Cobb: Fear of Blacks Is Now Motive Enough for a Self-Defense Shooting

The index of cases like [the Arbery shooting] seems to point to racial presumptions implicit in how we interpret the concept of self-defense. It is reminiscent of the “gay panic” defense of old, in which violence committed in the name of self-defense was acceptable based on a straight person’s allegedly rational fear that a presumably gay person might assault him. We are living in the age of the black-panic defense.

There was no conviction in the trial of George Zimmerman, who killed Trayvon Martin, and no charges were brought in the deaths of John Crawford and Tamir Rice. But no one can seriously believe that if two armed black men chased down and shot a white man in Glynn County, Georgia, they would walk around freely for more than two months. Whatever [Alan] Tucker’s motives, his release of the shooting video appears to have accelerated the arrest and charging of the McMichaels with murder and aggravated assault. The efforts to bury the case have failed, but it remains hugely significant that two prosecutors saw the video and thought that the two men should go free. The question is whether a jury of twelve Georgians will agree with them.

      Just my guess, but its a reminder that just because you carry a gun, openly or otherwise, you have a responsibility to do so legally and in a way not to intimidate others. No doubt you have watched the video and looked over the laws in Georgia. I would have to say that Arbery probably felt intimidated by the actions of two armed men who first tried to stop him and then blocked his path with firearms displayed. He reacted out of fear and for that he is now dead.

      The odd thing I noticed is both of these men (McMicheals) had been court officers and should have known their detention of Arbery wasn’t legal. They should have also known that while the open carry of those firearms was legal, their actions while carrying them was, at best, questionable.

      I believe it is a reminder to all of us, if we want to keep this right, we need to exercise it as the founders intended. If crap like this happens, there will eventually be enough opposition to the Second Amendment that is will change, be heavily regulated or gone.

        I agree with the Randy Jones assessment. There was nothing defensive in this encounter- the McMichaels inititated it with little or no evidence that Arbery was their “suspect” other than being black and jogging.

        I run about 5 miles per day, would that make me a suspect if I were black and some crime had been committed within a 2 mile radius? Let these looney’s lawyers defend them- I see no reason to become embroiled in race issues when it appears a prejudice may have been the primary reason for the encounter. Also keep in mind that the primary reason we carry is for self defense.

          Only an individual with a bigoted mentality would stoop to provide cover for the McMichaels. Those two were waaaaay out of line and waaaaay out of bounds with the law. A couple of days ago some guy supporting the McMichaels claimed they had a video of the deceased committing the crime. Where is it? Nowhere because it does not exist.
          The armed McMichaels are two buffoons who without any solid evidence whatsoever took the law into their own hands and an unarmed man who tried his best to fight back is deceased. The McMichaels initially determined the perp was Black so in their small minds all Blacks are now perps. It does not work that way unless you are a bigoted bag of manure with a box of popcorn cheering the McMichaels on..
          Firearms should have never become part of the equation. All that was needed was a photo to turn over to the police and surely the McMichaels had phones with cameras like the individual who filmed the tragedy and was key to putting the McMichaels where they belong.
          Deadly force is only to be used when there are no other options such as staying home or maintaining a non confrontational distance from the suspect. Too bad the jogger was not armed, it would have been a clear case of self-defense.
          There are individuals on this forum who show their bigoted behinds at the mention of a Black crime. To these bigots…You just keep thinking the face of the Boogieman is Black and leave the door open for some armed lily white perp to make a stupid bigot their new wife.

        It’s also a reminder that retired “highly trained professionals” aren’t necessarily any better at handling firearms than non-military / non-law enforcement folks, contrary to what the disarmament community pushes.         +1. The purpose of the article is to remind you to be on the “strategic defensive” when you carry. That is to say, when I carry a firearm, I’m not looking for trouble. I’m looking to be left alone though I am prepared for and situationally aware of trouble.

