Whole Foods concealed carry sign (courtesy The Truth About Guns)

Returning from the Sin City SHOT Show, looking to re-stock my radicchio supply, I was waylaid by this pair of signs at my local Whole Foods. I immediately realized the letters aren’t big enough for a Texas-legal 30.06 sign (1″ tall by law). And what was all that other text? 30.06 signs are supposed to have the required wording – and nothing else. Unfortunately, the signs are posted on automatic doors that slide open at the mere thought of a customer. I had to step back, wait for the foot traffic to disappear, snap the photo, enlarge it and read the text. Here’s what it says . . .

Section  11.0412 of the Alcoholic Beverage Code requires this notice be provided that it is unlawful to carry a weapon on the premises unless the weapon is a concealed handgun the person is licensed to carry under Subchapter H. Chapter 411 of the government code. However all firearms including concealed handguns are prohibited on these premises. PURSUANT TO SECTION 30.06, PENAL CODE [TRESPASS BY HOLDER OF LICENSE TO CARRY A CONCEALED HANDGUN], A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE [CONCEALED HANDGUN], MAY NOT ENTER THIS PROPERTY WITH A CONCEALED HANDGUN.

I wonder if you could appeal an arrest for refusing to leave Whole Foods with a legally concealed handgun on the basis that the market’s 30.06 sign uses brackets instead of parenthesis.

But I bet you could make a case that (again) the letters are too small and the sign confusing. You’re good to carry – except you aren’t. Clear as mud. And hard to read as it swishes out of view in less than a second.

Typical. The anti-gunners at Whole Foods couldn’t get the details right. Goes with the territory I suppose. I mean, if antis looked at the details of concealed carry they’d see that “allowing” Americans to exercise their natural, civil and Constitutionally protected right to keep and bear arms on [unguarded, cash-rich] premises is [free] common sense crime control.

Nope. They’d rather plug their ears, close their eyes and pretend that nothing bad will come of their “gun-free zone” policy. Which is perfectly true – right until it isn’t.

  1. Not from or in Texas but I spend time there and carry there.

    Isnt that the sign you see everywhere that sells alcohol? Like every gas station and HEB?

    It doesnt look like any 30.06 sign ive ever seen. Maybe the hemp smoking geniuses that run whole foods combined them?

      • I would feel comfortable ignoring it just long enough to tell the manager he’ll never see me again, and why.

        As if we needed another reason not to buy grossly overpriced food.

        • Agreed, however, I had the opportunity to eat some of their different beef roasts, largely because I was traveling on the company’s dime. The meat was delicious, but I’ll never eat there again. Stupid hoplophobes.

        • The reason i go with the organic vegetables is because they can’t be grown in “biosolids” a lot of farmers are starting to use around the country. That’s marketing speak for dried human excrement they’re growing your food in

        • I don’t mean to burst you bubble David PA/NJ but there is no offical definition of “organic”. It normally means no chemicals (pesticide/herbicide) are sprayed. But fertilizer is okay to be applied. With most of the organic farms being smaller operations they may not have the access to cheap animal based fertilizer like the nonorganic farms do and so they may buy whatever is cheapest to fertilize with and cities have a ton of this stuff they are trying to get rid of. Basically what I am saying is that unless you know the farmer and the process that they use than your idea of “organic” and their idea of “organic” can be two different things. Find a local farmer at a farmers market and ask them about their process and then buy from them. That way you know. As an infection control nurse I can tell you that as long as it was dried and cured properly the risk of diease is nothing rather it be pig, bovine, horse, or yes even human.

        • David P. – Hate to burst YOUR bubble but there certainly is a definition of organic and it is administrated by the USDA NOP. I have owned a certified organic operation and you obviously have NO knowledge of the system and what it means. You are NOT free to choose what ever fertilizers you like. Synthetics are routinely prohibited. As for municipal biosludge, you also show your ignorance. Not only is it a vector pathogens, even if it is dried (which it is typically NOT) it is still laden with heavy metals, antibiotics and other substances not conducive to good ag practices.

          That said, I would not shop at Whole Paycheck even if they welcomed guns.

    • John Mackey (the founder of WF) claims to be a libertarian. Well, now I know he’s not. I carried in the downtown Austin store for 3 years until I moved out of state. They had some lettering on the door during those 3 years saying guns not permitted which I ignored (not a 30-06 sign). I figured it was to appease the lefties.

