A 17-year-old accused of killing two protesters days after Jacob Blake was shot by police in Kenosha, Wisconsin, remains in custody in his home state of Illinois as his attorneys fight efforts to send him to Wisconsin to stand trial on homicide charges.

Kyle Rittenhouse appeared on a video stream and wore a face mask during a brief court hearing Friday morning in Lake County, Illinois. Judge Paul Novak scheduled an Oct. 30 hearing on the extradition request, though prosecutors told Novak they were prepared to move faster.

“The law is pretty clear cut on this,” Lake County Assistant State’s Attorney Stephen Scheller said. “This case has been dragging on now, we’re already into October. … We want a hearing as soon as possible.”

John Pierce, an attorney for Rittenhouse, said there was “no reason to rush” and questioned Wisconsin prosecutors’ motivation for pursuing the charges.

“This is a very unique, extraordinary situation,” Pierce said. “There is a massive amount of video evidence that shows beyond a shadow of a doubt this is not a legitimate criminal prosecution, it is a political prosecution.”

In court records filed late Thursday, Rittenhouse’s attorneys argued that he was acting in self-defense and extraditing him to Wisconsin authorities would violate his constitutional rights.

They also argued that Wisconsin prosecutors and Illinois authorities didn’t follow legal technicalities required for extradition. Angelina Gabriele, Kenosha County’s deputy district attorney, said Friday the county’s documents “are in compliance with all legal requirements and their other claims do not have any legal merit.”

Extradition is typically a straightforward process, and legal experts have expressed doubt that Rittenhouse’s attorneys could successfully prevent a court from sending him to Wisconsin to face charges there.

His arrest has become a rallying point for some on the right, with a legal defense fund that has attracted millions in donations. But others see Rittenhouse as a domestic terrorist whose presence with a rifle incited the protesters.

The document echoes attorneys’ previous portrayal of Rittenhouse as a courageous patriot who was exercising his right to bear arms during unrest over the shooting of Blake, who is black.

Extraditing Rittenhouse, they claim, “would be to turn him over to the mob.”

“The premature and unsupported charges are contributing to unwarranted public condemnation,” attorneys wrote. “Rittenhouse has been publicly branded a ‘mass murderer,’ a ‘terrorist,’ a ‘racist,’ and more.”

Rittenhouse surrendered to police in his hometown of Antioch, Illinois, a day after prosecutors say he shot and killed two protesters and injured a third during unrest on the streets of Kenosha on Aug. 25 over Blake’s shooting.

Rittenhouse, who is white, is charged with first-degree intentional homicide in the killing of two white protesters and attempted intentional homicide in the wounding of a third. He also faces a misdemeanor charge of underage firearm possession for wielding a semi-automatic rifle.

Like Rittenhouse, the two men killed and the third man wounded were or are white. If convicted of first-degree homicide, Rittenhouse would be sentenced to life in prison.

Legal experts had questioned what basis Rittenhouse’s attorneys could use to fight his extradition, which is usually an uncontested step. Mike Nerheim, the Lake County state’s attorney, has said that Illinois Gov. J.B. Pritzker signed a warrant to return Rittenhouse to Wisconsin after a request from Wisconsin Gov. Tony Evers, a fellow Democrat.

The killings happened amid protests on Kenosha’s streets two days after a white police officer shot Blake seven times in the back, leaving him paralyzed from the waist down and sparking outrage after video of the shooting was posted online. A Wisconsin Department of Justice investigation into that shooting is ongoing. The three responding officers are on administrative leave.

According to prosecutors and court documents, Rittenhouse shot and killed 36-year-old Joseph Rosenbaum, of Kenosha, after Rosenbaum threw a plastic bag at Rittenhouse, missing him, and tried to wrestle his rifle away.

While trying to get away in the immediate aftermath, Rittenhouse was captured on cellphone video saying “I just killed somebody.” According to the complaint filed by prosecutors, someone in the crowd said, “Beat him up!” and another yelled, “Get him! Get that dude!”

Video shows that Rittenhouse tripped in the street. As he was on the ground, 26-year-old Anthony Huber, of Silver Lake, hit him with a skateboard and tried to take his rifle away. Rittenhouse opened fire, killing Huber and wounding Gaige Grosskreutz, of West Allis, who was holding a handgun.

Rittenhouse’s extradition would not be an issue if he had been arrested in Kenosha the night of the shootings. Cellphone video that captured some of the action shows that right after the shootings, Rittenhouse walked slowly toward a police vehicle with his hands up, only to be waved through by police.

He returned to his Illinois home and turned himself in soon after. Police later blamed the chaotic conditions for why they didn’t arrest Rittenhouse at the scene.

  1. The kid was justified in defending himself. Remember these cases are decided on a moment by moment analysis, unless it is a police shooting in which case the effort is first to clear the officer.

    So yes, he’s innocent of murder.

    Beyond that he is a stupid child who had no business playing militia, by himself with no training or support of others, in the chaotic streets. He is too damned stupid to own or carry firearms. Perhaps another eight years of growing up would help.

Yes, he used his weapon to defend himself but unlike so many people much older then his 17 years, he didn’t panic, didn’t start spraying the attacking mob with 5.56 rounds from his 30 round magazine. Instead, lying on his back, being approached by multiple assailants, he kept control of his weapon, exercised responsible trigger-control firing only at people who directly attacked him, then attempted to surrender to the police.
      I think he displayed a kind of emotional maturity his attackers surely lacked. There aren’t many people twice his age that could have done what he did.

The only reason he got separated from his group was because he was offering medical aid to everyone who needed it! During that time the police moved their line, cutting Kyle off from his group.       Even then, there was a reporter from Daily Caller with him most of the time. That reporter is the one who first started attending to the hothead that had attacked Kyle first.

