“The California state Legislature has sent a package of gun control bills to Governor Jerry Brown,” capradio.com reports. “The bills regulate sale of ammunition, ban more types of semiautomatic rifles and add punishments for lost and stolen guns.” And how.

The bills [detailed below] now go to Governor Brown’s desk to await their ultimate fate. Governor Brown is scheduled to leave the state in 48 hours. If he doesn’t veto some or (haha) all of these bills before his departure, Lt. Governor Gavin Newsom will take over as acting Governor. No question Newsom will sign every single measure (save the ones already on his ballot initiative), giving new meaning to the oft-heard words “full retard.”

Here’s the rundown [via The Firearms Policy Coalition]:

SB 880 (Hall): Bans common and constitutionally protected firearms that have magazine locking devices.
SB 894 (Jackson): Re-victimizes victims by criminalizing the failure to report lost and stolen firearms.
SB 1235 (de Leon): Now competes with Gavin Newsom’s Safety for All Act/Ammo Ban.
SB 1446 (Hancock): Confiscation of lawfully acquired, standard capacity ammunition feeding devices.
AB 857 (Cooper): Forced “Ghost Gun” registration.
AB 1135 (Levine): Bans common and constitutionally protected firearms that have magazine locking devices.
AB 1511 (Santiago): Bans the loaning of firearms.
AB 1673 (Gipson): Redefines “firearms” to include items that are not firearms.
AB 1674 (Santiago): Bans buying more than one firearm within a 30-day period.
AB 1695 (Bonta): Makes some non-violent misdemeanors punishable by prohibitions on owning firearms.
AB 2607 (Ting): Dramatically expands who can request a Gun Violence Restraining order [to include co-workers, employers, mental health professionals and employees of high schools and colleges].

Just in case you’re wondering, Lt. Governor Newsome’s ballot initiative — which includes some of the measure above — would have to be withdrawn by midnight tonight. His peeps say it ain’t happening. How great is that?

    • Lawsuits.

      Lemme ‘splain about laws and lawsuits in CA.

      Each of the 120 CA legislators may introduce 40 – FORTY – new bills each session.

      They don’t, thank whatever, but the incremental cost of adding a bill to the hopper is negligible.

      Look now at the Peruta lawsuit. It’s been running for I think seven years now, and bids fair to run up to SCOTUS in year nine. About one law, one small piece of one law.

      Lawsuits are like bailing the boat with a teaspoon. If we could keep more water from getting in, eventually we’d keep the boat afloat. The CA Legislature has demonstrated it has no plans whatsoever to ‘rest on their laurels’. And that effort is a sideshow – with each legislator having lots of other bills they may introduce, s/he can do things which might in fact benefit constituents or the whole state.

      Once we might have counted on SCOTUS to continue the work of Heller and McDonald. I think that hope has proved vain.

        • You guys are talking about attacking the law in the Courts. BIG waste of time. I’m talking about taking the legislators to Court.

          It doesn’t have to be “about guns” (the proof of that is that gun-control isn’t). It’s like a neighborly fight over a fence, (except their throwing their undue government gang-signs at you). Cigarette lawsuits weren’t about closing the tobacco companies, the EPA isn’t about protecting the delta-smelt. It’s not what you can prove, it’s what you can creatively claim. It’s not about the evidence, it’s about the seriousness of the charges, and you don’t even have to win. They might ‘settle’ to make you go away, or you just take your loss while typing up your next case style, and blame your protest on a video.

          All you just need to do is pay a small retainer to the right son of justice and say ‘go get me something’. Those legislators, and their supporters, and party, have more money than RJ Reynolds, and, it’s common sense, it’s about time, it’s about justice, it’s for the kids, sea levels are rising and because we have to do something.

  1. Ammo Sales (SB 1235): No more mail order bulk shopping to contain costs.
    Ban possession of standard-capacity magazines (SB 1446): Los Angeles tried this and received exactly zero turn-ins.
    Bullet button ban (SB 880/AB 1135): We’ll have to disassemble the action instead.
    Gun lending (AB 1511): No more training.
    Guns with some assembly required (AB 857/AB 1673): Defines a chunk of aluminum or wood as a firearm. No more 80% guns.
    Gun [violence] restraining orders (AB 2607): Now your disagreeable employer or employee can rat you out, and you lose your due process rights along with your property.

