“It appears someone forgot to exempt police officers from the ban of ammunition clips with more than 7 bullets in New York State’s new gun control law, ” wabc.com reports. “It’s a big oversight that apparently happened in the haste by the Cuomo Administration to get a tough package of gun-control measures signed into law.” Haste as in Cuomo somehow waiving the Constitutional requirement for a three-day waiting period between a bill’s introduction and a vote in the General Assembly . . .

The NYPD, the State Police and virtually every law enforcement agency in the state carry 9-milli-meter guns, which have a 15-round capacity. Unless an exemption is added by the time the law takes effect in March, police would technically be in violation of the new gun measure.

Technically as in actually. OK, ready?

State Senator Eric Adams, a former NYPD Captain, told us he’s going to push for an amendment next week to exempt police officers from the high-capacity magazine ban. In his words, “You can’t give more ammo to the criminals.”

Or citizens. “Technically.”

    • Was this an oversight, or just wishful Liberal thinking? They passed a law making all those nasty guns and “ammo clips”, etc. illegal. If they really believed what they were doing was effective then one of two things should have followed: 1. NY Cops obviously would never need more than seven bullets in their ammo magazine clips, or 2. NY Cops really shouldn’t need to cary guns anymore anyway, since who are they going to shoot at and why? Nobody else has a gun, why should they need one, much less one with fifteen bullets?

    • I can’t believe the gall these people have. Current and retired officers to be exempt? Don’t forget to include celebrities and politicians. And Cuomo’s uncle Vinny, Vinny’s got to have his Glock.

  2. Police tend to be law-abiding and should therefore be held to the same standards as the law abiding, even when it comes to guns.

  4. I think peace officers need to follow the same laws at the “subjects”…..if you’re going to treat it like a prinicipality, every one of the “kings men” should follow.

      I’m starting to get really irritated with the whole two-class system for firearms ownership. If you really think 7 rounds are enough, then make it the same law for everyone.

      When the domestic forces of government (state/federal LEOs, etc.) are in a separate legal class from private citizens under laws governing firearms, even unto retirement, and private citizens have LESS access to firepower than domestic forces controlled by the government… how is that not a bald-faced violation of the Second Amendment?

      Seriously, WTF?

    • I’d say that we need a Federal law saying citizens can buy anything they damn well please but that the police and federal agents are limited to six shot .38 special revolvers, .22 lr bolt action rifles, and pump action shotguns of 20 gauge or smaller.

    • If retired cops are exempt, EVERYONE should be exempt. Retired cops are not a special class of citizen. Neither are military veterans.

    • It depends on the state, and on the manner in which they retire. Some retired LEOs can keep their gear, some can’t. Some move to Texas.

  9. The police need more than 7 rounds in a mag so they are not outgunned by criminals. Isn’t that why civilians need more than 7 round mags too?

    I know there is a double meaning here but not really if you are a retired LEO you will get an exemption (when they ammend the law). If you’re not on the job any more, you are a civilian like anyone else. Some are more equal than others.

  11. Just to point out a factual inaccuracy, THE NYSP use .45GAP as does the Sherrif in ym county and all the municipal depts carry .45ACP. otherwise whne I pointed this out today they all just laughed at it. what cop is going to bust another for a mag over 7rds.

  13. Why shouldn’t law enforcement have to live by the same laws as everyone else? If no one else gets 8 bullets, why should the police need 8 or more?

    I heard that all the violent criminals in New York have already gotten rid of all their “assault” weapons and standard capacity magazines. You see, these are now outlawed, and they don’t want to break the law. So the police have nothing to worry about. All they need to fend off these formerly violent thugs are lollipops, sunshine, and hugs since all the bad things are against the law now and no longer exist.

  14. Assemblyman Al Graf (R,C,I-Holbrook) recently expressed his opposition to the poor government process that yielded a hurried vote on incomplete legislation. Graf indicated that the legislation contained numerous flaws, including one that hits extremely close to home.

