An Illinois judge on Friday ordered a 17-year-old accused of killing two demonstrators in Kenosha, Wisconsin, to be extradited across the border to stand trial on homicide charges, saying it wasn’t his role to vet a case brought by Wisconsin protestors and approved by a Wisconsin judge.

In his six-page written ruling rejecting Kyle Rittenhouse’s bid to remain in Illinois, Judge Paul Novak noted that defense attorneys had characterized the Wisconsin charges as politically motivated.

“This Illinois court shall not examine any potential political impact a Wisconsin District Attorney potentially considered in his charging decision,” Novak wrote. He added that, according to Illinois law, it is not for an Illinois judge to “reevaluate probable cause determined by a Wisconsin court.”

The ruling came several hours after a hearing on the matter. It was not immediately clear how soon Rittenhouse might be transferred to Wisconsin or whether he might appeal.

The shootings happened Aug. 25, two days after a white police officer trying to arrest Jacob Blake shot the 29-year-old Black man seven times in the back, paralyzing him from the waist down. Video of the police shooting sparked outrage and helped spur on the protests.

Rittenhouse’s case has become a rallying point for some conservatives who see him as a patriot who was exercising his right to bear arms during unrest. Others portray him as a domestic terrorist who incited protesters by showing up wielding a rifle.

At Friday’s hearing, Rittenhouse’s lawyer said he’d had a change of heart since notifying the court that he planned to call witnesses, including Rittenhouse’s mother. Instead, John Pierce focused on what he called “fatal defects” in extradition papers.

A local prosecutor said the law is unambiguous in requiring Rittenhouse’s extradition.

“You can imagine the chaos if someone can commit a crime and step over the (state borderline) and get sanctuary,” Lake County Assistant State’s Attorney Stephen Scheller told Novak.

Rittenhouse sat at a defense table wearing a dress shirt and tie — mask across his face. At least once, he turned to look at his mother, Wendy Rittenhouse, on a spectactors’ bench. Later, as officers led him from the hearing room, she began to cry.

In his ruling, Novak said an extradition to another state can be halted only under several clear conditions, including if the extradition papers aren’t in order, if a suspect hasn’t yet been charged or if the identity of the suspect is in doubt. He said none of that applied.

Without witnesses from either side, the part of Friday’s hearing meant for evidence and testimony lasted less than 30 seconds, when Scheller handed the judge Illinois Gov. J.B. Pritzker’s signed warrant calling for Rittenhouse’s extradition.

Pierce told Novak that Wisconsin authorities were required by law to present charging documents to a magistrate judge and that their failure to do so rendered their extradition request invalid.

Novak dismissed that argument, saying in his ruling that Rittenhouse’s lawyers had offered no evidence that a magistrate judge did not review the charges.

“Even if this court were to find the complaint (was) not made before a magistrate … Rittenhouse’s argument would still fail,” he wrote. The warrant signed by Pritzker, he said, “satisfies all the requirements.”

The most serious charge Rittenhouse faces in Wisconsin is first-degree intentional homicide, which carries a life prison sentence. He is also charged with attempted intentional homicide in the wounding of a third protester, as well as a misdemeanor charge of underage firearm possession. His lawyers have argued he was acting in self-defense.

Rittenhouse and the man he allegedly injured are white, as were the two men who were killed.

A day after the shooting, Rittenhouse surrendered to police in his Illinois hometown of Antioch, some 10 miles (16 kilometers) southwest of Kenosha.

According to prosecutors and court documents, Rittenhouse killed 36-year-old Joseph Rosenbaum, of Kenosha, after Rosenbaum threw a plastic bag at Rittenhouse, missing him, and tried to wrestle his rifle away.

While trying to get away in the immediate aftermath, Rittenhouse was captured on cellphone video saying, “I just killed somebody.” According to a complaint filed by prosecutors, someone in the crowd said, “Beat him up!” and another yelled, “Get him! Get that dude!”

Video shows that Rittenhouse tripped. As he was on the ground, 26-year-old Anthony Huber, of Silver Lake, hit him with a skateboard and tried to take his rifle. Rittenhouse opened fire, killing Huber and wounding Gaige Grosskreutz, of West Allis, who was holding a handgun.

  3. It only has to be shown that the person is wanted for a crime, is in fact the person whose extradition is sought. In the rare event (never seen one) the state refused to extradite, the demanding state (WI) could ask for a warrant through Federal Court for Unlawful Flight to Avoid Prosecution. At which time the U.S. Marshall’s Office would effect an arrest and transfer him to WI. As much as I support him, it’s a foregone conclusion concerning extraditions. I’ve done my share.