    Punishment for theft (AB 1176): This is good – it should have stayed a felony.

    • AB 1176 is not “punishment for theft” of firearms, it is a misdemeanor charge for failing to report the theft of firearms within 72 hours of discovering the theft.

        • No biggie, the clock starts when you discover the gun is stolen, even if it’s one you don’t check on more than annually because it’s hidden somewhere.

    Like I say, its sad we have to count on the feds to someday get california to recognize the constitution of the united states, and not their ideology, as the supreme law of the land.

    • And the sad part is, it very well may have to come at the barrel of gun. We can send in feds to rightfully end segregation, and it should be the same for ALL of our enumerated rights.

  3. All is not lost as of yet, and the Sacramento bBee has suggested that Brown, who leaves for vacation in Europe tomorrow morning, will be vetoing at least some of the bills: “Gov. Jerry Brown suggested Thursday that he will take mixed action on a series of gun control measures before leaving on a European vacation Friday, vetoing some bills and signing others.

    “We certainly have a lot of laws here,” Brown said in an interview. “Of course, that’s my general view. We could probably have fewer, but we’ll look at them.”

    The Firearms Policy Coalition has sent around an e-mail suggesting that Lt. Governor Gavin Newsome, who will become acting governor on Brown’s departure, is likely to sign any bills not vetoed by Brown by Friday. Newsome certainly has the power to do so, but the case law is clear–from Brown’s first tenure as Governor–that Brown has the authority to rescind any action taken by Newsome on Brown’s return in a few weeks. Moreover, it would be highly amusing if Newsome vetoes DeLeon’s ammunition bill in order to boost the merits of his own ballot proposition on the same subject.

    • So the only recourse at this point (since the courts obviously won’t be) is a single man at the head of the Executive branch.

      As the saying goes, “two is one, and one is none.” If these bills do not pass immediately, they will pass within six months.

    • Moonbeam has nothing to loose. He’s termed out and ready to retire….this is the legacy of Democrats and will be as the nation goes. Bills introduced in redrawn districts favoring democrats while systematically presenting gun control bills that infringe on every citizens’ to lawfully protect themselves.

      • But Moonbeam vetoed the last raft of overly insane gun laws for being ‘too restrictive’.

        I do have some faith that he’ll do it again, one way or another.

      • You know what? I might disagree with Jerry Brown on alot of things, but he is a model civil servant. If every politician had his standards the country would be about 10k times better off.

        • As much as I often disagree with Moonbeam, I would agree on your assessment – he really is a pretty good public servant – as they go.

          Sadly, my (semi)faith in his reasonableness was confirmed/shaken when he signed about half of the crap that was put on his desk.

          Oh well.

    • If signed, the ammo bill does not go into effect until January 1, 2018. But at least it does not require a permit from the State in order to buy, only that the vendor has to report you to the Department of Justice and charge you extra fees for a background check.That gives us a year and a half to stock up. Freedom Munitions will be hearing from me.

      • I just did a quick inventory. Hunting ammo(gotta use non lead) for my 12 ga is my weakness at this moment. At the rate I’ve been shooting and my age a couple of cases of 12 ga should hold me til I’m too old to hunt or another Lincoln takes office and forces the states to recognize basic civil rights.

    There is no doubt citizens of California suffer a litany of infringements upon their God-given freedom to keep and bear firearms (among others), those presently under consideration merely the latest of a long history with a single obvious goal.

    “In every stage of these Oppressions We have Petitioned for Redress in the most humble terms: Our repeated Petitions have been answered only by repeated injury. A Prince whose character is thus marked by every act which may define a Tyrant, is unfit to be the ruler of a free people.”

