We all know about the situation in Kenosha, Wisconsin. Part of the land of cheese and snow drifts taller than your car has devolved into chaos rather unsurprisingly…chaos and violent protests seem to be The Thing to Do lately. Most recently a 17-year-old purportedly present to assist others in protecting businesses fired on his assailants, killing two of them.

The Kenosha Police Chief, Daniel Miskinis, had something to say about that:

“Everybody involved was out after the curfew,” Miskinis said. “I’m not gonna make a great deal of it but the point is — the curfew’s in place to protect. Had persons not been out involved in violation of that, perhaps the situation that unfolded would not have happened.”

Kenosha set a curfew when they realized they were in a state of emergency thanks to all the violent protestors rioters. It’s been set at 8 pm to 7 am curfew. They’ve announced the hours nightly this week and it seems unlikely to change anytime soon given the current circumstances. The latest curfew now starts at 7PM and is in place through Sunday, August 30, 2020.

This seems like a fantastic time to bring up John Farnam’s rule, something I seem to be repeating endlessly this week: don’t go to stupid places with stupid people and do stupid things. Take that however you like in this admittedly complicated context.

Don’t want to get shot by someone trying to defend their life and property? Don’t break the curfew. Don’t riot and burn buildings. Don’t throw bricks at fleeing people, beat them with a skateboard, deliver potentially-fatal kicks while they’re on the ground, and then complain when you wake up dead.

Yes there are likely a lot of details missing from what went on in the Kyle Rittenhouse situation. It’s still fresh enough that I’m gathering details and waiting it out a little bit longer. Does it look like a justified shoot(s)? Yes, right now it does.

Should we ask why he crossed a state line with a rifle he couldn’t legally open carry at his age in Wisconsin? Probably. There are some who are appalled that we even wonder why he was there in the first place, but it’s a still legitimate question.

There’s a flip side to that question, though. We may be at the kind of tipping point where we’ll have an increasing number of armed citizens offer to help protect local businesses from rioting, looting, and burning to the ground is the logical response.

Defense of property is typically not something justifiable for self-defense. For example, if some guy is in your driveway stealing your car no, you should not exit your house to confront him, not unless your wife, husband, or child is in said car. But these are different times.

There are a lot of what-ifs, a great many unknowns, and a ludicrous amount of wildly bad behavior going down (and for the most part the people behaving badly get away with it scot free).

Still, it’s hard disagree with Chief Miskinis. He’s not wrong about rioters breaking curfew (and assaulting people).

What do you think? Should people from outside areas, even other states, be traveling there to defend businesses from rioters?

      Especially in light of recent Police video cam releases and autopsy evidence.

      • Realistically, that 14% number is not accurate. BFs of any age have violent crime rates about the same as the rest of the population. The same goes for BMs over age 35. That leaves U-35 BMs as the primary perpetrator of that 52-54% of murders. So it’s more like 3% of that demographic committing over 1/2 the murders…

    • Right now law enforcement is out-numbered. Politicians have limited their actions and restricted their numbers. So you may have to protect yourself. And the first thing you need to know is what the law is in your state. Here is the Texas law on self–defense.
      Sec. 9.32. DEADLY FORCE IN DEFENSE OF PERSON. (a) A person is justified in using deadly force against another:

      (1) if the actor would be justified in using force against the other under Section 9.31; and

      (2) when and to the degree the actor reasonably believes the deadly force is immediately necessary:

      (A) to protect the actor against the other’s use or attempted use of unlawful deadly force; or

      (B) to prevent the other’s imminent commission of aggravated kidnapping, murder, sexual assault, aggravated sexual assault, robbery, or aggravated robbery.

      And one VERY NICE thing about Texas law is it explicitly spells out when you can use DEADLY FORCE to protect property.

      Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:

      (1) if he would be justified in using force against the other under Section 9.41; and

      (2) when and to the degree he reasonably believes the deadly force is immediately necessary:

      (A) to prevent the other’s imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or

      (B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and

      (3) he reasonably believes that:

      (A) the land or property cannot be protected or recovered by any other means; or

      (B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

      So know the law in the state you are in. Remember, there are lots and lots of people taking video of these riots and people are being arrested weeks after they occur. The thugs that were shot in Wisconsin were ID’d within hours.

    He did the right thing, and has nothing to be ashamed of, he is clearly defending himself.

