Oh boy. Senator Diane Feinstein and her team are up to their old tricks, introducing new Assault Weapons Ban legislation for 2019 that builds on her failed 2017 effort and adds a bunch of new restrictions, regulations, and bans.

Her new bill would outlaw private sales, enact safe storage mandates, and prohibit the transfer of “high capacity” magazines, among other Second Amendment infringements.

If you didn’t care about bump stocks and don’t believe in that “slippery slope” thing, you should care now. Check this out:

Other provisions:

• Requires a background check on any future sale, trade or gifting of an assault weapon covered by the bill.
• Requires that grandfathered assault weapons are stored using a secure gun storage or safety device like a trigger lock.
• Prohibits the transfer of high-capacity ammunition magazines.
• Bans bump-fire stocks and other devices that allow semi-automatic weapons to fire at fully automatic rates.

Updates to Assault Weapons Ban of 2017:

• Bans stocks that are “otherwise foldable or adjustable in a manner that operates to reduce the length, size, or any other dimension, or otherwise enhances the concealability of a firearm.”
• Bans assault pistols that weigh 50 or more ounces when unloaded, a policy included in the original 1994 ban.
• Bans assault pistol stabilizing braces that transform assault pistols into assault rifles by allowing the shooter to shoulder the weapon and fire more accurately.
• Bans Thordsen-type grips and stocks that are designed to evade a ban on assault weapons.

Universal background checks, mandatory safe storage, no transfers of existing standard-capacity magazines, no bump stocks, no folding or adjustable stocks, no large-format pistols, no pistol stabilizing braces (they hate disabled persons!), none of grips or stocks designed specifically not to violate the “assault weapons” definitions.

This is insane. God forbid a rifle have an adjustable stock so everyone in the family can use it. God forbid a pistol have a stabilizing brace so disabled shooters can use it. You know, firearms should apparently only be usable by able-bodied adults.

And replacing a banned pistol grip with one that isn’t a pistol grip is now “evading” the ban? That’s rich. So which is it? Are pistol grips a problem or aren’t they? Why are you banning pistol grips if replacing one with a “traditional” or otherwise non-pistol grip doesn’t resolve the “problem?”

For more details on magazine bans, grandfather clauses, and what makes an “assault weapon,” here’s the rest of the text. Well, the rest of the bill’s summary:

Key provisions:

• Bans the sale, manufacture, transfer and importation of 205 military-style assault weapons by name. Owners may keep existing weapons.
• Bans any assault weapon that accepts a detachable ammunition magazine and has one or more military characteristics including a pistol grip, a forward grip, a barrel shroud, a threaded barrel or a folding or telescoping stock. Owners may keep existing weapons.
• Bans magazines and other ammunition feeding devices that hold more than 10 rounds of ammunition, which allow shooters to quickly fire many rounds without needing to reload. Owners may keep existing magazines.

Exemptions to bill:

• The bill exempts by name more than 2,200 guns for hunting, household defense or recreational purposes.
• The bill includes a grandfather clause that exempts all weapons lawfully possessed at the date of enactment.

Funny, I always thought “assault” was a verb, not an adjective.

    • “Good grief” we say. They should be saying this about us! What ever happened to national reciprocity and hearing protection act? What about scotus rulings on micro stamping, state “assault weapon” laws, magazine capacity restrictions, and waiting periods? We gave up the initiative and they are putting us on the defensive with this crap!

  1. You suggest donating to the NRA. That should be only if you WANT this bill to pass into law. The NRA is useless and has betrayed its purpose and members.

    • To be clear, I did not originally include them at all. After the bump stock BS and the red flag law BS, the NRA is feeling fairly dead to me. However, unfortunately, the argument was made that the NRA is still the 800-lb gorilla in the room for us and that this bill goes way, way beyond bump stocks. Basically, that they’re still needed in the corner of the Second Amendment on this one so the NRA at least has to be listed there. They’ve successfully fought AWBs in the past and fought to ensure the previous one did, in fact, sunset in 2004. So…they were added in before publishing.

      If you’re donating money donate to whomever you please, of course.

    • I’m not a fan of the NRA right now either, but I’d imagine they’d fight this one with everything they have. If this passed they would know that they, and the 2A, are done for good, outside of a, let’s call it, radical regime change.