  8. Well, I understand the situation, but somehow… when people are stupid enough to vote for people that clearly and openly want to ban guns, don’t be surprised when they actually do it. I know and I’m pretty sure all readers on this site here never voted for them, even the gun owners from California.

    But what to expect? This is not something new and unfortunately California people seem to be majorly fine with this civilian disarmament that is going on…

    • What you describe is the direct result of the citizens of California not being represented. In a democracy/republic, it is impossible for the elected leaders to consistently operated contrary to their constituents’ wishes; what we see now is due to far away cities governing the lives of those in local areas with impunity. That is not representative government.

      • From what I’ve seen so far, the same as always; bitchin’, whining, playing at being keyboard commando. And now, when it comes down to putting up…. we shall see how many are willing to potentially sacrifice their comfy, secure jobs and/or lives when orders go out. When that happens, I don’t doubt that a lot of those on the OK rolls & III% forums are going to be first in line to be made examples of…. especially those still wearing a uniform. They’ll crucify enough of their own for not reporting tragic boating accidents or showing proper loyalty to the State, that the rest will be unwilling to suffer the same fate.
        It worked for the Soviets and the Stasi, and definitely seems like that’s the model California is aspiring to.

    Every time I turn around, the government is bleeding me, restricting me, and in general, making my life rather miserable. Don’t get me started about property taxes! Cripes!

    I and the wife will be leaving within the next four years. I thought I might stay and fight-the-fight, but I’ve decided that I don’t want to die in this particular ditch. I’ll go find another ditch, in another state. Wyoming is looking pretty good right now.

    If Brown vetoes some or all of the bills, I’ll say “thank you” in knowing that a broken clock is correct twice a day.

    • Finally…I’m there with you. Its time we leave in mass, no vertical dirt or beach is worth this. For the next 3 years, I’ll work securing customers outside CA, hopefully I can leave sooner.. I just finished a 12 state work tour for two months. Rolling Bluegrass hills of KY, Nebraska, Iowa, North GA mountains, Michigan, MN, TN, Mississippi. There’s a better greener world outside CA with a culture of liberty and not infringing on a man ability to lawfully protect his family and people he works with.

      I’ll mail my 10 round mags and bullet button to the CA Governor and a report of the economic impact of my company leaving.

  13. Don’t worry, President Trump has got this. The same way Obama threatens states with the cudgel of the federal government, Trump could tie highway funds to the state’s limit of the 2nd Amendment.

    If you plan on staying, I’d stockpile and bury everything. And maybe buy some armor. 🙁

    • A buried rifle is about as useful as no rifle; by the time California repeals those laws (if ever), all the buried guns will be long forgotten, and their owners buried with them. After these laws go into effect, hidden gun caches will be hot commodities for paid informants, looters, or anyone who will happily dime out their neighbor for free (because guns).

      Sadly, this isn’t something ya’ll can sit out, or hope to change with lawsuits or counter-legislation….. and practicing Irish democracy is too passive to make a difference. It sucks, but a lot of good Californians are going to have to choose between living on their feet elsewhere, or on their knees there.

  18. I went down to the local jail to interview violent offenders about these new laws. They ALL promised to fully obey these new laws once they are back out on the street after early, early, early parole. I am very proud of the California politicians for enacting these new laws to keep us safe!

  19. The ammo restrictions are plain and simple a harassment of law-abiding gun owners. The idea that additional ammo restrictions would stop a mass murderer buying a 100 rounds for his evil deed is just plain psychotic.

    • It’s typical anti-gun smug feel good BS. They look down on people who own guns, so anything that can make the lives of gun people more difficult just reinforces their egos and sense of self-righteousness.

      • Any pro-gun person with a national audience should bear in on this restriction as embematic of how delusional gun-grabbers are.

        1) Millions of gun owning families can easily go through a thousand rounds a day doing various sport shooting activities. (I’d say 90% of muggles don’t know that)

        2) There are probably TRILLIONS of rounds in circulation and billions more made each year.

        3) The government put a law in place with onerous tracking procedures and expense thinking that it will prevent a terrorist from acquiring 100 rounds to do their evil deed.

