Did anyone really think she’d be indicted? Particularly after Bill’s tarmac tête-à-tête last week? And Hillary telegraphing that of course she’d be thrilled to retain Loretta Lynch if she’s elected? That’s clearly not how things work these days, David Petreus et al. notwithstanding. After all, she didn’t mean to!

This is, of course, bad news for guns and those who care about the civilian right to keep and bear them. If elected — and Nate Silver is optimistic — it seems a good bet that she’ll make a California-like push for new gun control legislation — at minimum, a reprise of her hubby’s “assault weapon” ban — as one of her first priorities. Never mind the generation or more of anti-gun rights rulings we can look forward to from a decidedly more left-leaning Supreme Court.

Maybe it’s time to look to the skies.

    • If it had been Lynch who squashed it, I’d agree, but the FBI are pretty straight shooters when it comes to the law. If they did not recommend indictment, then there was nothing there to indict. Director Comey’s press conference on the matter was highly irregular. I think he wanted to express his disgust with how Clinton handled the data, but had to admit that the mishandling did not rise to the level necessary to indict.

      Nothing really changes. Her supporters will comtinue to see her as innocent while her detractors will continue to see her as the pond scum she is.

      Just one more example of how good the Clintons are at covering their asses.

        • There was also a case a couple years back of a young kid in USMC signals intelligence who accidentally sent an email marked Secret to his yahoo account instead of his usmc.mil account. He admitted this mistake to his superiors immediately and did everything he could to help clean up the mistake.

          He was bounced out the Corps and had his life ruined over that incident.

    In the end the FBI director was faced with a choice – let her latest in a long string of misdeeds slide yet again, or have the crisis of having a Presidential nominee under indictment. He chose the former.

        One of the many problems with the FBI case is that Obama sent her things on that server. He was aware is was a private server. Guess what would happen if they pursued Hillary?

        FBI did the best it could, Comey delivered his most scathing rebuke, without actually calling a crook, a crook.

      • I am super cynical about the government, but I drank the kool-aid that maybe some principled people worked at the FBI. Comey didn’t even feel compelled to resign. I am struggling to find anything remotely American left in our institutions. If U.S. government has abandoned the rule of law then obviously something outside of the government must restore it. That’s where we are. Things are going to get very interesting.

    • There are the elites and the rest of us. Every day there are more dots to connect and the picture gets uglier. I wonder if we will know the enormity of what’s behind the scenes before it’s too late? It’s almost like you can see the US dying slowly over the next century or two while not knowing what to do to stop it. Everything special about the US is being systematically corrupted at its core.

    • On reflection, Comey was right – no prosecutor would take this case to trial. I mean, not due to lack of evidence, but because they don’t want to be ostracized or worse. Per Game of Thrones, “when you play the Game of Thrones you win or you die”. Well, even a successful prosecution – rather unlikely in front of an Obama-appointed judge – might just result in a pardon, so why put your neck out there? There’s just no upside. So I guess Comey did what he could and gave Trump a bunch of soundbites to use against her.

        FBI Director Comey knew beyond a shadow of a doubt that Loretta Lynch’s Justice Department would never prosecute Hillary … and even if they did, Obama would pardon her before the ink was dry on the court records of her conviction.

        What he did was actually quite clever. He said in plain words that Hillary broke the law, did something that even an average person would know was incredibly irresponsible, and likely exposed her e-mail server to hackers while in foreign nations. Those three statements are incredibly damning. And the frosting on the cake: he did it without any advanced notice and without any opportunity for the Justice Department or the White House to censor the press release.

        I am confident that Loretta Lynch will fire Comey or otherwise relegate him to irrelevance — something like reassigning him to monitor illegal ivory trafficking on the North Slope of Alaska — in the next few days.

        • IF the FBI Director was being “clever”. IF the FBI Director was attempting an end-run around the politicians controlling DOJ. IF the AG subsequently fires or otherwise sidelines the Director, then the Director was not clever enough, and underestimated the degenerate character of the Clintons.

          I suspect that what actually happened is that Lynch realized (or planned) that she would not be accused of Clinton favoritism, especially after the airplane visit, if she was not the one to announce the preordained decision. In fact, none of the political and leftist leadership in the DOJ would be stained by the report if the FBI Director (whom the Clinton press machine heralded as the one true Boy Scout in the pile) made the non-announcement.