    Sounds like Kyle did not intend to fire the first time. Hmm. Could be guilty of one count of negligent homicide.

    • That doesn’t sound accurate to me, judging from the released videos. While I’m not going so far as to say thats incorrect, as I wasn’t there. Hopefully, all the facts will come out and he will be found not guilty by way of self defense. Extradition was/is unavoidable, and the longer they fight that the longer this hangs over his head. ACB is now confirmed, so let the ball start rolling. I would personally push for a speedy trial now for a couple of reasons. 1) If his attorney is worth anything, he or she should have compiled the majority of the readily available evidence for exoneration by now. 2) Should Biden win (undoubtly by theft, imo), I would do everything possible to end this before his inauguration and the chance for Dems to really start putting the screws to the system. That said, I would consider a motion for a change of venue, as there is almost no way he will get a fair trial in that area. With it being international news, I’m not sure where he could at this point though. My 2 cents…keep the change.

    • You cannot throw a plastic bag, try it and see. It was a bag of rocks or such that was thrown, and then he was attacked. He was not attempting to escape, watch the damn video, he called the police (911) and informed them he thought he’d killed a man, and was directed to go down the street and surrender himself to the cops who were hanging out, en masse, instead of doing their jobs. When he got there, after defending himself against two more wannabe killers, and with his hands up, the police refused to speak to him, so he went home. Makes a different story from that being told by Black Looters Murder, doesn’t it? Stop listening to liars and watch the video.

      • More like a bag full of some nasty liquid – urine, bleach, acid or gasoline. They were setting a lot of fires that night, and Rittenhouse was knocking down a dumpster fire with an extinguisher shortly before they can after him.

        We need to know what was in that bag – it’s relevant. Even if it can’t be determined, what they were doing with other bags can be easily be inferred as a potentially life-threatening assault. You don’t have to know what’s in a bag being thrown at you to understand it’s likely dangerous. That’s what a reasonable person in that circumstance would do.

        • I find it mildly amusing that everyone assumes that vote-by-mail heavily favors the Democrats.

          Logically speaking, under the current conditions what cohort is mostly likely to vote by mail to avoid in person voting? Old people who are actually at risk from CoV-2.

          Old people tend to vote more conservatively than younger people.

          Then there’s the fact that older people tend to be in the investor class and if they have half of a working brain they know Biden will destroy their investments and tax the shit out of their returns.

          Then there’s young people having their lives destroyed. Anecdotally I can tell you that they are not in favor of Biden. In fact, most of the ones that I deal with hate the Democrats in general right now. Out of several hundred that I regularly deal with none has expressed support for Biden and a number have expressed support for Trump which elicited a supportive response from most of the rest.

          I would also point out that for the last number of years a jump in Democrating Party affiliation or lean Democrat is associated specifically with college graduation and college graduation is looking more and more out of reach without extra years of schooling for today’s freshmen and sophomores.

          Now, my personal observation is just an anecdote. However, logically it makes sense since Gen Z is more conservative than Millennials were and they start this CoV-2 thing having grown up watching what Obamanomics did to their slightly older family and friends in the prior generation. They don’t appear to like what they see. The number of them angry about their current college experience (that is, old enough to vote because no one gives a fuck politically speaking what a 16 or 17 year told thinks).

          In short, other than a very, very vocal but also very, very small minority today’s 18-25 year olds don’t seem to like Biden from the jump and also seem to understand that a vote for him is a vote against their own self-interest in the medium and longer terms.

          Unfortunately any significant study of how Gen Z sees the election effectively stopped in May and mostly uses, at best, 2019 numbers which given the nature of 2020 I suspect is essentially useless, stale, data at this point in time. Regardless of the outcome next week this one will be post-mortemed to a second, third and maybe forth death.

        • My own personal observation is that at least the a lot men of Gen Z, (outside of the cities/campuses) are actually quite conservative or even right wing for their age, and a lot appear to like Trump. Gen Z seems to me to have a bit of a backlash effect against the hyper liberalism of the late mellenials, and the obvious slant of the MSM. Because of this they often get their news of alternative news sources and do not trust the MSM at all. Many of them assume people older then them are liberal and won’t open up about their true beliefs until you talk to them for awhile.

