California Just Got Even Tougher On Guns the huffingtonpost.com headline proclaims. “The state has some of the strictest gun laws in the country. Voters just said they’re not enough,” the strap-line ads, helpfully. Copy that. No wait. Don’t copy that. Highlight and delete Proposition 63 ASAP. Which could actually happen, should a case challenging its provision or provisions reach the Supreme Court — now that the Trump administration will elevate a strict Constitutionalist to the Supremes. Meanwhile, HuffPo wonders where the NRA was in all this:

As the former roasted chicken magnate Kenny Rogers sang, you got to know when to hold ’em. The NRA had to deploy its limited resources where they could do most good. Despite the Golden State’s goose-stepping march towards civilian disarmament, I reckon the NRA did an excellent job defending gun rights in this election cycle.
Anyway, again, gun rights advocates now have a plan B. It will take years and hundreds of thousands of dollars to implement and there’s no guarantee the Courts will strike down these unconstitutional regulations, but some hope is better than none.
That’s why we need federal preemption of all gun related laws and a mandatory USC 1983 charge for anybody who attempts to enforce them. With Trump in office with a GOP Congress, we have a chance to pass this. Don’t squander it.

The language reads: “Shall not be infringed”. That is not unclear.
There is nothing specifically assigning that power to the federal government. There are also no personal consequences to would be tyrants. Both need to be passed into law.
The 2nd amendment needs teeth.

USC 1983 provides significant teeth to enforce the Second Amendment. The problem is getting all of the state and federal government executive branches and courts to recognize our natural, unalienable right to keep and bear arms to be an actual right.
The 14th Amendment provides the State pre-emption the 2nd Amendment needs. Its just not being applied.

Pat Brown, CA Gov (January 5, 1959 – January 2, 1967) essentially did to the CA economy that Obama has done to the national economy. All his socialistic ideas and programs put the state in the red. The voters got sick of it all, and replaced him with Ronald Reagan, CA Gov (January 2, 1967-January 6, 1975) for two terms. During those terms, Reagan, without cutting jobs or raising taxes, put the state into the black.
The state is not beyond redemption. It only needs the people in control to offend even their own supporters as they strive to turn the state into the utopia envisioned in the 1960s while sitting around in a haze of marijuana smoke and dropping acid before going on to become politicians and professors bent on destroying the nation from within.

It appears that a lot of Californians have escaped California for Oregon, Washington, Colorado, Nevada and Texas to make those places just like California. It’s only a matter of time before they rule those areas.

The ballot issue for universal background checks passed by about 10,000 votes with Bloomberg’s group spending $11 million dollars and the NRA contributing about $2 million. A little more concerted effort on educating people as to what the bill really was about, because most people who supported it showed they didn’t understand it, and the bill would have failed.
The cure for this insanity is National Reciprocity. Unlike many of the abysmal redefinitions of the interstate commerce clause which have bloated our federal bureaucracy and repressed liberty, national reciprocity is a classic example of why we have a federal government. Those states which unconstitutionally infringe upon the free exercise of keeping and bearing of arms need to be put in their place. National reciprocity will gut their repressive regulations to the core and expose them for the fraud they are. Citizens of those states will rise up in rebellion when they are prevented from carrying and yet citizens of the other 49 states are free to exercise their natural, civil, and Constitutionally protected right while within their repressive state. No other issue is equally paramount to restoration of the true 2nd Amendment rights of the People. No other issue will tear open the liberal wound which festers in this country and allow us to excise the necrosis.

IF the Constitution was actually adhered to by all states equally then the 2nd Amendment would have nullified all gun control laws completely. However, since our Constitutional Republic has been distorted and twisted, many states and judicial jurisdictions choose not to fulfill their Constitutional obligations. No other topic more readily exemplifies this condition than the right to keep and bear arms. It is therefore within the power of the Federal Government to correct the inequity and legislate in support of the 2nd Amendment nationwide. And now is the time to git er done.

But the question is probably a bit moot; Brown signed a law that a firearm left in a vehicle must be secured in the trunk or in a lock box (with explicitly no LE carve out). That should slow the smash and grab burglaries.

Prop 63 passed along what were probably pretty much party lines–62% in favor, 38% opposed, which is fairly close to the democrat/republican demographic split.
The good news about 63 is that it is in large part redundant of the laws passed and signed by the Legislature in the last session, which included the “large capacity” magazine ban that now includes formerly grandfathered in mags purchased prior to 2000. New laws also include an ammo law, requiring that information be recorded by the seller, and requiring all sales to be face to face, but not including the licensing provision of 63. Moreover, discussion seems to indicate that the new State law ammo ban was to go into effect 1/1/17, while 63 doesn’t go into effect for a whole year. Also, the legislature passed bills that purport to amend 63 before it was even passed, and I have little doubt that a legal battle is looming as to which takes precedence, and which may delay implementation of those specific provisions. And to top it all off, the DOJ has neither the computers nor the staff to process 10 million background checks and issue licenses, much less store or analyze the incoming data from sales. 63 recognizes as much, and includes a provision allowing a massive loan to pay for those infrastructure requirements. But since when has the government ever completed a project of this magnitude on budget and on time?
Some enterprising Nevadans should set up shop about two miles from the ca border, fence off a nice big parking lot so plates can’t be read/photographed and sell ammunition to californians at a reasonable mark-up. Might as well be able to make some coin off ca stupidness and do some good for those few good people stuck living in the new state of despair.
