One of the very first topics in the third and last presidential debate: gun control. As the moderator pointed out, the candidate’s views on gun control was one of the top voted questions on their online poll. As expected, Donald Trump responded with a full throated and boilerplate NRA-endorsed defense of gun rights. Hillary Clinton offered her now standard “I support the Second Amendment but…” line, with an interesting twist.

She claims that her opposition to the Heller decision, the biggest gun rights win in the Supreme Court in recent memory, is only because it supposedly puts the lives of children at risk. She claimed to support the right of people to bear arms for self defense, but in the same breath claims that the Supreme Court “got it wrong” when they act to support that very same right for people to have a loaded firearm in their home. Because we need to think of the children.

Wallace: Secretary Clinton, thank you. Mr. Trump, same question. Where do you want to see the court take the country and how do you believe the constitution should be interpreted?

Donald Trump: Well, first of all, it’s great to be with you and thank you, everybody. The Supreme Court, it’s what it’s all about. Our country is so, so, just so imperative that we have the right justices. Something happened recently where Justice Ginsburg made some very inappropriate statements toward me and toward a tremendous number of people, many, many millions of people that I represent, and she was forced to apologize and apologize she did. But these were statements that should never ever have been made.

We need a supreme court that, in my opinion, is going to uphold the second amendment and all amendments, but the second amendment, which is under absolute siege. I believe if my opponent should win this race, which I truly don’t think will happen, we will have a second amendment which will be a very, very small replica of what it is right now. But I feel that it’s absolutely important that we recall because of the fact that it is under such trauma. I feel that the justices that I am going to appoint — and I’ve named 20 of them — the justices that I’m going to appoint will be pro-life, they will have a conservative bent, they will be protecting the second amendment, they are great scholars in all cases and they’re people of tremendous respect. They will interpret the constitution the way the founders wanted it interpreted.

And I believe that’s very, very important. I don’t think we should have justices appointed that decide what they want to hear.

It’s all about the constitution of — and so important, the constitution the way it was meant to be and those are the people that I will appoint.

Wallace: We now have 10 minutes for open discussion. I want to focus on two issues that in fact by the justices that you name could end up changing the existing law of the land. First is one that you mentioned, Mr. Trump, and that is guns. Secretary Clinton you said last year, and let me quote, the Supreme Court is wrong on the second amendment.

Now in fact in the 2008 Heller case, the court ruled that there is a constitutional right to bear arms but a right that is reasonably limited. Those were the words of the Judge Antonin Scalia, who wrote the decision. What’s wrong with that?

Clinton: Well, first of all, I support the second amendment. I lived in Arkansas for 18 wonderful years. I represented upstate New York. I understand and respect the tradition of gun ownership. It goes back to the founding of our country. But I also believe that there can be and must be reasonable regulation. Because I support the second amendment doesn’t mean that I want people who shouldn’t have guns to be able to threaten you, kill you or members of your family.

And so when I think about what we need to do, we have 33,000 people a year who die from guns. I think we need comprehensive background checks. We need to close the online loophole, close the gun show loophole. There are other matters that I think are sensible that are the kind of reforms that would make a difference that are not in any way conflicting with the second amendment.

You mentioned the Heller decision, and what I was saying that you reference, Chris, was that I disagreed with the way the court applied the second amendment in that case. Because what the District of Columbia was trying to do was protect toddlers from guns. They wanted people with guns to safely store them, and the court didn’t accept that reasonable regulation, but they’ve accepted many other.

I see no conflict between saving people’s lives and defending the second amendment.

Wallace: Let me bring Mr. Trump in here. The bipartisan open debate coalition got millions of votes on questions to ask here, and this was, in fact, one of the top questions that they got. How will you insure the second amendment is protected? You just heard Secretary Clinton’s answer. Does she persuade you that, while you may differ on regulation, that she supports a second amendment right to bear arms?

Trump: The DC v. Heller decision was very strongly and she was extremely angry about it. I watched. She was very, very angry when upheld. And Justice Scalia was so involved, and it was a well crafted decision, but Hillary was extremely upset, extremely angry, and people that believe in the second amendment and believe in it very strongly were very upset with what she had to say.

Wallace: Let me bring in Secretary Clinton. Were you extremely upset?

Clinton: Well, I was upset because, unfortunately, dozens of toddlers injure themselves, even kill people with guns because, unfortunately, not everyone who has loaded guns in their homes takes appropriate precautions.

But there’s no doubt that I respect the second amendment, that I also believe there’s an individual right to bear arms. That is not in conflict with sensible, common-sense regulation. And you know, look, I understand that Donald’s been strongly supported by the NRA, the gun lobby’s on his side, they’re running millions of dollars of ads against me. And I regret that because what I would like to see is for people to come together and say, of course, we’re going to protect and defend the second amendment, but we’re going to do it in a way that tries to save some of these 33,000 lives that we lose every year.

Wallace: Let me bring Mr. Trump back into that. Because, in fact, you oppose any limits on assault weapons. Any limits on magazines, you support a national right to carry law. Why, sir?

Trump: Let me just tell you before we go any further, in Chicago, which has the toughest gun laws in the United States, probably you could say by far they have more gun violence than any other city. So we have the toughest laws and you have tremendous gun violence.

I am a very strong supporter of the second amendment. And I don’t know if Hillary was saying it in a sarcastic manner but I’m very proud to have the endorsement of the NRA. It’s the earliest endorsement they’ve ever given to anybody who ran for president. I’m very honored by all of that.

We are going to appoint justices. This is the best way to help the second amendment. We’re going to appoint justices that will feel very seriously about the second amendment. That will not do damage to the second amendment.

      • Per the stats I found in 2015 there were roughly 260 child related accidental shootings, 83 were fatal. The same year over 700 drowned in swimming pools. So, banning pools “for the children” would save more lives. But that would not foster her facist regime as quickly now would it.

        • WaPo reports last year the incidence of toddlers finding guns and killing themselves or others averaged about one a week. This year, they continue, the incidence is averaging about two per week. *

          I am not a Parent, but it seems obvious that Parents with toddlers and loaded firearms in the house ought to exercise some real “common sense” and make sure their toddler(s) cannot access the loaded firearm at any time. When the Parent judges the child old enough to understand and exercise the rules of gun safety, the child(ren) should be taught firearms safety. All that being said, the judgement to secure firearms against young children’s access and when to teach firearms safe handling is up to the Parent(s) and our mileage may vary.

        • Well, before getting too excited about solutions, I would like to hear what makes anyone think that all of those infants/toddlers shot themselves. I’m betting there’s no video or witnesses nearly every time.

          I’ve had guns for over 50 years, minimal training for the first 20-30 of those years. But nobody ever had to tell me not to leave loaded guns lying around the house, even before I had children. Ignoring the probability that a lot (if not all) of those children were murdered by one or both of their parents seems kind of stupid, to me. Don’t believe it? Let’s get 100 children of the appropriate ages together with a dozen firearms without ammo or firing pins, whatever you like to guarantee safety, and see how many even pay any attention to the guns, followed by how often they drop the hammer, followed by having it pointed at themselves or mommy or whatever. If you think about it, you know the answer.

    • I am not fond of Trump either, but, as you said, I like “her” much less. I find a most appropriate analogy from the “polish a turd” episode of Mythbusters. In it, they took feces and compressed them into a sphere and were then able to polish it conventionally (it should be on youtube). They got a pair of turd spheres to a high gloss. Anyway, the analogy is that Trump is a regular unformed turd and Hillary is the polished turd. While neither are appealing, I will take the unpolished turd all day because it is true to its nature. I know exactly what it is and what to expect. The polished turd tries to hide the fact that is is just as foul, smelly, and unsanitary as the unpolished one, but it is. Now some unsuspecting person will come along and say, “hey, shiny rock, let me pick it up and put it in my house.”

      • However the mainstream media expects you to put that shiny turd in your mouth where the candy coating melts instantaneous. They demand you smile and like it and remain silent. And pay thru the nose for the excitement and experience.

        Trump is much less than a turd. He isn’t a diamond to be sure but still pretty tough.

        Turds belong in the field where they can be plowed over and buried.

Can he do the job? I see potential, but I also see someone who’s always been about himself. He has the potential to gather the right people around him and lead. If he can’t do that then we’ll just have to rely in bureaucratic inertia.

        • All politicians are about themselves, and the more powerful the office, the more this is the case. The main difference with Trump is in his delivery. Though even at his worst, he’ll be a better President than Hillary at her best.

I do know America will never get to really know without actively investigating as the now finished Debates are pretty much rigged by the Dems and the Reps jointly to only really allow Dems and Reps to participate.

    Frankly, I’m most curious about Hilary Clinton’s definition of someone being “brought to justice”.

        • The first assault weapons ban was really bad for democrats. I doubt they will repeat that mistake at the Federal level, so states like Idaho and Wyoming are unlikely to see any impact at all. But I can see more states going the way of California.

        If equality is needed, THEN EQUALITY IS NEEDED. Be what you are asking to be equated with, or be something that someone else aspires to and works to be equal with. That’s how it works. Equality is the formula for ‘sameness’ on either side of two short horizontal lines, the result of which is the same regardless of which you calculate it across the Equal symbol.

        However “Equality” is, or is not. Equality does not need to be “asked for” and it certainly doesn’t wait around to be “given” as it cannot be. Equal treatment can be requested, but it too is based upon ascertainment of whether something or someone IS EQUAL. No one wants to equate themselves with someone who is wondering if they’re equal, or even potentially ‘not equal’.

        Therefore, what’s got no future are unequal people blaming (or claiming lack-of) privilege. No one wants anything to do with that broken crap. Hope their kids can get out from underneath that sh_t before they have kids.

    • I agree with all of this. Furthermore, after reading the comments section of any number of TTAG articles, and putting 30 minutes of thought into it in advance, my 18 yr old could have addressed the topic more effectively than Trump did.

      It is one thing to attempt to persuade/motivate by guilt (toddler argument) when you can actually, and clearly, tie the guilt back to the event. It is a whole different ball game when you use it as an attempt just to shut someone down, because who would argue with “saving toddlers”. I would like to think that, for many people, her robot speak would have given away her attempt at the latter, but it is not likely.

The “safe storage” requirements that were struck down would only apply to handguns registered prior to 1975. How many DC residents with a 33-year standing DC gun permit had toddlers in their care?

  16. He should have ripped her apart right when she brought up the old bullcrap about the 33.000 deaths, the online and gun show loopholes. We know that they do not exist, it’s written down in the law and even if those loopholes would exist, she and her party would have already failed to close them in the last 8 years.
    It was very likely that this question would pop up and everybody knew which rigged arguments Clinton would come up with. Is it really asked too much that he should prepare on debunking her most obvious lies? That’s what i would do as preparation for a debate. Study her argument and destroy them.
    And did he finally understand that ‘no fly no buy’ violates both the 2nd and 5th amendment?

  17. The first segment was the most telling about their positions. Hillary made it clear that the SCOTUS should be an activist group for social change. She never once mentioned upholding the founding principles of the Constitution. Donald gave the only right answer and said that the justices must uphold the Constitution. This is the difference betwixt our two parties right now. The liberals will destroy the checks and balances system with activist judges and that will destroy our nation. She is the greatest threat to our liberty that I have seen in my 56 years.

      • It is not activism to read “shall not be infringed” and understand the word clearly written. It is activism to say that doesn’t mean reasonable common sense restrictions. No other enumerated rights have ANY laws which restrict their exercise, none.

      • It’s only activism if one of the black robed think that they (by appointment and confirmation to the SCOTUS) have suddenly become one of the founding fathers, or that the person who appointed them, or the persons that confirmed them have suddenly become one of the founding fathers.

        The SECONDARY role (ALTHOUGH PERHAPS MOST IMPORTANT) of the SCOTUS is to beat back the barbs of law that conflict with the Constitution, not to mold the Constitution, through contemporary interpretation, to fit whatever the aholes pop out of the Congress and Senate (or lower jurisdictions).

        The first is to decide (break a tie) in contradicting lower Courts. If lower Courts continue to pump out bad decisions [hello 9th Circuit black-robed POS] then they should remove that Court from the Circuit, because they are too swayed by the aholes that swarm around them (and their own brokenness).

    Ted Cruz, or even Rubio, would have obliterated Hillarys Communist anti RKBA arguments. But the GOPe made sure there was no Conservative running to oppose her, because they would rather have the Clintons calling the shots from the Executive office so they can play second fiddle and pretend to oppose them, rather than actually defeat them.

    • Fred, we’re on the same page. How could Trump have risen to where he is in industry being as stupid as he sounds in a debate. Hillary fed him statements again and again, that he should have been able to use to expose her for what she is. Instead, he just keeps repeating the same stuff. It looks like Trump got into the contest to keep better candidates out.

