When you think of heavily gun controlled states, names like New York, California and New Jersey immediately come to mind. But don’t sleep on Maryland. The Eat Crab or Die State has long been at the forefront of Second Amendment rights abrogation and a new bill entered in the state’s House would move the Old Line State way up on the #gunsense hit parade.

HB 1261, authored by House Speaker Adrienne Jones along with Reps. Vanessa Atterbeary and Eric Luedke, was introduced Friday and would ban a range of firearms after October 1. It would also require those already owning assaulty-looking guns to register them.

But what makes the bill fairly unique is the escalating cost of registering “assault guns or copycat weapons” that kicks in after the bill’s deadline.

Registering with the Department of State Police before January 1, 2021 costs Marylanders nothing. But then complying with the law would require emptying your wallet.

Here’s the bill’s escalating penalty fee schedule:

1. ON OR AFTER JANUARY 1, 2021, AND BEFORE MAY 1, 2021, A REGISTRATION FEE NOT EXCEEDING $290 PER FIREARM;

2. ON OR AFTER MAY 1, 2021, AND BEFORE NOVEMBER 1, 2022, A REGISTRATION FEE NOT EXCEEDING $580 PER FIREARM; AND

3. ON OR AFTER NOVEMBER 1, 2022, AND BEFORE MAY 1, 2023, A REGISTRATION FEE NOT EXCEEDING $1,000 PER FIREARM.

What happens if you fail to register your gun at all before May 1, 2023? Prosecution, of course!

A PERSON WHO LAWFULLY POSSESSED AN ASSAULT LONG GUN OR A COPYCAT WEAPON BEFORE OCTOBER 1, 2020, AND WHO REGISTERS THE ASSAULT LONG GUN OR COPYCAT WEAPON ON OR AFTER JANUARY 1, 2021, AND BEFORE MAY 1, 2023, ONLY AFTER BEING DISCOVERED IN POSSESSION OF THE ASSAULT LONG GUN OR COPYCAT WEAPON BY A LAW ENFORCEMENT OFFICER, IS NOT SUBJECT TO THE PENALTIES IN § 4–306 OF THIS SUBTITLE.

A PERSON DESCRIBED IN SUBPARAGRAPH 1 OF THIS SUBPARAGRAPH IS GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO IMPRISONMENT NOT EXCEEDING 1 YEAR FOR EACH INCIDENT IN WHICH THE PERSON IS DISCOVERED WITH UNREGISTERED FIREARMS.

“Assault long guns” has already been defined in Maryland law here. HB 1261 lists a range of “assault pistols” that would be banned, guns like the TEC-9, the Czech Skorpion, Uzis and the like.

Oh, and “copycat weapons” under the bill means any gun that has one of those really disturbing features like thumbhole stocks, forward grips, barrel shrouds, yadda, yadda, and:

THE ABILITY TO DISCHARGE THROUGH FIRING ACTION ANY OF THE FOLLOWING ROUNDS:

A. .450 BUSHMASTER;

B. 5.56 MILLIMETER (INCLUDING THE 5.56X45 11 MILLIMETER NATO AND .223 REMINGTON);

C. 7.62 MILLIMETER (INCLUDING THE 7.62X39 13 MILLIMETER, .308 WINCHESTER, 7.62 NATO, 7.62X51 MILLIMETER NATO, .30 14 CARBINE, 7.62X33 MILLIMETER, OR 300 AAC BLACKOUT);

D. .50 BMG;

E. 5.7X28 MILLIMETER OR

F. ANY OTHER ROUND DETERMINED BY THE DEPARTMENT OF STATE POLICE TO BE CAPABLE OF PENETRATING THE STANDARD BODY ARMOR WORN BY LAW ENFORCEMENT OFFICERS WHEN FIRED BY THE PISTOL;

No ambiguity there, huh?

Will Maryland’s Governor Larry Hogan sign such a bill if it gets to his desk? Don’t bet against it.

  1. Yeah, I’m sure owners of such weapons would be lined up and eager to fork over their money in exchange for…less privacy at best? This law seems designed to foster non-compliance.

        Unconstitutional on that alone , like a poll tax to keep poor blacks from voting . I bet even the American civil liberties union and the naacp would jump on this if a few poor and minority Gun Owners complain enough.

    • They all are it’s more of a question of how many people will report those that own anyway. NY/NJ/CT honestly suprised me with not only how many never registered but how few report their neighbors. But longer term Bob has the right of it in making more criminals that they can manipulate.

    • Registration rates have already been low in states without exorbitant fees. This will depress those rates even further!

    • All of these kinds of measures are complete violations of the 2nd Amendment which insures the existence of an armed citizenry that is capable of resisting governmental tyranny. That’s a pretty significant stumbling block. At some point, sooner rather than later, we’ll have to have a supreme court decision about this. The court will either declare gun-control laws to be unconstitutional—which should happen if the 2nd is truly honored—or it will effectively invalidate the 2nd and, in so doing, invalidate the entire Bill Of Rights. Simply put, insuring that you have a citizenry that has free access to weapons like the AR and AK platform guns is essential to the preservation of liberty and freedom. Or at least it is essential to an originalist reading of the 2nd Amendment. How can you have an armed citizenry if the state can use its power to make obtaining weaponry virtually impossible? The simple answer is: you can’t.

      • Our forefathers made their own guns and bullets. Guess if they eliminate our way of purchasing guns and especially ammo we’ll have to eventually go back to doing that. Only way to keep the tyrranical government at bay. Registration isn’t constitutional, and certainly high taxes on doing so is not constitutional either. Arresting those who have guns is illegal too. Gonna let them take over Maryland residents? I sure hope not!

    • And I thought NSW’s $30 permit to acquire (and transfer tax) was ridiculous. And the assault weapon calibers rules out anything higher than a rimfire cartridge.

      Time to get the Fudds to realize their sacrosanct 270 is now an assault weapon because it can penetrate police body armor.

    • The reason for registration is what? For the money or for confiscation. The number of murders in Baltimore by these weapons is astronomical and has to end. Is ownership of these weapons a threat to the populace or to the government? Do the Democrats really want to disarm their people as it seems they are ready to withdraw from the Union as they did before. They’re going to need an armed populace to do it, just as before or the Union is going to kick the shit out of them, just as before.

    • The doic says we have the right to bear arms. Didn’t say they can’t tax the shit out of it. Poll taxes are a good example of a right being taxed but if you can own A GUN tax free then the argument could be made you still have that right.

      The voting public is supposed to rein this in but it won’t happen. This hits the OFWG gun owners financially and that plays well with this crowd. In the end the registration scheme is a precursor to confiscation of course and the registration fees will pay for the overtime.

    • Stupid is as stupid does. I live in a very liberal state. I’ve known many people who have since moved to Arizona, North Carolina, Florida, Alabama, et al — most to escape some aspect of said liberal state, mostly to escape the cost of living and taxes. I don’t know that any of them have changed their voting habits in their new states.

      I have friends who vote democrat (granted the republicans aren’t much better on the 2A) who sputter in disbelieve at the tortuous nature of US gun laws when I explain it to them. They agree that much of it is absurd. They agree that shooting is fun and safe when done properly (the ones that I bring to the range) and generally agree that the legal restrictions we operate under should be relaxed to at least some degree. Then they go and vote democrat, because they want their student loan forgiven, because their mother drummed into their head that abortion is sacrosanct and every time you forget to vote (D) a woman dies in a back alley, because they have some vague sense that they like Bernie Sanders.

    • I live in MD. At one time I considered moving if the state tried to enact any more gun control laws. (They implemented new laws in October 2013 which banned a lot of firearms. However since the authors of these bills don’t have a clue what they’re talking about, the effects have been mostly avoidable.) The most logical state for me to move to was Virginia. I think we all know how that has recently turned. So I no longer believe that moving is the best option. I will stay & fight, both figuratively & literally.

    • Realistically the compliance is a generation or two away as they try to replace Americans with “New Yorkers”. It will be interesting to see how well they can keep anyone not tied to the state in the state with their current intended path.

    That could be 9mm. So having a scary looking unregistered 9mm would make you a criminal.

    • 9mm won’t penetrate LE body armor. 10mm, maybe. More likely, some of the Magnum revolver rounds will, such as .500 S&W Magnum, .460 S&W Magnum, .454 Casull, .44 Magnum, .357 Magnum, .41 Magnum, or .327 Magnum.
      Does Maryland’s”assaulty-looking handgun” ban on also apply to revolvers, or only scary-looking “fully-semiautomatic” pistols?

      The Desert Eagle can fire .44 Magnum, .357 Magnum, .50 AE, and some other powerful rounds that aren’t on their list.

  9. This law looks like it was written by a 2nd grader! In some states, a 3rd grader would already know the difference between a .223 and a .308. My bolt deer rifle is a .308… with a scope …and a synthetic stock (an assault rifle? banned?). If I bought a $250 wood stock, would it magically become a harmless deer rifle? It makes a little hole going in and a big hole coming out the other side…of a deer. I’ve never considered shooting a human but, I can’t imagine it would do them any good.
    They’re too stupid to run drafts of a proposed law past someone who knows what the hell they’re talking about? I’ve been developing medical software for nearly 40 years… from a systems perspective, this looks like it was designed by a temp …who didn’t finish 8th grade.
    The average IQ is 100. While this is not considered exceptionally bright, it seems like the entire bottom half of the bell curve is hopelessly attracted to the Democratic party.

  10. Like most civilian disarmament laws, this law will be unenforceable because it requires that a person incriminate themselves which the Fifth Amendment of the United States Constitution expressly forbids.

    While a state could claim that possession of a certain type of firearm is illegal (which is totally unconstitutional but that is a discussion for a different time), a state cannot claim that failing to incriminate yourself (reporting that you own a “controlled” firearm after it is no longer legal to report that you own said firearm) is illegal.

  11. Since we had to obtain the infamous “Not Disapproved” stamp from MSP when the firearm was purchased n years ago, I’m guessing they’re already registered.

    A bare AR 15 lower (not an AR10) required that wonderful “not disapproved” stamp from MSP. Since an AR lower can be mated to a number of different uppers of differing calibers, does an “unassembled lower” have to be registered? As what, exactly? An assault lower?

    Oh, and 80%? I guess only if you’re caught with one?

    Like “Virginia is for Lovers”, Maryland in the late 70s-early 80s also was pushing a state slogan. “Maryland. Oh, what a State I’m In!”

  12. Hmmmm…if they know where to issue the fine doesn’t that also mean they know where the gun is registered?? I get that secondary sales happen, but this should not apply to primary sales where the firearm has ALREADY been registered at time of purchase! Total garbage this bill is!

Seems these single digit IQ bill writers added some extra numbers in there…. so would that theoretically negate those specific phrases then? Since the wording is very explicit and as far as I’m aware there are no calibers with the designation of 5.56×45 11mm or 7.62×39 13mm

  27. When I bought my lower for my AR I had to register it. So now I have to register it a second time? Or is it that they are trying to add a price tag to future purchases on top of the price for the firearm? At which point how does this effect owners of fully automatic weapons that have the credentials to own them which if I’m remembering correctly is roughly one thousand dollars each year per firearm? Additionally how does this effect places that sell firearms and thier FFLs? I feel these are all questions that aren’t being answered and left with this minimal information provided so far that over all access to legal firearms will drop drastically. If that happens wouldn’t that be in direct conflict with our second amendment?

  30. Folks are missing a key point by concentrating on the draconian registration fees. This Bill can be interpreted to ban a host of semi-automatic firearms, especially when it refers to semiautomatic pistols which have the capacity of accepting a magazine outside the grip. The guns to which the fees apply are BANNED. You can keep them if duly registered, but cannot sell or transfer them in Maryland, or purchase them for that matter.

  34. Blatantly unconstitutional. Registration allows authorities to have a database of all holders putting them at risk from the privacy granted to all. It directs to a whole range of legal guns as a class which has a low rate of being used in murders (less than 3%). It burdens the poor who can ill afford to use their 2nd Amendment rights. Attacks the 2nd Amendment rights of possess and carry which excludes no weapons. Further burdens sports shooters and hunters. This is nothing but the start of all registration and eventual confiscation as we saw in Germany, Russia, and China.

(just like here in COMMUNIST-RUN N.Y.) with “emperor” cuomo that has openly opined he intends to ignore the U.S Constitution, Bill of Rights, the POTUS, his SWORN oath of office, and install “HIS OWN progressive” (communist) government in N.Y. to make N.Y. the most “progressive” state in the union. It is like a “completion” between democommunists to see who can turn their states into communist-controlled SH**holes the fastest.

    • I have two meetings next week in Annapolis with my district Delegates. Enough is enough. Read the bill…banning 308? Banning a threaded barrel? Forcing me to register and at the same time charging me $280 per firearm that “violates” their tyranny? Not on my watch!

  37. I grew up in the State of Maryland with weapons in our home, I was instructed on how to use a gun correctly, when and only when to get one from the closet. My Grandfather was a hunter and hunted most of the States, If my Father didn’t correct me about the use of a gun than my Grandfather would. I only broke the rules once showing a weapon to another child. The penalty was NO TV for a month, NO Bicycle for a month, NO going to the movies on Saturday afternoon and NO allowance for a month. I remember after Seventy years. The parents of some of these children that have caused these problems across the Country should have tried teaching their children RESPONSIBILITY they don’t have the right to harm anyone else.

    • Just crunched some numbers from the FBI database…between 2015 and 2018, 61 murders occurred in MD using hands, fists, or feet. During the same timeframe, a total of 30 murders were committed using a rifle or shotgun, while 1,259 murders occurred with the use of a handgun, of which 80% were criminal on criminal activity with 95% of those handguns either stolen OR procured internationally as a result of the drug trade. These politicians better wake up!

  40. I thought our elected officials were supposed to represent the people, not push their agenda. This is just another example of #1 how the values and principles of Marylanders are moving to the extreme left and #2 reality, statistics and the wants of the citizenry are being ignored. If they get this signed into law, I will move my residence to another state within 30 days of the signing. Governor Hogan, if it get to you, Please VETO.

  41. The Constitution was enacted to protect the citizens from the government. When written, the 2nd Amendment applied to the most advanced and sophisticated military weapons of the time. While it may be true that the Framers might not have anticipated the weapons of our time, neither did they anticipate radio, television and the internet, yet these are solidly protected by the 1st Amendment.

  44. This “bill” is “an infringement of the 2nd Amendment to the Constitution of the United States of America. If passedALL American citizens have a duty to strike it down and anyone who interferes is an enemy of the people and has no right to live.

  45. Hogan— major disappointment. He should change his party affiliation to Democrat. Wish I would not of voted for him and never will again. The left will continue to chip away at the 2A. We need to get the majority in the courts and file lawsuits to overturn these infringements on out rights.
