There are executive orders, executive action that can be taken. We haven’t decided what that is yet, but we’re compiling it all … as well as legislative action, we believe, is required.'” TTAGs legal eagle and political strategist Ralph reckons Joe’s just saber-rattling. In fact, the remark could be seen as a positive sign; an acknowledgement that the Obama Administration knows it doesn’t have the votes for civilian disarmament in Congress. That said . . . “Make no mistake,” Ralph warns. “The gun grabbers are all in.”

  1. Courts have already ruled (Heller v. DC and McDonald v. Chicago) that it is an individual right to own firearms. If Obama tries to do an EO, it will be overturned quickly in the courts. He doesn’t want that fight.

    Congress is not all-in. The southern democrats have reservations.

The only thing I would add to that is if they could REALLY do it by EO then I think they would have already done it. Why would they leave it up to congress and risk having their clocks cleaned in the midterm election and leaving Obama’s last two years with him twirling his thumbs with repub house and senate like after the 94 ban? If he was able to do it with EO then that would allow the dems in the house and senate to deny they wanted a ban and it wasn’t their fault!

        If God forbid there was another school shooting and then they tried to do something by EO wouldn’t look bad on their part because they could have done something and didn’t. Even if they did something by EO now wouldn’t it look like they were asleep at the wheel and didnt take action to keep 20 six years old safe?

        I am not saying that they don’t have a trick up their sleeve but I would have thought they would have played their aces if they had them already.

      • Don’t worry guys, I’m sure they ruling caste will still allow we proles to possess assault rifles under certain circumstances. Those circumstances would only include times when the ruling elite feel like invading/liberating/occupying an oil producing nation. They’re ALWAYS happy to shove a gun into working class hands when it’s time to “promote liberty” in someone’s country besides our own, lest they have to send their own kids. The question is, are we going to keep sending our kids to fight for a country that now seeks to disarm us at home?

  4. The NRA and the Second Amendment Foundation shouldn’t have gone anywhere near the talks at the White House. By heading to these so-called “discussions” gun advocates are giving cover to issues that shouldn’t even be discussed.

    This White House has zero interest in our side, but is very interested in creating the political theater needed to make it look the White House tried to play honest broker, but the gun advocates were unreasonable.

    • I disagree. If we don’t look like we have or share any concerns, it makes it easy to dismiss our side as kooks. But by offering up constructive feedback and showing a compromise, it makes for nice photo ops and allows the WH and the Dems save face when this thing falls flat. Remember: nothing is worse than a cornered animal.

        This is pure political theater, which this White House excels at.

        Gun advocates are heading into a rigged game and the only way to win is to not play. Remember, President Obama does not care about the next election, because he’s not up for re-election.

        • Blake, Obama cares more about the next election then anyone. His presidential legacy so far is 16 trillion in debt. Most legacy building is done in the last two years. The last thing he wants is to spend the last two years with a repub house and senate who tries to undo everything he did in the first 6.

          The nra had to go no doubt about it. I just hope the first thing the NRA does is pull out poll numbers that show their approval rating, the presidents approval rating, and congress approval rating and tell Biden there is a reason their approval rating is higher than the other two and they would be willing to take this to the American people if they need to.

Last I heard, my individual rights aren’t up for bargaining, and if anyone IS going to bargain for my individual rights it ought to be ME, not some political lobbying group. I bet this is how black people feel every time Jesse Jackson or Al Sharpton claim to speak for all black people.

Not going would look (and be) childish, and would give them reason to propose or do as they wish (because they had the opportunity to talk and refused). Yes it is all for show, and no I don’t think anybody in the WH cares what the NRA thinks. I just hope they don’t send another old guard moron that wants to compromise. They need to lay out facts and solutions that they can point to when the administration ignores them. They have no choice but to go.

Minority Leader Mitch McConnell has already said nothing will happen on this for months since there are more important battles to fight, like the debt ceiling, entitlement reform, confirmation hearings and finding out who/what/where for Benghazi and Fast & Furious. Uncle Joe can say all he wants, but this is just the Dems lining up an issue for the 2014 elections. . . . . we need to have our own issues and have people recognize my guns are not what is siphoning money from their checks, limiting their earning/growth potential or setting their kids up for a poorer economic future than is possible today.

    • Several studies have acknowledged that gun owners are the single largest demographic willing to be single issue voters and also tend to have good memories on the actions of politicians. It will be interesting to see what kind of shake up there will be in the Senate come 2014.

        • I don’t care to stereotype them, but honestly, there are a lot of slow pokes in coal country. “Well, i don’t like Obama, but daddy always voted democrat, so i guess i’ll have to.” They oppose everything the party stands for, but still vote for them because it’s “what Daddy did.” It drives me up the damn wall.
          I’ve actually met people who thought they HAD to vote for obama (as in, were not allowed not to) because they registered as a democrat in the 70’s.