        The Feinstein legislation is not new, not a surprise. Why didn’t the premier civil rights organization in the nation not already have a prepared response to launch immediately after the press release of Feinstein’s new proposal? If waiting to see what is in the proposal is the strategy, that means NRA thinks there may be some acceptable trade-offs in the text. And this is with whom we should trust our rights and our money?

        Maybe it is time to make this obvious point more obvious: all the major cities are turning Leftist. Once all the large population centers are controlled by Leftists, there will not be enough votes remaining to successfully oppose any legislation. There is no Electoral College for anything other than electing a president. The population centers will rule. Look at Washington, Oregon, California, New Jerksey, New York. Numbers is numbers, and constitutionalists don’t have the numbers.

    • Tom, right on brother. The NRA betrayed all of us. I’m a lifetime member who will never donate another penny to them. Support the GOA, Second Amendment Foundation, and local state Pro 2A lobbying groups instead. Also, really important to open a dialogue with your local, state, and national reps in a respectful, to the point, and articulate manner.

    • I don’t agree with everything the NRA has done but they are the ONLY reason we don’t have the same laws as Australia. If you don’t support them you are a freeloader that is a detriment to the 2nd Amendment and a traitor to the Constitution.

  2. In the press release, they list both the Las Vegas and Sutherland Springs shootings as taking place in October of 2018. They were both in 2017.

    It may seem like a small detail, but I think it’s important.

    Any distortion of the truth, no matter how small, is significant.

    • Oh yeah, and Sutherland Springs shooting was ended by a citizen wielding a gun that would be a felony under this idiotic law.

    • VERY important, since the supposed need for these draconian restrictions is the crisis of mass shootings caused by these “weapons of war”. If these terrible scary assault weapons are the preferred choice of mass-shooting attackers, it is very curious that she can only find one example to cite in the last year, and has to borrow from the preceding year to promote her alleged crisis.

      So very wrong, mi amigo. What is important is being morally correct. Facts are not valuable in and of themselves. The message is what is important. If facts can illustrate, then fine. If not, well, facts don’t win arguments: “People are not swayed by the height of you logic, but the depth of your emotion.”

      2017, 2018, at this point in time, what difference does it make? Both events actually happened. The damage was actually done. The point is made, even without reference to a specific, or even correct, date.

      People in general do not make decisions based on logic and data, but on how they feel they are being treated or impacted by events; emotions. How I feel is more important to me than how many numbers and statistics you can claim.

      Time has changed; ideas make the difference, not data. A fact-based nation is an uncaring, unfair, uninterested nation. Not a place where real people live.

  3. In Washington State, I-1639 redefined ALL semiautomatic rifles regardless of features, caliber and capacity as “assault rifles” effective July 1, 2019. This law applies to ALL such rifles in possession and ALL rifles transferred in to the future. It even applies to .22 rimfire semiautomatics with fixed, tubular magazines of any capacity with wooden straight stocks and no features like the Marlin Model 60. The Washington State AG presented to the State Legislative session ending in March 2019 three anti-2A measures. One measure will BAN ALL “assault rifles” as newly defined by I-1639. If the banning of ALL semiautomatics, including .22 rimfire rifles, regardless of capacity and features, doesn’t pass in the 2019 legislature, it will go before a public vote as a direct to ballot measure like I-1639. The second measure will BAN magazines holding more than 10 rounds, and the third measure bans 80% builds and parts. No transfers are allowed for detachable magazines above 10 rounds. Essentially, all modern semiautomatics will be banned in WA State, if not by the legislature, by a direct to ballot vote. And, according to advocates of this infringement, this is “just the start” what comes next is confiscation.

    • FFS! Seriously? I live in WA state and I didn’t know abt this additional attempt to disarm me and my family. What can I do to help stop this obvious attempt to destroy MY #2A rights?
      I am furious 1639 even passed. Voter fraud happened here but not a damn word from anyone! My sheriff has stated he will not enforce the new law here, but the fact that confiscation will be the next step, I will not give mine up.

    • It’s a good thing they didn’t hold a ballot initiative on the Civil Rights Act of 1964. The Democrats would have voted it down.