          The question is what was important enough for Comey, that he put his face on the dance?

    • We learned a few things today. America is not or at least no longer exceptional as our institutions are just as corrupt as any others in the world. Also State employees will always side with the State. Flowery oaths mean nothing when the chips are down.
      As rule of law continues to degrade, conflict between ordinary citizens and State agents representing tyranny is going to be increasingly frequent and inevitable. If you see agents harassing your neighbors we can no longer assume they are acting in the best interests of citizens. We should feel no moral obligation to help the agents. If state agents fall while oppressing our fellow citizens we shouldn’t mourn them. They don’t represent us. We need to start caring for the real Americans and socially shun the thugs hurting people for privilege and a paycheck.

    • Yes, I expeced the FBI to man up and charge her. I don’t know how they failed, if it was coruption, incompetance, or collusion, or inappropriate influence, but yes I expected her to be indicted as that is what should have been done based on the law and how it has been applied to many people.

      Those States that support these politicians and elect them over and over to positions of power while they trample on the Constitution are the States that have ALREADY seceded. The States that oppose such people and actions are not secessionists and need not consider secession. they need to consider how to consolidate themselves into a defensible bastion of Constitutionality while divorcing themselves from the Statists and Fascists and Socialists.

      Accepting Statehood and accepting elected federal office requires an oath to uphold and defend The Constitution of the United States of America. To take that oath and then refuse to accept those terms is a violation of the contract. That makes the contract null and void. Those of us who took the oath and abide by our pledge are NOT the bad guys.

      This is not advocating secession, it is demanding a divorce.

          The oath we took when we volunteered was to protect and serve the Constitution and to obey the LAWFUL orders of our superiors. It should seem obvious that an order to violate the Constitution goes directly against that oath on both counts.

          If military and former military to not move directly to revolt it is because we have not yet exhausted the Constitutional methods of redress. At the least there still remains the (remote) possibility of an Article V convention to address the tyranny the Progressives and Liberals have introduced into the system.

          On this the day after our celebration of Independence I leave you with this excerpt from that document:

Now they are actively importing aliens and working to get them accepted and further dependent on the government by convincing them that the Republicans will immediately round them up and send them back home, or at a minimum force them to work for a living.

      Until the productive people of this country refuse to pay for these programs that support unproductive citizens (or non-citizens) there does not seem to be a remedy for this downward spiral other than allowing it to go on until there are not enough productive people left at which time the Democrat Progressive Liberals will be so entrenched in power that they will live high off the hog while the peasants barely survive.

      If you have not already, read Atlas Shrugged. Sure there’s some off-the-wall Libertarian philosophy in it, but the politics is spot-on. From Arizona across to Georgia, the conservative South shall rise at some point and throw off these anti-Constitutional tyrants. From this point it is only a question of when, not if.

      • I have read it several times. it’s an enlightening read. I’d be more than happy to quit paying my taxes until the bread and circus is over. I hate that some 30+ percent of my income is scraped off and directly given to a federal government I have no faith in. I would opt smooth out of social security if possible. I know how to invest my money far better than the government. and being 29 years old, I fully expect to see exactly none of that social security money back. When the gravy train of free shit is over, I will suffer along with everyone else. I who have worked an honest career all my life and have been extorted of my income for all those years will eventually end up in exactly the same boat as those who did jack shit but leech off the government tit. It pisses me off on a daily basis.

    As an aside, there’s far too many examples of people mishandling classified info, far too many of us US citizens who have held security clearances (I had a DOD & a NATO clearance, straight out of school) and know the rules to believe that Hillary was innocent. She just happened to have the DOJ and FBI in her corner, because our government is being run by a man of the third world. The only people who actually believe she’s innocent are the Pajama Boys of this country, who have never done anything of consequence for national defense.

      • Of course not. The hard-core Democratic voters votes have been bought and paid for – much like the black voters’ votes. There’s a reason why 90% of the black vote in the US pulls the donkey lever come election time – they’ve been bought and paid for, rather cheaply I might add.

        There are, however, enough undecided and independent voters in the polls who are up for grabs. Each party has a base of about 40 to 43% of the electorate. The election is won by moving the independents’ votes in swing states.