        That’s different than the “tactical offensive” when you’re not left alone and have to finish the fight.

          E) In Georgia, citizen arrests are legal.
          F) Both father and son were legally allowed to have firearms.
          G) It is legal to carry firearms in a vehicle in GA.

          I) The DA found no criminal actions on the part of the white guys.
          J) Finally, 911 was called on the dead sacred black twice prior to the incident.

        I too agree with Randy. I have not seen anything to this point to suggest that even the displaying of a firearm was warranted. In fact, if this young man had gone after the gun-wielding person to defend himself, he was in the right to do so. The fact this young man walked through a home under construction does not show any ill intentions. I myself have done so many times to see the rough in layout. As I always do, I will wait until all evidence is presented but on the surface, and from the video evidence I have seen, this is a bad shoot.

          Gee if you see a unarmed rapist or an unarmed man who just beat someone to death of course you have no duty nor right to pursue the individual in question and if a 20 something attacks a 60 year old how dare he shoot in self defense. Did the McMichaels have that level of influence in their community? 2. Why did it take so long for the video to forward? 3. What explanation can the first DA have for the delay? 4.           Well Bobby, the reason is they, at first, felt there were no charges to be brought. The DA first handling this case had a DIFFERENT opinion than those who came in later after all the recusals. That takes time.
          They don’t just release the vids as soon as they get them for obvious reasons——–the lynch mobs form too quickly.
          Lastly, who says which legal opinion of a crime being committed is correct here?
          I’ll tell you. NO ONE BUT THE GRAND JURY! And ultimately the jury of We the people.

      Defensive gun use posts are pertinent to Gun Rights, whichever side of the argument they may fall on where public opinion is concerned. Every time a citizen rightfully defends his or herself with a firearm, it adds to the defense of the Second Amendment and the natural Civil Right it enumerates.

      The opposite is also true. Every time a citizen wrongfully uses a firearm it harms the case for all of our natural Civil Right to keep and bear arms.

      We would be fools not to pay close attention to both cases.

      I see it either way. It depends on how well their defense is able to present the case s well as the racial and gender makeup of the jury. There have been more than a few cases where I was stunned by verdicts.
      That said the smart defense would have been to never get yourself into such a situation in the first place.

      Black panic might be reasonable in other cases but not this one. If I were being chased by armed men and I was going to get killed anyway, I might as well go on the offensive and try and get a barrel up.

      That said, I do keep my eyes open around unknown / unfamiliar blacks the same way I do around cops and tweakers. I keep my distance until I’m required to interact. Once they pass my sniff test, everything is well, but not before. I’ve had my ass grabbed and spanked enough times by randos in the grunts, in public no less, to keep a distance around gays as well.

      True, its not an open and shut case, but it is. Even if he had the hammer, that would not be a felony. First I would like to point out the ‘hammer’ was reported by the same people who are currently arrested. There is, as far as I know, not video evidence of the ‘hammer’ being dropped. The same people who claimed hey wanted to question him and possibly make a citizen’s arrest. Except, as I recall from living in Georgia years ago, you can only make a citizen’s arrest against someone who committed a felony and only then if you have proof or first hand knowledge they committed the crime. there was a 911 call, but the portion of what was released from that said they say him at the construction site, but did not mention seeing he take anything or damage anything. Trespassing on an ‘open’ construction site I believe is a misdemeanor. Still not a reason for a citizen’s arrest.

Further, if there is evidence that justifies the shooting, will the Georgia legal system have the integrity to avoid a Trayvon style show-trial.           No actual PROOF needed at that time. The investigation that follows often provides the PROOF———-or not. But the arrest is still valid.

      It’s an open on shut case because Georgia Law only allows you to make a citizens arrest in the immediate wake of a crime and not days later. The contrast with the Zimmerman case is obvious to anybody who knows the facts. Zimmerman contacted the police first and was moving away from trouble and going back to his truck when Martin attacked him..