    • He’ll plea to manslaughter and minor in possession of a firearm. Riots will erupt over the lesser plea. Next in line for charges and lawsuits will be his parents for letting him have a firearm. All he should really be charged with is minor in possession, but prosecutors won’t go down that road. They’ll make an example out of him to send a message, while turning a blind eye to the violent protesters. I hope a gaggle of attorneys pro bono him so he’s not pro bono’d in adult prison.

        If Mr. Rittenhouse gets a half-way decent defense attorney, he will beat all homicide charges because there is ample video evidence which makes it crystal clear that he was exercising righteous self-defense.

        Wisconsin might still try to jack him up on minor carrying a rifle if there is such a thing in Wisconsin. That would be the only thing that they use to jack him up.

          I think his interviews prior to the event help him a great deal. First of all, there is video (or perhaps a still photo) of him volunteering and trying to clean graffiti. Then there is the impromptu video interview where he says that he is there to protect people and businesses from destruction.

          He will walk — and rightly should.

      • Minor in possession? Are you kidding me? In Florida anyone 16+ can possess a firearm without adult supervision. Though you have to have a hunter safety course to get a hunting license. I forget the cut off date. I owned my first handgun at 16. A S&W 19. 4″.

  3. With respect, I live rater rural. It 13 miles from home to the state road. You have to work to be back here. If someone is breaking into my car after having driven at least 22 miles (closest market / civilization) up canyon roads and then into the midst of my 40 acres (no mule) to my house to break into my car, that demonstrates forethought and intention, and will be confronted.

    Time was, you could highlight Republican principles on a flash card, particularly when it came to national security. At the 1980 Republican National Convention— when Republican clarity about the party’s ideals was at a peak — Americans knew where we stood, and the Reagan-Bush administrations followed through with policies that gave life to those principles.

    The premise, as laid out in the party platform, started with the proposition that international order created peace and prosperity for Americans. That “peace through strength” meant a formidable military presence around the globe, an asset to us and a deterrent to our enemies. That fair trade was a motivation to overcome differences. That democracy and human rights were legitimate objectives worth persuading others around the globe to embrace. And that to achieve these results, we would stand by our allies and together we could restrain those nations, like Russia, that wished to harm us.

    These were simple, bedrock principles — ones for which there wasn’t much daylight between Republicans and Democrats — and they guided us well through the American century. Tragically, it appears these Republican principles have been lost. Nothing makes that clearer than the lack of a 2020 Republican platform to frame the ideas Republicans stand behind. Rather, the party has instituted a blind endorsement of President Donald Trump and his “America First” priorities, whatever those may be.

    This absence of principles, above all else, is what drove me and more than 70 other national security leaders from previous Republican administrations to conclude that former Vice President Joe Biden would be better to lead and preserve our national security than a president who claims to be a Republican, but one that Ronald Reagan wouldn’t recognize.

    As the secretary of the Navy in the George H.W. Bush administration, it pains me to admit this. Not just because I believe that the GOP truly stood for something great and that previous Republican presidents acted on principles, but also because the absence of any principles puts our nation and the world in tremendous danger.

    We have alienated our allies and been suckered by our enemies further afield, as well. We abruptly canceled joint military exercises with South Korea, a vital economic partner that presidents of both parties have relied on to check North Korean aggression. Instead, Trump “fell in love” with North Korean despot Kim Jong Un and allowed him to move ever closer to building nuclear weapons that are increasingly capable of reaching our nation.

    Thankfully, no South Koreans have (yet) lost their lives as a result of our betrayal, but the same cannot be said for the Kurds in the Middle East. We removed U.S. forces that were keeping the Turkish military from moving against our Kurdish allies — allies who helped us defeat the Islamic State militant group — allowing Turkey to displace 100,000 Kurds and kill many more. In turn, the region is even more chaotic and now another incubator for yet more terrorist activities.

    We have alienated our allies and been suckered by our enemies further afield, as well. We abruptly canceled joint military exercises with South Korea, a vital economic partner that presidents of both parties have relied on to check North Korean aggression. And it is an instinct that U.S. military service members recoil against because they swore to defend the United States, not to be used as a blunt instrument against their own people.

    My concern about the abandonment of Republican principles in the Trump era is not about wistful nostalgia for an earlier time, however, or even a vague desire to “do the right thing.” Today, all of America’s security challenges are international and require an international response. The COVID-19 pandemic proved, once again, that viruses do not respect international barriers and that “fortress America” is not a fortress at all. What happens in a market in Wuhan affects us here, as the nearly 182,000 people COVID-19 has killed in the United States can only attest to from the grave.

