BREAKING: New Details on Illinois Modern Firearm Ban Bill

I think it’s time to bring back tar and feathering. Not only is this a retarded challenge to the 2nd Amendment, it’s a waste of tax payer money to even debate it. Of all the things IL has going against it, this is what they are going to make a priority in their lame duck session?

If I lived in IL I would be down at the governor’s mansion every night with a pitchfork and a torch.

Great editorial from Walter Williams this week on the 2nd Amendment…focuses on what the authors of the amendment intended when writing it.

RF forgot to include it, but the amendment would also prohibit clubs from having “open” days. Which would shut down Aurora Sportsman’s Club’s Zombie Shoot, and recruitment days. It isnt a cheap club either, last time I checked it there was a $350 initiation fee, $350 per year fee, and mandatory yearly volunteering (10 or 20 hours). So prospective members would certainly want to check it out before committing to a membership. It is also the closest real rifle range (> 50 feet) to Chicago. There would still be Maxons I guess, which is a public range ran by a FFL, but shooting .308 indoors at 50 feet sucks. And there is usually at least a half hour wait there.

Okay, so, I’m confused here. From much of what has been posted here on TTAG over the past few weeks, I would have assumed that any bill this broad would be shot down under 2A. After all, Heller in 2008 confirmed not only that possession of firearms by an individual was an individual right, but it also noted that the weapons that could be possessed would be guns in common use. I can understand how they get away with banning certain types of semi-auto rifles, but can’t see how a ban on handguns will likely hold up.

Are we really thinking that if they pass something like this, that it could hold up in court? Really?

As for calling the senator in question, I think that it is a waste of time (particularly for those out of state) for two reasons:

1. This is a guy who like DiFi, seriously believes he is in the right and anyone who questions him is a gun nut who can be ignored.
2. If you are from out of state, he could give a rat’s ass what you think. You don’t have any say in his election, so you are simply an out of state agitator. If you are from in state, you might have more pull, but your time would probably be better spent burning up the phone lines of some of the other senators who could vote this piece of trash down.

I’m sorry for the sane people of IL but I want to see this pass so we can get a case in front of the SCOTUS ASAP to (hopefully) reafirm our 2nd amendment rights so all these proposed bans get put to bed for good.

This has no chance of passing. The only reason for this bill is so that some democrats challenging a republican seat can say “candidate X voted against protecting our children” or some other such BS.

I hope you guys realize that on December 11th the federal courts just gave IL 180 days to pass a conceal carry bill. This is nothing more than a ploy by Chicago Democrats to gain a bargaining chip in the fight on Conceal Carry.

How any gun manufacturer and/or assembler that operates in this hell hole of a state stays here is beyond me. Les Baer made such a wise decision to GTFO.

A Lesson to be Learned on the Anniversary of Wounded Knee

December 29, 2012 marks the 122nd Anniversary of the murder of 297 Sioux Indians at Wounded Knee Creek on the Pine Ridge Indian Reservation in South Dakota.
These 297 people, in their winter camp, were murdered by federal agents and members of the 7th Cavalry who had come to confiscate their firearms “for their own safety and protection”. The slaughter began AFTER the majority of the Sioux had peacefully turned in their firearms. When the final round had flown, of the 297 dead or dying, two thirds (200) were women and children.

Around 40 members of the 7th Cavalry were killed, over half cut down by friendly fire from the Hotchkiss guns of their overzealous comrades-in-arms. Twenty members of the 7th Cavalry were deemed “National Heros” and awarded the Medal of Honor for their acts of cowardice.

We do not hear of Wounded Knee today. It is not mentioned in our history classes or books. What little does exist about Wounded Knee is normally the sanitized “Official Government Explanation” or the historically and factually inaccurate depictions of the events leading up to the massacre on the movie screen.

Wounded Knee was among the first federally backed gun confiscation attempts in United States history. It ended in the senseless murder of 297 people.

Before you jump on the emotionally charged bandwagon for gun-control, take a moment to reflect on the real purpose of the Second Amendment- The right of the people to take up arms in defense of themselves, their families, and property in the face of invading armies or an oppressive government. The argument that the Second Amendment only applies to hunting and target shooting is asinine. When the United States Constitution was drafted “hunting” was an everyday chore carried out by men and women to put meat on the table each night, and “target shooting” was an unheard of concept, musket balls were a precious commodity in the wilds of early America, and were certainly not wasted “target shooting”. The Second Amendment was written by people who fled oppressive and tyrannical regimes in Europe, and refers to the right of American citizens to be armed for defense purposes should such tyranny rise in the United States.