        Zimmerman has disregarded dispatches direction to discontinue pursuit, he exited his vehicle to more effectively stalk Martin.

          Charlottesville was an Antifa/BLM ambush set up by the city government and perpetrated by the PD.

          After months of legal struggle against the city which was trying to stop the demonstration against the removal of a Confederate statue, and several other demonstrations actually going forward peacefully, the Unite The Right people got the legal go ahead from the courts. They were supposed to have parking near the location, and police keeping counter protesters away, but the day of the even they were forced to park at a considerable distance. They were supposed to be allowed to have their own PA system, but due to being unable to drop it off by vehicle they could not.

          BLM and Antifa were organized into large blocks of people by the police with only narrow corridors through the crowds created by flimsy barriers. Unite The Right people were forced to enter the area in those narrow corridors between BLM and Antifa. when the UTR people were well into the midst of the counter protesters BLM and Antifa then began throwing objects. At that point the police declared the UTR assembly “unlawful” in violation of the court orders and ordered the UTR people to disperse. The UTR people attempted to egress back by the route they had entered through via the narrow corridors between barriers but were blocked by police. Police removed barriers at the front of the assembly and forced UTR people to disperse through antifa and BLM. Then the police withdrew to a safe distance to let BLM/Antifa have their way.

          What followed was essentially a fighting retreat by the UTR people back to where the UTR they had been forced to park. In the famous parking garage photo of the black man who was beaten you will see another man on the ground. That is white guy who was just beaten down by the black guy in the picture and his friends. The white guys beating the black guy had come to the other beaten guys aid.

          There is a video of a UTR guy shooting at the feet of a black guy. What is not shown is that black guy using a spray can as a flamethrower at the UTR guys immediately before.

          James Fields, the man who ran into a car which ran into a car which ran over communist combatant Heather Hyer, had driven down a street which he found to be blocked by the other cars stopped by an antifa/blm crowd. His vehicle came under attack by Antifa and BLM with sticks, bats, and bricks and he panicked and hit the gas causing the accident.

          The post event legal situation was a disaster. A number of white guys got railroaded into various crappy plea deals while the few antifa/blm people that got charged had their charges dropped or got otherwise let off.

          Media coverage was pure fiction but permeated our society so thoroughly that even Ann Coulter and Rush Limbaugh still spout the false media narrative.

          The city government of Charlottesville is full of open communists and they have actually bragged about this but most of it has gone down the memory hole, been deleted, hidden or otherwise covered up.

          It’s all out there though, if you look for it.

    This is an interesting case, and of course bad for the 2nd amendment. These white dudes are, at best, mentally challenged. They started an armed agressive encounter. I am capable of unbiased, non binary thought. I’m also studied in the law. Unless more information comes to light, I highly doubt these guys will be convicted of any degree of murder, despite what the media mob would like. Depending on what we find out, I could see them being charged with assault with a deadly weapon, manslaughter, or nothing at all. What’s strange is that the deceased himself could have used deadly force in lawful self defense throughout the entire encounter.

    It’s almost like the media mob picks cases that are difficult to have a happy end. In this way the politicians can continue to rape the black community and the 75% out of wedlock birth rate can go unaddressed. Also, the top killer of black people in this country is abortion, done by their own mothers. Sad.

          I’m willing to defend the rights of all Americans and that often means defending the worst of the worst to prevent a bad precedent become entrenched and used against everyone else in the future.           Its also a bad precedent to set to allow theft to go unchecked in a society. Now people have to take time off from work, sleep, family, etc, to establish a neighborhood watch to protect their own communities.           The difference between your sister’s case and this case is that, as cold as it is, one is a statistic that happens every day; the other is a sensational, ratings getting, drama festival that pours gasoline on an already raging dumpster fire. To compound the matter, the MSM media doesn’t usually care about the welfare of White people, most Asian people, or “privileged” people. The media are part of the same crowd that wants us all replaced with low skill, low education, third world types which have a higher tolerance for corruption and are much easier to control. They are literally a means to an end for political power and the media is almost exclusively democrat (communist) controlled.

