun owners to put trigger locks on their loaded weapons so their 4 year old son doesn’t blow his brains out while playing with your pistol. We want your guns locked away so your 17 year old mentally deranged youth doesn’t get hold of it and kill 20 kindergartners and 7 adults. I know this will dip into your profit margin a little because since the murders gun sales have skyrocketed in anticipation of a law that won’t happen. But let’s look at reality. The second amendment isn’t under attack. America is.

      Once again you are blaming law abiding gun owners for what murderers have done.

    • The hyperbole of your statement is so extensive it would be too difficult to address it all so let me pick two items of interest from your statement. First you reference high capacity magazines well what is a high capacity magazine? In this context the word “high” would mean a larger than standard number. Yet, we look at what modern semi-automatic rifles are equipped with at sale and see 30-round magazines. In fact a quick review of firearms dealers websites you must select an alternative option for lower capacity magazines. The same holds true for modern double stack pistol magazines which, again, as a default come in the 12-17 round capacity depending on the caliber and size of pistol frame in question. These things come as the standard, the normal, the everyday accessories for modern firearms. Accordingly, no you are not trying to ban “high” capacity magazines but are instead trying to ban the normal capacity magazines.

      You have also mentioned wanting to ban armor piercing ammo. What kind of armor are you speaking of? If your goal is to eliminate anything that will penetrate NIJ Level IV body armor (Level III Soft Armor plus trauma plates) then you have missed the mark. Magnum caliber rifle rounds and indeed most larger hunting calibers (which go completely unaddressed my the SAFE Act) are going to penetrate that level of armor. This of course is also irrelevant since this armor is so rarely seen in daily life and I doubt you intend to equip ever man, woman, child and LEO with such armor let alone mandate its daily wear.

      Perhaps though you were speaking of NIJ Level III which is vulnerable to those larger rounds mentioned and at closer ranges is in danger of penetration from higher caliber magnum handguns. Which by the way go completely unaddressed by the NY SAFE Act.

      Or did you mean NIJ Level II which will protect you from smaller caliber handguns? Which by the way go unaddressed by the NY SAFE Act. You see if you were really interested in dealing with “armor piercing” ammo you would know that this becomes a questions of size and velocity of the round coupled with the material properties of its construction and not whether it was fired from a scary looking rifle with a pistol grip.

      Crafting legislation to deal with that though would require understanding chemistry, physics, and some higher level math. It would also lead to the understanding that this “problem” can’t be addressed from a material solution and might require some social changes away from cultures of violence. Much easier to ban normal products and use incendiary language.

      We saw bills which were submitted in Illinois, Washington State, California, etc etc which are going after all sorts of things. Illinois would have essentially banned all modern firearms. It was shot down for now.
      The New York Safe act is a joke. It outlaws all modern firearms. Not directly but in case you hadn’t looked no one makes a 7 round magazine. This makes all the magazines used in normal capacity illegal. Even the CA compliant 10 round magazines are a no go. How is that not going after your guns?

      Armor piercing bullets? Please define to me what that means please? I am not ridiculing you, but I want to understand what your definition is. The fact is a 30-06 standard bullet in a bolt action rifle will probably go through most light weight body armor that law enforcement wares. It is a standard bullet, nothing fancy. So please let me know what you are referring too. Special compound armor piercing bullets for pistols have been outlawed to the public for years.

      Modern sporting rifles are the most popular rifle in the US today. In fact it is used heavily in competition shoots, it is used for hunting, and home defense.

      Many gun manufacturers sell their guns with locks. California has a safe storage rule, but that doesn’t seem to make it safer.

      We have not seen the official report on Newtown so I will not respond to your accusation that Mrs. Lanza did not store her firearms properly. I will be the first one to point out the error if she had them laying around with easy access.

      I know you think we are about profits, or some thing like that. It is easy to think that this is about money, you know dehumanize us. First off TTAG and it’s writers are not paid. I would love to be, but I am not. Second we do not get funding from anyone who chooses not to advertise with us. For the most part, this is a grass root, volunteer blog. The biggest on the planet I may add. 🙂
      Profits in gun sales is slim. I know it requires you to talk with manufacturers and resellers, but go and ask sometime. It might be worth the education.

    • David, I don’t agree with your statements, and I’m not going to try to convince you to change your views. Anyway, TTAG can often become an echo chamber regarding gun rights. And sometimes it’s good to have a healthy debate with someone who has the opposite viewpoint. But using loaded language in pejorative statements that insult others will not get people to agree with you.

  3. Also a point of interest. This company is located in Webster NY (my hometown) and also the location of the holiday shooting that killed 2 firefighters (i was 2 miles away when it happened). I love Webster and my parents still live there…. just too bad its located in NY. Good for Allstar!

  6. In many of the comments I have seen in articles like this there are many parallels being drawn to the Revolution. As I have thought this over I think that this boycott is perhaps our modern Declaration of Rights and Grievances (1). An economic and political protest against unfair regulation and restriction of trade (to say nothing of other fundamental rights).

    If this is our Declaration though and we see some relief from these rules and restrictions I am then left to wonder will we be able to avoid other historical parallels. Will we have a destructive protest akin to the Boston Tea Party, flash points like the Boston Massacre or conflagrations like Lexington and Concord?

    Just some historical musings before I head off to teach a class on law and order…