    In addition to working together to stop a deadly disease, we need our allies to join us to combat terrorism, ameliorate or adapt to climate change and stem mass migration. But it seems there’s no ally we won’t alienate. Trump has started diplomatic spats with Canada, Australia, Germany, France and, somehow, even Denmark and Sweden. These incidents have consequences for American national security leaders who have forged working relationships over three generations and report that our allies no longer trust us.

    I am supporting Biden because he, more than Trump, embodies American — and even Republican — national security principles now. As President George H.W. Bush said, “America is never wholly herself unless she is engaged in high moral principle.” As President Dwight Eisenhower said, “A people that values its privileges above its principles soon loses both.” As President George W. Bush said, “We can only see the reality of America’s need by seeing it through the eyes of the threatened, oppressed and disenfranchised.”

    These are all beliefs espoused by Republican presidents who have lived and acted on them. It was only under Trump that the Republican Party started behaving as though principles didn’t matter.
    I have not always agreed with Biden, and it’s unlikely I will always agree with him if he is elected president. But when disagreements do occur, I will have returned to the ranks of the loyal opposition and will be able to express my objections and prescriptions by appealing to the deeply held principles that have guided him throughout his career in public service. Those differences will likely be due to conflicting views over policy, and at least the Democrats put out a party platform of policies to debate.

      • I’ll need citations from reputable sources that our military is in such great shape. Our crew went nose-to-nose with Russian trawlers, Russian destroyers, Russian bombers, and Russian fighters routinely. It didn’t even make the news. Today? If one of our pilots gets within fifty miles of a Russian pilot, it headline news. That newest Zumwalt ship class? It’s a death trap, waiting for a wave to capsize it. Word has it that when it rolls past 60 degrees, it’s gone. Real ships can roll as much as 100 degrees, and the righting arms bring it back up. Look that term up, “righting arm”. The marine engineers forgot everything they knew when they returned to a failed French ship design. In short, I think you’re full of schitzls, as is anyone who would publish such drivel.

        • 100 degrees? You’ve lost your mind. I’ve been on naval vessels for the last 20 years, and parts of the ship are designed to BREAK OFF at greater than 40 or so degrees. 100 degrees is more than laying fully horizontal. That would put the sides of the bridge underwater. The props and the keel would be literally out of water. None of our ships have ever been designed to roll 100 degrees and survive. Actually no ships ever have been designed that way

          Well that is a little less extreme. I could see 50 degrees from vertical and still righting itself. As long as the watertight integrity is maintained of course. A decent enough breach in the hull and 50 degrees may well be signing the ships death warrant. However, things like the mast, and a few other bits that sit high up on a warship would certainly be compromised in process

          Early in my Navy career, I was told that the guns would detach if the ship ever rolled beyond 45 degrees. That scuttlebutt was proven false when we rolled past 55 degrees, many times, over a three week period on a North Atlantic cruise, during the winter months. During a 6 week period, we never saw seas less than 35 feet, to give you an idea how rough it was.

          Thankfully, we never rolled past 60 degrees. 55 is scary as all get out, and the crew was well battered when we finally made a port call in Plymouth, England.

Now this is off topic but awhile back a guy told me he shot a slaughter hog behind the ear at point blank( barrel around a half inch away) and didn’t kill the sow. Sometimes he gets his shit screwed up because, well, just because.h e had a.410 #6 didn’t say 2&1/2 or 3. Now I’d have bet money on a DRT, but he said it ran off squealing and he shot it with a slug. Now some of you guys that shoot or trap hogs what do you think? my dad just busted them in the head with a sledge hammer because WW2 vet n we didn’t have gunms on the farm, so I don’t know about shooting hogs, but I’d a sure bet at point blank a .410#6 2&1/2 would have killed it.

    • A friend of mine tried to euthanize a deer that had been hit on the highway, he shot it in the back of the skull from about 4’ away with a Kimber ultra carry .45 fmj and the bullet bounced off the deers skull.

      He ran back to the car to get his girlfriend’s ccw .357mag and that one did the trick…

    • I’ve never heard of any one using a .410 with a load of 6’s to shoot a pig. We used a .22 for pigs and cows. Saw one horse killed that way.

      I never saw any type of shotgun used to slaughter farm animals.

