Elmer Humberto Aparicio-Castillo, an illegal alien from Venezuela, was arrested for alleged human trafficking and later, for illegal firearms possession.

In what is a sure sign we have a new administration running the country, a press release was issued by the U.S. Attorney’s Office for the Middle District of Tennessee Friday about the arrest of an illegal immigrant from Venezuela in possession of a firearm. The Fifth Circuit Court ruled in August 2024 that illegal immigrants have no protected Second Amendment rights and as such may not possess firearms if in the country unlawfully.

It looks like Americans may be seeing a return to some sense of law and order that dissolved under the Bident Administration.

Here’s a look at what the U.S. Attorney’s Office released:

Elmer Humberto Aparicio Castillo, 28, of Nashville, Tennessee, was charged yesterday with unlawful possession of a firearm by an illegal alien, announced Acting United States Attorney for the Middle District of Tennessee Robert E. McGuire. Aparicio Castillo is a citizen of Venezuela who is unlawfully present in the United States with a criminal history related to immigration offenses.

“This prosecution demonstrates our continued commitment to enforcing the law, especially against those who are prohibited from carrying firearms,” said Acting U.S. Attorney Robert E. McGuire.

According to court documents, on January 8, 2025, federal agents with Homeland Security Investigations (“HSI”) Nashville and other law enforcement officers executed a federal search warrant at 2334 Hobson Pike in Antioch, Tennessee. As the agents approached the house to execute the search warrant, five male occupants, including Aparicio Castillo, fled on foot from the back of the residence. All were caught. Following his arrest, officers conducting a safety sweep recovered a Glock 23, Gen 4 .40 caliber pistol with an extended magazine with a maximum capacity of 31 rounds which was loaded with 19 9mm rounds. After waiving his Miranda rights, Aparicio Castillo admitted that the pistol had been in his possession and that he had thrown it away as he ran from the house.

This case is being investigated by Homeland Security Investigations and the Metropolitan Nashville Police Department. Assistant U.S. Attorney Rachel M. Stephens is prosecuting the case.

It’s a lot of hype around the arrest of a single illegal, but it’s a start in the right direction for restoring law and order in the United States.

        • Agree. Told a friend that was talking about the immigration issues that we have enough crime and poverty, we do not need to import more of that.

          • The bigger issue is that it is technically low-intensity (non-military) Invasion. So, technically, he is guilty of engaging in efforts that are intended to destabilize & destroy the United States; therefore an Act of War. So I think send him immediately back in a body-bag or pine box.

            Then send a few thousand more back that way and then they will get the message. Mass-migration is just engaging in warfare by “soft” means.

        And we have no idea at this point how the 2028 Presidential election will go. We could get Kamala or Newsome, and in 5 minutes, this person is let go from jail and NOT DEPORTED. Just let go, and maybe even transported to the city of his desire.

        I say hold him in a US prison for 3.5 years, then send him back to the country of his origin. Maybe with some prison time first, he’ll go back home with a few body parts missing, and will decide that America is just too expensive for him to come back.

        • Why should the American Taxpayer pay for him to be in our prisons. You do realize how much it costs per year right? Send him back. If you want to make a message out of it, there are other ways.

        • In some states they may be, and private for profit prisons with corrupt judges keeping them full with financial incentives didn’t help. Problem is those were not the ones hit with bail and sentence reform the last half decade.

      In the unlikely (although not unprecedented) event that the accused actually had 9mm Luger cartridges in a handgun chambered for .40 S&W, I have heard reports that a pistol chambered in .40 S&W will sometimes fire and extract 9mm Luger cartridges. I have no idea if the 9mm cartridge would generate enough pressure to cycle the slide.

      (A 9mm–.355 caliber–bullet is smaller than the .40 caliber barrel which allows a significant amount of expanding gases to escape around the bullet and thus potentially fail to provide enough pressure to move the slide back. Even if the cartridge cannot move the slide far enough back to eject the spent casing, it is entirely possible that the human operator could manually pull the slide back resulting in the pistol ejecting the casing.)

      • While not recommend it could also have had a 9mm barrel to replace the 40sw it came with. So long as the aftermarket is close enough on tolerance it will absolutely fire but extraction is sometimes an issue. Curious on whether the extended mag was for 9 or 40sw as the last 40 of that type I remember was around 28 rounds or so.

      • he may have swapped the barrel for a 9mm barrel, on the market to take a .40 glock to 9mm and can even use the .40 magazines loaded with 9mm. I’ve done it for a couple of my glocks to try out and works fine and extracts fine. not sure about his particular model though.

    • Andrew, I’ve seen 9 mm loaded in .40 cal more than once. If the extractor grabs the rim and holds the round against the breach face it will usually fire. It will not cycle through and the bullet falls to the ground a few feet away. But hey, if you want someone to kill you, pointing a .40 cal loaded with 9 mm at them is a good way to make that happen.

    • When I began looking at their arguments for flooding the country with illegals back in 2016, I noticed how they conflate legal and illegal immigration as a tactic to fool people. Nearly ten years later, and some people still haven’t caught on because they obviously don’t want to catch on. They want to be lied to so they can confirm their own bias or stick it to the other “team.” Imagine wanting to live a lie. That’s easier than admitting you were wrong for some people. For others, it’s about hating this country.

        • Can make self deportation very attractive when birthright citizenship doesn’t apply to illegal aliens’ children, allow any public services to be paid to them, or allow enrollment in public school as well as setting up a proactive reporting system for employers hiring illegals especially where it suppresses the wages of native workers.

          Well, they just getting started and taking it easy. Holman has said they haven’t shifted into high gear yet for rounding them up and deporting them. So time will tell.

        Its a common misconception that tax dollars are not used to pay for abortions.

        There was what was called the ‘Mexico City Policy’, which banned federal funding of abortion overseas. Yes, it had to be specifically banned.

        As secretary of state, Hillary Clinton attacked the Mexico City Policy. Her husband, President Bill Clinton, revoked the policy during his administration and President Obama lifted the ban upon taking office in 2009.

        The United States Agency for International Development (USAID), which is tied to the State Department, steered more than $100 million tax dollars to Planned Parenthood, its international affiliates, and the pro-abortion Population Council between 2010 and 2012, according to the Government Accountability Office, and nearly $500 million in tax dollars to other pro-abortion organizations during the same time frame. With even more under Obama disguised as ‘foreign aid’ that always went to Planned Parenthood international affiliates and was also funneled back to Planned Parenthood in the U.S. . When the pro-choice start talking about affordable elective abortions – this is what they are talking about, the American tax payer paying for their elective abortions – when Planned Patenthood starts talking about funding they are really talking about the American tax payer dollars funding them.

        In his first term Trump put a stop to it, but a couple of days into his term Biden reversed that and started funneling tax payer dollars again for abortions.

        After the Supreme Court’s 2022 Dobbs v. Jackson decision, Biden took aim at the Hyde Amendment throughout his administration including ordering his secretary of health and human services to “protect and expand access to abortion” including the dangerous and sometimes fatal drug regimen responsible for most of the nation’s abortions. This “protect and expand access to abortion” included the funneling of tax dollars under various federal programs to fund elective abortions.

        Now Trump has published his intent to restore the ‘Mexico City Policy’, but also has issued an executive order affirming the Hyde Amendment and putting an end to the forced use of taxpayer dollars to fund or promote elective abortion. The executive order does away with Bidens funding of elective abortions with tax payer dollars by embedding forced taxpayer funding of elective abortions in a wide variety of federal programs.