          Life and livelihood are about the only reasons to chase after a criminal since they are essentially slam dunk if if goes to court; everything else is too much legal liability. Irreplaceable equipment needed to support your family and a lawn gnome usually have two different legal weights, one is livelihood, the other is property. Chasing someone for stealing a disposable lawn chair, while legal, would be a pretty stupid thing to do. One could say they will just come back for more, well, they might; but it seems more like a symptom of a rotten police force. If the police are corrected, handing surveillance footage to the blue gang will should sort it out. This vigilante stuff probably came about because someone refused to do their job and tossed the whole theft thing in the trash bin.

          Do you remember the movie, Boys Don’t Cry? It was inspired by a real incident in southeastern Nebraska. A confused girl masqueraded as male and dated some girls. Two studs found out and raped her. After she got them charged for it, they murdered her and two friends who had given her shelter.

          In another case in Omaha, two white guys thought it would be fun to abduct, rape and murder a black girl. The case was solved only after one of the murderers turned himself in and implicated the other. Unfortunately, he suicided before the trial so the other one got off.

          An immigrant family from South America had a job making repairs in an Omaha church. Some other Hispanics thought there was money to be stolen. They tortured the father and then murdered the entire family. One of them turned himself in, pleaded guilty and testified against the others. They didn’t get off.

    Two prosecutors read the case file and recognized the name of one of the people involved, recused themselves because they had worked with one of the subjects in the case, and referred the case to subsequent authority. In the meantime, the County Sheriff’s office decided to wait on a prosecutor to take the case before any action against a former peace officer and DA’s investigator. The Sheriff was clear the his office had made NO decision about charging (or not charging) the retired DA’s investigator and his son.

    The father and son may – or may not – have killed the runner because he was “black.” The cell phone clip is NOT clear about what happened behind the truck. The inconclusive evidence does not give the press the unfettered right to lie about the known facts!

      The news reported that a neighbor named ‘Roddy’ Bryan took the video. They did not site a reason why he felt the need to follow and record the event. The police have now questioned him and, last I saw, stated they haven’t decided whether to charge him or not. He supposedly stated he released the video because he wanted to clear up conflicting stories and bad information about the shooting. I’ve seen the video a dozen times and I can see where this didn’t clear up anything. It can easily be interpreted to go either way.

      According to what his lawyer said, he was on his lawn and saw the guy running, someone he didn’t know, and being chased by someone he did know and recognize. He jumped in his car and followed as well and recorded it. If he is just an innocent witness or not, I don’t know, but there is a lot of conflicting information. The fact that he talked at length to cops without an attorney present was a pretty dumb move.

      The mob now wants him charged too with murder, among other things. He claimed releasing the video would prove the two guys not guilty. I can only speculate that it was done under the notion that the police would try and lynch the two vigilantes if he didn’t get the video out immediately or draw a lot of attention to the matter.

      He has since lost his job and received tons of threats over the matter, despite only filming the incident.

      There was no due process of law. It was covered up twice, for months, by buddies of the McMichaels. This has to be settled in a court of law, not explained away by a corrupt white woman who worked with a McMichael for many years.

      When there is a homicide it is considered unjustified until proven otherwise. This case had video evidence that was enough to demand charges. You can’t have a dead body laying in front of you, while you are holding a gun, then say, “Self defense, officer,” and get away with it.

      To court we go for peaceful justice. If not, there will be non peaceful justice.

          This happened months ago and the DAs wrote letters saying there shouldn’t be any charges. Three DA refused to press charges after going through the evidence. The governor had to send in the GBI and now they are looking into investigating the local authorities for corruption.

          There was no due process of law. There was a good ol’ boys club covering up for their friend. They even went to the crime scene. WTF!