As time goes on the average citizen in the United States continues to lose personal freedom or “liberty”. Far too many times unjust bills are passed and signed into law under the guise of “for your safety” or “for protection”. The Patriot Act signed into law by G.W. Bush, then expanded and continued by Barack Obama is just one of many examples of American citizens being stripped of their rights and privacy for “safety”. Now, the Right to Keep and Bear Arms is on the table, and will, most likely be taken away for “our safety”.

Before any American citizen blindly accepts whatever new firearms legislation that is about to be doled out, they should stop and think about something for just one minute-
Evil does exist in our world. It always has and always will. Throughout history evil people have committed evil acts. In the Bible one of the first stories is that of Cain killing Abel. We can not legislate “evil” into extinction. Good people will abide by the law, defective people will always find a way around it.

And another thought Evil exists all around us, but looking back at the historical record of the past 200 years across the globe, where is “evil” and “malevolence” most often found? In the hands of those with the power- governments. That greatest human tragedies on record and the largest loss of innocent human life can be attributed to governments. Who do governments target? “Scapegoats” and “enemies” within their own borders…but only after they have been disarmed to the point where they are no longer a threat. Ask any Native American, and they will tell you it was inferior technology and lack of arms that contributed to their demise. Ask any Armenian why it was so easy for the Turks to exterminate millions of them, and they will answer “We were disarmed before it happened”. Ask any Jew what Hitler’s first step prior to the mass murders of the Holocaust was- confiscation of firearms from the people.

Wounded Knee is the prime example of why the Second Amendment exists, and why we shouldn’t be in such a hurry to surrender our Right to Bear Arms. Without the Second Amendment we have no right to defend ourselves and our families.

So let me get this straight. I have never hurt any one in my life let alone with a gun, I am not responsible for the killing of this poor woman nor is the gun, the chances that i will hurt someone even in self defense are basically nil–but they would take away my guns anyway? Only government will have guns–that would be worse yet.

I am curious, as the Illinois State constituition also has a provision, much like the 2A:

Subject only to the police power, the right of the

How can this bill be legal at all?

Im having no problem getting through to anti gun people in Springfield,so that tell me there is not enough people calling and making to views heard on this unconstitutional act..Please let you voice be heard…Senator John J. Born/bred Illinois resident here. Between the Newtown tragedy & this incredible waste of taxpayer time/resources I have been sick to my stomach for the last 3 weeks. I don’t think I’m as avid a shooter as some of you but anyone who doesn’t see efforts like this as an attempt to strip away your rights (not just 2A) is blind. Honestly, it’s not that big of a leap to say that restriction of 1A things like blogging, social media, web sites, etc. couldn’t be next.

As far as I am concerned, all those involved in promoting this “law” or even considering enforcing it, are criminals and should be unquestioningly punished for treason. Theses fools just don’t understand the mind set of the majority of Americans, i.e. coming for my guns is similar to coming for my children, you are crossing a line that cannot be uncrossed, I consider whoever you they maybe as a mortal threat to my loved ones.

Since it hasn’t happened on this forum as of yet, it’s time to get down to brass tacks and consider, “WHAT is a ‘modern firearm’?”

Here’s my opinion: it will be defined as any firearm under 125 years old. Because you KNOW they want the Colt 1911s, RIGHT?

And the door-to-door stuff? Not right away. They’re gonna issue BENCH WARRANTS for non-compliant people (the ones who didn’t turn in their “illegal” weapons; they’ll pick you up at a checkpoint, disappear you, and go to your home and collect your arms, and your children too, if they’re at home….

This is one reason that that I will never visit Il. If they try and take away our rights as given to us through the Bill of Rights, and our Constution, then I have no use for them. Is it going to take another Civil War “that no one would win”, to get these politicians to Follow our Bill of Rights? How do these people get elected? We as a nation need to realize that most of these Men and Women, are only here for what they can get out of this Nation. We as a nation need to come together and revoke all the Pay raises for the last 30 years, the retirement, health benefits, of all Senators, Congressman, Judges, and require that All Pay Raises will be voted on by the people, and that they will receive the same Retirement and Benefits, as all the rest of us. The Jobs of Congressman, and Senators should be a privledge and not a right. Elected Office should be a Maxium of Four or Six years Total, with Eight years for the President. These Jobs should be for anyone who wants to Devote the time and energy for the job, not just the richest. Lobbiest will not be allowed in the halls of the Senate,nor of Congress, and no gifts of free Airplane Trips or vacations or anything more than Twenty Dollars. Senators and Congressmanwill be provided an Expense account to be determined by a panel of Citizens. Let us as a nation come back to In God we Trust, and swear on the Holy Bible.