      Oh, how I wish this were true. But Trump is pretty much a one-trick pony at this point. Bombastic speech and outrageous behavior can only get you so far. And the free advertising that he’s gotten for the last 18 months? Once the conventions are over and the campaigns throttle up, watch the media starting pulling their 24/7 coverage of Trump and his speeches. Sure, it will mean lower ratings for them, but they are more than willing to take that hit if it means they get their preferred candidate across the finish line in November. Trump’s been boasting that he has a tenth (90 vs 900) of the nationwide campaign staffers as Hillary does, and I believe that even if he belated tries to ramp his staff up, it will be too little too late. Note that Trump is already laying the groundwork for his excuse that “We Wuz Robbed!” when he loses in November. And know that this is not coming from a #NeverTrump perspective, this is just a conservative telling you what I’m seeing plainly.

      Prepare for another 8 years of ever increasing government power and restrictions on our rights. Whether Hillary will push things over the line and trigger a backlash is the big question. The magic 8 Ball says “Yes” to the first question and “Ask again later” to the second.

  9. Today, FBI Director Comey makes official what we all have known for sometime: The Rule of Law is well and truly dead in this country.

    • That’s a dangerous realization when it hits a critical mass of people.

      A good counter to those anti’s: “What happens when the police or the government they represent ARE the bad guys?”

      • This is what I have been preaching to my black associates. I tell them that we have a mutual distrust of the police. They distrust the cop on the street and I distrust the cop’s leadership. I tell them that this is our common ground to fight corruption. I tell them that racism is a distraction to keep us divided and that way we can’t win.

      The intellectual onanism that lawyers put onto paper works only because the vast majority of people respect the law. When that stops being the case, and lawyers become literal speed bumps in a parking lot, cops cease enforcing the law because judges and DA’s make decisions like the one above… well, things get very dicey for the elites, and they have to retreat behind steel gates, concertina wire, bulletproof glass, etc.

      Just look at Mexico for an example of what I speak.

          The problem with the US right now is that we know we didn’t use to be corrupt, that we’re becoming corrupt, and we’re in that uncomfortable middle ground in between what the US used to be, and the “El Norte” version of Mexico where we could dispose of political rivals like yesterday’s trash.

          Right now, we have to pretend that there’s still law enforcement and courts.

  10. I am not surprised. In fact I think it works out better for us. If she was charged then the dems would put someone like Joe Biden up who is more electable but still hates gun owners. If Trump is going to have any chance at winning it will be most likely against Hillary. Lastest polls shows Repubs keeping house and senate, and if it could have been done by executive order then Obama would have already done it.

    Don’t get me wrong I am not happy about this but do you really think the dems would have said “Hillary is out so we aren’t running anybody.” They would have found someone equally against guns as her.

      I’d bet money that if Biden was the nominee and some scandal came out against him (with overwhelming proof) that the Dems would cut him loose before they’d go to THIS degree to save his candidacy.

      That Clinton can even be CONSIDERED as a candidate for President at this stage is just mind boggling. That people defend her just defies all arguments that humans are ‘intelligent.’

How these people can support HRC and this government, from the SCOTUS, POTUS, our representatives, senators, all the way down to your town school board. All of these people who have no respect for our founding principles and the rule of law. Just speak to them – all they ever have is Republicans are evil, progress is good. There is no way any intellectually honest person can support HRC for anything but a cell, but what do we get, exactly that, people support her by the boatload.

        I don’t know how you can bring these people to understand what they are really doing. This person has literally committed thousands of felonies, any one of which would put you or I in a deep dark cell somewhere underground forever.

    • Petreus intentionally gave classified information to a journalist whom he was banging who was writing about him. That;s kind of critical – he gave it to somebody that he knew would publicize it or use it. He then lied to the FBI about it (18 USC 1001) then he admitted under oath he knew it was classified and intentionally gave it to Broadwell. Which, it was pretty hard to deny – apparently they had a gmail saying “Here is the sensitive info we talked about babe”.

      The two cases are apples and oranges pretty much. Now, in terms of stupidity and potential risk to national security Clinton’s deal is far, far worse. And you could argue Clinton is just better at wiggling around the law (probably true). But as far as Trump’s line about “Petreus was screwed for doing far less” – no, it’s not really that simple. If more of them had markings then they would have had a better case for “willful, knowingly, grossly negligent” etc.

