To be fair, there isn’t much that doesn’t baffle ol’ Joe these days.

When it overturned California’s 10-round magazine limit last Friday, the U.S. Court of Appeals for the 9th Circuit emphasized what Americans commonly do when they exercise their constitutional right to armed self-defense. Joe Biden, by contrast, thinks the relevant question is how many shells Americans are allowed to have in their shotguns when they hunt migratory birds.

Those two approaches represent the difference between judges who take the Second Amendment seriously and politicians who only pay lip service to it. Biden’s presidential campaign, which promises a raft of new gun restrictions while barely nodding toward the Constitution, shows the extent to which the right to keep and bear arms has become a partisan issue, a development that does not bode well for civil liberties.

The Biden campaign’s website mentions the Second Amendment just once, saying, “It’s within our grasp to end our gun violence epidemic and respect the Second Amendment, which is limited.” Even that grudging acknowledgment is more than the Democratic Party’s platform offers.

After promising to respect the Second Amendment in 2004, 2008, and 2012, the Democrats erased the constitutional provision from their 2016 platform, although they did mention “the rights of responsible gun owners.” This year’s platform omits that phrase as well.

”I respect the Second Amendment,” Biden insisted last March while arguing with a Detroit autoworker about gun control. But the evidence he offered was not exactly reassuring.

”I have a shotgun,” Biden said. “My sons hunt.” He notably omitted any mention of the right to self-defense, which the Supreme Court has recognized as the Second Amendment’s “central component,” or of handguns, which the justices described as the “quintessential self-defense weapon.”

In explaining his plan to ban “high-capacity magazines,” Biden also talks about hunting. “Federal law prevents hunters from hunting migratory game birds with more than three shells in their shotgun,” his campaign says. “That means our federal law does more to protect ducks than children.”

      Let me ask the Trump supporters, it is almost 4 years later and I haven’t seen Mexico pay for anything, much less a multi-billion dollar wall. Trump has raided our defense funding and housing for military dependents, but where has the money gone?

  2. The Second Amendment has absolutely NOTHING to do with hunting and sporting firearms. In fact, most sporting firearms are NOT protected by the amendment. It states “ARMS” which has been defined as military weaponry for hundreds or thousands of years.

    • That is an odd position to take, and a dangerous one. Are you SURE you want to argue that ONLY in-use military firearms are protected under the 2A?

      • I don’t much like Ollie’s line of reasoning either, but he makes a point. Arms. Military grade weapons. Military forces have used muzzle loading smoothbores, albeit long ago. So, if you can point to instances of ANY weapon being used by a military force, then it’s a legitimately protected military arm. Ultimately, if you can pack a bit of powder into it, and put a projectile on top, it should be protected.

        Convoluted thinking, I know, but nothing says we have to discard obsolete arms in favor of modern arms.

        • Yes, but by this reasoning you would deny 2A protection to, e.g. most CCW pistols (many of which are better than available military offerings), most .22 rifles, many sporting arms, shotguns, etc. etc. You are also denying protection to new innovations that are not yet adopted by a military. And you are forgetting that, in a militia context, a valid “arm” may or may not be an issued military arm. It could well be (and historically, often was) a sporting arm or something else. The 2A protects all, not just a narrow military subset.

        • Napresto-the militia is a regulated entity meaning it is military and so illegal to use to police citizens and can be ordered around by a tyrant thus the second half of the sentence about The People bearing arms unfringed was and is the remedy.
          I assure you if you live in a large city your police have full auto rifles, M16s M4 M14 which are given by the military under 1033 program to local police and they receive training from military which is a violation under the Constitution.
          So why do police need machine guns and grenade launchers? I think the 2nd is the least of our worries or what type weapons we are “allowed”.
          And here is a drop in the bucket about the FBI losing hundreds of weapons yearly: A shotgun and a submachine gun were stolen from an FBI vehicle parked on the street in New York. A Special Agent parked the car at about 2:00 pm on December 26, 2001, and discovered the break-in when returning to the car at about 6:00 am the following day. The submachine gun and the shotgun were taken from a rack mounted on the front seat of the vehicle.
          Your state is the one that is making gun control laws not the federal government so pay attention! The 2nd is okay but the state will soon make a law your firearms are to never leave your home without state govt permission. You will keep and bear and that is it, you won’t even hunt. FFL dealers will have to deliver purchases to buyers and that will be restricted I am sure as well like say only on Mondays 11 am to noon…

      • I have always believed the use of the word “Arms” in the Second Amendment’s language refers to all sorts of weapons. I think the usage has a double meaning that refers directly to objects [firearms, edged-weapons, spears, bow and arrow, crossbows, clubs, slings et al] and further infers a reference to the right to defend oneself, other persons and property from wanton aggression and intrusion. This double-meaning goes hand-in-hand with the double meaning of “the security of a free State”, which refers both to the security of the polity {State} and the individual freedom of the persons who established that polity to protect/insure their natural freedoms and “unalienable Rights”.
        The Second Amendment should be understood in a broad scope that includes resistance to tyranny, self defense, hunting, recreation and competitive skill to name a few.

      • That was the rationale for the ONLY 2A case to reach SCOTUS, after the NFA 1934, concerning a sawed off shotgun, since there was no defense the prosecutor lied that such weapons were never used in the military and therefore they were not protected, and the court agreed and found for the prosecution. Sawed off shotguns were used extensively during trench warfare of WWI.

