Monday night a clerk in a Brooklyn, New York grocery store was attacked by a man with a knife. The clerk was carrying a firearm and shot the attacker, 25-year-old Edwin Candelario, Jr., who also worked at the store, killing him. Candelario had reportedly returned to the store to retrieve his keys.

As CBSN New York reports, there’s security video of Candelario, Jr. approaching the clerk with a knife and the blade was found at the scene.

There’s only one problem. The un-named 34-year-old clerk didn’t have a permit to carry a gun. That’s because he lives in a city that only issues concealed carry permits to those who are wealthy or well-connected. So while this was yet another successful defensive gun use, it wasn’t a legal one.

The clerk has been arrested and charged with criminal possession of a firearm.

Candelario’s family can’t understand why the clerk killed him.

“He could’ve shot him in the leg. He could’ve pushed him. Why did he have to shoot him five times? That’s murder,” said Luz Sanchez, the victim’s aunt.

New York’s “may issue” system for issuing carry permits has been notorious for its graft and corruption. So-called “expeditors” have given prosecutors and cops cash, hookers and vacations to get their clients permits.

Someone who works a job with a higher risk of possible trouble — someone like a lowly Brooklyn grocery store clerk — doesn’t have a prayer putting together the scratch needed to pry loose a carry permit from the city that would allow him to carry a firearm legally to protect himself on the job.

And that’s exactly the way New York’s powers that be want it.

    Any audio to go with the video? Maybe the guy with the knife thought the clerk was a robber?
    We won’t get Candelario’s side now. But he learned not to take a knife to a gunfight.
    Why would he be carrying a knife? Sounds like HE was planning to hurt someone, too. Hmmm.

      • The fact that they both worked there and the guy went from “going in to get his keys” to apparently pulling a knife says this needs a close look. This wasn’t as simple as a robbery. And since one of the two parties that could give their sides is dead…

    • We don’t need to know the other side of the story to know that New York is unconstitutionally depriving millions of people of their right to keep and bear arms.

    • Personally, I am focused on the initial charge(s), as posted above, “The clerk has been arrested and charged with criminal possession of a firearm.”

      To me that says, the weapon was not registered (NY). As such (I think), the DGUser did not violate any CCW type law. I did not read the actual MSM report, which (for me), will only raise accuracy questions about the report.

      I see/read other reply’s, even the OP is alluding to CCW …

      The *key word* in the OP’s statement is *carry*. If this incident was not outside, but rather inside, there is not much of a carry issue; that I see. No one will know how the gun arrived at the incidents locale, (in a gun case?, loaded/unloaded?), unless someone does not know how to STFU.

      Bringing a knife to a gun-fight is not a decent career move.
      I would like to hear other peoples thoughts on *this* reply. Maybe I missed something.

      • In New York, you need a permit to own a handgun. You need a permit to handle a handgun (sometimes, depending on the store). And yes, letting a friend shoot your handgun is illegal because it’s not on his permit. Even worse if the other person has no permit at all…
        The only benefit is that your handgun permit is automatically considered a concealed carry permit. No extra training necessary. (also, this does vary by county)
        However, NYC is a special case. They don’t recognize permits issued by the state. You have to have a specific NYC permit. And as stated in the article, is only available for the rich and well connected.

      • The 2nd amendment is the clerk’s permit. It does not say, the right to keep and bear arms shall not be infringed, as long as you have a permit.

        • In NYC the 2nd Amendment is dead to all but the rich and famous. You did notice the shooter was not charged with assult or murder or any homicide. The man with the knife was exhibiting intent to use deadly force the knife and was met by deadly force the gun. Noticed no one questioned the legality of the knife ! The idea of shooting in the leg is rediculous and only seen on make believe TV.

    • The only way that is going to happen is if the DA actually pushes for a serious charge.

      I don’t know how it is in New York, but in Chicago during the handgun ban, you would never be actually prosecuted for possession in a legitimate self deference situation to prevent a challenge to the law.

      You also need to have a clerk who is willing to go threw all that B.S. involved with a challenge. Because it WILL turn his life upside down.

      • In WV about 40 years ago I was watching a murder trial in the local paper and news. The murder weapon was a .32 acp that should have held 8-9 rounds. The guy that did the killing was claiming self defense. He fired 5 shots. The state was questioning him on the stand. When asked why he fired 5 shots he said, ‘that was all the bullets I had.’

        Number of shots fired in such an incident really doesn’t mean a lot. Maybe our man had a double stack but only fired 5 because that’s all it took?

  13. Sooooo, assuming the story we have is correct, if a person is attacking me with a knife, I’m suppose to push him away, let’s ask every cop we run into if they’re being attacked by a knife will they just simply push them away? Or shoot him in the leg? Which will the cop do?

    As crazy as this sounds but it’s cheaper liability wise, if a liability thing comes out of this, to kill the attacker than to wound him, if the victim shot the attacker in the leg than the the attacker could have claimed life long injuries and want to lots of money to take care of him.

    This is AGAIN, one of those things where the attacker has all the rights and the victim has none.

    • He isn’t being charged with shooting the guy, only with illegally possessing the firearm he shot him with. NYC has two kinds of permits, a premises permit, allowing you to keep that particular firearm on the described premises (and nowhere else, unless being transported unloaded and in a locked container) and a carry permit. The latter are as rare as hen’s teeth, the former available after jumping through a bunch of hoops. But this guy, even assuming he had a premises permit, wasn’t on the “right” premises. If he is really lucky, it is the bodega owner’s gun and there was a permit for it.

  14. The knife laws in NYC are so stringent, I would be surprised if Candelario’s knife wasn’t illegal. They have most folding knives classed as ‘Gravity Knives’ if they can be flicked open. Knives must have blades no more than 4 inches, and if you have it clipped to your pocket with the clip visible, it is ‘open view’ and you’re subject to arrest. Knives have to be unseen unless they are ‘in legitimate use’.

The inconsistency of laws regarding self defense in this county is ridiculous, what manner you chose to defend yourself should not be used to prosecute you for a perceived violation of some obscure code violation. He was on private property, he was not carrying the weapon in public This was a clear case of self defense, the death of George Floyd was a clear case of murder and civil rights violation..

  20. Amazing all the rushes to judgment. no one knows anything really from the reports. A friend’s brother (heroin addict) literally pulled a stocking down over his face, took a handgun, and walked into a five-and-dime store where his best friend was working behind the counter. Pulled a gun on him, demanding the contents of the register. The friend pulled a double stack Sig from under the counter and emptied the magazine into him killing him on the spot. Was it a actual robbery, or maybe an inside job that didn’t go quite the way the deceased and potential accomplice planned? Who knows? Not me. Widow at the wake (with track marks up and down her arms) all she kept repeating was, “why didn’t he shoot him in the arm?” Other friends knew it was a real robbery. That’s just what he did for a fix.

  22. Same thing up in Minneapolis last week. Pawn shop owner defending his life and property in his business, shoots and kills a looter and the cops charge him with murder. He was supposed to retreat, because they do not believe in the castle doctrine in a business. In a home it’s OK to defend yourself but not in your business. With all the rioters and looting and burning out side where the hell was he supposed to retreat to. A white guy in a black neighborhood during a riot, what do you think his chances would have been outside.

  24. I am very glad that I have been able to get a gun permit , and carry my weapon in many states . I will never understand how New York gets bye without having to honor the constitution .
