The NYPD, the State Police and virtually every law enforcement agency in the state carry 9-milli-meter guns, which have a 15-round capacity. Unless an exemption is added by the time the law takes effect in March, police would technically be in violation of the new gun measure.

Was this an oversight, or just wishful Liberal thinking? They passed a law making all those nasty guns and “ammo clips”, etc. illegal. If they really believed what they were doing was effective then one of two things should have followed: 1. NY Cops obviously would never need more than seven bullets in their ammo magazine clips, or 2. NY Cops really shouldn’t need to cary guns anymore anyway, since who are they going to shoot at and why? Nobody else has a gun, why should they need one, much less one with fifteen bullets?
No they should be limited to 7 rounders too, that way they can’t kill more innocent bystanders.
Of course they need assault clips. They won’t be able to shoot 14 innocent bystanders at once otherwise!

When the domestic forces of government (state/federal LEOs, etc.) are in a separate legal class from private citizens under laws governing firearms, even unto retirement, and private citizens have LESS access to firepower than domestic forces controlled by the government… how is that not a bald-faced violation of the Second Amendment?

How do “retired” cops also get exemptions?
It depends on the state, and on the manner in which they retire. Some retired LEOs can keep their gear, some can’t. Some move to Texas.

By the NYPD standard 7 rounds for an officer means one hit. A civilian with 7 rounds will have at least 5 hits.

I heard that all the violent criminals in New York have already gotten rid of all their “assault” weapons and standard capacity magazines. Which brings up another intended consequence of the law that didn’t work out quite as planned. The purpose of the 7 round mag limit was to block the sale of most handguns in NY state except for those compacts and 1911s that already have a limited capacity. Which is why it was rushed, to force NY LGSs to sell those guns to some other state. Your guy’s solution was to sell without a mag, assuming that at some point someone will fill the need for compliant mags (at an undoubtedly inflated price), thus defeating at least part of the law. I don’t get the ammo bit though. Is there another odious part of the law no one is talking about yet?

The law should exempt cops ONLY with the service weapons provided by the municipality. Any privately held guns owned by cops should have to be held to the same standard as any other citizen’s privately owned weapon. The service weapons they take home should have to be locked up at all times so their family members and others cannot get access to them. Any weapons that are personally owned and not locked away would have to be restricted to the same standards as their neighbors.
Cop = Civilian.

When a retired police officer becomes a civilian and wants to continue to posses a handgun he or she should have to apply and pay fees for a concealed carry permit just like the rest of us civilians.
I completely agree. A raw point out here in California is that leos can buy anything while the rest of us are limited to the Roster of “Safe” Handguns (which is getting smaller, not larger). (There is a loophole, but it adds a c-note to the cost.) Since these leos are buying non-dutyor off duty
firearms, there is no rational reason for the exemption (an exemption that until fairly recently extended to full auto ARs.)
Then again, I take the argument one step further. LEOs are an outgrowth and assumed the duties of the old militias. The cops are citizens, not a special class. Therefore there is no constitutional reason that they should be allowed to bear arms that are forbidden to the rest of the citizenry.

Don’t most full size 9mm handguns hold 17 rounds?
Full sized 9 mm handgun usually have 15 round standard size mags, but there are many standard size and extended 17 round mags as well.

I worked in NYC as a Transit P.O. I carried a .38 Smith&Wesson which was adequate for the job. I really don’t understand why a switch was made to the 9mm. Criminals had access to automatics weapons in the 20’s, 30’s, 40’s, 50’s, you get the idea and the .38 revolver did the job. Diallo might have lived if the officers were using them. Another thing that seems to me unfair is that when I was working I could go into a store that sold guns and buy anything I wanted just showing my ID. I think any weapon that is not to be used at worked, basically the service handgun, should have the same purchase restrictions placed on them as for any other citizen.