      They have an off duty cop in the store. I walked past him regularly. If I still lived there and saw the 30-06 sign, I think I would have thrown up right on the door.

    • I dunno if he smokes hemp, but the guy who runs while foods john Mackey is an ardent libertarian and outspoken against socialism and government intrusion. Prolly more so that any CEO in the US today. I do not know his views on gun control, and I’m sure he believes he has a right to not allow guns on his property, but I’m actually surprised.

      • Honestly? This looks like something done by a local manager and not something that came down from corporate. Considering the CEO’s leanings, he might be interested in knowing about something like this. RF ought to kick it upstream and see if anything floats.

  2. So what, they have metal detectors at the entrance or something? I thought Texas was gunner paradise.

    The local Whole Foods here in WA don’t carry those signs, but these days, I spend a lot more time hitting up deals at Ranch 99, H-Mart, Viet-Wah, Uwajimaya, and farmer’s markets.

    • I’ve open carried at the Bellevue Whole Foods a few times.
      The only comment I’ve gotten from the staff was a woman at the deli telling me my gun was pretty.

    • No, just east a little more—you are thinking about Louisiana, where we are “Sportsman’s Paradise” and every judge has a gun rack in his pickup with loaded shotguns and at least one rifle. Where every neighbor carries open carry which is state law. And we have inexpensive and easy to obtain concealed carry, which is even recommended and subsidized by our local public school principal for all his staff and teachers.

      Just a little east where the eating is even better (crawfish etouffee, seafood gumbo, boudin balls, alligator sauce piquant, etc.)

    • More evidence that Texas is not the gun friendly place people say it is. Seems more like a myth right now to this transplant North Carolinan. Especially since you Texans have to earn back your handgun open carry that every Texas cop has freely.

      • Well the thing about the 30.06 sign is that businesses can choose to put it up or not put it up, its basically up to the discretion of the property owner or corporate policy. Its generally a good indicator that corporate is probably some left wing turds and you shouldnt shop there.

      • TX is gun friendly. It’s just that TX is also property-owner rights friendly, too.

        That said, I’m pretty sure that sign doesn’t qualify as a 30.06 sign. They are (supposedly*) pretty strict about having the correct sized letters on the sign.

        * I haven’t actually tested this myself.

        • Any cop can arrest someone based on that sign. Actually any cop can arrest someone for anything including nothing, but I digress…

          If that happens then it’s up to a jury to decide guilt. Good luck with an Austin jury. I don’t think they will quibble over letter size. They will convict.

      • As a Texan, I don’t really count Austin as being part of Texas. Is it a cool place to visit to eat, drink, and have a good time? Sure, but that’s about it.

  3. Not surprising, I’ve been in bars where the 51% sign is just a black and white printout of a picture that management found doing a google search, all distorted and pixelated from jacked up scaling and printing as an image, and then stuck off in the corner somewhere.

    Doubt that Art would cut you a break though if you got busted carrying in there.

  4. Make it a point to not shop there. In this economy, a business will fold if it loses even 10% of its customers. And make sure that the management knows why they’re going out of business.

  5. I choose to disregard these type of signs on top of that I can conceal my EDC gear very effectively, that being said your milage may very.

    • Well, yeah, of course you can carry and not get caught. That’s always been true everywhere. The issue is what happens if you get caught? Then you have a felony and are likely to lose all your gun rights for life. Yeah, not worth it. Are you sure you won’t trip and fall, pass out, have to defend yourself, bump into someone, etc.?

      Let’s just say you happen to resemble the description of a criminal suspect so the cops come up and question you, and do a Terry stop right there in the produce aisle? You’re screwed. Nope, I wouldn’t risk it. Austin DA will prosecute, and you can appeal based on the height of the letters in the sign, and you might win, but an appeal can cost tens of thousands of dollars, and it’s a good question as to whether you would win.

I always figured WF to prohibit carry on their store premises in states where legal carry is otherwise allowed, but I’ve never seen a sign posted prohibiting carry, at least in the stores in Florida. So, I carry in WF much like I do everywhere else it is legally OK to carry. Concealed is concealed. Unless they start doing metal-detection or pat-downs every time I go get my turkey wrap, no one is the wiser.

  7. Tell the manager you re not going to shop there anymore and why. Then tell him/her it is apparent they do not really care because they could not be bothered to get the sign details right.

    • Never interrupt your enemy when he is making a mistake. If they have improperly posted signs, why tell them that? As of right now, they aren’t legally enforceable.

