Joe Biden is Baffled by the Second Amendment

Is it duck season yet? (AP Photo/Nati Harnik)

To be fair, there isn’t much that doesn’t baffle ol’ Joe these days.

When it overturned California’s 10-round magazine limit last Friday, the U.S. Court of Appeals for the 9th Circuit emphasized what Americans commonly do when they exercise their constitutional right to armed self-defense. Joe Biden, by contrast, thinks the relevant question is how many shells Americans are allowed to have in their shotguns when they hunt migratory birds.

Those two approaches represent the difference between judges who take the Second Amendment seriously and politicians who only pay lip service to it. Biden’s presidential campaign, which promises a raft of new gun restrictions while barely nodding toward the Constitution, shows the extent to which the right to keep and bear arms has become a partisan issue, a development that does not bode well for civil liberties.

The Biden campaign’s website mentions the Second Amendment just once, saying, “It’s within our grasp to end our gun violence epidemic and respect the Second Amendment, which is limited.” Even that grudging acknowledgment is more than the Democratic Party’s platform offers.

After promising to respect the Second Amendment in 2004, 2008, and 2012, the Democrats erased the constitutional provision from their 2016 platform, although they did mention “the rights of responsible gun owners.” This year’s platform omits that phrase as well.

”I respect the Second Amendment,” Biden insisted last March while arguing with a Detroit autoworker about gun control. But the evidence he offered was not exactly reassuring.

”I have a shotgun,” Biden said. “My sons hunt.” He notably omitted any mention of the right to self-defense, which the Supreme Court has recognized as the Second Amendment’s “central component,” or of handguns, which the justices described as the “quintessential self-defense weapon.”

In explaining his plan to ban “high-capacity magazines,” Biden also talks about hunting. “Federal law prevents hunters from hunting migratory game birds with more than three shells in their shotgun,” his campaign says. “That means our federal law does more to protect ducks than children.”

To be fair, Joe Biden did have a rational thought several years ago — then it got lonely and died off.

    3. avatar Miner49er says:

Interesting claim, so you think dishonesty is a bad thing in the administration?

The question would be, how many of Joe Biden‘s confidantes and advisers have been arrested and sent to prison?

The idea would be to compare that to Donald Trump‘s circle of friends, as the good book says, ‘you will know them by the company they keep”.

Well, looks like we need to wait a while, Trump is still racking up the convicts:

“Federal prosecutors on Thursday charged Steve Bannon, President Donald Trump’s former campaign adviser, and three others with defrauding donors of hundreds of thousands of dollars in a border wall fundraising campaign.
Bannon has been arrested, according to a spokesman for the US attorney’s office. Bannon’s lawyer did not immediately respond to a request for comment.”

Let me ask the Trump supporters, it is almost 4 years later and I haven’t seen Mexico pay for anything, much less a multi-billion dollar wall. Trump has raided our defense funding and housing for military dependents, but where has the money gone?

      1. avatar jwm says:

‘Known by the company you keep’. So as a self avowed socialist you’re in company with stalin, mao, hitler, pol pot. You’re guilty because of your associates is what you’re saying. Good to know that you accept that as a legal standard. It will make your trial so much less complicated.

        1. avatar Miner49er says:

          “Stalin, mao, hitler, pol pot”

First, none of those guys were socialists, instead they were authoritarian dictators who controlled their population through fear and force.

And the idea that Hitler was a socialist is especially laughable, you should ask Bayer agriscience, BASF or Siemens AG about the Nazi ‘socialism‘.

But again, which of Biden’s team have been charged, convicted or sent to prison?

You’ve had almost 4 years of the stable genius grifter controlling the department of justice and the FBI, multiple investigations by the DOJ and Congress, but no charges, much less convictions.

          What’s up with that?

Is it possible that grifter Trump and Fox News lied to you when they told you that Hillary and Obama and Biden were all criminals who would soon be charged?

How about Q-anon, and his silly fantasies it soon everyone in the Democratic Party would be in prison, what BS!

Yes, Donald Trump loves the poorly educated and apparently so does the NRA and Wayne Lapierre who have profited bigly from your stupidity.

Well, 170,000 dead Americans, it is what it is…

        2. avatar jwm says:

That’s all a socialists is. A hard core extremist with a gun in his hand. And that doj and fbi have been corrupted and working against Trump. But you knew that. Treason by any other name.

And I know i shouldn’t ask, but what’s with the 170 thousand number? Car wrecks? or Covid? If the wu flu how many folks has Trump sent to nursing homes to die? How many prisons has he emptied out to protect the socialists voter base?