        The courts *must* declare ‘tyranny of the majority’ prohibited concerning civil rights, like the 2A…

    • The WA State legislature is also considering an initiative that will upset the “preemption” laws in WA. What this means is that individual city governments can make anti-2A rules that are in violation and inconsistent with the WA State constitution and existing laws. For example, a city council may decide to outright ban all semiautomatics and detachable magazines without grandfathering them. Existing owners of semiautomatics and magazines would need to be remove such property from the city limits. In my opinion, this is a greater risk than direct-to-ballot initiatives, because the new rules established at the city level would be far more invasive, not require a vote, not require discussion or dissent, and not have to follow any WA State law. Watch for this one in WA State, as it has been successfully pulled of by other anti-2A legislators and city governments.

    • Say that to the people of the state of Washington whose rights were thrown down the toilet by not just voter fraud, but manipulation of facts and outright fraud to get signatures from real people. WA has gone full retard on the 2nd amendment. How about Commiefornia where the 2nd amendment is practically illegal.

      I am sure, as I was one in WA, many people thought “Meh this will never pass, it’s clearly not legal” yet here we are.

    • Its the law here in California, almost everything she is proposing in this new bill we already have and don’t be surprised if they try to outlaw forward grips, muzzle devices, binary triggers, folding stocks, .50 caliber bullets, pistol grips, detachable magazines, and all of the other stupid laws we have here in the final version of this bill.

      If you do not think there is anyway they will use large urban populations to pass laws that the rural smaller population doesn’t want, then you have not been to California or heard of the very restrictive laws that we have here. They have begun to use this strategy nation wide with NYC, Los Angeles, Seattle, Portland, Denver, and a lot of other large cities fully supporting their BS agenda. Oregon and Washington also know what it is like for 1/100th of the land mass to own 90% of the state politics.

    • That attitude will get it passed. Take it from someone who lives in NY. Many guys here thought the laws they wanted to pass would never happen, they didn’t even vote, much less donate to a org that would fight or get active in protesting.
      Now we got the SAFE ACT and there are bills in the NY state legislature to force us to buy insurance just to own a gun and surrender our username/passwords to our social media accounts if we want a pistol permit.
      Your wrong if you think they can’t get these things passed. Its all a matter of convincing the other politicians they can still get elected if they do it.
      They will push the laws until we fight back enough that they don’t get elected.
      We all have to get off our asses if we want to preserve our gun rights.

    • This is political theatrics. It certainly has no chance of passing the Senate. It may not even pass Congress, unless a convenient incident happens.

      It is a rallying cry to the party faithful and political grandstanding to be seen to be doing something. And if it fails to pass, it can then be used to demonize the opposition.

    When they take your guns or the right of future generations to have guns, we are finished.

          The NRA doesn’t fight for freedom, they fundraise off of the threat of it being taken away. Why would they want to stop it? They lose money that way. Why are we always the one to compromise if the NRA is as powerful and everyone thinks they are? How is it that under a Republican Senate, Republican House, and Republican President the only thing we get is more rights taken away?

  9. Yawn. We knew this was coming. It will always be coming. Only wondering why Feinstein, and others, don’t cut to the chase and sponsor a full-up ban on all semi-automatic weapons, and guns capable of firing more than one bullet without reloading? The courts would be happy to hide behind the Second Amendment by declaring that only a complete ban on firearms is unconstitutional. Having single shot firearms fills the requirement to allow private citizens to possess firearms. “Shall not be infringed” is obsolete due to the many “reasonable” (compelling government interests, less than strict scrutiny, tradition and history) restrictions. Thus, we are left with “…the right of the people to keep and bear arms…”

    I don’t think there has ever been a court holding that “…shall not be infringed…” is of any legal consideration. The courts always rule “…shall not be infringed, except for…”

  10. I can see the morons in Trenton, led by our clown of a Governor embracing this nonsense as the perfect solution to “gun violence ” in NJ. Of course our “leading lights” will conjure up an “assault pistol” description banning all semi-auto handguns and add that to this bill. It will be interesting to see how SCOTUS views this backhanded attempt to totally emasculate the 2nd Amendment.

    • My only hope for NJ gun laws is that they become such egregious violations of the 2nd amendment that SCOTUS will eventually strike them down.

      Beyond that, there is no saving NJ. Our current governor flat out told voters he has a leftist agenda to make NJ more like California and that he was going to raise taxes to implement that agenda.

      NJ is willingly digging it’s own grave and will jump in with both feet.