    “My daughter is a New York City police officer, and under this legislation, we’ll be taking bullets out of her gun while the bad guys have no such limitations,” said Graf. “This is what happens when you circumvent the legal, responsible legislative process: you end up with a well-intentioned bill that completely misses its mark and ends up putting the safety of our children and families at risk.”

  15. I hate the way the reporter just kind of says “yeah it’s a problem, but it’s okay; it was a massive piece of legislation that they rushed on”.

    • Which brings up another intended consequence of the law that didn’t work out quite as planned. The purpose of the 7 round mag limit was to block the sale of most handguns in NY state except for those compacts and 1911s that already have a limited capacity. Which is why it was rushed, to force NY LGSs to sell those guns to some other state. Your guy’s solution was to sell without a mag, assuming that at some point someone will fill the need for compliant mags (at an undoubtedly inflated price), thus defeating at least part of the law. I don’t get the ammo bit though. Is there another odious part of the law no one is talking about yet?

  16. Retired cop = civilian. Period.

    The law should exempt cops ONLY with the service weapons provided by the municipality. Any privately held guns owned by cops should have to be held to the same standard as any other citizen’s privately owned weapon. The service weapons they take home should have to be locked up at all times so their family members and others cannot get access to them. Any weapons that are personally owned and not locked away would have to be restricted to the same standards as their neighbors.

    That is “Are we in the middle of a wild eyed McCarthy Era moment?”
    The president’s question is, “Is what I just signed as bad as the abuse of power Nixon used surrounding Watergate?”
    For the Sepreme court: “Are we about to rule very stupidly on Dred Scott’s case?”
    Answer so far, Naaaah.
    Maybe some hope yet from the Supremes.

  20. Police certainly don’t need KILLING MACHINES with NO LEGITIMATE USE except for mass murder. Especially if any of them are on depression or anxiety medication or have ever lost their temper. What if one of them goes nuts? Imagine the social cost?

  22. When a retired police officer becomes a civilian and wants to continue to posses a handgun he or she should have to apply and pay fees for a concealed carry permit just like the rest of us civilians.

    • I completely agree. A raw point out here in California is that leos can buy anything while the rest of us are limited to the Roster of “Safe” Handguns (which is getting smaller, not larger). (There is a loophole, but it adds a c-note to the cost.) Since these leos are buying non-dutyor off duty
      firearms, there is no rational reason for the exemption (an exemption that until fairly recently extended to full auto ARs.)

      Then again, I take the argument one step further. LEOs are an outgrowth and assumed the duties of the old militias. The cops are citizens, not a special class. Therefore there is no constitutional reason that they should be allowed to bear arms that are forbidden to the rest of the citizenry.

      1. Not reporting crimes on the innocent to keep precint crime census low
      2. Police shooting innocent bystanders in unnecessary cinematic shootouts.
      3. Raping women while on duty.
      4. Police prostitution rings.
      5 unjust police harrassment and racist stop and frisk laws.

      These are just the icing on the cake, ignorant douche master…

    Don’t most full size 9mm handguns hold 17 rounds?

    • Full sized 9 mm handgun usually have 15 round standard size mags, but there are many standard size and extended 17 round mags as well.

    If The people have to be restricted in the amount of ammo they carry, as not to have more than the police.

    Why would the Police need more than the people if the people have less than the police?

    Now, how many times have the “Use of Excessive Force” been applied to the NYPD in the past 10 years?

  31. I worked in NYC as a Transit P.O. I carried a .38 Smith&Wesson which was adequate for the job. I really don’t understand why a switch was made to the 9mm. Criminals had access to automatics weapons in the 20’s, 30’s, 40’s, 50’s, you get the idea and the .38 revolver did the job. Diallo might have lived if the officers were using them. Another thing that seems to me unfair is that when I was working I could go into a store that sold guns and buy anything I wanted just showing my ID. I think any weapon that is not to be used at worked, basically the service handgun, should have the same purchase restrictions placed on them as for any other citizen.