Hint: .22’s have been used many a time by military services world wide, and there is no qualifier, except “militarily important” in US v. Miller. Not which military, nor when they employed them. Not that the point matters all that much, SOG units were often issued integrally suppressed Hi Standards in .22

          One could easily take the approach that the classification of action is the ultimate determining factor. Seeing that’s a pre-existential within so-called “settled law” already, & use that against them.

      • That was the reasoning used in Miller v. US, where the justices claimed that short barrel shotguns where not known to them to be used by the military, thus upholding a law which prevented people from owning the most obviously militarily useful weaponry.

        And if you had to reread that sentence multiple times because it didn’t make much sense, then you understand the “logic” of that ruling. And no, the 2nd Amendment does not exclude protection of “sporting purposes” (aka, non-military) weapons, the basic assumption of that ruling. It protects all arms with its operative statement. The preamble just makes it clear that the purpose is to especially and explicitly protect those useful for militia use.

        There is so much unconstitutional law and rulings that needs to be overturned.

    • The purpose of the 2nd Amendment is to insure the right’s of citizens to defend themselves against governmental tyranny. When government starts limiting magazine size or outright banning weapons like AR’s and AK’s it is the kind of political action that “shall not be infringed” directly recognizes. To defend against tyranny, an armed citizenry must have weaponry suitable for that task, something that an AR-15 or AK-47 and their variants are exactly suited for. To further the 2nd’s point, the possession of weapons like these also signals the kind of power-sharing that implicitly denies the “monopoly of power” that authoritarian governments use to control their populations.

      We should never forget that the 2nd. was written by revolutionaries who, even as they were building it, manifestly did not trust government to protect gun ownership unless it was expressly ordered to do so. It is no great surprise that most conservatives clearly understand this unambiguous element of the 2nd Amendment. It is also no great surprise that progressives, intent on erecting an intrusive administrative state, see guns as a direct threat to their need to establish control.

    • Actually “arms” as a noun rather than a verb, is defined as a “a means of offense or defense” particularly in reference to weapons designed for one, the other or both purposes. The intended target of such weapons isn’t specified. A bird gun is certainly a weapon designed for offense, against birds.

      A similar definition was used in 1755, “weapons of offence, or armour of defence” by Dr. Johnson’s Dictionary of the English Language. Again, a desired application isn’t specified. Defensive armor could be meant for large cats or sharks under this definition.

      So, no, military application is not a standard for protection unless you choose to infer it for some other reason.

      • Makes a good story, so long as you maintain strict rules against having the slightest idea what you’re talking about. The court anguished over the question, eventually holding that each side had solid reasons for their positions, there was no way to find a rational way to choose between them. Therefore they would make no choice and would leave that choice to each woman who was pregnant, thus “freedom of choice”. Pretty sure they also considered that a government with the authority to prohibit abortions would also have the authority to mandate abortions. The decision was difficult to justify, but simple to understand, and extremely simple to counter. If you don’t like it, pass a Constitutional Amendment outlawing abortion. Not only has that not been done in the past 46 years, not only has it never been TRIED, it has never even been mentioned, since everyone knows it would not pass, why waste the money?

        And it has always fascinated me that all the noise on the subject comes from men, occasionally women past menopause. I guess it’s part of the attitude of keeping women barefoot and pregnant, treat them as property with no thoughts and no life.

        • While I’m sure it wasn’t an easy decision for the justices, that doesn’t mean we can’t criticize it as a wrong decision. If nothing else they should have left it as the right of the states to choose the legality.

    • I used to be a Libertarian. I was even a member of the LP.

      Then I noticed something: LP members and Libertarians sounded embarrassed to defend the Second Amendment. Then I noticed what really motivated Libertarians, the debates in which they were the most animated, were those involving borders, drugs, sex (especially sexual perversions not within the Overton Window) and tax evasion.

      Not long after, I ceased being a LP member, then Libertarian, and finally libertarian, in that order.

      As far as I’m concerned, libertarians are little more than dope-smoking perverts who just don’t want to pay taxes – so they have more money for dope.

  26. For those of us who have been around for Biden’s entire career in politics, the only indication that Biden is suffering from some form of dementia is the manner in which Biden utters nonsenses, not the quantity or quality of his nonsense.

    Also not recently remarkable is his propensity for plagiarism and thefts of policy ideas. He has been known as something of a goofy, hands-on pervert and grifter his entire life, so none of this is news.

    No, it’s the tics and deepening aphasia that are new and notable. Biden has been given to unthought utterances his entire life – he’s been noted as the man in politics for whom there was no delay or filter between a mental thought and utterance of said thought. Recently, his utterances make no grammatical sense, nor do they fit his circumstances. If Biden were looking at a shapely woman’s décolletage and he suddenly slipped up and said “What a rack!” we would be less concerned. That would have been Biden being the same Biden we’ve known for 50 years: no filter, a bit of a lech and not possessed of better words to express the idea.

    What we have today is (using the above metaphor) Biden looking at a shapely woman’s décolletage and saying “Ford could have a winner with the Mustang in ’65!” – a huge error of time perception and situational awareness. Such a man could mistake the “football” for a device with which to order lunch.

    As such, it behooves us to cease worrying about Biden and accept his situation as dire and perhaps a year or less from preventing him from discharging the duties of POTUS. What we should be worried about here is the potential of a Kamala Harris as POTUS – a female who has no scruples whatsoever and for whom the law isn’t so much as a speedbump in her quest for power.