  11. Well, now we have some cool new terms to use! Thanks Diane! Worried about assault weapons? Be very afraid of assault pistols. They are apparently only defined by weight, not any type of features or technology. A light weight poly AR pistol if it could beat the 50oz weight threshold would not be an assault pistol. A really heavy steel match pistol with optics and a match weight might in fact be.

    Ooo, assault pistol braces, if you put one on your assault pistol, it becomes a double assault! Insert an assault drum and you are one scary dude!

    • Fortunately, my family banned assault many generations back, therefore for us there are only rifles and pistols, no “assault” anything, so I can simply ignore these laws.

      This would be an “Assault pistol”.

      Someone wake up the fudds and explain that the Dems are trying to classify large-caliber revolvers as ‘assault weapons’ now.

          Simpler to ban all firearms with a pistol grip (a feature of “assault weapons”)

        • However, in WA State they classified ALL semiautomatics regardless of features (e.g., pistol grips, lugs, detachable magazines, muzzle brakes, etc.) and regardless of capacity and regardless of caliber (includes .22 rimfire) as “assault rifles.” ALL semiautomatic rifles are now “assault rifles” in WA state. Now that they have done that they are comping after ALL semiautomatics to BAN them all in WA State. Double action will later be considered the “new” semiautomatic action and it will be targeted as a “loophole” along with pump action that accept detachable magazines. They’re coming after ALL guns.

      • Agree. What we really need to fear for the coming term would be an ex parte disarmament hearing bill, or a ban on private sales (with “adequate record keeping” for all legal sales, of course).

  12. Dear Senator Feinstein. Last year we saw hundreds of thousands of law-abiding citizens use firearms effectively in the defense of their lives and the lives of their loved ones. In most of these incidents no shots were fired at all. This is a very strong indication that law-abiding citizens use sound judgement when confronted with deadly force situations. In many of the aforementioned incidents, law-abiding citizens lives were saved by the very firearms you are attempting to ban. I urge you to stop advancing your specious ideology, which is endangering the very lives of the constituency you claim to protect.

  13. According to Gallup, ‘gun policy’ was the fifth most important issue going into the 2018 midterms that gave the Democrats control of the house. The fifth most important issue might be worth trying to handle, but it’s a fact that all the people who voted for it in Gallup polling surely don’t want more of it. Second amendment supporters are likely to vote for ‘gun policy’ as an important issue, possibly even more than second amendment opponents. The Democrats just can’t seem to resist shooting themselves in the foot over gun control and I’m fine with that assuming the never passes.

    Even if it does pass, American gun owners and the firearm market are totally different today than they were in 1994. Many gun owners are already used to ignoring state bans. I don’t see this working out how the Democrats would like if they manage to get it passed.

    • Well, yes, but “gun policy” includes both sides of the issue, it is important to me, for sure! That does not mean that “prohibiting firearms of some description” is desired by all those people.

  14. Crazy. The thought that goes through my mind when I see all this banter about gun control is how no one talks about the warning signs of our societal regressions. Shouldn’t we all be more intelligent and responsible as a society with all this information at our fingertips and how convenient things have become?? Not! Instead we are faced with laws that want to strip our rights away and treat law abiding citizens as criminals. It blows my mind. Literally, on how far we’ve come and where we’re going. Not good gents, not good!!….ps. I’m new here.

      • Thank you! I’ve been reading these comments for a couple years and sit back and watch the “trends” and “climate” of my fellow firearm owners. We all need to band together as much as possible the way I see it. I’ve watched my state of Florida (native here) turn into a Masshole, NY, NJ, whore house. I’m done with it. It’s on a national level now.

    Violation of this new law by any politician results in immediate summary execution by any citizen if the politician does any of the following:

    1. Use sentences with more than 10 words.
    2. Has any of the following two words or any variation thereof – racism, homophobic, homophobic, Islamophobia, hates, nationalist, white, privilege, the phrase – “Pay their fair share” or “For the children”, extremist, dog whistle, alt-right, progressive, 97%.
    3. Accepts money from any foreign government.
    4. Proposes a bill more than 10 pages long.
    5. Is caught in any statement easily proven false by less than 5 minutes using google or duckduckgo.
    6. Is proven to have lied, to anyone, for any reason.
    7. Transfers any campaign money from the campaign to their own bank account.
    8. Proposes any new regulation without repealing 10.
    9. Refuses to affirm the 2nd Amendment forbids ANY infringement on a citizens right to own any weapon, excluding only nuclear, biological and chemical weapons of mass destruction. (Chemical powered firearms or lasers will not be included in those categories.
    10. Invokes separation of church and state in any matter other than churches being officially endorsed or favored in a bill, a national religion being declared, or active church officials holding government office.
    11. All Congress critters and government employees will be subjected to random drug & alcohol testing no less than 10 times a year. Any positive result will mean instant summary execution.
    12. Members of the house may serve at most 6 terms, Senators may serve 2 in their lifetime. Judges will be appointed for 10 years.
    13. The public may nominate a total of 10 Congress critters every year. The ten will then be voted on and the top five will be executed by flamethrower on National Television. If nominated and not selected to die horribly for our entertainment, they may not be nominated next year.

    There…That would be my response to any gun bill proposed by anyone other than ones repealing laws.

    California has already defied the federal government on illegal aliens. I think its time for the states to go there own way. No need for violence. Just leave the Union.

  19. It amuses me, they are talking about “sporting guns” again. I think this is a big screw up on our part. We should be arguing that anything with sporting purposes is less protected because those aren’t the primary function. As the left likes to point out so much, there’s that militia part. We have the guns to make the militia, that means that the constitution really protects a weapon suitable for such service more so than a hunting weapon.

          Are you claiming that it is the “global elites” who do the actual voting? If you define “grass roots” as voters, then, yes, the “global elites” are funding a grass roots movement. If you define “grass roots” as an ill-defined, unorganized, leaderless mob that suddenly emerges without obvious stimulus, then there is no grass roots movement.

          My point is that frustrated legislation is a significant rally post. The more frustrated the leaders cause their voters to be, the more it looks like an irresistible wave; better to get in front than be swamped. At that point, you have the committed joining the expedient.

          And the wave breaks.

        Too many believe the first civil war/revolution was launched and won by a rag tag, disorganized, untrained mob of gun owners. Reading about the early history of the country, one understands that organizations already existed to mount a rebellion, politicla leaders were visible and prominent. Though many patriots operated in secret, all the signers of the declaration, all the military leaders were well known to the populace (and to the royal governors). Look around. Are you depending on mobs to somehow overthrow a government? Not one successful revolution in history was a pure, unorganized grass roots uprising of the individual citizens/subjects. Even a revolution requires planning and provisioning. So far, all we have is a minor subset of 100 million gun owners crying “molon labe’.

    • My representatives are: Tom McClintock (Very pro 2A), Kamal Harris and Diane Feinstein. Only one of those actually represents me and the other two could care less how I feel about the 2A (because I do not live in Los Angeles or San Francisco, and that is who elected those two). I wrote Diane Feinstein once and I got the carbon copy curtesy letter that was obviously the same letter she sends out to everyone that writes her regardless of what they wrote about.

    The only way for the second ammendment to survive is to encourage new shooters … irrespective of gender, religion and sexual preferences.

  30. While this bill has no chance in hell of passing, the writing is on the wall of what will pass when the Democrats regain two branches of government.

    To those paying attention, you might want to make sure all future purchases are done through private sales, to avoid the inevitable database that Feinstein et al will produce when all 4473’s are digitized in the 2020’s, in order to avoid the mandatory buy-back in the 2030’s.

    There are a lot of Republicans I don’t like but when a general election come along, I still vote for them, because the Dems are worse.

      Which limits do you find on “provide for…the general welfare”?

      A ban on “assault weapons” does not violate the constitution because it is not a complete ban on keeping and bearing arms. Banning assault weapons fits the power to provide for the general welfare because if it saves one life, it serves the public welfare. Indeed, a ban on every type of firearm that permits more than one shot without reloading is not denying the people the right to keep and bear arms. Denying and/or regulating a category of firearms is settled law, decided by the SC.

      Providing for the general welfare permits wide latitude in those things Congress can do in order to provide for that welfare.

On the positive side, this bill is so absurd, and other bills recently passed in other states, so overreaching, it’s becoming inevitable that the Supreme Court is forced to visit assault rifle bans and rule them unconstitutional in what will become a “Heller Decision for Semi-Automatic Rifles.”

    Our Second Amendment has been a disfavored right for too long. SCOTUS has to visit these bans and rule on them as soon as possible.