      There is a book from the early 1960’s “You Can Trust the Communists…To do What they Say”. Hillary is a real threat to the 2nd amendment. She’ll exec order away the Protection of Lawful Commerce in Arms law. She will put in place the 25% tax on firearms and ammo that she wanted in the 1990’s. And then she’ll get an “Assault weapons ban” that works like the skank in Massachusetts decided to interpret their law. Finally, she’ll get “Australian style” gun control aka Confiscation with Compensation. You can trust the Communists–and Hillary Clinton–to do what they say.

  19. Because parents apparently don’t know what a gun is capable of – and a law mandating storage of that gun is somehow more incentive than the idea of their children blowing their face off with a gun.

    Also, more toddlers die each year by poison and drowning and likely falls, but we are going to focus on the smallest possible cause of death – about 500 per year out of 330,000,000 people – a category called firearms. Priorities people. Will they mandate laws to lock up chemicals and baby gates for stairs? Nope. Guns? Yes! Because guns!

    Teaching your kid about the dangers of firearms? Not ok. Locking your firearms up so nobody can get to them in an emergency? Ok.

    • It breaks up the boredom in the 5 minutes it takes to un-handcuff it from the inside of the safe at the bottom of the pool.

      If a gun needs to be “safe”, it can always be made “safer”, if its owner/user needs to be safe then the evil liberal_progressive_communist_globalist (D) need to sustain that need (not sustain what makes them safe).

  20. At this point I do not understand why anyone would grant any credibility to anything HilLIARY says. She wouldn’t know he truth if it bit her in the butt…repeatedly. She lives in her own Fantasy World and deliberately lies about the rest.

    Trump missed some great opportunities last night, like pouncing on pointing-out Putin really wants HilLIARy to win because he knows she is weak, stupid and incompetent based on past experience, so she won’t give him any effective challenges.

    HilLIARy is a mortal enemy to the Second Amendment, the NRA and American gun owners. Period.

    The only “winner” last night was Chris Wallace, who in my humble opinion, ought to Moderate all future Presidential Debates from now on as long as he wants to.

    Right after Nov 8, I am re-registering as an Independent and to Hell with the Democrats and Republicans.

    • I would prefer to register NPA, but we have closed primaries in FL so I’d be throwing away my input there. And since this town is a democrat cesspool, I’d also lose out on local elections where there are few or no R candidates.

  22. Toddlers? Here’re some stats. The most frequent number mentioned is @33,000 firearms deaths per year. @21,000 of those are suicides. That leaves @12000 deaths. 6500 or so are justifiable homicide. @1600 are negligent discharges (sometimes referred to accidents and this is where toddlers come in). Now we are down to @ 4000 intentional firearm homicides. The majority of these firearm homicides occur in about 6 urban areas and involve primarily children (12-24-year-olds.) (Yes, the official age definition for children for firearms reporting is up to 24 years old.) Of those @4000, 538 are (0-11), 2479 are (12-17) and the rest are technically adults.
    So, toddlers are considered to be 1-3 years old and make up a small subset of those 538 deaths in the 0-11 range. To use this small subset of deaths to craft national gun policies or laws is illogical and deceptive.
    The use of the term “children” referring to those up to 24 is deceptive.
    To ignore the fact that most “gun violence” involves teens and young adults in six urban areas and rather than target that problem policy makers and the press demand more restriction on the national level only highlights the true agenda of anti-2A groups.
    In a time when overall national crime rate, including homicide, is down, the facts are that those states and cities with the highest gun crime rates are those with the most restrictive firearms regulations.
    Wyoming, for instance, has the highest rate of gun ownership of any state ( 4 times the next highest), has few gun restrictions, however, it ranks lowest in gun crime and in 2016 had no toddlers killed by firearms.
    Please, folks, understand the issues and you’ll see through the BS and make better comments.

  23. Unfortunately, I live in Oregon, and as if we didn’t have enough to worry about, with Clinton probably gonna be Mademoiselle Presidente, we also have the lovely Kate Brown as Governor. She and her cell mates, one state above us, and on state below us, got us squeezed to death. They want to ban the sale of AR-15’s, and have background checks on all ammo.
    God help us!

  24. Small point for Hillary, friend of the Toddler. More toddlers are killed each year by their parents running over them in their cars than killed with firearms.
