NSSF, the trade association for the firearm industry, is focusing on former Vice President Joe Biden’s radical antigun campaign promise to repeal the industry-essential Protection of Lawful Commerce in Arms Act (PLCAA). The bipartisan law prevents activist lawyers and politicians from attacking the firearm industry with frivolous lawsuits that are designed to bankrupt manufacturers for the heinous crimes committed by individuals.

Democratic presidential candidate Joe Biden and his running mate U.S. Sen. Kamala Harris (D-Calif.) have sworn to eliminate the law that was passed with strong bipartisan support in Congress in 2005.

“Joe Biden and Senator Harris have promised to repeal this law for one single reason. They want to unleash a wave of baseless lawsuits filed by agenda-driven antigun groups and plaintiffs to tie up firearm manufacturers in legal proceedings and bankrupt them through court costs, judgments and penalties,” said Lawrence G. Keane, NSSF Senior Vice President and General Counsel. “The Biden campaign refuses to blame criminals that commit crimes and instead purposefully misleads the public into believing a responsible industry is at fault in order to achieve their gun control agenda. The Biden-Harris plan would allow harassing lawsuits that would be similar to suing Ford for a death caused by a drunk driver.”

Biden has repeated the false claim that firearm manufacturers cannot be sued. It is the same campaign tactic employed by Hillary Clinton in 2016, which Politifact labeled “false” four years ago. It is still just as false today.

The PLCAA does not totally exempt firearm manufacturers from all liability. Just like other industries, including auto makers, pharmaceutical companies and others, firearm manufacturers can be held liable for defective products, breach of warranty, criminal misconduct and other behaviors for which they are directly responsible. This is no different from a car company being held liable for defective air bags, but not when a drunk driver kills a pedestrian. Biden knows this but still continues to make his deceptive claims.

Biden’s plan to roll back PLCAA is in keeping with his admonition during the Democratic primary when he said, “Our enemy is the gun manufacturers.” Biden attacks the industry that produces firearms for the U.S. military, federal, state and local police agencies. It’s the same industry that more than 15.4 million people turned to in order to obtain firearms this year to protect themselves and their family.

Nearly 6.2 million have done so for the first time in 2020. Under a Biden administration, the industry that provides the means for tens of millions of law-abiding Americans to exercise their Second Amendment rights to protect themselves and their loved ones would be at risk.

    • Most gun owners own 3 or more guns. With 4-5 mags each, most gun owners will be looking at a $2,400 to $3,000 fine just to keep what they already own, should Joe Biden be elected President! (By Cheating).

      Right now, go buy all the magazines, small spare parts, springs and oops kits, and ammo you think you will needs for the next few years. Before the election. After the election, should it lean toward Biden, you won’t be able to. Once he is in office, should that disaster occur, you won’t be able to. Online sales even of parts will be outlawed. It’s on his campaign website! As is a $200 tax stamp for every magazine and “assault weapon”.

          The only useful thing to come out of this nearly four year long freak show is that the Federalist Society has done an outstanding job pulling Trump’s strings and tweaking his ego to get what they wanted out of him.

          So hell yes, those are the people I credit for a job expertly accomplished. The next time we have an actual conservative as President, they should be honored with a Presidential Gold Medal of Freedom.

He has to create an alternate reality where he can account for something good that Trump did by attributing any accomplishment to someone else, anyone but Trump. If enuf had to admit to himself that Trump isn’t 100% terrible, then he would have to admit that he, as well as the CNN and MSNBC shows that he watches, were, gasp…wrong. Some people are incapable of admitting that. It’s called having a fragile ego.

      • You forgot that your heroes will eliminate the filibuster and expand the Supreme Court to 13 so they have a 7-6 majority. They’ll reverse Heller so 2A applies only to state and local governments. They’d probably let PLCAA suits go ahead on dubious political theory, like “negligent marketing,” but they won’t have to since PLCAA will be repealed. Gun cases will be held to looser standards of proximate cause than other products. Even without it, the sheer number of baseless cases would bankrupt them with legal fees. That’s all assuming these idiots don’t force a civil war before the courts could get too involved.

        • All that they will accomplish is to make all gun manufacturers move their operations overseas. That’s the only thing that the Democrats excel at; Moving our jobs overseas.

  2. The Democratic Party has raised more than $500 million dollars for this election than the Republican Party. Everyone on this site needs to donate hundreds if not thousands to the Republican Party NOW. The big Republican donors are not stepping up and donating their money.   4. I continue to see the yuuuge Trump 2020 banners being flown proudly in the beds of trucks everywhere, including just an hour ago during my lunch break sprint to get some chow. I’ve personally seen groups of several vehicles with them, and recently witnessed (and applauded from the sidewalk) a private rally of 30+ personal vehicles with as many as half a dozen banners in some of them. Everyone is supporting Trump everywhere I see…and this is SoCal!

    I have seen, to this day, only one single Biden bumper sticker. And one (clearly confused) person wearing a Biden 2020 T-shirt. That’s it. And no mention whatsoever of the Kamala person trailing at his heels.

    • Biden bought up a small truckload of used T-shirts, had them screen printed, then donated them to the Goodwill stores around the country. That was the only way he could get anyone to wear his T-shirts. Bag Lady and her friends will be wearing them for years to come.

    • Obviously there’s more enthusiasm for Trump. Yet, Arizona and the southeast are swing states. The polls for AZ Sinema vs. McSally in 2018 gave McSally a slight edge. Democrat Sinema won by a couple of points. Right now, Democrat Kelly has a huge lead over McSally for Senate. If Arizonans are willing to elect two democrat senators, one of which could be considered radical despite pretending to be a moderate, then why wouldn’t they vote for Joe?

      The path to a Trump victory includes AZ, FL, NC, and PA. FL is a must. He can lose one from the list as long as he gets the other rust belt swing states. Somehow this race is extremely close thanks to interference from the dishonest media and tech companies. Democrats are desperately clinging to “but Russia!” and the “European” virus.