      • Disagree. As a former TS/SCI clearance holder: Information in an email/message/letter/document is inherently classified according to its *content*, not its markings. The fact that text sent via the private email system was not marked (in some cases) doesn’t remove the risk to the handler of protecting the *information*. Hillary and her staff either knew or should have known by subject matter or content the nature of the material they were handling. If someone along the way stripped classification markings off, so much the worse. Presence or absence of markings in no way removes responsibility of the handler to treat classified material in the correct way. Small example: I used to take notes of meetings on legal pads. The info I wrote down was classified because of the subject matter and context. I always treated these notes as classified at the level of the info I knew they contained.

    I also finished in the top 10% of my law school class and served in Federal Law Enforcement for several years.

    The difficulty of proving intent varies across different federal statutes. The devil is in the details – like really in the details, they most likely reviewed the headers and how specific classified documents were marked. We’ll never see those documents because they are still classified. As far as the FBI’s credibility I don’t see Jim Comey ruining their credibility for Hillary Fucking Clinton.

    Trump needs to ease off the on “it’s rigged” crap. One day that might be his FBI and in the long run our society depends on functioning generally respected institutions. (which is why the media always being FOS is a problem).

        18 USC 793 (f) requires “gross negligence: with respect to specific kinds of classified information. Other parts of 793 reference “willfully” (i.e.: it requires intent). 18 USC 798 also requires “willfully”

        The federal standard form posted above is nice, note that it says “may result in conviction” – not will. It says “may” because the government has to prove a state of mind. The federal SF is designed (obviously) to scare people.

        These are complex statutes. Read them.

        If they prosecuted every time somebody foolishly or stupidly handled classifiied information, then courts would be full of dumbass privates or junior NCOs in the Army who stupidly scanned that SECRET level document then sent on the NIPRNET for convenience. It happens all the time.

        I’d love to see Hillary Clinton behind bars, but in this case Comey’s decision is not out of the norm.

The divisiveness in this country is off the charts, and federal employees are taking sides based on the goodies they can score from the political elite. Is there any integrity within the fed anymore?     • If she becomes president we will have Civil War 2.0. There is no getting around this. Democrats keep telling me how much they like Bernie (but still “nevertrump”), and then try to tell me if Trump is elected there will be another civil war, and while there might be some idiots rioting, there will not be an all-out war like there will be if Hillary wins. Democrats do not have the spine to start a real conflict if Trump wins. Trump will win in November and the Democratic Party is going to crumble into nothingness.

    Comey’s comments basically lay out the legal case against HRC and then he says “Oh, but just ignore all that no charges are “appropriate” in this case”. WTAF?

    This is basically like a police chief saying “Well, yes, Strych9 was indeed drunk, twice the legal limit in fact. While operating his motor vehicle in an intoxicated state he did indeed jump a curb, run through a number of private yards, return to the street and strike a grandmother and her three grandchildren in a crosswalk, killing all four. These facts are not in dispute. He quite clearly acted with “extreme carelessness” during the entire event. However, charges are not appropriate in this case”.

      If HRC wins then it’s “Game over man! It’s game over!”.

      There might be an occasional Waco or Ruby Ridge but that will be a very small minority of people and they will be quickly swept aside. Most Americans will go along to get along. You can see that in the fact that there is, in fact, very little outrage over Manchin’s comment that “Due process is killing us”. Most people just don’t care. They’re too busy waiting for Kim Kardashian to put out her next nude selfie. (Seriously Kim, just pull a Lindsey Marshal and start a damn porn site already.)

  42. The one bright spot out of all this is that now the FBI has lost all their credibility. If their feckless incompetence in investigating terrorism plots in the US hadn’t already convinced you of the incompetence of the FBI, this event convinces us that they’re not only incompetent, they’re also bought and paid for.

    One more time: When law enforcement turns around, and they wonder where the support of the “law abiding citizens” has gone… they shouldn’t wonder.

  47. Funny, the FBI and DOJ (not the DOD) prosecuted a reservist just a ;year ago for storing classified data on unapproved equipment and retaining it after he went home. (in other words, he did two of the things Hillary did, but not all of them) Who was the FBI’s director last year, I think his name was Comey?

    He plead guilty, and they let him go with a $7500 fine, two years of probation, and a lifetime ban on ever applying for a security clearance again. Obviously that last part was what they really wanted.

    At this point, I’d be satisfied if HRC could never hold a position of public trust again.