    • My concern would be that Obama could do something drastic, like reactivate the 1994 – 2004 ban or somesuch and congress could intentionally do nothing about it. It’s easy to vote against someone that does something you don’t like but they could sit back, let Obama take all the heat (he isn’t up for re-election anyway) and place their bets on the hope that even though they weren’t a solution, at least they weren’t part of the problem. That way they don’t have to have the fight and Obama can take all the heat.

  6. Try watching last night’s episode of The Daily Show. The whole episode was on guns. 20% of the show made me laugh, 5% were some good points to start that went in a bad direction, and 75% of it just pissed me off. The guest was General McChrystal, who TTAG posted a video clip of him on MSNBC yesterday. He said that .223/5.56 ammunition is too dangerous for civilians.

      • McChrystal is trying to land another gov’t gig after his ended so ubruptly. . . . . I wonder how much more he needs to accrue in pension credits? or better yet, maybe he wants to get back in Barry’s good graces so he can land on a few corporate boards.

      • The difference with Stewart is, yes he went after guns last night, but that will probably be it. Whereas MSNBC has been non stop gun control from the time the children’s bodies hit the ground! He (Stewart) will go after both sides, and compared to Fox and MSNBC, HE is more fair and balanced when it comes to most topics!

  7. Sure there are EO’s that they can do but it would be stuff on the books already. They could make gun trafficating a felony. They could go after people who lie on their forms. As far as enacting new legistration, I don’t see it. If they could move assault weapons to NFA an increase the tax on NFA items then it would already be done. They would have already have it done that way they wouldn’t have to worry about the dems losing their a** in the midterm election. This article said it best “saber rattling”. I am not saying we need to let down the pressure or be complacent but we need to push through this.

    • Agreed. It means they’re scared of the failure of their plans. It’s time to keep up the pressure all over the place, if not increase it in certain areas.

      Any EO that takes it upon itself to counter the 2nd Amendment and create new law needs to be challenged immediately… for that matter if it just tries to create new laws by bypassing the lawmakers elected by us: Congress, it needs immediate challenge.

I would like to add this thought: There is alot of NRA-bashing on this and other sites that serve our community – i.e. “they’ll use any excuse to raise money”, “LaPierre makes a gajillion dollars in salary”, yadayada. But the NRA said this election was the most important ever for us, and they pushed hard. Alas to no avail, but they were right and wouldn’t any one of us wish LaPierre made 10x what he makes if he could make the antis momentum go away like that?

    We’ll need every last resource, every voice, even the NRA TTAGers.

    • Exactly! We need to fight this on all fronts. I am an NRA member. I don’t think the armed guards in schools thing is a good idea( I see it as an expansion of the police state). I prefer the idea that teachers should be allowed to carry, but so far the NRA is not compromising on what I can or cannot have so I’m still in favor of them generally speaking. Is the GOA more in line with my beliefs? Oh yeah! So I’m a member there too. I’m also a SAF member and I’m thinking about joining JPFO. Maybe I don’t agree with all of them 100% but they are all fighting to preserve my rights so I support them.

      So what if the NRA raises a bunch of money. Do you think they don’t know that if they turn tail they will lose those big pay checks. What keeps them honest is our wallets. It’s capitalism at it’s finest.

      • I joined GOA and SAF. I haven’t renewed my NRA membership but since I want to become an instructor (eventually) and you need to be a member in good standing for at least 2 years, it’s something I should do.

        I just think the NRA fights Anti-Gun Hysteria with Pro-Gun Hysteria.

    • I had been talking about it but finally joined the NRA last week. I feel like one of the best things I can do in these times is increase the membership of pro-2A organizations. Thinking about joining SAF and GOA as well.

      • I joined the SAF a couple weeks ago. I really like them and their heavy focus on legal action. I also recently sent a nice sized check to the NRA-ILA. I’m going to have to look into GOA. Thank you for joining the NRA. They really do a lot for us.

  11. My understanding is that Obama is considering signing EO’s to do things like strengthening the NICS check system, forcing states to send metal health records to NICS, things like that. He’s made no mention that I can find of signing EO’s to force “disarmament”.

    • That’s something I support. If we are going to have background checks, then shouldn’t they be complete and force the states that do not report mental health records do so? Most pro-2A people don’t blame the gun, but they do tend to blame mental health issues. If you support that stance then you should be for that. I think that’s something that maybe the NRA could’ve done before, maybe lobby to have that as part of the reciprocity act. It would be a fantastic compromise if we could get reciprocity, as well as give some positive PR to the pro-gun lobby. But now it could be strengthened through EO and reciprocity will still be kept out of the voting hands of the senate by Harry Reid.

