The round mound of far-left sound, Michael Moore, has a proposal for “fixing” our problematic Second Amendment with this:

PROPOSED 28th AMENDMENT TO THE US CONSTITUTION

“A well regulated State National Guard, being helpful to the safety and security of a State in times of need, along with the strictly regulated right of the people to keep and bear a limited number of non-automatic Arms for sport and hunting, with respect to the primary right of all people to be free from gun violence, this shall not be infringed.”

I, Michael Moore, along with all who support an end to this epidemic of gun violence, propose a new Amendment to our Constitution that repeals the ancient and outdated 2nd Amendment (which was written before bullets and revolvers were even invented), and replaces it with a new 28th Amendment that guarantees States can have State militias (a.k.a. State National Guards which are made up of citizen-soldiers who are called upon in times of natural disasters or other State emergencies), allows individuals to use guns for sport and gathering food, and guarantees everyone the right to be free of, and protected from, gun violence (i.e., the public’s safety comes ahead of an individual’s right to own and fire a gun).

This amendment would allow states and the federal government to pass laws that would regulate gun ownership in the following manner:

• As over 90% of gun violence is committed by men, in order for a man to purchase a gun, he must first get a waiver from his current wife, plus his most recent ex-wife, or any woman with whom he is currently in a relationship (if he’s gay, he must get the waiver from his male spouse/partner). This law has greatly reduced most spousal/domestic gun murders in Canada.

• All automatic and semi-automatic guns are banned.

• No gun or clip can hold more than 6 bullets.

• To activate a gun for it to be used, the trigger must recognize the fingerprint of its registered owner. This will eliminate most crimes committed with a gun as 80% of these crimes are done with a stolen gun.

• One’s guns must be stored at a licensed gun club or government-regulated gun storage facility. Believing that having a gun in your home provides you with protection is an American myth. People who die from a home invasion make up a sad but minuscule .04% of all gun murders in the US. And over a third of them are killed by their own gun that the criminal has either stolen or wrestled from them.

• To own and operate a gun one must obtain a license (like one does to operate a car). To get a license you have to complete a gun training and safety course and pass a thorough background check.

• As nearly half of all gun deaths are suicides, mental health care must become a top national health priority and must be properly funded. And by making it more difficult to purchase a gun – and requiring its storage outside the home – easy access during a suicidal moment is denied.

• Current restrictions placed on the Centers for Disease Control (CDC), due to successful lobbying by the NRA, have prohibited them from studying the gun violence epidemic in the US. These rules need to be removed and the funding restored. Science will then be free to find out why we are ALONE among nations in killing each other at such a massive rate (hint: It’s not just the guns – it’s us as Americans).

These are a few of the regulations that can be enacted to both protect society yet not deny hunters and sportsmen their fun. This is the sane approach that meets everyone’s needs — everyone, that is, except those of the serial killer, the mass murderer, the violent ex-husband, the disgruntled employee or the disturbed and bullied teenager. We will never eliminate all murder; that’s been with us since Cain killed Abel. But we CAN join the community of enlightened nations where gun violence is that rare occurrence — as opposed to the daily tragedy we now suffer here in the United States of America. This can come to an end with the repeal of the 2nd Amendment and replacing it with the 28th Amendment.

For those who believe it will be impossible to do this, let me close by sharing with you two important facts that should give us hope:

1. We are not a country of gun nuts. 77% of all Americans do NOT own a gun! If three-quarters of the country has decided they have no need for a gun, three-quarters of the country may also decide they have no need for an archaic amendment that allows retired accountants to own 47 assault weapons. LET’S ORGANIZE THE 77%!

2. When President Obama tried to get Congress to pass simple, common sense gun control legislation after the massacre at Sandy Hook Elementary, polls showed 90% of the country backed him! But the NRA beat him. LET’S ORGANIZE THE 90%!

We can start with the upcoming midterm election. Let every candidate know: If you take NRA money, we will remove you from office.

Then do it.

        Why Should California, which is hundreds and hundreds of miles away from Virginia have the exact same laws if the culture and population are not the same?

        Texas, being Texas, should not be ruled by the dictates of New York or New Jersey. Heck, Austin shouldn’t be ruled by San Antonio or Dallas.

        Nobody wants war or bloodshed. The answer? Peaceful secession. Let each go their own ways. Good laws and government structures will win out. And perhaps it’s true that government structures in rural areas won’t work in urban cities. Ok, why not try that…see how it goes. I’m pretty sure there are many of us who already have some of our own conclusions to these things, but I’d rather several million people in a city be affected by stupid, asinine statutes than several hundred million people.

        Time to form more perfect unions, ones that are not perpetual and ones that are voluntary.

        • You have it mostly correct.

          Why should a city such as San Francisco, or NYC be able to disproportionately influence the state that is supporting it? In most cases unwillingly and under threat?

          As I have said before, the solution is City States.

          All cities over 700k are put to a referendum by the populace of the State that they are in. The non-city populace votes on whether to keep or expel the city (the population of the city does NOT get to vote, after all, if they have treated the rest of the state well, they have nothing to worry about, right?)

          If it passes, the city or cities are immediately fissioned off as independent City States (such as DC already is), with 2 electoral votes each (and no more, regardless of how big or small they are).

          This is probationary, and in five years, a second referendum is held. If the state that is hosting the City State approves it, the City State is re-integrated. If not, the fissioning is permanent.

          This solution is much more elegant, and does not condemn all of those normal (read non-Leftist) people trapped in a tyrannical hellhole such as California, Massachussetts, or New York. The Leftists are not handed vast tracts of land and resources that they absolutely do not deserve.

          This method is pretty much the only way to head off sectarian violence. The Leftists are no longer sharing the same goals or aspirations as the rest of us living in the United States of America, and amicable divorce is the only viable solution.

      • Secession is when a state chooses to leave the union. What is it called if a majority of the other states decide to kick them out? I’m starting to wonder if we should look into that.

        • I don’t think there’s a term for it as it’s never came up… Sure annexing territory and secession but removing statehood? I don’t even think they have a process for that. Let alone a term.

        • Thanks Gun Doc. I appreciate it but I don’t think the process is codified anywhere. Although the process you outline would be a rather elegant solution to the issues of these huge cities basically ruling the rest of the state. Now we just gotta get that put on whitehouse.gov in the form of a petition.

        • You are absolutely correct.

          It is not codified, because even though the Founders tried to plan for every eventuality, I am certain that they could not have envisaged the borderline seditious behavior displayed by the Leftists, their sympathizers and their leash-holders.

          The most important aspect to moving this forward- under NO circumstances should a Constitutional Convention be called. This has been the dream of the Leftists for many years, and would kick wide the door to all sorts of chicanery, including the possibility of the above verbal diarrhea from Mr. Stay Puft becoming codified.

          This needs to be done (I am very sad to say) through executive order (NOT to be confused with “Executive Actions.” They are two distinct and separate things). The Legislative and Judicial branches are worse than useless in cases such as this.

          I hate to say it, but the same set of circumstances are being set up as were present in 1859.

          If we are to avoid a repeat of that horrendous, morally indefensible and wholly unnecessary slaughter, we must avoid the collective propensity for insanity:

          Doing the same thing, over, and over, and over, and expecting a different result.

        • Do not confuse “Constitutional Convention” with “Convention of the States”. Two very, very different animals. The terms are not interchangeable.

        • Expulsion never needed to be codified because it was simply unthinkable.
          The closest historical analogy we have is when certain uppity territories have become openly rebellious and needed to be forcibly put back in their place. Very ugly business for all involved.
          But expulsion makes no sense since it would mean the rest of the country would effectively be saying “we neither need nor want your tax revenues or your natural and economic resources… now go away.”
          That just doesn’t happen in real life… so the only solution is to invade, expel the state government in the capitol and install a puppet government.
          Now there is an idea with plenty if historical precedent.

  14. You note that although he preserves a right to own firearms for sporing purposes and hunting, HE ELIMINATES THE RIGHT TO ARMED SELF DEFENSE. That’s right, no guns in the home, no concealed or open carry (unless you are hunting or sporting).

    As I commented on another blog, his math is kind of fishy too. 90% 0f murders are committed by men, and 80% of murders are committed with stolen guns. so is he saying that men steal guns to kill their girlfriends? Who woulda thunk? This math also does not account for the fact that most of the victims of gun violence (and by that I mean nonsuicides) are black males between the ages of 14 and 23; is he saying that you have to get your gf’s permission to steal a gun to go shoot up the other gang?

      A Winchester model 62A carries 15 rounds and is not a semi or full auto. It is relevant only in the face that there are (very few) guns that would fall into that category.

    • Moore is the first anti-gunner I have read about who has put forth an actual constitutional amendment. Way more than any of his tribe have done to date. The anti-gun mob wants to overturn an enumerated constitutionally protected right with mere legislation (51 votes, and you can bet the Dems would suspend the 60 vote rule). We can respect his understanding that it will take an amendment to properly alter the constitution.

  25. This day in age words comeback to bite you. You don’t get to erase them or define them. The public will only hear that the NRA wants “additional regulations” on the 2nd amendment, thus time for “common sense gun control laws.”

    “The NRA has given strength to the BATFE, they have sided with “gun control” politicians and implied that the BATFE should exist. Now Republicans have to side with the “gun control” group, the NRA leadership and the BATFE for their upcoming elections. We have already seen Republicans calling for more laws/infringements. This puts Trump in a bad position going forward, which is why he is trying to delay the discussion.

    Why does anyone need a stock that is used for range entertainment by a few people? Why would a person need a .50 BMG at a public range if they are not taking out vehicles and aircraft? Why do people need impractical drum magazines, belts and extended magazines for fun mag dumps at the range? Why do people have to have flash hiders if they only shoot at targets at the range during the day? Why is it necessary for people to use infrared or thermal devices to shoot at the range?

    Most people don’t have or need these things. So why shouldn’t they be banned along with the bump fire stocks? Let’s just have guns with no attachments, require thin barrels for semi automatic long guns and regulate the calibers/rounds for specific purpose use that isn’t combat. Since we are at it, let’s make it illegal to have any pistol that can fire a bullet over the speed of sound.

    Come NRA, you have done it before, you can do it again. You can cut off much of the negativity toward your org by being cool with such range toy regulation, as it will keep semi auto guns safe for a little longer. That way the water only rises in temperature slowly; maybe slow enough that your current members will expire before the repeal of the human right of self preservation and private property protection using modern tools.     “The problem with kneeling down is the fact that it’s a concession to disingenuous people who are proposing things that wouldn’t have done anything to stop the attack. The current strategy from “gun control” groups is to maintain the fear of firearms. The NRA is playing into that by agreeing that the bump fire technique is too deadly/dangerous to go unregulated. Now the public is going to see that EVEN the NRA agrees that “gun control” is necessary and that the Vegas attack would have been less deadly if there was more laws.     The NRA should use it’s money to help fix the hood/ghettos. Help less fortunate kids go to good schools. Have a mentor program for kids with bad parents or no parents. Reach out to local governments to get gun safety put into the public school curriculum at the earliest age possible. Help fund mental health programs and work with politicians to improve the deficiencies with the mental health system. Work to improve the quality of the police force and don’t defend or go silent when bad police do something wrong. Etc.” -Link to comment

  28. The fact that every year since englands handgun ban, except 2010, had higher murder rates than those prior to the ban proves unequivocally that the notion that gun laws reduce homicides is false.

    Gun regulations do tend to reduce gun murders, but have no demonstrable effect on homicide rates in general. Gun laws can not be shown, in all cases I have seen both inside and outside the US, to reduce homicides in any way.

    Murder is murder, and people shot to death aren’t magically more dead than people stabbed or bludgeoned to death.

  29. What people like Michael Moore can’t get their head around is that the Right to Keep and Bear Arms pre- dates the 2nd Amendmendment. You can appeal it, revise it, gut it whatever. It doesn’t matter. It’s a God given right, and it doesn’t derive from the state. The State cannot take it away. They can only protect it or violate it. Oh, and it’s non-negotiable.

    The right of personal self-defense being so fundamental, it overrides the freedom of speech guaranteed in the First Amendment. Any person, group, or judicial body which calls for, or attempts reducing this absolute right to self-defense shall be considered to have committed capital treason. This crime shall not be subject to Presidential Pardon, nor subject to any Statute of Limitations.

    Of course, some language needs to be added to ensure that there is no possibility of “prosecutorial discretion”.

  51. I am not currently in a relationship, nor do I have any exes. Does this mean I can purchase firearms freely, or must I first find a girlfriend to vouch for me? (Also, how does this not qualify as sex discrimination?)

    I’m pretty sure I disagree with everything on the list except maybe making training more readily available. I propose that every high school in America should offer a 1-semester, Basic Firearm Handling and Marksmanship course to teach safe and effective usage. If some schools lack the facilities to offer such a course, perhaps teaming with other nearby schools to offer the course at an off-campus site may be an option.