        4) It’s willful ignorance of reality plus harassment of legal gun owners.

        5) All the other laws are the same stripe, ineffective against the bad guy and harassing of the good guy.

  21. I’ve lived in both Massachusetts and California, two states dominated by one party. The sense of smug self-righteousness that the anti-gun politicians in these states have is truly disgusting. When it comes to ideas that they support, if you don’t fully endorse, and applaud them you are labeled as either a “redneck”, “ignorant”, or a “bigot.” They use the media to ensure that the average uninformed citizen only ever hears one side of the story, with their opinions presented as facts. California should be one of the best parts in the country to live in; it’s a beautiful place and I love California girls. But it’s all ruined by the tyranny of San Francisco and Los Angeles.

    Add on top of that the majority of young people (and yes, I am one of the “millennials”) have never had any exposure to firearms. To the majority of my peers, guns are just a scary “boogeyman” and they’ve grown up in gated communities and gone to ivory tower liberal arts colleges where sociology professors tell them the world should all just smoke a joint and sing “Kum Ba Ya” and then everyone would live in peace. Hopefully they’ll get smarter as they get older and experience the real world, but I don’t know that I can be that optimistic at this point.

    If the Governor flies to Las Vegas for a day of gambling, the Lt Governor takes over and can sign or veto legislation or write executive orders the minute the Governor hits the state line?
    Can you imagine Joe Biden taking the responsibilities and powers of president because Obama wanted to see both sides of Niagara Falls?

    • I see, there’s a long standing “gentleman’s agreement” that the acting governor won’t actually do anything except try to handle dire emergencies, but that only works if the acting governor is a gentleman.

      The courts have ruled that the Lt Governor has all the powers of the Governor the minute the Governor leaves the state.

  25. I encourage everyone here who is incensed by these infringements to immediately contact Jerry Brown’s office. It is only through a deluge of opinion and reasonable argumentation that we can demonstrate that we “the people” stand against these bills. Google “Jerry Brown contact” for phone number and an easy email form (which doesn’t require inputting a physical address).

    Together we can make our voices heard. Don’t get angry, don’t comment on the boards, contact your representatives. It is the only way to win.

    P.S. – for those who think it isn’t possible to prevail in uber-liberal California, remember that Jerry Brown vetoed a bill which was almost identical to this years SB880 (banning semi-autos), and that was in the wake of Sandy Hook. Let’s do this.

  26. Well it’s done. Checking Gov Brown’s webpage the following passed: AB 1135, AB 1511, AB 1696, SB 880, SB 1235, SB 1446. The following were vetoed: AB 1176, AB 1673, AB 1674, AB 2607, SB 894

  27. Each of the supporters of the these bills (the legislators and the Governor) have just committed two federal felonies punishable by ten years to life in Leavenworth for each offence. The laws that they’ve violated are the Conspiracy Against Rights (Title 18, USC, Sec. 241) and the Deprivation Of Rights Under The Under The Color Of Law (Title 18, USC, Sec. 242) codes in the United States Code. These laws both state that ‘ANY person’ that ‘conspires to’ and/or ‘deprives ANYONE of a right that is secured by the U.S Constitution is guilty of a felony’. Since the Heller decision confirmed that 2A is a fundamental right protected by the Constitution (that was the brilliance of Scalia’s opinion), governments are forbidden from “chilling” that right. CA has just done that! It is also a violation of Article I, Sec 9, Clause 3 because it criminalizes a previously legal item. It is therefore “ex post facto law.”

    So you Californians should get off you lazy asses and fight for your constitutional rights! Find a federal judge friendly to 2A and challenge these laws as unconstitutional under Article I. Then get mean and charge each and every one of the legislative usurpers that voted to enact these laws, and Gov. Sh*t brindle… uh, er… Brown for signing them, with violations of Title 18. Then have them arrested by the FBI. (I’d do it myself, but I no longer reside in CA so I’m not damaged by these unconstitutional actions.) Politicians are NOT above the law and the Constitution and the USC are the law of this land.