  9. The sign may be unclear, however, it is private property. As such, I think we need to respect the property rights of Whole Paycheck and not shop there.

      • Disagree. Just because a Business is open to the public doesn’t mean property rights are automatically trumpeted. If so, that gives the government at every level a reason to start dictating to the business what they can or cannot do. Of course we already have that to a certain degree anyways (absolute worst is banking and healthcare), but in terms of the right of the individual business to provide service, we should be moving away from that mentality.

        • I believe that private property rights do not inherently and automatically extend to property that is used for public commerce, and must be balanced with the rights of the public with whom that property is intended to be used to engage.

          That balance does not mean that the State gets to circumvent all property rights automatically, nor does it mean that the property owner may violate all rights of the public persons invited onto the property for public commerce.

          Ultimately, I have yet to see a valid argument that someone merely exercising the right to keep and bear arms in any way inherently interferes with the conduct of a public business.

        • I’m with YD, have to disagree with Chip on this one. Going down the “It’s privately owned, but open to the public=state control is proper” road leads straight to “bake my cake or go to jail, Mrs. bakery owner”–and so on ad infinitum. As far as I’m concerned, it should have been left strictly up to Ollie who he wanted to serve his BBQ to. Since then, probably 99% of nanny-state intrusion has been based on the alleged authority of the state to regulate public commerce.

          That’s exactly the false dilemma that I implied when I referenced the balance of rights in the public conduct of affairs. Being forced to participate in something that is a sincere violation of one’s conscience (such as being forced to create a custom cake or take photographs for a homosexual wedding, forcing a Kosher deli to serve non-Kosher foods – or vice versa, forcing a Muslim butcher to handle bacon, etc.) is clearly wrong.

          Someone walking into a public business while carrying a firearm (especially a concealed firearm, but the same applies to a lawfully open-carried firearm) can not reasonably be construed to violate the conscience of the business owner.

          The former requires the business owner to take explicit action in a manner that violates the business owner’s conscience. The latter requires no action, explicit or implicit, on the part or the business owner.

  10. If you do a little research on the CEO, John Mackey, you’ll find him to be quite freedom-minded and very much a proponent of Libertarian ideals. As a former employee of Whole Foods Market, I’m actually kind of shocked to see this sign.

  11. Whole Foods has had that policy for at least a year…but has never posted it before in public. On their website, they wrote:
    “No one, including Team Members, customers and vendors, may bring firearms, concealed weapons, explosives, or the like to any Whole Foods Market store/facility location. Only commissioned law enforcement officers or other authorized security personnel are permitted to have firearms on Company premises.”

    So, here’s an easy exemption…make yourself an “authorized security personnel”, since it doesn’t say who/what the authorizing authority has to be for those people, just that law enforcement officers need to be commissioned.
    Of course, YMMV depending on the specific laws of you locale.

  12. If open carry actually passes, the very next thing POTG need to focus on is getting rid the absurd 30.06 law. If a store wants to post a “no guns” sign, that fine, it’s their right to do so. But exercising your right to keep and bare arms should not get your arrested.

      • Property rights can still be respected – such signs could be enforced the way many other localities do: the management/owner can ask you to leave if you’re carrying, and it only becomes a crime (usually something like criminal trespass) if you then refuse to leave. But making it a class A misdemeanor the instant you cross the threshold and step inside with an otherwise legally-carried gun (even if nobody has any way to know you have it) is idiotic.

        In any case, I try to always respect the wishes of any business that posts any sort of “no guns” sign, even if it’s not legally enforceable – I don’t give them any of my money.

        • Again disagree. We have similar laws in AZ. If a private business that is open to the public puts up a sign, it’s only a misdemeanor of trespassing after the owner, manager or employee sees it, asks me to leave and I refuse.

        • I guess I have to fall in the middle on this one. To me, the sign is written notice that you and your gun are not welcome on my property. I really don’t see why I should have to add verbal notice to that. Same thing if I, for whatever reason, did not want pets or children or ice ream cones on my property. The only good reason I can think of for requiring verbal notice is a proof problem–if the putative trespasser claims he did not see my sign and therefore didn’t have notice that he was not welcome. I suppose requiring verbal notice from the outset would address that.

          Except that pets, children, and/or ice cream cones can reasonably be construed to interfere with your business (by causing a disruption, being unsanitary, damaging goods, etc.).

          A firearm can do none of those things.

  13. So the text isn’t at least 1″ tall? Well, then. It doesn’t matter what it says, it’s not a legally enforceable sign. So far, in the few years I’ve been licenced, I’ve seen exactly three places in Austin that I can’t carry at because they’re the only ones that have had proper 30.06 signage: hospitals, Ikea, and Sprouts. I never really liked Sprouts, so their posting the sign was the incentive I needed to never go back. Somewhere in that Whole Foods, a closet is missing its broom.

    • Yep the Sprouts in Plano is the exact same way, one of the largest signs I have come across so far, unfortunately my wife loves sprouts so she is kind of peeved we are no longer going there. As for Ikea, that sign saved me 3 hours of Maritally forced browsing a week or so ago, but the 30.06 is a complete steaming crock. I got quite the kick out of the “Weapons Free Zone” posting on the front door of IKEA, as if anyone that doesnt care about being legal would give it another look.

    • Or just let them alone and don’t inform them that the sign, quite literally, means nothing… You know, so you can actually keep carrying legally while going there.

      • Or, better still, don’t go there. They clearly don’t respect your rights, so find somewhere else to buy ridiculously-priced fruit.

        • I agree, ideologically. However, it’s becomes quite a chore to find all the gun friendly products, places, and companies, only stick to them.

          I’ve tried, and if you have anything that resembles a life, you’ll likely make some concessions.

  14. I’ve personally seen incorrect signs in Illinois all over
    two different plasma donation centers, a mosque, a Buffalo Wild Wings, and a Wal-Greens
    the only correct signs I’ve seen have been on University of Illinois property and on Champaign-Urbana MTD buses and buildings

  15. The whole foods nearest to me has a no gun sign, and has for at least several months. It’s small, it’s inconspicuous (30.06 is a peculiarity of Texas, not Colorado, law), and they can FOAD, they get no more money from me.

    Honestly the huge rafts of people here willing to ignore a sign so they can hand their money to anti-gunners astounds me.

  16. To be pedantic, and this is Law we’re talking about, I see two signs, not one. And 30.06(3)(B) says “a sign posted on the property that” and (i) says “includes the language described by Paragraph (A) in both English and Spanish”.

      Their sign fails to meet the legal requirement on two counts: letters not 1 inch high (I’ll take Robert’s word for it,) and the sign is not displayed in a manner clearly visible (which includes readable) to the public.

      • That looks like an 8.5×11 piece of paper with 15 lines on it plus white space.
        Quite impossible to be 1″ high letters.

  17. whether Im carrying or not is on a “need to know basis”, and if Whole Foods ever has a need to know that I’m carrying, it will be because we all have a bigger problem occurring than a ccw holder “tresspassing”.

  18. Other than what is printed on the back of my Michigan CPL as being a no carry zone by law, I pay no mind to any business or what have you that says I cant carry! I just go on about my business with no regard, and no one is the wiser!
    Matter of fact I gotta run to Target time now! carry on.. being asked to leave the property is one thing. But the worst thing that can happen is you get killed by a criminal because you abide by some ‘Rules, that are not laws’

  20. Glad I’m in Indiana where the signs don’t carry the weight of law. In other words the worst they can do is ask you to leave. (If they figure it out your armed, that is.) Carry On!

    I do my shopping at Kroger, I can carry, they told MDA to pound sand, points towards discounted gas, locally grown and organic items, and there’s an armed deputy there- what’s not to love.

    Also, I don’t like all the pretenious looking people at Trader Joes, Sprouts, Whole Foods, not a fan of nose up in the air crowd.

    • Target has stated they don’t want your guns either. It’s not engraved in a corporate policy or anything like that, but they knuckled under to Harpies Demand Action and issued a press release.

      • Target expressed a preference not a command. Their primary preference is to get your money. I bet if you walked into your local target OCing nobody would bat an eyelash.

    That’s not what the law says. “Includes” does not preclude additional wording. Being posted on a sliding door that makes it nearly impossible to read is another matter entirely, though.

  25. I’ve been to a few whole foods in Illinois. Lot’s of overpriced s##t. Do whatever you want RF. Concealed is concealed. I’m pretty happy I’m not looking to score women of a certain age or weirdness…been there-done that…

  27. They started posting those signs in other cities in Tx at least 6 months ago. Sent em a letter saying I won’t return, and why. Got a crap form letter back. Even though it doesn’t meet the letter of the law I’m not inclined to risk being a test case for the legality. The ole “beat the rap but not the ride” issue.

    Central Market is better anyways.

  29. what’s all of this hating on Whole Foods? They have awesome meats, sausages, uncured bacon, seafood, dry aged steaks, and other good stuff that makes the skinny vegans start sweating uncomfortably.

    Last time I was in Whole Foods pocket carrying a CM9 in an Uncle George, the hippy chick behind the counter said, “is that an organic cucumber in your pocket, or are you just happy to see me?”

  30. I like Whole Foods for the excellent milk and free-range chicken and eggs.
    I’m pissed as hell about the 30.06 signs though; I’ve carried there for years, providing them with free protection. I get along fine with the constable who stands guard at night and we talk about the latest Glock (combat tupperware).

    No more.

    But DON’T GIVE IN–if we just abandon Whole Foods, we lose ground to Bloomberg’s Astroturf group “Moms Demand Action”–and that snarky witch Shannon Watts.

    WRITE to them. I’ve sent three certified letters to the CEO and heads of marketing in Texas.

    Keep up the pressure. They’re not gaining any business with those signs, and there’s plenty of competition; make them aware of it. I even used the easy filter on my credit card’s web page to print up a list and total of my purchases last year and included that; MONEY TALKS. Let’em know it’s un-American, un-Texan, un-Friendly….and costly.

    • Agreed. I think Whole Foods is salvageable from an RKBA standpoint given the CEO’s somewhat libertarian leanings. I’d love to see them come around on this issue.

  31. The WF up at the Domain has a 30.06 sign about as big as a Honda Civic…they must have learned from this one too because they put it on the stationary door

  32. I checked the whole foods at Mopac and William Cannon after I saw this post. The coonts had the same sign put up on one of their doors at this store also. Shame.

  33. The letters aren’t 1″ high – so the sign is invalid, but there’s nothing in the law that I could find that said the sign couldn’t be on the same physical sign as other information. Their intent is clear so I’d give my money to someone else. You _shouldn’t_ be convicted of trespassing, though, if caught. That doesn’t mean you won’t be arrested if some cop doesn’t know the law and your concealment isn’t as good as you thought.

  35. Considering that Whole Foods clientele doesn’t consist of any Lone Star Card shoppers, I’d say it is now a target rich environment for parking lot muggings, and such. If you chose to keep shopping there, Farago, don’t take the Ferrari. 🙂

    HEB has friendly helpful staff, good fresh baked goods, produce & meat, & decent prices.
    Why would I go somewhere I’m not wanted?
    They may find that in Texas, they’re not following a very sound marketing policy by doing this.

  37. I really love the stores. And the CEO is actually a personal hero of mine. I have as a small business owner tried to model a lot of what’ve do after John. That’s why it hurts me to say I can no longer shop at whole foods. They will no longer let me in. In fact they have posted signs saying that try no longer want me inside, and have no respect for my civil rights or the civil rights of others in my minority group. Please whole foods respect all civil rights even the right of self defense. And John I thought your a libertarian. WTF? I respect your stores property rights but it is not smart to trust personal defense to the state. Also I might as that study after study shows licensed concealed carry holders are LESS likely than police officers to commit violent crimes. So you would be safer NOT allowing police in your store and allowing us( nobody is suggesting that).

    So does anybody know if Sprouts has a sign?

  38. I’d say I’m going to boycot Whole Foods, but since I’ve never set foot in a Whole Foods in my life that wouldn’t have too much impact.

    You need to get out of Austin occasionally RF. Carry is welcome at Smoky Moe’s BBQ or Dahlia’s Cafe up here in Liberty Hill.

  39. I live in GA and I carry at the mall, which also has a nice sign. But they don’t have metal detectors, so I ignore the signs. Concealed is concealed.

  40. When you see a news article about someone busted for CCW in a Texas WF (someone who wasn’t creating a problem otherwise…), let me know. I think the signs are up for insurance purposes. Here in PA they don’t seem to mind. They’re tearing down 200 yards of little shops in my small town so that they can replace the normal WF with a mega WF with a restaurant with separate bar and live music. Don’t know if the music or booze will be organic. They’re competitive in price with the large farmer’s market one mile away. Whether you mind the prices is just a personal issue. We have a SuperFresh, a Giant, a Trader Joes, and the Farmers Market. No one has to pay for organic if they don’t want it. However, if you want a choice of hot sauces, WF is the place to go. Same with olive oils and good vinegars.