As for education levels. At MU in American Poly Sci classes Professor Abbas began every class with a tirade against Israel. And anybody that dared speak up about it got failed. What you consider education is indoctrination. The fact that you would call it education shows how far down that rabbit hole you’ve slid.

  2. avatar Ollie says:

The Second Amendment has absolutely NOTHING to do with hunting and sporting firearms. In fact, most sporting firearms are NOT protected by the amendment. It states “ARMS” which has been defined as military weaponry for hundreds or thousands of years.

    1. avatar napresto says:

That is an odd position to take, and a dangerous one. Are you SURE you want to argue that ONLY in-use military firearms are protected under the 2A?

      1. avatar Paul says:

I don’t much like Ollie’s line of reasoning either, but he makes a point. Arms. Military grade weapons. Military forces have used muzzle loading smoothbores, albeit long ago. So, if you can point to instances of ANY weapon being used by a military force, then it’s a legitimately protected military arm. Ultimately, if you can pack a bit of powder into it, and put a projectile on top, it should be protected.

Convoluted thinking, I know, but nothing says we have to discard obsolete arms in favor of modern arms.

        1. avatar Napresto says:

Yes, but by this reasoning you would deny 2A protection to, e.g. most CCW pistols (many of which are better than available military offerings), most .22 rifles, many sporting arms, shotguns, etc. etc. You are also denying protection to new innovations that are not yet adopted by a military. And you are forgetting that, in a militia context, a valid “arm” may or may not be an issued military arm. It could well be (and historically, often was) a sporting arm or something else. The 2A protects all, not just a narrow military subset.

        2. avatar Huntmaster says:

It’s protected if it’s a reed shaft topped with a piece of stone.

        3. avatar Bob Wyman says:

Napresto-the militia is a regulated entity meaning it is military and so illegal to use to police citizens and can be ordered around by a tyrant thus the second half of the sentence about The People bearing arms unfringed was and is the remedy.
I assure you if you live in a large city your police have full auto rifles, M16s M4 M14 which are given by the military under 1033 program to local police and they receive training from military which is a violation under the Constitution.
So why do police need machine guns and grenade launchers? I think the 2nd is the least of our worries or what type weapons we are “allowed”.
And here is a drop in the bucket about the FBI losing hundreds of weapons yearly: A shotgun and a submachine gun were stolen from an FBI vehicle parked on the street in New York. A Special Agent parked the car at about 2:00 pm on December 26, 2001, and discovered the break-in when returning to the car at about 6:00 am the following day. The submachine gun and the shotgun were taken from a rack mounted on the front seat of the vehicle.
Your state is the one that is making gun control laws not the federal government so pay attention! The 2nd is okay but the state will soon make a law your firearms are to never leave your home without state govt permission. You will keep and bear and that is it, you won’t even hunt. FFL dealers will have to deliver purchases to buyers and that will be restricted I am sure as well like say only on Mondays 11 am to noon…

      2. avatar DerryM says:

I have always believed the use of the word “Arms” in the Second Amendment’s language refers to all sorts of weapons. I think the usage has a double meaning that refers directly to objects [firearms, edged-weapons, spears, bow and arrow, crossbows, clubs, slings et al] and further infers a reference to the right to defend oneself, other persons and property from wanton aggression and intrusion. This double-meaning goes hand-in-hand with the double meaning of “the security of a free State”, which refers both to the security of the polity {State} and the individual freedom of the persons who established that polity to protect/insure their natural freedoms and “unalienable Rights”.
The Second Amendment should be understood in a broad scope that includes resistance to tyranny, self defense, hunting, recreation and competitive skill to name a few.

      3. avatar LarryinTX says:

That was the rationale for the ONLY 2A case to reach SCOTUS, after the NFA 1934, concerning a sawed off shotgun, since there was no defense the prosecutor lied that such weapons were never used in the military and therefore they were not protected, and the court agreed and found for the prosecution. Sawed off shotguns were used extensively during trench warfare of WWI.

        1. avatar MADDMAXX says:

Sawed off shotguns were used extensively during trench warfare of WWI.

I carried a “sawed off” 12 gauge side by side as a “bush gun” in Vietnam…

        2. avatar 9x39 says:

Frankly, there were short blunderbuss in the Revolutionary War also. Everyone needs to stop worrying about the state of their other firearms. Hint: .22’s have been used many a time by military services world wide, and there is no qualifier, except “militarily important” in US v. Miller. Not which military, nor when they employed them. Not that the point matters all that much, SOG units were often issued integrally suppressed Hi Standards in .22

One could easily take the approach that the classification of action is the ultimate determining factor. Seeing that’s a pre-existential within so-called “settled law” already, & use that against them.