      He worked in that city as a lifeguard. He had medical training. He was there to HELP people!

      • If you view all of the video prior to Rosenbaum being shot, you’ll see that plastic bag multiple times. At one point, it seems to have held a 12 ounce can of coke or similar. It had a few other unidentifiable items throughout the night – maybe snacks and crap. At the moment it was flung at Kyle, it seems to have had a plastic bottle of water, maybe 1/4 full, with some other unidentifiable items. All relatively light weight, but they may have done some damage if the bag had hit Kyle with any speed.

Too many cases where people who pursued others became the attackers and this case involves video evidence of multiple people attempting to murder someone running for their life after already utilizing the method of self defense they should have seen as a deterrent in the first place.   7. If the local government and local police had been doing their jobs, there would have been no need for people like Rittenhouse to be there protecting businesses. Antifa and BLM can only operate with the full cooperation of local governments and local police, and the fact that they’ve tried to prosecute practically everyone who defends themselves from Antifa and BLM while allowing Maxist thugs to go free proves it.   8. I just love it when ‘legal experts’ tell us that extradition fights are usually based on ‘there was no crime’ or ‘somebody else committed the crime’ and claim that neither of those arguments could possibly apply to Kyle.

    1. Self defense, especially reluctant self defense after failed attempts to disengage, is not a crime.

    2. Those who Kyle was force to defend himself from were committing criminal assault (Rosenbaum) and attempted murder (Huber and Grosskreutz), so yes, Kyle wasn’t the one committing the crimes.

  9. After watching all the video evidence I can find, this entire case is about as clear as I have seen for self defense. He pretty much checked off all possible check marks to remove himself from the situation first.
    He doesn’t deserve to be sitting in jail. I agree fight the extradition. Fight it on all fronts.
    The charges are ridiculous.
    Once they get tossed I hope he sues the hell out of the DA’s office, and Biden and everyone else who defamed him.

      • DAs, like most government employees are immune from civil suits unless the harm came from negligence. In this case, however, it’s criminal malfeasance, which is a different process and requires the cooperation of the state’s congress.

      He ran away.
      He was cornered.
      He was attacked.
      He defended himself.
      He ran away again.
      He was caught and mobbed.
      Somebody tried to kick his head off.
      Somebody tried to open his skull with a skateboard.
      Somebody pulled a gun on him.
      He defended himself again.

      All of the above are my interpretation of the steps laid out in the DA’s probable cause statement in the charging documents. It reads like a defense attorney would write it.

All of this anarchy, death and destruction could have been avoided if the Kenosha police had simply allowed Robert Blake to continue assaulting the woman that he had raped then proceed, knife in hand, to her vehicle that her children were in. FBI crime statistics offer indisputable proof that most young children (12 and under) who are murdered are murdered by either mommy, daddy, or mommy’s boyfriend. It is also indisputable that African-American children are far more likely to be murdered by mommy or mommy’s boyfriend than White children. The officers should have ignored these objective realities. They should have allowed Robert Blake to proceed with the abduction. In the highly likely event that the children turned up murdered (no doubt stabbed to death rather than the usual beatings, bludgeonings, our strangulations that mommies and mommies boyfriends usually employ to murder children), the deaths of those children would have been just another example of evolution in action. The police would have been criticized for their refusal to protect the children. However; there would be no hoards of rioters looting, vandalizing, and burning Kenosha to the ground. We can be assured that VP candidate Senator Cameltoe Harris would not travel to Kenosha to do a photo op with the grieving mother.

    • Not really relevant. The relevant fact is, at that moment, they were trying to seriously injure or kill Kyle. They could have spent every previous moment of their lives caring for the needy, but since it’s true that what they were doing at the time, Kyle was legitimately defending himself, and that all that matters.

I heard that the two people who were fatally shot were both choir boys at Sunday services and that each had taken time to visit the elderly in a local nursing home where they entertained the residents with their wit and charm. The videos clearly show those two noble citizens were only trying to make their way through a few peaceful protesters to bring milk and cookies to the neighborhood homeless shelter. The real tragedy is the loss of the milk and cookies. We’re in the middle of a pandemic, don’t you know.

  22. I wonder if they are actually hoping to beat the extradition or are just trying to delay more and more to see if better evidence comes out or things cool down. It’s clear it’s a complete political hit job but every week it fades more and more… perhaps because the press can’t do as much now that it’s impossible to ignore that of the people he killed one was a serial rapist of children and the other was a domestic abuser convicted of, among other things, strangulation.

  24. The only thing Kyle is guilty of, is a misplaced concern for the injured rioters, and that is not a crime. This concern led him into harm’s way. While we think of this concern (and it illustrates what a fine young man he is), as a virtue, from a tactical and personal safety perspective, it’s not a virtue.
    Never approach a mob on your own, as doing so is a recipe for disaster no matter what is happening. Had Kyle teamed with at least one more defender (2 or more would be preferable), it’s possible and probable the crowd would have less inclined to get physical with more defenders on hand.
    It’s a cold hard reality, but rioters/mobs will always attack you in one way or another, and will view you as the enemy and not a good samaritan.

  25. What kind of jury is going to weigh his future. Lefty Town in a Dem state? Dragging this out helps how? Kid is screwed no matter how this goes down. His mamma & friends better keep em close, lot of cases like this, they end up punching their own ticket from the stress, public hate, press watching em for the rest of his life, if freed. Not a lot of employers want that kind of exposure either.
    Known too many vets who went down this kind of path, pray for Kyle with me people.