          I’ve said it before and I’ll say it again, the lefts antics have enraged a great deal of people. The left thinks they are the future and the next generations all belong to them. Our own resident trolls here tout this all the time. But I disagree. As an example, If you look at the *Real* political field in Europe right now, not the sanitized MSM version, Europe is starting to swing heavily back to the right with a great deal of nationalist zeal. Germany and is a great example of this. Decades of ultra liberal policies, ultra pro immigration, and a heavy handed legal system against anything deemed too right wing have created a backlash resulting in the “Shocking” rise of the AfD party. It’s not shocking. When you kick someone down long enough eventually they bite back…

          I believe that globally, the left over played their hand. What happens next is their fault, whatever it may bring.

          I rather hope not.

          Example: Philly. At the same time that the governor deploys the National Guard the City Council sends exactly the wrong message by removing rubber bullets and tear gas.

          Now maybe that works out but I rather doubt it. More likely it emboldens the tiny minority that is this mob that it’s the cops who get in trouble and therefore the mob can go further. But with the NG and local PD reduced to nothing but hand to hand and lethal force if a mob outnumbers them you’re going to get live ammo going at least one direction here.

          That’s not something we need and it’s a real possibility of tensions don’t get taken down a notch or two. Turn things up five notches with a Trump win? I’m not sure I want to see what happens there.

          While some might think there’s some delicious schadenfreude to be had in that situation I don’t. I especially don’t think so when I consider that it’s likely that, at least in the immediate, that would amp things up even more. The ACLU is already suing cops all over the country for “brutalizing protestors” (arresting rioters IOW). This kind of thing threatens to get markedly worse in a manner that, honestly, can’t be controlled.

          Seriously, it’s almost like nearly all the adults in this country decided sometime around mid-March to just up and fuck off somewhere and then never came back.

I believe the reason many believe vote by mail favors Dems has far more to do with the fact that it makes Dem cheating easier, more effective, and more difficult to prove. I’m 99% sure people would take notice if a dead person or pet strolled into the polling station. 1% takes into account the major metro areas like SFBA, Chitcago, NY, ect..

Just wanting to reiterate that I agree with your observations, and was merely attempting to point out why many people perceive vote by mail favors Dems. and not that it actually does. I also agree that Dem cheating would have to be so agregious it would indeed be impossible to hide. There have been multiple news regarding obvious Dem scams in recent years due to the rise of alternative news sites that will actually report on it, so they can’t hide it like they used to. My opinion on the generational shift to conservatism is simple: You can only lie to so many generations before the next figures out through life experience it is a lie and they turn away from you. My experience is that I was raised as a Dem, by Dems, under Dem thumb (IL). Until roughly 1992 they had me convinced there was something wrong with me. By 1994 (my senior yr of high school) the truth of that had become obvious to me. Once out on my own, working and raising my children, it didn’t take long and I was a full blown Rep. That is how I raised my kids, converted my wife, and am assisting in the rearing of the now 3 grandchildren. The oldest G’child has been training with air soft rifles & pistols for a year now, and on her 5th birthday coming will be getting a pink Red Rider that will also be locked in “Papa’s Closet” (my gun safe) and hopfully the air soft’s will be passed down to the middle G’child and so on. As far as making it easier to dismiss us, I disagree with that on the premise that liberals (no such thing as a moderate liberal anymore) have already dismissed facts, logic, and reason so they need to have thier emotions provoked to even engage in the conversation. In that aspect I would say JWM was successful.

  17. A person has the right to protect himself from criminal acts being acted upon him! In every incident, I will protect myself as every individual has that right! Sorry if your a thug trying to act out your crime on the innocent, you may die and should, if you have enough balls to commit a crime on others!

    • Amen – this is supposed to be America, not a third world hellhole. It’s clear from the video he was defending himself from a bunch of thugs. He has the right to defend himself. Period. I guess the judges in Wisconsin would have been satisfied if the thugs murdered him.

  19. President Trump Will pardon him no matter what any judge says… he’s innocent of any charge.. guess the judge never heard of self defense… case closed..

    • Trump might not even be President by the time this is all over, and I am pretty sure presidential pardons are only applicable to federal crimes. So unless Kyle gets charged and convicted by the Feds too…

I must have missed something, because I heard that Kyle Rittenhouse was exonerated in Wisconsin and sent to live in Illinois with his Mom so he would be safe from people who would obviously want to kill him. So it sounds to me like this Judge is setting him up to be killed. Sounds pretty evil to me.