    • Oh, you can go wherever you want. Just don’t go there with the express purpose of burning, looting and mayhem and there likely won’t be a problem.

    • There’s a lot of thick bone with curved/angled surfaces back there, so it depends on how the gun is angled relative to the head. Aim a bit more sideways, to hit the first vertebrae at the base of the skull, or better yet from above and angled to penetrate a bit forward, and you’re more likely to get your DRT. A 2.5 inch .410 cartridge will have roughly 220 grains of lead, but that heavy bone will deflect a lot of those pellets even at powder burn range. Should use a rifle or handgun though, if you have to shoot it.

        In the close-up video of Molotov cocktail attacker who took a bullet in the head: right after people apply a shirt to the wound on his head to try and reduce bleeding, he lets out a haunting moan/cry for a few seconds. I am wondering, was he moaning/crying:
        1) in physical pain from the head wound and people pushing on his head in good faith to try and reduce bleeding and save his life?
        2) in emotional pain from realizing that he really screwed up and was going to die in a few seconds?

          If the bullet hit brain matter, it could have ‘scrambled’ his thought process. There are supposed to be no pain sensors in there, but maybe in the scalp-skullbones?

          Trauma to the brain can cause brain swelling, maybe that?

        • There’s an autopsy report out that the head wound was just a superficial graze. Could still have knocked him silly, but he was hit 4 other times — one of those broke his pelvis and another went through the lung, which explains him bleeding through the nose. In summary, he was dead more than one way.

        • One of the many pages I’ve read today claimed that all four shots that Kyle took hit this kiddy diddler. The obvious skull shot was just a graze – tore up a patch of scalp, and looks serious, but just a graze. The killing shot apparently went in the neck and up into the brain. Apparently hit nothing solid, so it probably rattled around inside the skull a little before settling down.

          If what I read is accurate, kiddy diddler wasn’t aware of anything at all from the instant the bullet impacted. Wheezing, moaning, etc would all have been involuntary reflexes of the body shutting down. He was already brain dead, and the body had to play catch up.

  17. Everyone seems to be hung up on the “he crossed state lines to …”. Note that he lives only 12 miles from Kenosha. The businesses in town that he went to try to protect were likely businesses he and his family patronized and he likely knew some of the owners. Also, after being released by the police, he just went home, never considering the “state line” issue, resulting in additional charges. Those of us who live near state borders can forget that that invisible line can have major consequences. I live even closer than 12 miles from the Massachusetts border in Connecticut and if I forget and cross that invisible line while carrying my handgun, which was perfectly 2 feet earlier, I suddenly commit a felony according to Massachusetts law. We can hope the judge also crosses the state line daily and can empathize.

    • The “crossed state lines” thing is relevant. I live three miles from the state line. My county was a “dry” county until 2016 when a referendum question made it a “wet” county. Countless people were busted, and some died, because they crossed the state line to do something that was legal there, but illegal here. Bootlegging alcohol carried serious consequences.

      I’ll agree with you if you say “it shouldn’t make a difference”, but in fact, it does make a difference.

  19. Reminder that him being 17 is 100% irrelevant. The Constitutions of the US and Wisconsin protect the right to bear arms without any age restriction given. Any legislation to the contrary is a legislature assuming undelgated powers, and as such is authoritative, void and no force.

  21. The chief could deal with this but won’t or, more likely, has been ordered not to. The “protesters” are breaking curfew which makes them subject to arrest. Since there are more of them than there are police to take them into custody, police have the option to selectively arrest the ones actually rioting, vandalizing and looting. Very likely, they will resist arrest and they and their supporters will attack police with bricks, bottles, etc. Those qualify as deadly weapons which entitles the besieged officers to defend themselves with deadly force. Anyone in the crowd would be a legitimate target with those in front the biggest threat and the first to be shot.

  27. Kyle lives about 20 minutes from Kenosha, which was where he was raised and still had family living there (including his grandparents). A good friend of Kyle’s family asked him (and others) to help protect their car lot because it had been targeted the prior two nights.

    The two who died were convicted felons. The first dude who was shot and killed was a convicted and registered sex offender. The other one who was shot and killed was a chronic wife/girlfriend beater with MULTIPLE convictions for domestic violence and abuse, including strangulation.

    The other man (who lived) also has a felony record, including a previous conviction for carrying a gun illegally (he was a felon). He was the one who was standing over Kyle, pointing his gun at Kyle’s head. He still has not been charged with being a felon in possession of a gun.