      Even if he committed a crime a week ago, a day ago or even a couple of hours ago they had no legal authority to detain him. Private citizens cannot do a Terry Stop. If anything should make it clear that sworn officers are not the same as private citizens it’s this incident. Even if they had indisputable video evidence that this was the guy all they could legally do is call 911 and follow him at safe distance.

      The best you could say about Papa McMichaels is that he forgot he was no longer a police officer.

      The particular problem with this case is it that did not happen for almost 3 months, the prosecutors office covered up the case in order to protect their friends.

      It wasn’t until the accomplice’s video was leaked that the public found out and became outraged.

    I have gone through well over a dozen articles about this, not counting the repeated stuff. If you throw out the second and third hand information and comments by political folks, Hollywood types and the usual SJWs, you still get sketchy evidence as to what really transpired.

    The fact is what matters here is what we learn from it and how we can prevent things like this in the future. I started concealed carrying legally back in the 1980s. When I did, I was told by a mentor, while it is important to learn to ‘run the gun’ and become proficient with it, it is just as important to understand the responsibility that comes with the right to carry. Laws to vary from state to state, but it is important we understand them else we cause a conundrum like this goat rodeo.

    Actions by both parties could have been better, but the McMichaels probably caused the brunt of it. I believe it will go down as Involuntary Manslaughter. The firearm discharged while their was a struggle for it, Travis may not have meant to pull the trigger. The type of shotgun was not mentioned anywhere but my guess is it is a semi–auto. Else it would have to be racked several times during he struggle.

    If you were Arbery, minding your own business (presumption of innocence), jogging down the street and you were confronted this way, how would you have responded? How would you have responded if armed and if you were unarmed. Seriously, what would a reasonable person think and do?

    This would not be in the news is it was white on white, black on white or black on black. It would be buried in section five of a four section newspaper. But it was white on black and now every SJW, liberal politician and half of the Hollywood elite wants to take our rights. We as a gun community need to better educate our members, especially the new ones (apparently the old ones) to ensure we don’t lose what we hold dear.

If they thought he was a suspect in the robberies, why not call the police and show them your video evidence and let them decide? There was no reason for any involved including the deceased to be mixed up in all this. Self defense is one thing but vigilante justice is another. Bad judgement on the part of the father and son. I dont know if it was racially motivated or not but either way the two should both go to jail for initiating the encounter that resulted in a death at their hands to begin with. Their actions are wreckless at best and malicious at worst.

    Why was the confrontation filmed? I don’t understand the shooter’s point in doing this. Doesn’t seem like a defensive gun use. If you point a gun a someone sometimes the person who is being pointed at will not comply and fight back. Shooting someone for a property crime doesn’t usually hold up in the courts. This case needs a lengthy and by the book investigation. That being said, in my opinion, the shooter and his accomplices will probably do serious prison time.

      Bryant filmed the shooting. He is the neighbor that witnessed Arbery enter the construction site for a few minutes and called the police to report the trespassing. Bryant witnessed the father see Arbery run past the McMichaels’ home and the father run inside to get his son and some guns, then jump in the truck to hunt down Arbery. Bryant decided to also jump in his vehicle, help chase Arbery and record the incident.

      I think Bryant will be used as a key witness to convict the McMichaels. He could be arrested and pressured into doing it because he assisted the McMichaels in attempting to stop Arbery by using his vehicle. Right now his lawyer is trying very hard to keep him from getting charged and to remain an unfortunate witness to a murder.

    Without getting into all of the other aspects of this incident, I was pleased to see that GA doesn’t have a so-called “Hate” crime law. Never understood the desire to punish the possible motive for a crime as opposed to the crime itself – other than for those wanting to get votes for supporting such laws. Heck, one could say they hated not having money as motive for robbing a bank. Punish the crime. The motive doesn’t matter. Other than possibly giving the feds another reason to get involved. My impression is that they infer an individual crime is against a class of people as opposed to an individual victim. Gonna list an entire class of people as the victim(s)? In this case, the suspects may or may not have something against all blacks – or maybe it was just this one victim based on what dad knew about his past behavior. Though the one transcript of the initial 911 call that describes the problem as being “There’s a black guy running down the street” doesn’t do the suspects any favors.