  12. If he signs an executive order that attacks the Constitution there is only one action that should be taken. He should be impeached by the house immediately and tried for treason. If Biden is complicit, he should join Obama at trial. Obama has already talked about subverting congress’ authority on the debt ceiling and has shown he is willing to do whatever to abuse the Constitution. As a former Marine, this whole thing sickens me.

    • In a just world we all know that is what should happen but we all know that it won’t. Obama has already done lots of things that should have gotten him impeached, yet he was voted back in for another term. AS someone stated before, what sickens me is our very own people helped put him back in office.

  14. This morning on WLS AM Chicago, the head of the police union said he and most coppers do not have an issue with CCW, it’s the pols that have an issue with it. He said that IL is wasting millions more in attempting to fight the 7th CC ruling.

    Based on that interview, even here in Chicago, the anti sediment is mainly driven by the pols and the media, not the commoner. We all know here that we have a gang/broken family/societal issue, not a firearm issue. But the pols and media won’t call a spade a spade – criminals killing criminals who in a majority of cases are black and come from single/no parent homes.

    • I feel for you Joe, I’m 90 miles away in Milwaukee. I donate time to try to get at the minority kids before they feel no one cares & they look for gang comraderie. That said, the ones that slip through need to be stopped, not protected by the dems, Randy

    • Dealing with the real causes would require solving a crisis as opposed to “never netting a good crisis go to waste.” I have to part ways with you regarding the racial issue. I believe that problem comes from the fact so few guns are in the hands of responsible members of the minority community. Keep in mind these are the folks who bare the brunt of illegal gun crimes, hence more deaths of loved ones. Hell. Camden N.J. just lost it’s city PD, and now has a patchwork of LE protecting some very fine US citizens form a network of thugs.

  16. We have over 2,000 gun laws already. We have NICS, class 3’s are very difficult to obtain with their transportation closely tracked and only allowed in 37 states. Can someone please tell me how more laws , which in many cases duplicate existing ones, will prevent crime? If laws don’t keep out “Leaders” from committing, voter fraud, insider trading, felonies, or accepting illegal “contributions”, just to name a few, why does anyone expect criminals to be intimidated by more of what they ignore in the first place? All I see is the grabbers moving down the food chain. First selective fire, now semi autos and Mag capacity are on the menu.

    No one will convince me that the crimes at Sandy Hook were not manipulated, or worse, to create this anti gun frenzy.

      • If you think things are senselessly violent now, wait and see what life is like if you get your wish. They won’t get 1 criminal’s gun and they will take any gun capable of being used in a defensive situation.

  17. Bypassing congress and using an executive order? That would be a delicious, ironic, and fateful choice.

    It would lend a lot of clarity to the tyranny aspect, entirely enrage gun owners, spawn a multitude of legal cases, and stiffen the resistance and non-compliance on the part of the entire firearms community.

    And as always, any scheme would need money, and that money would have to be authorized by the House, so there would still be issues with implementation.

    In other words, it would result in utter chaos.

I think they nay-sayers and poo-pooers have been dismissing these concerns because they view events and potential policies through the lens of normalcy bias. I fear that a confrontation is *precisely* the goal here, not “business as usual”. Viewed from that (sad) perspective, these Vulgar Display of Power tactics are not only natural, but quite predictable with uncanny accuracy.

  19. Be watchful, and be careful. I spoke often that I would vote for BHO / Biden, and these matters are exactly why.

    However, we must fight legally and honorably. A single law abiding gun owner losing his or her temper – really losing it – would only feed the anti agenda. The antis want us to be angry. Lets continue to fight this fight honorably and reasonably for as long as possible. Our enemy has shown their hands – they want taxes, registration, restriction, and disarmament. They do not care a out facts or reason, and we must continue to exploit that weakness.

    So I’m going to put off getting a MOLON LABE tattoo for at least a little while.

  21. While they dont have the votes in Congress it shows NRA and SAF will have to fight not a gun ban BUT a registration scheme Obama will likely throw at us threw a EO. Call your Reps and Senators and join NRA we need all to help.

    • The problem with a registration scheme via Executive Order is that it has to be funded, and only Congress can appropriate funding.

  22. What are the limits on an executive order? According to what I’ve read, the president can give orders only on laws already passed by Congress or under the powers of commander-in-chief in the event of military action. Obama could further restrict imports of guns or could order changes in the background check system, but I don’t see that he can declare certain guns illegal or change their status beyond what’s already defined in law.

    • From what I’ve seen in four years, Obama does whatever he wants, whenever he wants, and faces literally zero repurcussions.

      • I don’t think that’s true. Obama is a skilled politician and always manages to bend his party to his political will. He insists that everyone gets their hands dirty. Obamacare passed because Obama was stronger than the fence-sitters who might have opposed him. It cost the Democrats control of the House and eight Senate seats.

        Besides, why would POTUS act alone when the Senate (at least) will do what it’s told to do? Look for Obama to hit gun control hard in his State of the Union address, and look for the MSM to back his play. The MSM is the Judas goat leading the country to the slaughterhouse.

    • Never in the history of this nation has any president used executive order in any firearms issue. If he chooses this route he will be the first and the backlash will be dangerous.

    Almost exactly what I was thinking when I read the title for this thread. Granted I dont know much about the EO process, I have read enough here that I am not overly worried about it.

  26. Checking Wikopedia (I know, not the most trustworthy of sources but where can you go in a pinch..) shows that to date, only two executive orders have ever been overturned by the courts. BHO has already used this tool hundreds of times, so it’s obviously his tool of choice…if we think he can’t do this and make it stick, we’d all be guilty of way underestimating the enemy.

However, given the “90 day” claim on discussing gun legislation and the obvious reluctance to force a change in the country so vast they want to spooky us into ill advised action so that we can rile this country emotionally again against the gun.     The fact remains this is direct, unfettered infringement on the 2A. Obviously unconstitutional and it is no secret. Only rallying every Congressman that would follow A NEW TRAGEDY and hoping could they amend the constitution. This has to be done before any true arms recourse on the government part can be taken.

    • Newsflash: he gets SS protection for life. He doesn’t care if he could never own a personal defense weapon again. Tax payers get to pay for his protection 24/7/365 for the rest of his life. His BS claims about his guns were mainly around his sporting shotguns. Pre ’94, he has all the credentials to have been an NRA board member, but I guess that was the reason for the post ’94 purge.

  30. They will create their executive order and before it is reviewed by the courts (where it may or may not survive) they will seek out the right people to confiscate weapons from. There will be two kinds that they start with. There will be meek and pliable people who will gladly surrender their weapons with a smile. These will be in the news alongside the other type.

    The other type will be people who are stupid and principled (and I’m not saying the two are the same thing as opposed to smart and principled), people like Randy Weaver or the Branch Davidians. Someone they can rely on to fight and make a stand. They will use all their resources to make sure that these people are killed or otherwise humiliated and made unable to fight ever again. These people will have their fates shown relentlessly on the television to terrorize the rest of us into being cows and turning in our weapons.

    If Clinton killed Randy Weaver in his drive for gun control, and razed a church and gassed children to death in Waco for gun control, and ignored a court order and took Elian Gonzalez at gunpoint and returned him to slavery in Cuba, then we should be prepared for violent demonstrations of power by this administration.

  31. There are two things to understand about Obama. He is a commited socialist and he shows a lot bluster. You saw that with the fiscal cliff negotiations. Despite what some conservatives say, he folded to a pair of twos after proclaming his way or the highway on taxes. He got less then Boehner offered and gave the Republicans in House the ability to veto future tax increases.

    It will be the same with guns. I have no doubt that he would like to ban guns outright but he knows he has no constitutional or legislative authority to do that. He would have done it already if he had the power. The bluster in this case is to sound tough and deliver some minor changes via EO. It would take a lawyer to go through the national firearms laws and determine where he can nibble around the edges. Like everything I expect a lot of sound and fury that will satisfy neither us or the gun grabbers.

    His goal is to lay the groundwork for future restrictions when he feels he can get it through Congress and in the meantime rely on individual states to place more restrictions on firearms ownership and perhaps confiscate some of those evil black rifles. This will be an additional issue dividing red and blue states. The deeper the blue the more bankrupt and crime ridden they will become.

    • I agree with everything but the groundwork for future restrictions. It isn’t that they won’t happen — it’s that they’re not even on his top-10 list. President Obama’s top priority is putting this issue behind him with the least political damage possible so he can focus on agenda items which actually benefit the Democrats, namely immigration and the federal budget.

      Don’t get me wrong — I’m sure he’s fine with throwing red meat (aka further infringements on personal liberty) to the activists within his party if that’s what it takes to move forward. There’s a reason he committed to end-of-January right up front: so he can get this over with as quickly as possible.

It seems to me that the buying frenzy and dwindling supplies of AR-15s, High Capacity Magazines, 5.56/.223 ammo and AKs has made me question where the hell all these people were when the votes in my home state swayed to Obama…If EVERY gun owner had turned out and voted against him, we should have had a landslide; There are far too many firearms owners who refuse to accept that this CAN happen! The Liberal gun-owners (yes i know some) still think the Supreme Court is going to overturn an EO; they think that its all rhetoric and scare tactics and that refusal is what will ensure that all the talking in the world isn’t going to mount to a hill of beans