      4. avatar EWTHeckman says:

That was the reasoning used in Miller v. US, where the justices claimed that short barrel shotguns where not known to them to be used by the military, thus upholding a law which prevented people from owning the most obviously militarily useful weaponry.

And if you had to reread that sentence multiple times because it didn’t make much sense, then you understand the “logic” of that ruling. And no, the 2nd Amendment does not exclude protection of “sporting purposes” (aka, non-military) weapons, the basic assumption of that ruling. It protects all arms with its operative statement. The preamble just makes it clear that the purpose is to especially and explicitly protect those useful for militia use.

There is so much unconstitutional law and rulings that needs to be overturned.

        1. avatar 9x39 says:

^ Should’ve read a bit farther down before replying. I reinforced what you’d already said before seeing you’d said it. :p

    2. avatar Mark N. says:

Back in the day, a military arm and a hunting arm were one and the same for the militia, whether that was a Brown Bess or a fowler.

    3. avatar Garrison Hall says:

The purpose of the 2nd Amendment is to insure the right’s of citizens to defend themselves against governmental tyranny. When government starts limiting magazine size or outright banning weapons like AR’s and AK’s it is the kind of political action that “shall not be infringed” directly recognizes. To defend against tyranny, an armed citizenry must have weaponry suitable for that task, something that an AR-15 or AK-47 and their variants are exactly suited for. To further the 2nd’s point, the possession of weapons like these also signals the kind of power-sharing that implicitly denies the “monopoly of power” that authoritarian governments use to control their populations.

We should never forget that the 2nd. was written by revolutionaries who, even as they were building it, manifestly did not trust government to protect gun ownership unless it was expressly ordered to do so. It is no great surprise that most conservatives clearly understand this unambiguous element of the 2nd Amendment. It is also no great surprise that progressives, intent on erecting an intrusive administrative state, see guns as a direct threat to their need to establish control.

      1. avatar Geoff "Ammo. LOTS of ammo..." PR says:

“To further the 2nd’s point, the possession of weapons like these also signals the kind of power-sharing that implicitly denies the “monopoly of power” that authoritarian governments use to control their populations.”

Hands and feet annually kill far more than semi-auto rifles, yet those are the ones they want to grab.

“It is also no great surprise that progressives, intent on erecting an intrusive administrative state, see guns as a direct threat to their need to establish control.”

Exactly why they will never get ours. They will become necessary for the reconstruction of a renewed republic…

        1. avatar Blkojo says:

Hands and feet kill more Americans annually than all rifles. Not just semi-autos but also bolt-action, lever-action, pump-action, single-shot.

    4. avatar strych9 says:

Actually “arms” as a noun rather than a verb, is defined as a “a means of offense or defense” particularly in reference to weapons designed for one, the other or both purposes. The intended target of such weapons isn’t specified. A bird gun is certainly a weapon designed for offense, against birds.

A similar definition was used in 1755, “weapons of offence, or armour of defence” by Dr. Johnson’s Dictionary of the English Language. Again, a desired application isn’t specified. Defensive armor could be meant for large cats or sharks under this definition.

So, no, military application is not a standard for protection unless you choose to infer it for some other reason.

By far the largest number of those abortions are women of color. The democrats strategy has worked so well that black people are the only demographic in the US to lose population numbers.

In addition to gun control the left has willingly embraced the margaret sanger plan to genocide an entire race. All the while claiming they are the poc’s best hope for a good future.

Evil on this level is beyond belief. But there it is, in plain view.

      1. avatar Dude says:

Considering the numbers aborted annually, you would think they would be anti-abortion. An extra 600,000 Democrats annually in a few decades would make us unable to hold national office again.

        All by out-breeding us…

        1. avatar jwm says:

Rational thought is not always something they are capable of. They interned American citizens in ww2 just because they were not white.

The margaret sanger plan was not put into action recently. It, like the kkk and gun control has been passed down until it is part of the institution of the party. Look at the folks that are all major players in the party. Very wealthy and for the most part very white. Even kamala who is not white comes from a family of slave owners.