      This is the first time something more akin to a lynching has been caught on camera and uploaded for the world. And it’s the first time both sides are in major agreement that this was wrong. There are people saying it brings up memories of Trayvon because of the bullet points. However, the Trayvon case had a clear divide between Democrat and Republicans. Even the EJ Bradford case (unfortunately) had a divide, that case is way more like this case. So did the Philando Castile case.

    It’s a shame the author and some commenters here already know exactly what took place and all circumstances pertaining thereto. However they seem to be severely lacking in knowledge of the laws of the state of Georgia. Until all facts are presented I will withhold my opinion of whether these men are guilty and of what crimes, at this point it will be difficult for them to get a fair hearing and they will be endangered the rest of their lives. If they do get a fair trial are found guilty then certainly they should pay the penalty required by the state. Neither emotions nor political influence should determine this outcome though. I usually read TTAG because there are some decent reviews of firearms. Now they’re posting assumptions based on what the msm is telling them to believe. And yes, there are thousands of instances of horrific crimes of rape, brutality and murder perpetrated against whites by blacks every year yet there are no public cries of outrage, no sensationalised media coverage 24/7, no riots or protests or calls for justice for the poor victims of these crimes. But I would just like to say that white lives matter too.

  44. As is usual with these type of shootings we don’t have all the facts which will come out at the trial. There are probably many things we don’t yet know. But people start giving their opinions based on the little that comes out in the media. It looks to me that writers like Jelani Cobb just want to spread the racist anti-gun rhetoric b.s. and paint all gun owners as racist killers just looking for a chance to gun down others be they black, white, hispanic. I also saw LeBron James screaming that blacks are hunted every time they walk out the door. Just more b.s. from racists trying to divide us by race. They always pick out a rare occurrence to push their agenda and never want to wait for the facts which most of the time don’t support what they’re saying so they aren’t interested in them. I’m no expert but from the little I’ve seen it looks like to me these men violated many of rules that are taught by experts. I think many of us wouldn’t have handled it they way they did.       Do you honestly think the cops would even bother responding? I had a motorcycle stolen out of my garage a few years back. Took the cops three hours to show up. They didn’t bother with the surveillance video that showed the guy’s face. Never even got my own copy of the incident report because the cops were too lazy to write it up.

      Cops are only useful for occasional emergency response and the carting away of dead bodies.

    IMHO, the victim’s skin color was NOT the motivation for the McMichaels’ actions. Like any police officer(presently one or ex), their prior knowledge of and the current actions of Arbery definitely were; from what I can so far gather from the reportings.

    Some food for thought here people:
    1) Prior knowledge and actions = probable cause to question.
    2) Citizens have the right to question people. Although not always the smartest thing to do, but it is NOT unlawful to do so.
    3) Citizens have a right to make a citizen’s arrest.
    4) Citizens are not only the FINAL arbiter of the laws(as JURORS)that they make through their representatives(politicians), they also are the ENFORCERS of said laws, either themselves or through delegation to police officers they hire.
    5) The McMichaels’ had the right to stop and question this guy. Certainly, if they KNEW that he committed a crime they would even have had the right to DETAIN him.
    6) They had the right to be armed. However, displaying the arms right off the bat(but how do you conceal a shotgun?) may not be the wisest thing to do.
    7) Arbery attacked the guy with the shotgun first(not a smart thing to do at any time) and attempted to take the weapon, like thugs sometimes try to take a cop’s weapon. He DID NOT have any REASONABLE reason to do so from what we know. But perhaps his guilty conscious or perhaps fear triggered him(It did in the Brown/Wilson shooting case in Ferguson).
    8) At that point, it became a life or death struggle for both men. Arbery lost that battle. It appears that the gun was going off while both men had their hands on it in the struggle.
    The guy with the pistol never shot it.
    9) Was the trigger accidentally pulled because of the struggling or was it deliberately pulled by either guy?
    10) If the two guys with the guns were out to shoot this Arbery guy, would they just not have gone and done so right off the bat??????!!!
    11) LASTLY, what if the McMichaels’ were two plainclothes detectives confronting Arbery and this occurred????
    Granted this is a tough one and a JURY will, as always, be the FINAL arbiter as it should be. Not me, not you, not the cops, not some single race-baited judge, not some bigotted racist neighborhood lynch mob. AMEN!

        I think all POTG/hobbyists should do/try one at least once just to gain knowledge. Especially before it gets shut down because of ‘muh tracking’ of serial numbers which I find of limited value IMHO.

    A whole lot of irrational logic being used here. How about we leave it up to the courts to decide whether they are criminals or heroes. While we all love guns (or we wouldn’t be here) we need to avoid supporting every person using a gun just because we own guns. We don’t know the whole story yet, so no one here can say whether they are criminals or not. However, justifying ever killing just because a gun was used is nonsense. I agree with those who said this conversation would be totally different if it were two black men killing a white man.

    The problem arises when the suspect attacks the guy and grabs the shotgun. NO ONE was in danger of death until that occurred. The whole situation CHANGED at that point to a life and death situation, instigated by the suspect. Same as if he grabbed a cop’s gun. The technicality of “cop vs citizen” IMHO should not be an issue but I’m sure it will be.

    You see, the right and authority to enforce the law is an inherent RIGHT of all citizens. In fact, the process of enforcement has its ABSOLUTE and FINAL culmination in the carrying out of the law BY A JURY of CITIZENS !!!!
    We the People MAKE the laws and merely DELEGATE OUR duty of enforcing them to LEOS as a matter of community convenience. We never relinquish that duty. At least not until we let them take our Constitution and trash it. Then we will have an ABSOLUTE POLICE STATE! Bet you would love that, A?!

    This will all play out in COURT as it is supposed to, thank God.

    P.S. There are lesser crimes that a cop cannot arrest for unless they WITNESS it themselves.

A plausible assumption, but I’ve not seen any information that points to their having direct knowledge that such an event occurred.. All I’ve seen/read indicates that they were acting on second hand knowledge and a black guy running through the neighborhood resembled the description they had been given of a perp… To be clear, I do not agree with what they did, I don’t think anyone has the right to arbitrarily pull a gun on someone or threaten someone with a gun unless they are acting in self defense or coming to the aid of another person who is not in a position to defend themselves… If a guy has “possibly” committed a crime that does not affect me or places another person in harms way take picture (everyone has a cell phone) and call 911…..

          Police arrested 19-year-old Ahmaud Marquez Avery (pictured below), who is not a student at Brunswick.

          “The man ran through the parking lot. I tried to get him to stop as well. He would not stop for us,” said Glynn County Schools Chief of Police, Rod Ellis. “We ended up chasing him to the back of the school were other officers helped us apprehend him.”

          Ellis said the .380 caliber semi-automatic handgun slipped out of the teen’s pants.

          They do not have the same trespass on a construction site law as us but I’m thinking the part that would apply is

          (a) A person commits the offense of criminal trespass when he or she intentionally damages any property of another without consent of that other person and the damage thereto is $500.00 or less or knowingly and maliciously interferes with the possession or use of the property of another person without consent of that person.
          (d) A person who commits the offense of criminal trespass shall be guilty of a misdemeanor.

          Larry English, the man who owns the house under construction, told The Washington Post that the structure was not robbed.

          “That’s completely wrong. I’ve never had a police report or anything stolen from my property, or any kind of robbery,” he said.

          Since it appears nothing was taken, the owner states nothing was taken there would be no crime involved.
          The father & son thought he was who had stolen a firearm several days before so they pursued him and after few tries managed to block his path.

          The situation quickly got out of control with the result of a death and 2 individuals who no matter how this works out will be worse off. Either in prison or bankrupt. Odds are their buddy will do anything to keep from being tied in with them.

          But to you and a few others the killing of a black is a cause for celebration isn’t it? Still got the klan robe in the back of your closet?

      The “new” video is said not to be Arbery. The family denies it’s him, thus the video is not spreading. They admit they did catch him on video on the 23rd, the day of the shooting.

      Maybe certain people seem to think every black man looks the same?

      Let’s say it’s him. The owner said nothing was stolen from his property, he never called the police. If Arbery was going there once a week, he never stole anything, according to the owner.

      Why do the McMichaels care about black men trespassing at a construction site they don’t own that haven’t stolen anything and when the owner does not give a shit? Why do they attempt to make a “citizen’s arrest” for a non felony when they know it’s Arbery, have evidence of him and they already know where Arbery lives? Why do they refuse to call the police and file a report so the cops can go down to Arbery’s home and tell him if he goes on the property one more time he will get arrested for criminal trespass? Why didn’t the home owner do that instead of the McMichaels? Why is it the 3 white men who have no say about the property next door think it’s up to them to take out Arbery?

      If you are the owner and have video proof of a person trespassing on a construction site take it to the police to give him an official trespass or put up a sign saying no trespassing. If you have numerous videos of Arbery he could get in major trouble if he is still on parole, he wouldn’t come back if you tell him you will go to the police.

      The McMichaels already known Arbery for years. Why don’t they go to his house and tell him not to trespass on the property anymore? Maybe because they have no authority over the property? Or maybe it’s because they were after him for their handgun? The evidence says the McMichaels were after Arbery for the handgun they assumed he stole, they behaved as if he was armed, they touch his dead body as if he had their handgun, the report says they believed he had the handgun, Travis is the one who shot him and he is the owner of the handgun.

      Here is the worst part. If the McMichaels knew it was Arbery going over to the construction site (they do not own nor have power over) numerous times and decided to take up arms to chase him down for that extremely low level crime, this would make it premeditated and reckless! You don’t refuse to go to the police for them to issue a warrant or parole violation, so you can do it yourself with guns, be willing to use those guns on him and actually do.

      They had no lawful authority to leave their property with guns to chase down Arbery for trespassing on a property they don’t own. They became the felony criminals once they drove off their property, therefore, they forfeited their legal protections for a civilian’s arrest. After all, they claim they only wanted to talk with him.

      In what world do you take a long gun to “talk” to a person you believe is a felon on the run? In what world do you refuse to go to the house or the police when you have numerous pieces of evidence? In what world do you tell the police you thought he was armed because he stuck his hands in his shorts one day? In what world do you accuse him of stealing your gun and go after him armed to have a chat about it?

      These men are guilty. The more evidence that comes out the worse it is for the shooter and his father.

      Worst case for Arbery is he visits a construction site to look around and hang out. According to the owner, he never stole nor damaged the property. He wasn’t “casing” the home to commit burglary, that is a made up story from people that want him to be guilty to justify the homicide.

      The evidence shows this had to go to court to be settled properly, which means the 3 DAs are corrupt. There has to be a DOJ investigation into this community, the FBI has to go poking around. It’s looking very bad for law enforcement in that area.

      I heard he lives 2 miles from the construction site or 12-20 minutes away. It’s not okay to dox the mother, but not doing so is allowing people to make up a story that he was on a 24-40 miles “jog.”

      If he did live 20 miles away, who the heck can run a 5 minute mile the entire length? I could run a 5 minute mile, I used to run a few in a roll, I am not running that speed the entire 20 miles, I will walk or slow down significantly. You have to be a super athlete to run a 5 minute mile for entire length of a marathon.
