A volunteer manning the voting operation at the Louisa May Alcott Elementary School “got into an argument with a fellow poll worker and pulled a .380 pistol out of his backpack, (Cleveland police spokeswoman Sgt. Jennifer) Ciaccia said. He didn’t point the gun at anyone, but verbally threatened people, she added.” . . .
He was arrested may be charged with “aggravated menacing, carrying concealed weapon and having weapons under a disability.” He was also found to have have been carrying a small amount of weed, so there’s that, too.
If Ohio’s like most states, volunteers have to identify themselves as either Democrats or Republicans in order to evenly staff the polls. What are the odds that the cleveland.com report would have ID’d his party affiliation if the miscreant had been a GOP volunteer?

(A) Unless relieved from disability under operation of law or legal process, no person shall knowingly acquire, have, carry, or use any firearm or dangerous ordnance, if any of the following apply:
(1) The person is a fugitive from justice.
(2) The person is under indictment for or has been convicted of any felony offense of violence or has been adjudicated a delinquent child for the commission of an offense that, if committed by an adult, would have been a felony offense of violence.
(3) The person is under indictment for or has been convicted of any felony offense involving the illegal possession, use, sale, administration, distribution, or trafficking in any drug of abuse or has been adjudicated a delinquent child for the commission of an offense that, if committed by an adult, would have been a felony offense involving the illegal possession, use, sale, administration, distribution, or trafficking in any drug of abuse.
(4) The person is drug dependent, in danger of drug dependence, or a chronic alcoholic.
(5) The person is under adjudication of mental incompetence, has been adjudicated as a mental defective, has been committed to a mental institution, has been found by a court to be a mentally ill person subject to court order, or is an involuntary patient other than one who is a patient only for purposes of observation. As used in this division, “mentally ill person subject to court order” and “patient” have the same meanings as in section 5122.01 of the Revised Code.
(B) Whoever violates this section is guilty of having weapons while under disability, a felony of the third degree.

Having a weapon if you’re a felon, on drugs, or you’ve been committed to a mental facility or a judge has found you mentally incompetent. It is a 3rd degree felony in Ohio.
It’s a very common charge in Ohio, usually given to someone who is drinking alcohol or using drugs while in possession of a gun.

Serious question: let’s assume that the story is written straight and that this guy obviously can’t control himself and pulls out a gun to end an argument. Should he still be able to legally carry a gun (if he was able to do so before) or should he become prohibited from doing so? And keep in mind that crimes like this don’t get people locked up for life.
I’d argue that he shouldn’t legally be able to carry, or at least not for quite some time- that is his debt to society to me, which isn’t just jail.
It is a serious question, and one that has no easy answer.
Though I understand the desire to jump to ‘prohibit’ this person from carrying in the future, I think a good dose of “punishment fit the crime” should be at work.
We don’t take someone’s DL away after their first wreck. We don’t chop off the hands of thieves anymore. We don’t suspend OTHER Constitutional rights on the basis of one crime or even one small set of crimes committed.
Whatever else (pro and con) it may be, a gun is a tool of self defense. Every living being as that natural right…to defend one’s own life. Period. Full Stop. End of Story. No exceptions.
We get into awfully murky territory when we try to play the game of “who REALLY has that natural right.” It is akin to saying some lives are worth more than others, and that is a very dangerous game to play. It seems like a fun game when we are making the rules, but in that game, the rules have a pesky way of being changed mid-inning.
My position is that we “punish” this guy for this act, and stop trying to play God over the universe by devaluing lives on the basis of some perceived future.
If he is convicted (which he will be) the laws will already prohibit him from ever owning a gun again as well as a carry permit.. Since he is obviously mentally unbalanced we are all better off if they do take his rights away. Not that a nut case like this will not go out and get an illegal gun. Next time the law will probably end his mayhem permanently.