      1. avatar LarryinTX says:

Makes a good story, so long as you maintain strict rules against having the slightest idea what you’re talking about. The court anguished over the question, eventually holding that each side had solid reasons for their positions, there was no way to find a rational way to choose between them. Therefore they would make no choice and would leave that choice to each woman who was pregnant, thus “freedom of choice”. Pretty sure they also considered that a government with the authority to prohibit abortions would also have the authority to mandate abortions. The decision was difficult to justify, but simple to understand, and extremely simple to counter. If you don’t like it, pass a Constitutional Amendment outlawing abortion. Not only has that not been done in the past 46 years, not only has it never been TRIED, it has never even been mentioned, since everyone knows it would not pass, why waste the money?

And it has always fascinated me that all the noise on the subject comes from men, occasionally women past menopause. I guess it’s part of the attitude of keeping women barefoot and pregnant, treat them as property with no thoughts and no life.

        1. avatar TrappedInCommiefornia says:

While I’m sure it wasn’t an easy decision for the justices, that doesn’t mean we can’t criticize it as a wrong decision. If nothing else they should have left it as the right of the states to choose the legality.

As for that last paragraph, that might be the stupidest thing I have ever read. Every woman in my family, regardless of age, is anti abortion. Quite possibly the worst strawman argument I have ever seen.

        2. avatar LampOfDiogenes says:

I’m sorry, but I have a question. Is it physically painful to be that stupid?

AND “Trump is an enemy of the state?” Where have I heard that, oh yeah… Komrad Brother Bernie, Creepy Uncle Joe, Pocahontas, Clinton News Network, MSDNC, New York Times, Washington Post, EVERY speaker (so far) at the DNC.. seems to be a running commentary amongst the radical leftist Socio/Commies.. Strange that an American PATRIOT such as yourself would take up the rhetoric of the fringe left and espouse it as FACT with NO evidence that the man has done anything (actually not made up bullshit) to undermine this Republic OR the Constitution…

    12. avatar LarryinTX says:

You like that “lying” bullshit, don’t you? How about you show us one (1) lie Trump has told which even comes close to “If you like your doctor, you can keep your doctor. Period.” Over and over and over, and he knew it was a lie before he ever said it the first time. That has cost the country and its citizens trillions of dollars, and you think Trump is a liar? You’re a moron.

And I will be happy to vote for his third term. Since you and your fellow travelers feel free to ignore the Constitution completely whenever you feel like it, I have no problem if he does, too.

    1. avatar Dyspeptic Gunsmith says:

Technically, no, Biden isn’t in an ‘advanced state’. It can get much, much worse from here, and sadly, since a man in his position and with his health care benefits probably has access to the latest medications to forestall dementia as long as possible, when it starts to get worse, it will get worse very suddenly.

Unfortunately for him, (and lucky for us) his days at full function don’t number enough to hide his senility. Few people will vote for a man clearly lost in the fog of old age.

Fish and Game laws have nothing to do with the 2 nd. amendment but if Joe braindead or his fellow Leftards only had functioning brains they would know or understand this fact.

Perhaps this quick video will help explain the 2 nd. to the braindead leftards and Joe.

    The 2nd Amendment: Liberal Edition

    1. avatar LarryinTX says:

I haven’t looked recently, but I seem to recall that hunting children is illegal regardless of the number of rounds your gun holds! Which would mean they have MORE protection than ducks. Joe is a moron, having nothing to do with his age, he always was a moron.

  23. avatar Pg13 says:

Last I checked I never had to defend my life from a duck. And I’ve got an extended tube on my be SBE3 for snow goose that takes it to 6 or 7 shells, soooo. Poor Biden: I know something about one thing therefore I know everything about all things. Sigh.

We are a bunch of wussies today. And, thus, in the gravest danger of losing what our Founding Fathers gave us. Want someone to blame for our predicament? Look in the mirror. I used to be a Libertarian. I was even a member of the LP.

Then I noticed something: LP members and Libertarians sounded embarrassed to defend the Second Amendment. Then I noticed what really motivated Libertarians, the debates in which they were the most animated, were those involving borders, drugs, sex (especially sexual perversions not within the Overton Window) and tax evasion.

Not long after, I ceased being a LP member, then Libertarian, and finally libertarian, in that order.

As far as I’m concerned, libertarians are little more than dope-smoking perverts who just don’t want to pay taxes – so they have more money for dope.

  36. avatar Dyspeptic Gunsmith says:

For those of us who have been around for Biden’s entire career in politics, the only indication that Biden is suffering from some form of dementia is the manner in which Biden utters nonsenses, not the quantity or quality of his nonsense.

Also not recently remarkable is his propensity for plagiarism and thefts of policy ideas. He has been known as something of a goofy, hands-on pervert and grifter his entire life, so none of this is news.

