New York Governor Andrew Cuomo has released the text of his State of the State speech. [Click here for live streaming.] bloomberg.com reports that Cuomo “wants to make New York’s gun laws the toughest in the nation, pushing to ban weapons with ‘military-style features’ and eliminate loopholes that allow the sale of large-capacity magazines . . . The proposal would allow the state to suspend or revoke licenses and confiscate weapons, close loopholes in the 2000 law banning assault rifles, flag large bullet purchases and require background checks for gun sales between private parties. ‘Some weapons are so dangerous and some ammunition devices so lethal that we simply cannot afford to continue selling them in our state,’ the report said. Current law ‘is so riddled with loopholes and so difficult to understand that it has become virtually unenforceable.'” The Gov has a seven-point plan . . .

1. “Enact the toughest assault weapons ban in the nation period”

2. “Close the private sale loophole by requiring federal background checks”

3. “Ban high capacity magazines.”

4. “Enact tougher penalties for illegal gun use, guns on schools grounds and violent gangs.”

5. “Keep guns form people who are mentally ill.”

6. “Ban internet sales of ammunition in New York.”

7. “Create a state NICS check on all ammunition purchases.”

  1. Anyone else expecting a mass exodus of gunowners from NY? Can gunowners challenge in Supreme Court of US that this is unconstitutional?

      • I believe you’d need to be a NY resident (and possibly a gun owner) to have standing to sue tho. Or if it’s all done in one omnibus bill perhaps an out-of-state ammo seller would have standing as well.

      • Now that McDonald v. Chicago has incorporated the Second Amendment, do the military equipment standards of Miller v. United States apply to the states as well? The definition was written about in the more recent Printz v. US. In Printz v. United States it was confirmed that the sawed off shotgun that Miller possessed had been regulated because it was not “ordinary military equipment” that could “contribute to the common defense”. While it would seem that a sawed off shotgun can still contribute to the common defense, it is certainly further from ordinary military equipment than an AR-15. My M1A is used in government sponsored Civilian Marksmanship Program events

      • Don’t forget about the “military utility” test of Miller. That was the real reason the grabbers spent decades before Heller claiming state militias had been replaced by the National Guard.

  2. “Civilians” are government employees who are not in the military. Non-government employees are “CITIZENS”. Citizens are armed and rank higher than any government employee.

    • Yes! We need to resist these attempts to redefine our nation’s terms to meet someone’s rose-colored view of reality. Via Wikipedia From Old French Civillian means of the civil law, ie judges, police, clerks and other civil servants, as oppossed to govt officials subject to military law. About 100 years ago international law adopted civillian to mean any noncombatant. Now international governing busybodies are trying to redefine civillian to mean unarmed subject. We need to make sure our words mean what they say and keep Citizen alive, both as a vocabulary word and the ideal. Nothing gets me steamed more than a cop/legislator calling me a civillian.

    • You might be on to viable legal defenses.

      Per Black’s Law Dictionary:

      citizen, n. 1. A person who, by either birth or naturalization, is a member of a political community, owing allegiance to the community and being entitled to enjoy all its civil rights and protections; a member of the civil state, entitled to all its privileges

      civilian, n. 1. A person not serving in the military.

  3. You should have watched the pre-speech spin up on c-span. The lt. gov called out the families of the firefighters who died in that ambush last month. They walked up one family at a time ready to cry on stage with the lt clapping like crazy and Cuomo spends 2 seconds saying sorry, hands them a flag, then spends the next 20 seconds positioning them for the perfect photo op.

    The widow of one of the men almost broke down. The look on her face practically screamed “Why are you doing this to me on national TV?” If I was on the stage I probably would have punched him in the face. It was just one of the most disgusting political displays I’ve ever seen.

      • Because when you’re asked to go up on a stage and take a flag for a dead loved one who died in the line of duty you usually do it. None of the families said anything one way or the other on gun control.

        There’s a right way and a wrong way to do this kind of thing. Letting your LT governor make the speech (giving a virtual on air BJ to his boss) and then just taking the photo op without saying anything meaningful is the WRONG way.

    • Nevermind the fact that the guy wasn’t legally able to own a gun in the first place and that their gun control laws didn’t stop him from getting them. Nope, lets punish the non-criminals instead.

  4. I know a lot of New Yorkers from all over the state, not just the City. Smart as you or me, but I just don’t understand how they elect the same ass hats from the same families, year after year. Bans only serve criminals and create felons out of otherwise honest people. The bans also seem to correlate to the viciously high murder rates in “gun free” cities.

    • As a NYer I can tell you that we are one of the most union-dominated states in the nation. When you combine the 1) unions from what little private sector we have left upstate, 2) unions from our HUGE public sector and 3) leftists and bleeding hearts of all stripes from NYC, what you have is simply an insurmountable electoral advantage. Often the same bozos and cronies jump parties, so voters feel there is no choice and no chance. Hundreds of thousands have left the state rather than fight the fight, thus the problem is worse. NY is unfixable. Like a drug addict, rock-bottom needs to be reached before there is any thought of a turnaround. Better just to leave and many more will after this.

    • Nope, not Starbucks. Anti-2nd Amendment folks don’t like them. They allow concealed carry in their stores in states where CCW is legal.

  8. The “loopholes” in the current laws is the fact that the criminal class do not obey them. I’d like to see them close THAT hole. And if the .223 is so lethal and so dangerous that it must be banned, what does that mean for all the other hunting rifles out there that are significantly more powerful? And does he plan on banning HPs because they are “too lethal”? I didn’t know that you could be more dead than dead. Though I do understand that you can be not quite dead dead, but very nearly dead.

    I know what we can do–rubber bullets for every one!

    • “Loopholes” also indicate that the people writing these laws have no flippin’ clue about what they are trying to legislate.

    • They won’t. The companies and the gun owners in these states have shown them for half a century that they’ll take any shit the state government throws at them.

  9. I hope they try to confiscate. I hope NYers find their balls and resist. I hope an example is made for any other states, politicians, and law enforcement that fancy themselves tyrants.

    And if NYers don’t resist, I hope the criminals and tyrants they bow down to prey upon them mercilessly to teach them what happens when you give up your rights.

    Fantasy, perhaps, but in this day and age of America, fantasy is all we have left.

  10. Cuomo backed off of the confiscation talk. He did however demand that an NICS check be done for every ammunition purchase. It seems NY is in a contest with NJ and CA to draft the worst gun laws in the nation.Methinks Uhaul is about to make record profit in NY state.

    I have to give the man credit for one thing: when he said “New York is not a man’s State” he was 100% on the money.

    Now, to be technically accurate, any ammunition fired from a gun is and can be lethal. There isn’t much difference between a 22LR and a .223/5.56, only the velocity. Neither one are all that powerful, but they are deadly. Heck a BB gun and sling shot are deadly too. Is Cuomo gonna take the NJ route where you need a DNA test to get a permit for a sling shot?

  16. Hey, “high” capacity magazines of more than 10 rounds are all ready banned here in NY. What’s he talking about with banning them? I hope this is like a double negative and he’s actually saying they’ll be legal, but I have my doubts.

    • He wants to lower the legal round count so say good bye to all semi automatic pistols by default, same for rifles….

    • He wants to get rid of preban magazines.

      Previous radio snippets have him speaking about “loopholes” in our AWB, and this is one of the points that he drives.

      So we are going to retroactively ban a product.

What I find truely sad through all this civilian disarmament talk, is that our great nation wants to and will probably enact laws making law abiding people instant criminals, people like me who have never so much as had a speeding ticket in all my 50 yrs on this planet. And Criminals will be listening to all this so they will know when it is safe for them to continue their “special” skill sets without the fear of an armed homeowner.

    • I feel the same way about Tennessee. No state income tax, and the number of NICS background checks in December brought a happy tear to my eye. Oh, sure, we’ve got plenty of gun banners in Memphis and even some in Nashville, but you’ve got Austin. No state is perfect, right?

Part of me is happy they’re grabbing so rabidly, as the froth makes it easier to fight, but I fear it is only to establish such a high baseline that, when these attempts fail, the can then “compromise”, throw out the patently stupid suggestions (national registration, NCIS checks for ammo) and still end up with a ban on SA rifles snd standard magazines.

The political agendas are very clearly present,the Gov should’ve done this different obviously he wants to capitalize on the families grief….The laws were there the problem is they failed to close the loopholes on the existing laws,I’m worried about all the illegal guns…..Let’s face it how many times are the police on location when a gunfight/shots fired happen to actually do something,not trying to put them down just making a point…The damage is done now the politicians are running damage control for there lack of doing there job. Blame the NRA Penalize the Law abiding weapon owners, and watch what happens when this goes thru the crime rate is going to go thru the roof…….

    2. “Close the private sale loophole by requiring federal background checks”-Have the govt pay for it and make it easy to access as a private citizen. Knowing the govt, this will not run smoothly, you will be charged an insane amount for it, and it will be a large inconvenience.

    3. “Ban high capacity magazines.”-No. Everyone knows that the “high capacity” magazines make killing lots of people easy meme is overblown by liberals who dont understand guns. A guy with a side by side could have caused just as much bloodshed in 20 mins (police response time in CT).

    4. “Enact tougher penalties for illegal gun use, guns on schools grounds and violent gangs.”-DUH (with my edit of course). When you put violent offenders behind bars, keep them there.

    5. “Keep guns from people who are mentally ill.”-This is a slippery slope. The current methods of diagnosing mental illness are not well understood, and it is quite easy to get several differing opinions from different professionals about the same symptoms.

As said above, criminals use minimal amounts of ammo in the commission of their crimes, dont practice, and rarely buy their ammo legally anyway. This will only effect law abiding citizens.

Liberals do not trust their “fellow citizens” — for a very simple reason, they do NOT consider us to be “fellow citizens.” That phrase implies equality and they do not consider us equal to them in any way. They are uniformly arrogant and and self-involved. The do not consider us to me wrong by the way, they consider us unqualified to make decisions for our own lives; we simply are not smart enough, elite enough, nuanced enough, sophisticated enough, et al, to conduct our own lives without their control.

    Frankly, I’m sick of it. I think we have reached the point where we cannot live together any longer and maybe secession is the answer. I KNOW the outcome would be different this time around.

  34. LOL, was talking to a friend who works at a local pawn shop and he related the following. Several days ago, a customer came in and wanted a pistol so they processed it to the background check, what with the rush, it takes four days sometimes. He was told to come back and in four days, the check came back fine and he sold the pistol. Two hours later the BATF calls back and says “cancel that sale”, friend goes why? Well he is a felon of course!

    That my friends is why the BATF has prosecuted less than 1% of the 1.83 mil felons and crazies rejected since 1994 because they cant get their own head out of their arse!

  36. For some reason, anything after the “but” when these knuckleheads talk looks a heck of lot like “infringement” to me, as in “…the right of the People to keep and bear arms shall not be infringed.”