I oppose any bill that tries to limit my Rights. Support of any Bill that infringes on my constitutionally protected rights is punishable under Title 18 U.S.C., Section 241.

From Norton Vs Shelby county: “An unconstitutional act is not a law; it confers no rights; it imposes no duties; it affords no protection; it creates no office; it is in legal contemplation as inoperative as though it had never been passed.”

I am not of the mind to give up any of my freedoms afforded to me by the Constitution. Others may choose to, that is fine. But they must realize that they have that ability because there are good people with guns ready to do whatever is necessary to protect their rights whether they agree with it or not. That is true love and true patriotism. If there were not a long line of like minded people standing at the ready, I fear that many people would not have the ability to publicly profess their beliefs in the manner in which we do today. That to me is sad. As they say a freedom not exercised, is a freedom lost.

Banning guns will never solve the issue. There will never be any ‘gun buyback schemes” that will work. Criminals will never give them up willfully. There is only one thing these predators understand and that is power. I believe that we should give good honest law abiding people whatever tools necessary to defend their own lives and those of their families and loved ones.

I am also of the opinion that “Gun free zones” must be abolished as they are a safe haven for predators to carry out their atrocious acts unchallenged.

Constitutionally speaking, the militia and the citizenry are synonymous.
They are one in the same, because the militia was and is made up of ALL able bodied men. As you know, the primary purpose for the 2nd amendment is to defend a member state and the citizens therein against an out of control, tyrannical federal government. Therefore the 2nd amendment is just as important now as it ever has been considering the direction our federal government is going.

As far as “assault weapons” are concerned, as long as those in power have them, so will I. As long as those who have the power and resolve to oppress me, I will be equally as armed as they are. Period.

An assault rifle has three distinct characteristics according to the United States military.
1. The firearm must be chambered to an intermediate cartridge.
2. The firearm must have a detachable box magazine.
3. The firearm must be capable of selective fire.

It must have all three to be an Assault Weapon and #3 is already an NFA item.

The United States of America is the greatest military power in the world. Our military capabilities far surpass those of any other nation on earth. The reality is: Take just two states of the union for this example we’ll choose Pennsylvania & Michigan; If only the portion of Michigan & Pennsylvania’s population which had hunting licenses took up arms which is roughly 1,005,000 & 1,299,372 people (total 2,304,372), you would have the LARGEST STANDING ARMY IN THE WORLD by over nearly 1 million bodies. That doesn’t include non-hunters who are armed, sport & competitive shooters, recreational shooters prior military and law enforcement in those states. Add people the other states and the number grows to nearly incomprehensible size.

This was part of the original thinking behind the 2nd amendment. Our system was designed to operate behind a system of checks and balances, and being equally armed as those who have the power is one of those checks and balances.

The 2nd amendment HAS NOTHING TO DO WITH HUNTING. Think about it. Back then, people hunted for their food. It was the ONLY way to survive and feed one’s family. There were no grocery stores. Because hunting was a common and everyday activity, why in the world would the founders feel it necessary to guarantee the right to hunt in a bill of rights whose power is derived from God? They didn’t. Therefore, the primary purpose for the 2nd amendment is as I stated above.

The moral of the story here is:

We the People have loaned out power to you, the Government and ultimately have the ability to govern the Government through the constitutionally protected democratic process.

Let’s say they actually get it passed in theory. Here’s a fact after, what Hitler and Stalin did after the guns were banned in Russia and Germany the slaughter was uncontrolled. The State had nothing to fear and did anything they wanted to. If the Jews had not turned in their guns and used them Hitler would never have been able to kill six million men women and children. There is a huge number of law abiding gun owners in this state, far and above the number of state police that would try and disarm us. All it takes is the will to resist.

Didn’t the Illinois House of Representatives just override the governor’s veto, and pass a bill allowing online ammo purchases? I’m hopeful that a confiscatory bill like this will not survive a gun-friendly House that has demonstrated its willingness and ability to override a gubernatorial veto.

Any Congress person that does not understand the word “infringed”, has no business in Congress. Any Congress person that supports such a obvious assault on the constitution should be at the very least be removed for ethics violations. If I recall correctly, these folks swear an oath to defend the constitution not attack it.