No, it’s the tics and deepening aphasia that are new and notable. Biden has been given to unthought utterances his entire life – he’s been noted as the man in politics for whom there was no delay or filter between a mental thought and utterance of said thought. Recently, his utterances make no grammatical sense, nor do they fit his circumstances. If Biden were looking at a shapely woman’s décolletage and he suddenly slipped up and said “What a rack!” we would be less concerned. That would have been Biden being the same Biden we’ve known for 50 years: no filter, a bit of a lech and not possessed of better words to express the idea.

What we have today is (using the above metaphor) Biden looking at a shapely woman’s décolletage and saying “Ford could have a winner with the Mustang in ’65!” – a huge error of time perception and situational awareness. Such a man could mistake the “football” for a device with which to order lunch.

As such, it behooves us to cease worrying about Biden and accept his situation as dire and perhaps a year or less from preventing him from discharging the duties of POTUS. What we should be worried about here is the potential of a Kamala Harris as POTUS – a female who has no scruples whatsoever and for whom the law isn’t so much as a speedbump in her quest for power.

Here’s what Chris Wallace said defending Joe Biden on Fox News Channel show Democracy 2020 (Coverage of DNC Convention) at about 10:15 pm EDT, August 19, 2020:

“I know one of the things that Republicans are going to talk about next week is the rise in violence in our cities. I think part of the argument the Democrats are making is that if we, and I understand this is very controversial, that if we got a lot of these guns off the street, especially the automatic assault weapons, which Biden helped ban back in the 90’s, that might reduce some of the violence in the streets. I understand that Democrats, I mean Republicans, will say ‘Joe Biden wants to take away your Second Amendment rights.’ The only problem with that is Biden has made it clear over and over, he’s not interested in taking away Second Amendment rights. He’s interested in taking away Weapons of Mass Destruction, like assault rif-  weapons.”
Chris Wallace, Fox News Channel, Democracy 2020, at about 10:15 pm EDT, August 19, 2020

Fox News should have Chris Wallace retract this statement and apologize on air for all the false and misleading items in this statement.

    1. avatar Sam I Am says:

“Fox News should have Chris Wallace retract this statement and apologize on air for all the false and misleading items in this statement.”

IIRC, Fox News is still owned by Australians, full on embracers of government as the the only legitimate provider of safety, comfort, wealth, protection, power.

Fox News has transparently been shifting left for the last five years. Always wondered how the son of Mike Wallace could be so different in political thought. That lasted for sometime, but somewhere/time the signal was given to move evermore leftward. Note also that originally Fox News was the “balance” to all the other news outlets. No no one needed to have leftist politics presented to them on Fox. Now, more and more leftists are appearing as “contributors”. As if Fox News followers are too stupid to understand that there is a wide array of leftist news outlets available.

I predict that before Trump can finish a second term, Fox News will be fully aligned with all the rest of the media. Probably as a result of pressure from advertisers, who themselves are becoming openly leftist. Or maybe it will just be the completion of the ideological values of the socialist owners of Fox News.

  38. avatar Miner49er says:

Joe Biden has been transparent with his tax returns and financials since day one, just like Obama, Hillary, John Carrie, John McCain, George the first, Bill Clinton, George the second, Reagan, etc.

Donald Trump promised his administration would be the most transparent ever, and now it looks like the federal courts are going to force him to honor his campaign promise to release his taxes.

I wonder why he refused to honor his campaign promise to release his taxes, do you think there’s a problem?

“A federal judge in New York on Thursday dismissed President Trump’s latest effort to stymie a New York grand jury subpoena for his tax returns and a trove of other financial documents.

The ruling by District Judge Victor Marrero relied heavily on the Supreme Court’s landmark decision last month that rejected Trump’s claim that presidents enjoy absolute immunity from criminal probes.

“That notion, applied as so robustly proclaimed by the president’s advocates, is as unprecedented and far-reaching as it is perilous to the rule of law and other bedrock constitutional principles on which this country was founded and by which it continues to be governed,” Marrero wrote.

The decision moves Manhattan prosecutors closer to obtaining Trump’s tax returns, though it’s unlikely the public will see them before the November election, according to legal experts.”

    1. avatar jwm says:

  40. avatar Jake Logan says:

“Federal law prevents hunters from hunting migratory game birds with more than three shells in their shotgun,” his campaign says. “That means our federal law does more to protect ducks than children.”

What is he implying? That that there is no shell limit for shotguns when hunting children?

  41. avatar adverse6 says:
