Supreme Court Justice Ruth Bader Ginsburg came in for no small amount of criticism for failing to retire during Barack Obama’s time in the White House. But she was apparently so sure that Hillary Clinton was going to win the presidency in 2016, she had no real concern about a Republican naming her replacement on the Court.

When Donald Trump was sworn in, it was clear that she was going to do everything in her power to try to remain on the Court until he was safely voted out of office after only one term. She nearly did just that. Today Ginsburg lost her long battle with pancreatic cancer.

As the AP dryly puts it . . .

Ginsberg’s death just over six weeks before Election Day is likely to set off a heated battle over whether President Donald Trump should nominate, and the Republican-led Senate should confirm, her replacement, or if the seat should remain vacant until the outcome of his race against Democrat Joe Biden is known.

Uh huh. If they actually think that Trump will wait to see if he’s reelected before naming a replacement, we have some beautiful beachfront property in North Dakota we’d like to talk to them about.

Harry Reid and the Democrats used the nuclear option and killed the filibuster on judicial nominees back in 2013, apparently figuring they would forever be in control of the Senate. As Majority Leader, Mitch McConnell has done a remarkable job of pushing through a record number of Trump nominees to the federal bench over the last 3 1/2 years, largely remaking the federal judiciary. And whatever may have happened to the Garland nomination in Obama’s final days in office, you have to expect he’ll push through a Trump nominee come hell or high water.

If that happens, it would, of course, be very good news for gun rights. Since assuming the middle seat on the court, Chief Justice John Roberts’ squishy, unpredictable vote has resulted in all pending Second Amendment-relate cases being denied cert, rather than risking an adverse Roberts decision. A fifth solidly conservative appointment — joining Thomas, Alito, Gorsuch and Kavanaugh — could be exactly what gun rights supporters have long been waiting for.

And then there are the potential political angles to a quick replacement for Ginsburg. A solid conservative choice pushed through now would further energize the Republican base and demoralize Democrats. It would also, no doubt, result in one of the most incendiary Senate fights in decades. But without the filibuster, there’s little Senate Democrats could do, short of convincing three Republicans to abandon a Trump nominee.

There’s also the issue of what would happen if the November election results in another Bush v. Gorestyle Supreme Court decision. If you’re President Trump, do you really want to put your fate in John Roberts’ hands?

In short, buckle up. It’s about to get very bumpy and awfully entertaining. There isn’t enough popcorn in the world for what we’re about the see in Washington.

          I wish justice for everyone. Justice is my criterion for good – not “nice”, and not “life” (a material fact that is neither the highest moral principle, nor a moral principle at all).

          An action or event is good precisely to the extent that it is just: a fair wage for a decent worker, an award and/or promotion for an exceptional worker, starvation for someone who refuses to work, a bullet for a home invader – all equally just, and therefore equally good, desirable, and worthy of celebration.

      • Remember when I commented several weeks ago that her choice to remain on the bench until she literally died – as compared to stepping down to retirement – brought up the issue of whether Justices can be declared medically unfit? How was she able to hold on, after falling asleep in front of the whole world during a SOTU address, multiple bouts with cancer and related trips to the hospital and treatments, and basically looking like a female Stephen Hawking near the end? If there is a prescribed method to remove POTUS from office (25th Amendment), as is being much-discussed as the “Biden/Harris” strategy, why is there nothing for SCOTUS Justices, other than Congress having to vote him/her out?

        Needs to be discussed at high levels, methinks.

        • Justices can be removed only by impeachment in the House and conviction in the Senate. There’s nothing preventing a Justice from being impeached, convicted, and removed for reason of incapacity, although that’s never been done.

        • Alan, you are correct, but as you state, it has not been done to a SCOTUS Justice. Other Federal judges, yes, but not in the High Court that I’m aware of.

          Justices serve at the behest of Congress and for “good behavior”, though I firmly believe RBG broached that requirement when she openly stated her political leanings when she said back in 2016 that America would “go to hell” if Trump were to become President.

          Great point.

          One of the ways to drive elderly justices from any bench, but especially SCOTUS would be to demand that they put in a regular 9-5 case-load schedule year-round, providing a few weeks off like people in private sector gigs have to do. These justices have a very short season of deliberation- insure that more time will be spent on more casework and demand a more rigorous schedule in the name of the people of the US.

          The same should be applied to those in the US Congress- once in session they should be kept in their assemblies to do “the people’s” business rather than work 2 days per week, run around the world on junkets or spend 4-5 day weekends at home or elsewhere in an “effort to meet with their voters”. BULL!

          In this day and age, contacting one’s Congressional office is only a click away and anyone who believes they can go meet with their Congressman, or especially their US Senator to discuss issues is worse than delusional. If these elites want to act like they are public servants, put them to work doing comparable hours in-office, just like people out here in the private sector must do. Earn the salary, earn the respect and see if they can earn a bit of public trust along the way.

        • Justice Anthony Scalia died while serving, was it OK for him to serve through significant illness because he was a man or because he was a Republican?

          With Ginsberg’s passing, it’s good that we have the MacConnell rule to follow:

          “The American people should have a voice in the selection of their next Supreme Court Justice. Therefore, this vacancy should not be filled until we have a new president,” McConnell said.”

          The Republicans set the standard, let’s see if they have the personal and political integrity to follow the standard they set in 2016.

        • I’m betting that such a SCOTUS justice would be quietly told to step down tomorrow or be impeached the day after, which may have happened a dozen times. Obviously such courtesy cannot be extended to all judges.

          Meanwhile, the people have elected the President and the Senate, time to install a new Justice before 3 Nov. The way Dems told us it should be when Scalia died, exactly the same for Trump. Meaning “who holds the Senate”? Tough shit, elections have consequences.

    • She hated the U.S. Constitution that she swore an oath to uphold (she was on record saying it should be more like South Africa’s Constitution, and suggested other nations looking for inspiration for their own Constitutions should look elsewhere than the U.S.’s for inspiration). She hated the individual right to keep and bear arms and swore up and down to have the Heller outcome overturned.

      Let me repeat that; for someone so up on women’s lib, she loathed the idea of an individual owning a firearm (to include women who, in raw physical strength, are no match for men–a firearm levels the playing field for them). If *ANYONE* should advocate for individual firearm ownership, it should be women. But no, so many of them literally want to go back to a time when the biggest and strongest held a monopoly on force over those smaller and weaker than themselves (i.e. see the Dark Ages/Feudal times).

      Judges need to uphold the Constitution and Amendments as-written; not interpret them based on their political leanings or vague notions. The chosen wording for the aforementioned documents is so plainly written, a layperson should be able to understand them (as was intended). It’s up to our House and Senate to change/add laws, and if we need to change the Constitution, that’s where Amendments come in.

      She used to be a fighter for bringing legal equalities to women, but I fear her position of power tainted her view of the very document she swore an oath to uphold. Anyone can become a tyrant, given enough power for long enough.

          The situation you present is why estate lawyers exist, and why other estate lawyers try to have such documents set aside. It is also why contract lawyers exist. In the end, if the matter goes to trial, it will be the opinion of the court that will prevail, i.e. interpretation of the law, and the meaning of the written agreement.

          In contract law, there is a concept called “substantial completion/performance”. Many a contract had been successfully contested under that concept. In all cases, it was the interpretation by the judge concerning contract term, performance, completion that determines what the written contract “said”, meant.           Reality: If words meant what we want them to mean, and the meaning was unassailable by any rational being, there would be substantially fewer lawyers and judges. This is why there are so many opinions, legal and individual, regarding the intent of the founders, who spoke an obsolete form of the English language.

        • Always a good read. However, the papers are not law; not the Constitution. Inferring the “true meaning” of the founder’s writings is, itself, opinion. Not even sure the papers can be included as evidence at trial.

          This makes me think you may have failed 4th grade English. We’re not talking about actual Old English, as-used in the original writing of Beowulf (which is obsolete). English comprehension is apparently a lost skill.

          The English used to draft the U.S. Constitution and subsequent Bill of Rights/Amendments is still 98+% contemporary English. Plainly written, and if you read the WHOLE U.S. Constitution and Amendments, everything becomes contextually relevant and straightforward.

          If you’re still scratching your head over the very plain wording that was used, look at the scribe’s transcripts during the ratification proceedings for both the Constitution and subsequent Bill of Rights.           Lawyers are great at perverting the very meaning of words, obscuring the intent and confounding the language itself. To hijack something simple, make it complicated, institutionalize it, and profit.

        • You are overlooking the point. Any rendering of the Constitution is an opinion of what “is” is. Can’t get away from it. There is no cosmic tribunal that will accepted as the unassailable gold standard of interpretation. Every word written, or spoken is subject to opinion as to its scope, meaning and application. If it were not so, no clarification of a statement would ever be needed.

          Let’s take a critical example and see how “upholding the constitution” is subject to different, legitimate differences in interpretation. Is the Second Amendment absolute? Be careful here because it will become quickly clear that it is not (although I maintain that it is*).

          If the Second Amendment is absolute, there can be no exceptions, nowhere, no time, nohow, none. However, it is legitimate to conclude that the founders could have never intended that there would be zero circumstances where limiting, even removing firearms from some people would be an “infringement” prohibited by the Constitution. If I posit that imprisoned persons should not be permitted firearms, I believe that I am upholding the intent and spirit of the Constitution. Yet, the plain language of the Second Amendment, as written and spoken does not recognize any exceptions. How can my idea of upholding the Constituiton be false, or a dereliction of oath? Isn’t it common sense that prisoners should not be allowed weapons, least of all firearms?

          The absolutist test must be applied when analyzing whether or not the Constitution is being upheld. Think about any provision of the Constitution. Are they all absolute? What about the First Amendment? Any type or manner of speech is permitted, under all conditions? Or is it only political speech that cannot be regulated? And who is the superior tribunal/entity that determines what constitutes political speech?

          Hypothetical: A Supreme Court Justice sits on the court because of being “a strict constitutionalist”. Overwhelming popular opinion is that said Justice will protect the Constitution, and adhere to its original intent. Then said Justice renders an opinion in a firearms case wherein said Justice appeals to long standing infringements (history and traditio) on the Second Amendment are permissible because the long series of legislation and judgements stand in agreement with a particular exception to the Second Amendment. Is this Justice, hailed far and wide as a strict constitutionalist, now in violation of the oath of office regarding defending and upholding the Constitution? Well in this case, said Justice levied an opinion that denying firearms to convicted felons is an justifiable exception/infringement. Said Justice can legitimately claim to be upholding the Constitution.

          We cannot escape the fact that declarations of upholding the Constitution are opinions of what the document actually declares. Sometimes opinions line up with our particular preferences, sometimes opinions line up with preferences we abhor.

          *When we want a proposition to be absolute, we must also accept the outcomes we don’t like.

          Romney and Collins are out; declaring the choice should be post election. Kelly is a threat in Arizona. If he is elected, he can be sworn in right after the Nov election. That makes a bare 51 majority in the Senate…at the very best. One more, “losing with honor is the greatest achievement” Republicrat, and confirmation by the Senate may not be possible.

          Of course, it is possible the Repubs can pick up one or two Senate seats resulting from the election….if, as, and when Trump is re-elected.

    • The American people already have as much voice in the choice as they are going to get. The current president and the current congress were elected by the people, and the Constitution is very specific about when their terms of office end. Elected officials don’t depreciate. They don’t progressively lose their legitimacy as their terms in office wear on. They are the voice of the people, from the day they are sworn in until the last second before they leave.

      So, f*ck you, Schumer. You’re putting out a very, very thin argument.

      • Yep. People keep talking about precedent and principles, but that’s just window dressing being mistaken for an actual window.

        The rules are simple and clear: The president has the power to nominate a candidate; the Senate has the power to accept or reject the candidate. That is all.

        There’s no required timeline. The president can wait or act instantly; the Senate can vote quickly or drag its feet indefinitely. Both parties have done it both ways, in varying combinations at varying times.

        In 2015/16, when the Senate refused to vote on lame-duck president Obama’s nomination of Garland and then accepted Trump’s nomination of Gorsuch, both sides played their roles according to the rules. It looks like time and circumstances are going to work against the Democrats twice in a row, which certainly sucks for them — but is also much better for America.

        And who on God’s green earth would ever have predicted that Donald Trump, of all people, could remake the federal judiciary in a constitutionalist mold? Almost makes me think there might be a divine providence looking out for the welfare of this creaky, ailing republic after all.

        • Trump, at heart, is a business man. Conservative justices are good for business. POTG benefit from conservative justices so it is in our best interest to vote for Trump. Trump himself may not be a die hard gun supporter but if his justices are conservative we will benefit regardless.

          There are currently 53 “Republicans” in the Senate. Collins and Romney are “No” for confirming an SC nominee. That leaves a one vote majority. McSally and Gardner are razor thin holding on. Losing one means a 50-50 split if the confirmation of a new Justice isn’t completed before the November general election. Losing two means the Dims will control the Senate, blocking any Trump nomination.

          Repubs are “defending” 25 seats; must win all. Most likely outcome is Trump re-elected, House and Senate controlled by Dims obstruct everything, again, for the next two years. Worst outcome is Dims win everything.

          There are apparently at least four Republicrats (Collins, Murkowski, Romney, Sasse[?], Gardner) who want no vote taken until a new president is sworn in, which is problematic enough. Trading McSally for Kelly would possibly be cancelled out by a pickup in Alabama, leaving the four listed above still squishy and unreliable. Assuming the cancelling scenario, the 3 vote majority for Repubs would be dealt a death blow by the four listed above. And this assumes every other Repub seat in play remains Repub.

          The down ballots will determine the fate of the nation, more than the presidential race.

          I agree that it isn’t a sure thing that Trump’s nominee gets through the Senate; there may be enough Romney-style cucks and traitors to derail the confirmation. But even the handful who don’t think there should be a vote before the election are still going to have to do it anyway if it comes before the Senate.

          The president is going to confirm a solid jurist who will almost surely be well-liked by the entire Republican base, and the pressure to confirm will be immense. The Democrats could still manage to give cowards like Romney a way to weasel out, but I put the odds at better than even that Trump and McConnell push it through successfully.

          BTW, regarding Mitt Romney, even my parents — Boomers who have a great nostalgia for the decorous bearing of ’80s and ’90s Republicans, are continually appalled by Trump’s crass behavior, and were proud to vote for Romney as a principled fellow Mormon — have soured on him after his smarmy grandstanding in the impeachment sham and repeated failures to stand up for the values he claims to hold.

          If he doesn’t vote for a solid, legally nominated conservative SC nominee and a Democrat ends up choosing the replacement, Romney is probably done for. A lot of people who voted him into office aren’t happy about his failure to stand up for them. He may be more likely to toe the line on this vote than you’d think at first glance.

          As for Mitt sticking his finger in Trump’s eye, I have to admit, Trump did humiliate him publicly with the whole audition/interview call for filling the Sec State position. Trump took that opportunity to stuff it to those Repubs who had opposed him in the primary. My observation is that by doing that, Trump ruined his first year in office, when he most needed at least token endorsement by all the candidates who lost the primary vote. The Establishment spent the next 3.6yrs seeking revenge; a total waste for everyone.

    At least five potential nominees on Trump’s wish list are former Thomas law clerks — Katsas, Muniz, Pacold, Rushing, and Todd. That’s more than any other Justice. Since Thomas has been the most reliable and dedicated Justice in terms of 2A, I think that’s encouraging.

    __It depends of course, because the GOP may hold the Senate and add a few seats as well. If so, JAN 3 is no deadline and Trump was right – as usual. Dems taking a majority in the Senate is possible but not likely.

    __They, like everybody being ‘they’, claim and have always claimed it is and will be a “special election”. But shenanigans, oh yes, and I corrected your spelling of shenanigans – BTW. As for being seated imeadiately, I’m sure you meant immediately, it still won’t be in time so that cancels out Romney’s vote with the Dems, one less AZ Dem to be there to vote, and a few others will be RINO/traitor votes as well including probably Susan Collins. This is why there’s a rush to name the new justice and have a vote asap.

    Sure is a relief to finally have that old RBG bat gone. The lost souls of millions of unborn is her real legacy. There’s a special place in the hot place that’s reserved for the likes of her.
